Tuesday, September 4, 1962
Mayor Lambert called the regular meeting of
the City Council of the City of Huntington Beach to order at 7:30
o1clock P.M.
The Pledge of Allegiance was given by all
present in the Council Chamber.
The Invocation was offered by Reverend Loren
Buelow, King of Glory Lutheran Cburcb, Huntington Beach.
Councilmen Present: Wells, Gisler, Weleb, Lambert
Councilmen Absent: Stewart
Dep % Reports On motion by Welcb, seconded by Gisler,
Rec & Filed
the reports of the City Treasurer, Collector,
Building Director, Engineer, Lifeguard Chief, Fire Chief and Recrea-
tion Director, were received and ordered filed. Motion carried.
Public Hearing Ordered On motion by Welch, seconded by Welch,
9117/62 7:30 FM Council ordered a public bea . ring for Monday,
September 17, 1962, at 7:30 o'clock P.M., or as soon thereafter as
possible, on an appeal to a denial by the Planning Commission of Use
Variance - UV #438, on property located at Springdale and Heil Avenues,
made by Doyle and Shields, and directed the Clerk to publish notice
of same. Motion carried.
Claim for Damages - On motion by Welch, seconded by Gisler,
Mrs. Evelyn Crandall -
Denied , Council denied a claim for damages presented
by Julius S. Austero, Attorney, on behalf of Evelyn Crandall,.1015
Georgia Street, City, in the amount of $35,000.00, for injuries -sus-,
tained on the Huntington Beach Tram, and referred same to the City
Attorney and the Cityls insurance carrier. Motion carried.
Mr. Hirsbberg - Comm. A communication from Mr. Bonbomm M. Cahn,
Reg. Investigation
Attorney, on behalf of Mr. Sburley.Hirabberg,
reqUesting an investigation of unwholesome and unsanitary condition
at 16111 Beacb Boulevard, City, was presented for Council consideration.

Bldg. Dir. Cleveland
Director Cleveland both informed the
Council that they had been investigating this situation.
Ref. to On motion by Wells, seconded by Welch,
City . Departments the matter was referred to the various
City Departments for furtber investigation and report back to the
Council. Motion carried.
Elks' Lodge Req. On motion by Wells, seconded by Welch,
.Perm. to Hang Banners the Huntington Beach Elks' Lodge #1959
was granted permission to have banners installed across Main Street
in the first, second and third blocks, and across Lake Street near
Lake Park, advertising their annual breakfast. motion carried.
Mr. Don Brown On motion by Welch, seconded by Gisler,
Mem. Hall Req.Granted
Surfing Films Mr. Don Brown, 1212 S. Euclid Street,
Pasadena, was granted permission to use Memorial Hall on September
21st and 22nd., 1962, for the purpose of exhibiting surfing films
to the general public, at a fee of $50.00 per nigbt, plus addition-
al fees required for police protection deemed necessary. Motion
carried.
Bolsa Chica Homeowners The. Clerk read a letter from the Bolsa
Comm. 'Read
Chica Homeowners Association, commending
the Council on action taken in supporting the Douglas Aircraft_
Corporation.
Comm. On motion by Welch, seconded by Wells,
Rec'd & Filed
the communication from the Bolsa Chica
Homeowners Association, was received and ordered filed. Motion
carried.
Mr. Fred Hermann - The Clerk presented a communication from
Offer to Purchase Lots
Mr. Fred Hermann, 320 12tb Street,
Huntington Beach, making an offer for the purchase of Lot 6 and
part of Lot 8, Block 314, for $2500.00, and tendering a check in
the amount of $500.00 as a deposit for such purchase.

Mayor Lambert - Mayor Lambert told the Council and Mr.

Hermann that he believed the City should
retain the�property they presently own and exchange it when oppor-
tunity was presented, for other property necessary for City us�es.

bid of Mandic Motors, and authorized the Purchasing Agent to purchase
a Valiant compact car for $1,563.56, including trade-in and sales
tax. Motion carried.
Bids Presented - The Purchasing Agent presented bids bn a
"Bookmobile"
"Bookmobile" for the Public Library And
informed the Council that it bad been necessary to receive bids on
the body, stparate from bids on the chassis. They were presented as
follows:

Purch. Auth. On motion by Welcb, seconded by Gisler,
From Low Bidders
Council accepted the bid df the Gersten-
slager Company for the furnishing of a "Bookmobile" body in the
amount of $11,777.76, including sales tax, and the bid of the
International Harvester Company Truck Division for a chassis in
the amount of $4,730.94, including sales tax, for a total bid of
$16,508.70, including sales tax, and authorized the Purchasing
Agent to purchase the vehicle from these companies. Motion carried.
Public Hearing Mayor Lambert announced that this was the
P.C. Res. #263 day and hour set for a public bearing,on
Resolution No. 263 of the City Planning Commission, -recommending
approval of Zone Case No. 263, on property situated at the SE
corner of Edinger and Edwards Street, and requested the Clerk to
read the legal notice.
The Clerk read notice of public hearing
on Zone Case No. 263, as published in the Huntington Beach News on
August 23rd, 1962, setting the hour of 7:30 o'clock P.M., or as
soon thereafter as possible, on Tuesday the 4th day of September,
1962, in the Council Chamber of the City Hall, Huntington Beach,
California, as the time and place for a public hearing for the
purpose of considering a petition for a change of zone from:
A-1-X General Agricultural District, as adopted by Interim
Ordinance No. 668, to: C-4 Highway Commercial District, with set-
back provision.

and gave the Council a resume' of the Planning Commissions reasons
for recommending this change of zone.
Zone Case No. 263 On motion by Welch, seconded by Wells,
Ap2roved Council approved tbe� recommendation of the
City Planning Commission, and directed the City Attorney to prepare
an ordinance covering Zone Case No. 263. Motion carried.
Public Hearing - Mayor Lambert announced that this was the
P.C. Res. No. 264
day and hour set for a public bearing on
Resolution No. 264 of the City Planning Commission, recommending
approval of Zone Case No. 264, on property located west of Golden -
west Street and south of Heil Avenue, and requested the Clerk to
read the legal notice.

ning Commission of Area Variance - UV #453, as published in the
Huntington Beach News, August 9th, 1962, setting the hour of 7:30
ofclock P.M., or as soon thereafter as possible, on Tuesday, the
4tb day of September, 1962, in the Council Chamber of the City Hall,
Huntington Beach, California, as the time and place for a public
bearing for the purpose of considering an appeal to the denial by
the Huntington Beach Planning.Commission of Area Variance - UV #453,
to regulations of the Districting Ordinance: To allow the construct-
ion of a four unit apartment to encroach 25 feet into the required
60 foot side yard setback measured from centerline, and to allow
concrete patios, fences and stairways, to encroach into the required
side yard setback, in the R-3 Limited Multiple Family Residence
District, located at the northwest corner of Atlanta Avenue and Hunt-
ington Street.
The Clerk informed the Council that they
bad been provided with copies of the appeal, and read a communica-
tion from the Planning Director giving a background on the Planning
Commissions consideration of this case.

Hearing Opefted Mayor Lambert declared the hearing open.
Mr. Lew Blodgett Mr. Lew Blodgett, attorney for the
AU2KDey Appellants, addressed the Council and
stated the case for the appeal.
Mr. Wm. H. Folsom Mr. William H. Folsom, 11752 Garden Grove
Boulevard, Garden Grove, addressed the
Council to present further facts regarding the appeal to this denial.
Hearing Closed There being no one else present to speak in
this matter, and there being no protests
filed, either oral or written, Mayor Lambert declared the hearing
closed.
UV #453 Following considerable discussion by the

Council, a motion was made by Wells,
seconded by Gisler, that UV #453 be granted to the applicants.
Motion carried.
Public Hearing Mayor Lambert announced that this was the

day and hour set for a public bearing on
an appeal by Luxury Homes, Inc. of Anaheim, California, to a
denial by the City Planning Commission of Use Variance - UV #456,
and requested the Clerk to read the legal notice.
The Clerk read notice of public hearing
on the appeal by Luxury Homes, to a denial by the City Planning
Commission of Use V-ariance - UV #4561 as publisbed in the Huntington
Beach News on August 23rd,_1962, setting the hour of 7:30 o'clock
P.M., or as soon thereafter as possible,- on Tuesday, the 4tb day
of September, 1962, in the Council Chamber of the City Hall,
Huntington Beach, California, as the time and place for a public
hearing for the purpose of considering an appeal to a denial by
the Huntington Beach Planning Commission of a Use Variance, UV #456,
to regulations of the Districting Ordinance: To allow the existing
subdivision directional sign 12 feet x 36 feet to remain at its
present location for a one year period. Located east of Beach
Boulevard and north of Clay Street.

munication from the Planning Director giving a background of facts
concerning this application for variance.

matter, and no protests having been presented,
either written or oral, the hearing was closed by Mayor Lambert.
UV #456 A motion was made by Welch, seconded by
Denied
Lambert, that Council upbold the Planning
Commission and deny the Use Variance. The motion failed on,a tie
vote.

possible, on Resolution No. 268 of the City Planning Commission,,and

Council granted a one year extension of
time in which to record the final map on Tract #4339. Motion carried.
Storm Drain Channel The Clerk preseated a communication from the
County_C-5 Channel
City Engineer regarding negotiations for the
construction of a storm drain channel in connection with County C-5
Channel and requesting Council action in proceeding with condemnation
on property needed for this construction.

Council approved the request of -the Engineerl
and directed the Attorney to proceed with condemnation, including
immediate,possession, on Lots 77, 78, 129, 130, 131 and 132,
Block "B", in Tract No. 392. Motion carried.
Eng. Recom. Pmt. The Clerk preseated a transmittal from
To R & M Lanbcaping
the City Engineer of Project Report No. 2,
with reco ndation that the City authorize the payment to R & M
Landscaping.,
Pmt. Autb. To. On motion by Welch, seconded by Gisler,
R & M Landscaping Council approved the report and the
Engineer's recommendation, and authorized the payment of $8,343.22
to R & M Landscaping for work done on Goldenwest Street through
Reservoir Hill. Motion carried.
Deeds Accepted - On motion by Welch, seconded by Wells,
Wilford G. Lewis
Council accepted deeds for street purposes
from Wilford G.,Lewis to the City, on property located at the soutb-
west corner of the intersection of Goldenwest and Edinger Street,
and directed the City Clerk to record same with the County Recorder
of Orange County. Motion carried.
Agreement Approved on motion by Welch, seconded by Gisler,
O.C. Flood Control
Council approved an agreement with the
orange County Flood Control District for work on the Westminster
(C-4) Channel, and autborized the Mayor and City Clerk to execute
same on behalf of the City. Motion carried.
F.V. Elem, School The'Clerk'�presentedla communication from
Req. Perm. to Pay Fees
Directlyto City the City Engineer, transmitting a letter
from the Fountain Valley Elementary School District, requesting
permission to pay fees on school site within Tract #4493 directly
to the City.
Recommendation On motion by Welch, seconded by Wells,
Approved Council accepted the Engineers recommenda-
tion, and approved the procedure presented by him in this -matter.

Water-RigbLs Deeds On motion by Welch, seconded by Gisler,
Accepted
Council accepted a water-rigbts deed for
Tract #3750 from Fluvious, Inc. to the City, and directed the Clerk
to record same with the County Recorder of Orange County. Motion
carried.
Rigbt-of-Way Deed On motion by Wells, seconded by Welch,
Accepted
council accepted a Right -of -Way deed for
widening of the south side of Edinger Avenue, approximately 400
feet east of Springdale Street, from David, a partnership, to the -
City, and directed the Clerk to record same with the County Recorder
of Orange County. Motion carried.
Right -of -Way Deed On motion by Wells, seconded by Welch,
Accepted
Council accepted a Right -of -Way deed for
the widening of the north side of -Garfield Avenue at the northeast
corner of Beach Boulevard and Garfield Avenue, from James Alexander
Schulte to the City, and directed the Clerk to record same with the
County Recorder of Orange County. Motion carried.,
Easement Deed On motion by Wells, seconded by Welch,
Accepted
Council accepted an Easement Deed for
corner cut-offs at the east end,of Kaimu Drive, from Ivan H. and
Laura I. Harper, and Kenneth W. Koll to the City, and directed the
Clerk to record same with the County Recorder of Orange County.
Motion carried.
Eng. Req. Term. The Clerk presented a communication from
Of Weir #1 Well
the City Engineer requesting that bond on
Royalty Service Corp., Ltd., well Weir #1 be terminated,
Bond On motion by Welch, seconded by Gisler,
Terminated Council directed that Continental Casualty
Corporation Bond No. 15 1 8736 be terminated in accordance with
Section 2448.1 of the Huntington Beach Ordinance Code, and the
owners notified. Motion carried.
Eng. Req. Permit To The Clerk presented a communication from
Dept. of Water Resouces
the City Engineer regarding Department of
Water Resources permit application, and recommending granting of the

Council approved the Engineer's recomm. end-
ation, and granted a permit to the Department of Water Resources,
and authorized the Mayor and City Clerk to execute same on behalf
of the City. Motion carried.
Bus. Lie. App. Pres. A business license application from
Sgperior Food Dist. Rigoletto Benedetti, dba Superior . Food
Distributors, which had been referred to the Council by the Clerk be-
cause of the type of business, was discussed at some length.
Cbief of Police Rec. Chief of Police Robidoux recommended the

granting of the license to the applicant,
stating that a thorough investigation bad been made and found to be
satisfactory.
Clerk Directed To On motion by Gisler, seconded by Welch,

Guy P. Settimio
P. Settimio to conduct an ambulance
service in the City, together witb an application for a Certificate
of Need and Necessity, was. presented for consideration of the
Council.

Petition Req. Annex. The Clerk presented a petition requesting

. annexation of certain uninhabited territory

Parcel No. 3A"
Petition The Clerk also read a certification-tbat

the petition was signed by more than 25% of
the owners or representatives.of property included in the area to
be annexed, both by area and assessed valuation.

Re: Alhambra Avenue Assessment District
Assessment District No. 6202
Gentlemen:
The rapid growth of the area described in Resolution
1611 of your body adopted June 18, 1962 without the concurrent
development of a sanitary sewerage system is a problem wbicb
has concerened this department progressively over the last several
years. This department, therefore, recommends:
1. That the construction of sanitary sewers to serve
the area described in said resolution, as shown upon the plans
and specifications of this improvement district is necessary as
