MINUTES: On motion by Worthy and secon'ded by
Miller, the Minutes of the Huntington
Beach Planning Commission of July 3,
1962, were accepted as transcribed and mailed by the Secretary.

The Secretary informed the Commission
th * at there was no further recommendation from the Orange County
Health Department regarding the problem of the effluent reservoir
and chlorination station,
Kenneth Carlson,..engineer for the sub-
divider, addressed the Commission and stated that he has met
with -6he Health Department and -reached an -agreement regarding
a,setback from the Talbert Water District effluent reservoir
and -chlorination station.
Fire Chief Higgins stated that ah
alarm system is being studied for the chlorination station and
will be installed as soon as possible.
Kenneth Carlson stated that the sub-
divider is in accord with the Fire Dept's requirement for
installation of an alarm system.
Sterling White, Macco Realty Co.,
addreb'sed the Commissiong and requested that the hearing be
continued for two weeks to allow more time to work.out details
with the Health Department.

Kenneth Carlson, engineer for
the subdivider stated that the subdivider is willing to
improve and dedicate'the interior street, but opposes the
dedication and improvement -of Garfield acro'ss the parcel
designated "Not a Part" of this tract.
Sterling White, Macco Realty Co.,
addressed the Commission and also objected to the 'requirement
of the Subdivision Committee to dedicate and improve street
across the parcel labled "Not a Part", stating that the pro-
perty has been under separate ownership.
Mr. White further agreed that
the matter should be studied further and requested,that action
on the tentative map be continued to,the next meeting.

UPON THE FOLLOWING CONDITIONS:

facilities or an alternate plan suitable to,the City
Engineer.

The hearing was opened to the
audience. L. W. Blodget,'Attorney, representing the applicant,
addressed the Commission and gave a lengthy history of the
subject proper�:y.' Further he objected to the requirement of
setback of 60 feet from the centerline of Atlanta Avenue, 50
feet from centerline being for street purposes and 10 feet for
the exterior side yard. Mr. Blodget suggested that between Lake
and Huntington Streets, Atlanta could be widened, all on the
south side where the land is vacant.
The Commission felt that this
would not be fair to that owner and probably the Citywould have
to purchase the extra right-of-way.
William Folsum, contractor for
the applicant, addressed the Commission and.spoke in favor.of
the subject variance.

There being no further comment,
the hearing was closed.
Commission discussion was held at
length.
The Planning Director pointed out
that in this case there are 2 - 27 ft lots at the corner of a
primary highway and a local street. He further pointed out
that after deducting tfie street widening and both side yards*
there is 19 ft left for a building. It was further noted
that * there are many lots in the City which have a maximum of*
19 ft of space for a building.
A MOTION WAS MADE BY BAZIL TO
APPROVE THE APPLICATION WITH A SETBACK OF 53 FEET FROM THE
CENTERLINE OF ATLANTA AVENUE. THE MOTION WAS LOST FOR WANT OF
A SECOND.
A MOTION WAS MADE BY LETSON AND
SECONDED BY MILLER TO APPROVE AREA VARIANCE: AV #453 AS
REQUESTED. THE MOTION WAS LOST BY THE FOLLOWING ROLL CALL VOTE:
AYES: Crabb, Letson, Miller.
NOES: Bazil, Kaufman; Worthy.
ABSENT: Chairman Stang.

It was noted that the general
location seems quite feasible for a church since property to
the west and north is future commercial and to the east a short
distance is a trailer park.

A MOTION WAS MADE BY BAZIL AND
SECONDED BY LETSON TO APPROVE USE VARIANCE: UV #454 WITH THE
FOLLOWING CONDITIONS:
1. The size and arrangement of parking to meet the standards
adopted by the Planning Commission.
2. The east and west sides between Heil Avenu e and the play-
ground area to be suitably fenced.
3. A minimum building setback of 15 ft.
4. The development to meet the standards of the R-5 Zone*.
5. Street improvements to Se installed on Heil Avenue to City
Standards including curb, gutter, sidewalk and paving.

The hearing was opened to the
audience. Russell M. loerger, applicant, addressed the Com-
mission and stated that the proposed variance will be merely a
private studio.
There being no further comment,
the hearing was closed.
Commission discussion was held
and it was -the concensus that a variance is not necessary un-
less the applicant intends to operate,on a commercial basis.
It was felt that as long as there are no signs and the studio
and museum are not used for buying or selling, the use would
not be commercial.
The Planning Director pointed
out that the applicant is proposing to construct a 17'1 ft x
65 ft building adjacent to the existing dwelling to be used as
a garage, art studio, museum of early California art and an
office. It was noted that this is in the middle of an R-2
Residential Zone which does not allow commercial uses and it
is the feeling of the Staff that the trend to residential use
in the area will continue in the future.

A MOTION WAS MADE BY CRABB AND
SECONDED BY MILLER TO APPROVE USE PERMIT #195 WITH THE
FOLLOWING CONDITIONS:
1. Approval of this application shall be for one year from
the date of approval.
2. The sign shall be removed by the owner on or before the
-expiration of the approval and a $250 bond shall be
posted guaranteeing such removal. If the sign is not
removed as required, the City retains the right of entry
for removal of the sign and the bond shall be forfeited
and the full amount paid to the City Treasury.
3.,. The bottom of the sign face shall be at least 10 feet
above the centerline grade of any street within 50 feet
of the sign -and the area under the sign shall remain
unobstructed except for the necessary structural members.
4. The sign shall be removed at the.owner's expense, upon
30 day's notice, if such is necessary because of street
widening.

DIVISION OF LAND: DV #170 To allow the division of land
ApDlicant John T. Fialko
of that portion of Lot 34 of
Tract 3744 legally described
as follows: Beginning at the most southerly corner of said
lot; thence North 5802811511 West along the southwesterly line
of said lot 104.22 feet to the West line of said Tract; thence
Northerly along the west line of said Lot 6 ft 8 in; thence
southeasterly in a straight line to the point of beginning.
The Secretary informed the
Commission that the subject division of land is a minor ad-
justment in property lines between Lots 33 and 34 due to a
walkway encroaching across the property line.

SUGGESTED ORDINANCE FOR The Secretary read a suggested

SUBDIVISION SIGNS
temporary directional subdivision
signs. A lengthy discussion
was held by the Commission. It wasthe concensus that the pro-
posed ordinance is desirable and would reduce the variance'
load on the Commission agenda.

SECONDED BY LETSON TO RECOMMEND APPROVAL OF THE PROPOSED
SUBDIVISION DIRECTIONAL SIGN ORDINANCE TO THE CITY COUNCIL. -
AYES: Crabb, Letson, Bazil, Kaufman, Worthy, Miller.
.NOES: None.
ABSENT: Chairman Stang.
-THE MOTION CARRIED.
DISCUSSION: The Secretary informed the Com-
mission that Chairman Stang will
be absent for the next three weeks. Vice -Chairman Kaufman has
appointed Commissioner Bazil as a replacement for Chairman Stang
to the Subdivision Committee in his absence.
