MINUTES: On Motion by Worthy and seconded by Crabb, the Minutes of the Huntington Beach Planning Commission of -September 5, 1962, were accepted as transcribed and mailed by the Secretary. TENTATIVE TRACT MAP NO 3274 - Continued - Number of Lots: 30 Subdivider: Fernhill Homes Total Acreage: 6.52 Engineer: Paul Calvo Co. Located south of Detroit Street, approxi- mately 130 ft east of Huntington Avenue, and legally described as being a subdivision of a portion of Lots 5 to 10 and all of Lots 1, 25 3, and 4, Block 203, Vista Del Mar Tract, and a portion of the SE4 of Section 11-6-11.- The Secretary informed the -Commission that he received a verbal request from the Subdivider to continue the hearing of the subjecttract to October 2, 1962. A MOTION WAS MADE BY WORTHY AND SECONDED BY MILLER TO CONTINUE THE HEARING.TO OCTOBER 2, 1962. ROLL CALL VOTE: AYES: Crabb, Letson, Bazil, Kaufman, Worthy, Miller, Chairman Stang. NOES: None. ABSENT: None. THE MOTION CARRIED. Later in the meeting, Mr. Roane, subdivider of Tract No 3274, addressed the Commission and asked for reconsideration of the subject tract. He further stated that he wishes the map to stand as is. The Commission agreed to reconsider the matter. Mr. Tom Talbert, owner of the property, addressed the Commissinn and stated that the proposed tract will be upgrading the area since -the subdivider proposes to construct high quality homes. The Planning Director pointed out the problem of extending Delaware Street to Highway 101 Alternate; therefore, eliminating possibly 8 lots of the proposed tract. He further stated that the subject map will need complete revision before any action can be taken for approval. 288 Page #2 Minutes - H. B. A MOTION WAS MADE BY KAUFMAN AND SECONDED BY CRABB TO APPROVE TENTATIVE TRACT MAP NO 4823 - REVISED, UPON THE FOLLOWING CONDITIONS: 1. The Revised Tentative Map dated September 4, 1962, shall be the approved layout. 2. Disposal of runoff water to be by pump station and facilities or an alternate plan suitable to the City Engineer. 3. All provisions of the park and recreation site requirements as set forth in Section 9751.21 of the Huntington Beach Ordinance Code shall be complied with. 4. Planninb Commission Tuesday, September 18, 1962 MASTER LAND USE PLAN AMENDMENT The Secretary read a letter Applicant - Signal Oil & Gas Co. submitted by the Signal Oil and Gas Company to the Com- mission regarding a general plan for development of its pro- perty east of Beach Boulevard and both north and south of Adams Avenue and respectfully requesting that the City of Huntington Beach approve the general plan and adopt same as an amendment to the official City Land Use Plan. The hearing was opened to the audience; there being no comment, the hearing was closed. Commission discussion was held at length. ,RESOLUTION NO 276 A Resolution of the City Planning Commission Re - Commending Approval -of Zone Case No 276 to the City Council. A MOTION WAS MADE BY MILLER AND SECONDED BY KAUFMAN TO ADOPT RESOLUTION NO 276 RECOMMENDING APPROVAL OF THE MASTER LAND USE PLAN AMENDMENT. ROLL CALL VOTE: AYES: Crabb, Letson, Bazil, Kaufman, Worthy, Miller, Chairman Stang. NOES: None. ABSENT: None. THE RESOLUTION WAS ADOPTED. USE VARIANCE: UV #468 - Continued 'To allow the construction Applicant - Robert L. Stellrecht of six detached dwelling units in the A-1-X General Agricultural District. Located west of Elm Street and approximately 96 ft north of Cypress Street and legally described -as Lot 3, Block B, Tract No 436, except the west 198 f t thereof. The Secretary informed the Commission that the subject variance had been continued from the previous meeting of September,5,. 1962, in order to allow the Staff more time to study the area which is presently zoned A-1-X General Agricultural District -as adopted by Interim Ordinance No 668. The hearing was opened to the audience. Mrs. Amy Kellogg,'adjoining property owner, addressed the Commission and protested the -subject variance. Joe Cappociama, Beach Blvd., addressed the Commission and spoke in favor of the proposed variance. He further. stated .that the ,Master. Mrs. Sheila Patterson, 81.81 Terry Drive, addressed the Commission and objected to the proposed sign. Mr. Cohen, 6835 Hollywood Boulevard, representing Fantastic Fair, addressed the Com- mission and stated that the proposed sign will not be near residential area. There being no further comment, the hearing was closed. Commission discussion was held. The Secretary pointed out to the Commission that the business which this sign is to advertise will be in an 80,000 sq ft building and will be the only business on the nine acre site except for the existing service station at Beach Boulevard and Terry Drive. He further stated that the Staff feels that our present sign provisions are correct and proper and for the general good of the City. Located west of Gothard Street and south of Warner Avenue and legally described as follows: All of Tracts No 263, 2645265, 273; and all of Tract No 274, EXCEPTING THEREFROM the W 162.50 ft of the N 225.00 ft; and all of Tract No 275, EXCEPTING THERE- FROM the W 162.50 ft. The Staff report was read by the Secretary. The hearing was opened to the audience. Mr. Arthur Berman, representing Salem Dev. Co., addressed the Commission and spoke in favor of the proposed development. He displayed a sketch of the proposed mobile home park. Mr. S. D. Caplan addressed the Commission and spoke in favor. R. B. Call, 1717 Palm St., Huntington Beach, addressed the Commission and opposed the subject variance. There being no further comment, the hearing was closed. Commission discussion was held at length. It was noted -that a -portion of'the property involved is located on high ground overlooking the westerly half of the property which is quite low and is very heavily peated. The Secretary pointed out to the Commission that because of this peat situation, a portion of the tract ad- joining on the west was deleted as unsuitable`for single family homes. The Commission noted that if the subject variance should be appealed to the "City Council, a condition recommended by the Planning Commission is that Gothard Street shall be widened to 40 feet from centerline and curb, gutter, sidewalk and paving shall be installed on Gothard Street. - 6 - 293 Pa-e rL7 Minutes - H. Rodem encroach 3 feet into the re- quired 20 ft rear yard area in the R-1 Single Family Residence District. Located on the north side of Citadel Drive, west of Edwards Street and legally described as Lot 170, Tract 3846. The Staff report was read by the Secretary. The hearing was opened to the audience; there being no comment, the hearing was closed. The Planning Director stated that this application involves a minor addition to a tract home. The proposed addition is 9 ft wide which will encroach 3 ft into the required rear yard. There will be remaining rear yard on each side of the addition which are 20 ft or more in width. It was noted that the area is. relatively undeveloped but there are a few scattered homes.in the vicinity. The Planning Director pointed out that the location appears to be an excellent site for a church which will serve as a buffer between the commercial area to the east and future uses to the west. A MOTION WAS MADE BY LETSON AND SECONDED BY WORTHY TO APPROVE CONDITIONAL PERMIT CP #112 WITH THE FOLLOWING CONDITIONS: 1. Talbert Avenue shall be dedicated to 50 feet from center- line and shall be improved with curb, gutter, sidewalk -and paving. A bond for improvements may be posted if street grades are not available. 2. The parking and driving areas shall be paved. 3. A fence shall be constructed on the north and west property Unes . There being no further comment, the hearing was closed. - - Commission discussion was held. It was noted that.the property is situated at the corner of a major highway and a primary highway which is -.generally con- sidered to be the preferred location for commercial development. The Planning Director pointed out to the -Commission that there are only two corners of the inter- section which may develop in the near future since the other two corners are occupied by a high school site and a mass of "postage stamp" lots. He further stated that the applicant is apparently making arrangements with a well known development firm for -putting together a shopping center and it appears to be a reasonable location for commercial use. RESOLUTION NO 272 A Resolution of the City Plannin- Commission Recommending Approval of Zone Case No 272 to the City Council. A MOTION WAS MADE BY CRABB AND SECONDED BY LETSON TO ADOPT RESOLUTION NO 272 RECOMMENDING APPROVAL OF ZONE CASE NO 272 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. The property is situated at the intersection of a major and a primary arterial highway. 2. There are only two corners of the intersection which may develop in the near future since the other two corners are occupied by a high school site'and a mass of "postage stamp" lots. 3. The following parcel of real property as submitted on the applicant's petition is described herewith: Located at the southwest cor- ner of McFadden Avenue (formerly Sugar Avenue) and Edwards Street and legally described as Lot 82, Tract 4275. The Secretary read the Staff report. �'.i'•W 296 Pace #10 minutes - H. B. Planning Commission Tuesday, September 18, 1962 The hearing was opened to the audience. John Prins, agent for R. H. Grant, addres.sed the Commission and spoke in favor. Robert Webber, 6402 Hamden Circle, addressed the Commission -and submitted a petition signed by over 300 property owners protesting the subject zone change. Carl Lamio, 6401 Dunn Drive, opposed the R-3 and C-4 zone change. He further stated that the area would be over -crowded by rezoning it to multiple residences. Bill Tinsley, 15521 Toway Lane, also spoke against granting -the proposed zone change. Richard Munn, Citadel Drive, vigorously protested the subject zone case. Also protesting verbally were: George Wood, Ann Jonston, Richard Dee, Halsey Jenorwitz, all home -owners of the Stardust Tract. Jim Hodges, representing the applicant, addressed the Commission and displayed -various sketches -of the proposed development. There being no further comment, the hearing was closed. Commission discussion was held at length. It was pointed out by the Secretary that on February 20, 1962, the Planning Commission heard a rezoning request on this property for a C-4 zone. At that time it was the Commission's feeling that there was more than adequate commercial zoning in the general area and consequently the case was denied. That denial was upheld by the City Council. It was further noted that .the applicant now proposes a 150 ft square service station site for C-4 zone and the balance for an R-3 zone. The Secretary informed the. Commission that in discussing the request with the applicant's agent, he indicated that they were proposing a series of one story 4-unit buildings for a total of about 40 units. Some of the building on Edwards Street might be 2 story studio apart- ments. RESOLUTION NO 273 A Resolution of the City Planning Commission Recom- mending Denial of Zone Case No 273 to the City Council. A MOTION WAS MADE'BY LETSON AND SECONDED BY BAZI'L TO ADOPT RESOLUTION NO 273 RECOMMENDING DENIALOF ZONE'-CASE"NO 273 TO THE CITY COUNCIL FOR THE FOL- LOWING REASON: 1. Tract No 7, EXCEPTING the S 126. 58 ft. . . Commissioner Bazil stated.he would withdraw from the hearing since he had a small interest in the property under consideration. Robert Zinngrabe, adjacent property owner, addressed the Com- mission and read a letter opposing the zone change. Mr. Ludlow, Shell Oil representative, proposed.lessee,_addressed the Commission.and spoke in favor of the proposal. Mr. Wanda, co-owner of -the convales- cent hospital, which is located on the south side of Main Street and east of Delaware, addressed the Commission and spoke against the granting of the C-2 zone. There being no further comment, the hearing was closed. Commission discussion' -was held. A MOTION WAS MADE BY MILLER TO RECOMMEND APPROVAL OF'ZONE CASE 274 AND THE MOTION FAILED FOR LACK OF A SECOND. RESOLUTION NO 274 'A Resolution of the City Planning Commission Recommending Denial of Zone Case No 274 to the City Council. A MOTION WAS MADE BY KAUFMAN AND SECONDED BY CRABB TO.ADOPT'RESOLUTION NO 274 RECOMMENDING DENIAL OF ZONE"CASE NO'274 FOR THE FOLLOWING REASONS: 1. The property, situated at the intersection of a primary and a secondary arterial highway, is not considered to be the proper location for a commercial district. 2.
