MINUTES: On motion by Crabb and seconded by Letson, the Minutes of the Huntington Beach Planning Commission of September 18 and September 25, 1962, were accepted as transcribed and mailed by the Secretary. TENTATIVE TT2,ACT FLAP NO 3274 - Continued Number of Lots: 30 Subdivider: lernhill Homes Total Acrea-e: 6.52 En-ineer: Paul Calvo Located south of Detroit Street, approximately 130 feet east of Huntington Avenue, and legally described as being a subdivision of a portion of Lots 5 to 10 and all of Lots 1, 2, 3, and 4, Block 203, Vista Del Mar Tract, and a portion of the SE4 of Section 11-6-11. Mr. Roane, subdivider of Tract No 3274, addressed the Commission and requested a two week extension of time for consideration of the tract. ABSENT: None. THE MOTION CARRIED. ZONE CASE NO 267 - Continued Change of zone from M-1 Light Apalicant - Oka Bros. Corp. Industrial District to R-1 Single Family Residence Dis- trict. The following parcel of real property as submitted on the applicant's petition is described herewith: Located approximately 660 feet north of Banning Avenue and west of Bushard Street, and legally described as the NZ of the SE4 of the SW4 of Section 18-6-10. The Secretary suggested that Zone Case No 267 and Zone Case 275, which is the next item on the agenda, could be heard under one public hearing since both cases are of similar nature and the properties involved are adjoining. The City Attorney stated that this would be acceptable, provided the applicants of each zone case ,302 Page #2 Minutes - H. B. Corporation, addressed the Commission and stated that he will agree to the suggestion of the Secretary, provided that it is understood that the matters are still separate zone change requests. Dale Heinly, representing Geneva Deeble and William Lyon, proposed developer and owner in escrow, addressed the Commission and agreed to concurrent hearings, pro- vided each case remains separate. ZONE CASE NO 275 - Continued Change of zone from M-1-A Applicant - Geneva Deeble Restricted Manufacturing District to R-1 Single Family Residence District. The following parcel of real property as submitted on the applicants petition is described herewith: Located at the northeast corner of Banning Avenue and Cannery Street and legally described as: PARCEL I: The SW4 of the SW4 of Section 18-6-10, EXCEPTING THEREFROM the Elly 80 ft thereof. PARCEL II: The SW4 of the SE4'of'the SW4 of Section 18-6-10, EXCEPTING THEREFROM the W I ly 80 f t thereof. Two letters submitted by the Huntington Beach Chamber of Commerce were read by the Secretary stating their concern over changing industrially zoned areas to residential and urging that,the Commission refrain from zoning any industrial property to other uses. The Staff report on each case was read by the Secretary. The hearing was opened to the audience. George Gillette, attorney for Oka Bros,, addressed the Commission and stated his opinion about the various conditions existing in the area. He further spoke in favor of the proposed zone change. Dale Heinly, attorney for Geneva Deeble, addressed the Commission and spoke in favor of the Deeble case. He further indicated that the property is a prime residential area. William Lyon, developer of Nova Homes, addressed the Commission and displayed an aerial photo- graph of the southeast area. He pointed out on the photograph the relationship of the southeast industrial area to the resi- dential development along the coast. Harold Craig, owner of property at Brookhurst and Hamilton, addressed the Commission and stated that he had protested the proposed ready mix plant and again he voiced his opinion as favoring residential development'. Frank Kearns, Industrial Agent for the Southern Pacific Railroad, addressed the Commission; - 2 - 303 Pale ;�3 Minutes - H. B. Planning Commission Tuesday, October 2, 1962 pointing out the necessity of maintaining adequate industrial area. He further noted that the Southern Pacific Railroad has no rail service to the area but that freeways are very important for locating industry. He felt that the industrial growth would occur with completion of the San Diego Freeway. Commissioners questioned Mr. Kearns regarding benefit to the City from industrial development. Fire Chief Higgins called attention to his report of August 1960 on the hazard of oil storage at the Edison plant and the Wilshire tank farm. A map showing the hazard area, extending approximately 1500 feet in all directions from the existing and proposed tanks, was displayed by the Fire Chief. He further stated that since the Edison Company doesn't have adequate fire protection facilities, there would be no way to control a fire. He also pointed out that the property involved in Zone Case No 275 was just across Cannery Street from the proposed tanks of the Edison Company. Lloyd Mount, 600 N. Euclid, Anaheim, addressed the Commission and stated that he is the owner of property to the south and stated that it is important to keep all areas within walking distance of the beach as residential. There being no further comment from the audience, the hearing was closed. Commissioner Bazil voiced his feeling on the matters and thereupon, A MOTION WAS MADE BY BAZIL AND SECONDED BY LETSON TO -DENY ZONE CASE NO 267 AND ZONE CASE NO 275.- During discussion by the Commission, George Gillette, attorney for Oka Bros., raised a point of order questioning if separate actions should be taken since there are two separate zone cases involved. The Commission agreed to take separate actions and Commissioner Bazil, with the consent of the second, withdrew his motion. George Gillette, attorney for the Oka Bros., requested that Zone Case No 267 be continued to November 6, 1962. Planning Commission Tuesday, October 2, 1962 After further discussion and considering the'arguments'both for and against Zone Case 275, the Commission determined that the following -action should be taken: RESOLUTION NO 275 A Resolution of the City Plan- ning Commission Recommending Denial of Zone Case No 275 to the City Council. A MOTION WAS MADE BY BAZIL AND SECONDED BY WORTHY TO ADOPT RESOLUTION NO 275 RECOMMENDING DENIAL OF ZONE CASE NO 275. ROLL CALL VOTE: AYES: Crabb, Letson, Bazil, Kaufman, Worthy, Miller, Chairman Stang. NOES: None. ABSENT: None. THE RESOLUTION WAS ADOPTED. The City Attorney ordered _- copies of the transcript of the hearing from Robert R. Jarmusz, Court ,Reporter, _present at the hearing,- which are to be made part of the record pertaining to the case. ZONE CASE NO 277 Change of zone from A-1-Y Annlicant - Macco Realty Co General Agricultural District, as adopted by Interim Ordinance No 672, to R-1 Single -Family Residence District. The following parcel of real property as submitted on the applicant's petition is described herewith: Located at the northwest corner of Adams Avenue and Bushard Street, and legally described as being a por- tion of the E2 of the SW4 of Section 6-6-10. The Staff report was read by the Secretary. The hearing was opened to the audience; there being no comment, the hearing was closed. Commission discussion was held. The Secretary -informed the Com- mission that this is a routine rezoning of a tract to R-1 and that single family homes are now under construction on the en- tire tract. --SOLUTION NO 277 A Resolution of the City Plan- ning Commission Recommending Approval of Zone Case No 277 to the City Council. A MOTION WAS MADE BY WORTHY AND SECONDED BY CRABB TO ADOPT RESOLUTION NO 277 RECOMMENDING APPROVAL OF ZONE CASE NO 277 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. It was noted that the property involved is a large commercial site at the corner of two major highways. The Secretary informed the Commission that approximately 1 30 acres of land is included in the parcel which. was approved with the tentative map of Tract 4704. RESOLUTION NO 278 A Resolution of the City Flanni.n� Commission Recommending Approval of Zone Case No 278 to the City _ Council. A MOTION WAS MADE BY MILLER AND SECONDED BY LETSON TO ADOPT RESOLUTION NO 278 RECOMMENDING APPROVAL -OF ZONE CASE NO 278 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. The property is situated at the intersection of two major arterial highways. 2. The property is situated at the corner of a section which is a more desirable location for commercial zoning. The following parcel of real property as submitted on the applicant's petition is described herewith: Located east of Brookhurst Street and approximately 560.00 ft south of Yorktown Avenue and legally described as being a portion of the SW4 of Section 5-6-10, Tract No 4816. The Staff report was read by the Secretary. The hearing was opened to the audience; there being no comment, the hearing was closed. The Secretary stated that this is a routine case of zoning a proposed single family tract to R-1. Plannin, Commission Tuesday, October 2, 1962 307 The Secretary informed the Com- mission that this property is a portion of the approved Tentative Map of Tract 4806 and was designed for multiple family use. Generally speaking, the location is good for a multiple family use, although it will probably be.several years before there is much demand for multiple units. He further stated that property to the east, extending to Brookhurst, has been zoned R-3 for a proposed "Town House" development and to the.north and west is proposed for single family use. - - ESOLUTION NO 280 A Resolution of -the City Planning Commission :ecommendinl- Approval of Zone Case No 200 to the City Council. ' A MOTION WAS MADE BY CRABB AND SECONDED BY BAZIL TO ADOPT RESOLUTION NO 280 RECOMMENDING APPROVAL OF ZONE CASE NO 280 TO THE CITY COUNCIL UPON THE FOLLOWING CONDITION: 1. That the Council approve the change of zone but withhold adoption of the Ordinance until the property is subdivided. REASONS: 1. The property is adjacent to a major and a primary arterial. 2. The property was designed as an integral part of Tract_4806 and was intended to be used for an R-3 development. ROLL CALL VOTE: AYES: Crabb; Letson, Bazil, Kaufman, Worthy; Miller, Chairman Stang. The Secretary stated that this application is necessary because the A-1-X zone allows either a single family home or a duplex on each parcel of land and the proposal is for two separate single family dwellings. The Secretary pointed out to the Commission that a good compact commercial and professional center is developing and the proposed coffee shop should prove to be an attribute. A MOTION WAS MADE BY CRABB AND SECONDED BY LETSON TO APPROVE USE PERMIT #207 WITH -THE FOL- LOWING CONDITIONS: 1. Widen Bushard Street to 40 ft from centerline and -install curb, gutter, paving, sidewalk street trees and street lights -'to City Standards. 2. 'Widen Brookhurst to 60 ft"from centerline and install curb, gutter, paving, sidewalk, street trees and street lights. to City Standards. 3. Meet all requirements of the City Health Officer for clean and sanitary maintenance of the wading lake. 4. Construct a 6 ft masonry wall along the north property line adjoining the existing tract. 5. Construct a 5 ft chain link fence or equivalent along the flood control channel to Flood Control District Standards. 6. Install and permanently maintain the landscaping around and within the parking area substantially as shown on the plan. 7. Participate in the sewer, water and drainage assessment districts applicable to this area. 8. All provisions for drainage from the site shall meet the approval of the City Engineer. 9. There shall be provided one covered parking space for each unit. 10. If the lake is constructed, there shall be white sand in- stalled around the lake. 11. The -use of the salt water shall be approved by the Orange County Water District and Water Polution Control Board. 12. A vehicular access for emergency vehicles and fire hydrants shall'be installed and meet the approval of the Fire Chief. Located on the northeasterly corner of 16th Street and North Pacific Avenue in Sunset Beach. The Commission held a discussion. A MOTION WAS MADE BY KAUFMAN AND SECONDED BY MILLER TO INSTRUCT THE SECRETARY TO WRITE A LETTER TO ORANGE COUNTY PLANNING COMMISSION RECOMMENDING DENIAL OF UV #5052. CO1,F1UNI CATION: The SecretaryIread a letter submitted by the Stardust Home Owners Association, extending• their sincere apology for their behavior at the'mdeting of September 18, 1962. In their exuberance• over the favorable denial by the Commission of a re -zoning proposal of their area, the Stardust Homeowners Association believed that they. may have in some way disrupted or"caused delay in the pro- ceedings of the meeting.
