Monday, November 19, 1962
Mayor Lambert called the regular meeting of
the City Council of the City of Huntington Beach to order at 7:30
o! clod[ P.M.
The Pledge of Allegiance was given by all
present in the Council Chamber.
The invocation was given by Rev. Gary Robin-
son of the Huntington Beach Four Square Church.
Councilmen Present: Wells, Gisler, Stewart, Welch, Lambert
Councilmen Absent: None
Dept. Reports On motion by Stewart, seconded by Gisler,
Reed & Filed the reports of the Chief of Police, Treas-
urer, Collector and Chamber of Commerce
Manager, for October, 1962, were received and ordered filed. Motion
carried.
Hughes Letter - On motion by. Stewart, seconded by Welch,
Reed & Filed Council ordered a letter from Mr. Paul H.
Hughes, 18372 Pammy Lane, City, regarding
the replacement of a tree in the parkway in front of his house, re-
ceived and filed. Motion carried.
Fairview Pool Volunteers On motion by Welch, seconded by Stewart,
Granted Perm. to Solicit Council granted permission to the Fairview
Theraputic Pool Volunteers of Costa Mesa,
to conduct a fund raising campaign in the City during the year of
1963, subject to the solicitors registering with the Police Depart-
ment. Motion carried.
AV #487 - On motion by Stewart, seconded by Welch,
Pub. Hearing Ordered Council ordered a public hearing for Monday,
December 3, 1962, at 7:30 o'clock P.M., or
as soon thereafter as possible, on an appeal to a decision of the
City Planning Commission on the denial of Area Variance #487, and
directed the Clerk to publish notice of same. Motion carried.
H.B.Humane Society The Clerk presented a letter from the Hunt -
Reg. to Lease City Prop. ington Beach Humane Society, 724 Utica Street,
City, requesting Council to consider the
possibility of leasing City owned property at the intersection of
Newland Street and Edison Avenue, for use as an animal shelter.
Admin. to Arrange & On motion by Welch, seconded by Gisler,
Atty.to_Prep. Agree. Council authorized the City Administrator
to negotiate with the Huntington Beach
Humane Society for the leasing of this property at a rental not to
exceed. $35.00 per month, and directed the City Attorney to prepare
an agreement for Council consideration. Motion carried.
Res, from L.B. A communication from the City of Long Beach,
Re: Legislation transmitting a Resolution opposing legisla-
tion permitting or sanctioning the use of
partisan political labels by municipal office candidates, was pres-
ented for Council,consideration.
Atty. to Prep On motion by Welch, seconded by Gisler,
Similar Resolution Council directed the Attorney to prepare a
similar resolution for consideration by the
Council. Motion carried.

Operation Merry Xmas On motion by Wells, seconded by Gisler,
Caaaign Approved Council granted permission for various
youth groups from the churches to conduct
a campaign on November 29th, for food for the needy under "Operation
Merry Christmas". Motion carried,
Chambers Letter A letter from Mr. M. C. Chambers of the
Pres. to Council Huntington Beach Cab Company regarding the
request from Westminster Cab Companies for
permission to operate in the City of Huntington Beach, was present-
ed for Council consideration.
Ref. tc Admin. - On motion by Stewart, seconded by Gisler,
Study and Reoort the letter from Mr. Chambers was referred
' to the City Administrator for study and
report back to Council. Motion carried.
H.B.Jr. G of C Req. The Clerk read a letter from the Hunting -
Auto Safety Check ton Beach Jr. Chamber of Commerce, request-
ing Council approval for an automobile
safety check to be held December 1 and 2, 1962, at the Five -Points
Shopping Center, together with the sale of authorized seat belts.
Auto Safety Check On motion by Welch, seconded by Wells,
Approved Council approved the Autoisobile Safety
Check to be conducted by the Huntington
Beach Jr. Chamber of Commerce at the five -Points Shopping Center
on December 1 and 2, 1962. Motion carried.
Public Hearin gg Mayor Lambert announced that this was the
P.C. Res. #282 day and hour set for a public hearing on
Resolution No. 282 of the Planning Commis-
sion, recommending approval of Zone Case No. 282, on property
located generally south of Garfield Avenue, west of Main Street,
north of Palm Avenue, north of Ocean Avenue and east of the north-
westerly limits of the City of Huntington Beach, and directed the
Clerk to read the legal notice.
The Clerk read notice of public hearing
on Zone Case No. 282, as published in the Huntington Beach News on
November 8th, 1962, setting the hour of 7:30 o'clock P.M., or as
soon thereafter as possible, on Monday, the 19th day of November,
1962, in the Council Chamber of the City Hall, Huntington.Beach,
California, as the time and place for a public hearing for the
purpose of considering a petition for a change of zone from: M-2-0
Heavy Industrial District combined with oil, and R-1-0 Single
Family Residence District combined with oil, to: R-1-PD5-0 Planned
Single Family Residence District combined with oil, R-2-0 Two
Family Residence District combined with oil, R-3-0 Limited Multiple
Family Residence District combined with oil, and C-1-0 Neighborhood
Commercial District combined with oil.
No Written The Clerk informed the Council that they
Protests had been provided with copies of the
Planning Director's transmittal and the
Resolution of the Planning Commission, and stated that he had
received no written protests to the zone change.
HearinnE opened Mayor Lambert declared the hearing open.
E. A. Hartsook Mr. E. A. Hartsook, General Manager of the
H. B. Company Huntington Beach Company, addressed the
Council and presented maps and illustra-
tions showing the proposed development of the areas on which they
were requesting such rezoning. Mr. Hartsook informed the Council
that he would endeavor to answer any questions they might have
regarding this matter. .

Hearing Closed There being no one further to speak on the
matter, and there being no protests filed,
either oral or written, the hearing was closed by the Mayor.
Zone Case #282 On motion by Welch, seconded by Gisler,
Approved Council approved the change of zones, and
-directed the City Attorney to prepare an
Ordinance effecting the change. Motion carried.
Public Hearing Mayor Lambert announced that this was the
P.C. Res. #281 day and hour set for a public hearing on
Resolution No. 281 of the Planning Commis-
sion, recommending approval of Zone Case No. 281 on the beachfront
area westerly of the pier, and south of the Pacific Coast Highway,
extending to 38th Street on the west, and directed the Clerk to read
the legal notice.

showing the proposed development of the property encompassed in the
proposed zone changes. Mr. Hartsook informed the Council that he
would endeavor to answer any questions they might have in regard to
this matter.
Victor Fulgo Mr. Victor Fulgo, 4612 Operetta Drive, City,
addressed the Council and Mr. Hartsook, and
questioned the proposed plans presented for construction of apartment
buildings along the beach. Mr. Fulgo stated that he felt that any-
thing that would -deny the use of the beach to the public should be
avoided.

On motion by Stewart, seconded by Gisler,
Approved
Council approved the change of zones and
directed the City Attorney to prepare an

corner of Adams Avenue and Brookhurst Street, presently zoned R-3.
ITV #485 On motion by Welch, seconded by Stewart,
Approved Council approved the granting of Use'
Variance UV #485 with conditions stipulated
by the Planning Commission. Motion carried.
DV #174 - The Clerk presented a transmittal from the
Presented Planning Director of a request for a
Division of Land - DV #174, on property
located on the south side of Garfield Avenue, northeasterly of
Kaimu Drive.
DST #1.74 On motion by Stewart, seconded by Gisler,
.Approved Council granted the Division of Land -
DV #174, subject to the conditions'stip-
ulated by the Planning Commission: Motion carried.
Salyer Offer
The Clerk presented a communication from

and figures concerning the City's interest
in the west one-half

on which an offer had
been made to purchase by Mr. Don Salyer.
Sale Approved -
Following some discussion by the Council,

a motion was made by Stewart, seconded by
Gisler, that the City accept an offer of
Three Hundred Dollars
($300.00) from Mr. Salyer for their interest
in the property, and
directed the City Attorney to prepare a Quit
Claim Deed covering same.
Motion carried.
Dust Complaint
The Clerk presented a communication from
Acacia Street_
the Engineer, reporting on a study made of
the complaint which had been received re-
garding the dust on Acacia Street, and recommending that the street
be oiled by his Department.

Sewer Fee Coil.. On motion by Welch, seconded by Stewart,
Defer. Auth. Council authorized the City Engineer to
defer the collection of the sewer fees from
the Douglas site until June 30th, 1964. Motion carried.
HBES-Dist. Req. A transmittal �rom the City Engineer of a'
Reduction -Seger Fees letter from the Huntington Beach Elementary
School District, requesting a reduction of
sewer and water service fees, and recommending that the request be
granted, was presented for Council consideration.
Fee Reduction On motion by Stewart, seconded by Welch,
Autb prized Council approved the Engineer's recommend
ation, and authorized a reduction of Sewer
and Water Fees for the Huntington Beach Elementary School District
to 75% of the normal charge. Motion carried,
Tract #4243 - The Clerk presented a communication from
Reimb. Reg. the City Engineer regarding construction of
offsite water main in connection with Tract
#4243, and recommending reimbursement to the Subdivider for this work.
Reimb. Auth. to On motion by Welch, seconded by Stewart,
House & Home Dev. Co. Council approved the Engineer's recommend
ation, and authorized the refund of Eight
Thousand Eight Hundred and One and 40/100 Dollars ($8,801.40),
payable to House and Home Development Company, from the City Water_
Fund. Motion carried.
R/W Deed On motion by Stewart, seconded by Gisler,
Accepted Council accepted a deed for right-of-way on
the east side of England Street, north of
,"Yorktown Street, from Henry M. and Grace S. Nieto, to the City, and
directed the Clerk to record same with the County Recorder of Orange
County. Motion carried.
Water -Rights Deeds On motion by Stewart, seconded by Welch,
Accepted the City accepted deeds for water -rights
for Tracts #4816 and #4845 from Macco Realty
Comprany to the City, and directed the Clerk to record same w the
County Recorder of Orange County. Motion carried.
Req. Term. of Bonds The Clerk presented a communication from the
R.B.Watkins Well City Engineer, informing the Council that
the R.B.Watkins Operations well City of
Huntington Beach #3 had been found to meet with the requirements of
the clean up ordinance, and recommending that the clean up bond be
terminated in accordance with Section 2448.1 of the Huntington Beach
Ordinance Code, and that the drilling bond on this well be terminated
in accordance with Section 2427.3 of the Huntington Beach Ordinance
Code.

ation, and authorized the termination of

Presented City Engineer of Reimbursement Agreements
for Sewer Main and Water Main Extention on
Heil Avenue east of Bolsa Chica Street, for Council consideration.

Murdy Park Site On motion by Stewart, seconded by Gisler,
Deeds Accepted Council accepted the deeds and authorized
the Clerk to return them to Land Acquisition

or set of grantors in the amounts specified, when approved by Land
Acquisition Service. Motion carried.
St. Name Change The Clerk presented a letter from fhe'
Goldenwest to Knott Orange County Street Naming Committee,
recommending that the Council take official
action to change the name of Goldenwest Street to Knott Street, with-
in the City.
Deferred Considerable discussion was held on this
3u Days matter by the Council. On motion by Wells,
seconded by Gisler, Council directed that
the proposal be deferred for 30 days for further. consideration.
Motion carried.
Mr. Bangoy - Pres. Mr. Mac Bangoy, 6942 Canterbury Circle,
Golden West Homeowners City, President of the Goldenwest Home-
owners Association, addressed the Council.
He informed them that the group which he represented would appreciate
notification on any change of the street names in the area adjacent
to their development, prior to being approved by the Council.
Sunset Heights #1 Annex. The Clerk presented a petition requesting
Petition Presented annexation of uninhabited territory de-
signated as "Sunset Heights #1 Annexation",
which had been approved by the County Boundaries Commission, for
consideration of the Council. He then presented a communication
certifying that the petition had been signed by more than 25% of
the property owners in the area proposed to be annexed by area and
assessed valuation.

istrator, and directed him to proceed with
preparation and.distribution of these pamphlets on Civil Defense.

Cit. Steering Comm, The City Administrator informed the Council
Re: Mun. Fin. Dept, that the President of the Citizens Steering
Committee was in the audience, and bad -re-
quested permission to present a communication making recommendations
regarding a. Municipal.Finance Department.
Mr. Hartsook - Mr. A. E..Hartsook, chairman of the Citizens
Report Steering Committee, representing the Cit-
izens Sub -Committee on Finance, presented a
report from this committee recommending that the City proceed immed-
iately to enact legislation which would create a Finance Department
in the City, and authorize the employment of a Finance Director.
Atty. & Admin. to Following the report by Mr. Hartsook,_there
Prep. Ordinance was some discussion on the matter by the
Council. On motion by Stewart, seconded by
Welch, the City Attorney was directed to prepare, with the assistance
of the City Administrator, an Ordinance creating a Department -of
Finance and -the position of a Director of Finance in the City. Motion
carried unanimously.
Promotion Req. The City Administrator informed the Council
Presented that they had been presented with letters
from the City Engineer and the City Attorney,
requesting promotions within their departments. He.stated.that...
these proposals bad been discussed with the Employees Association
Committee, and that he had made his recommendations regarding each of
them.
Monte Weaver - On motion by Stewart, seconded by Welch,
Street Dept , Council approved the reclassification of
Mr. Monte Weaver in the Street Department,
from Maintenance Man, Range 29-B to Skilled Worker, Range 31-A, with
the promotion to be effective on the effective dateAof the Ordinance
establishing allocations. Motion carried.
Reclass. - Beach On motion by Welch, seconded by.Gisler, the
Maintenance Superv, position of Beach Maintenance Supervisor be
Park Maint, Superv. reclassified from Range 35 to Range 37, and
the position of Park Maintenance Supervisor
be reclassified from Range 35 to Range 38, with both reclassifications
to be effictive on the effective date of the Ordinance making the
reclassifications. Motion carried.

Council approved reclassification of Mrs.
Alice Hamilton from Legal Secretary to Prin-
cipal Clerk, Range 32, to be effective on the effective date of the

Maintenance Lead Man

Reclassified
Council authorized the reclassification of
the position of Maintenance Lead Man from
Range 33 to Range 34, to
be effective on the effective date of the
Ordinance making,the reclassification. Motion carried.

Merle Hall-Geo.Clemons On motion by Welch, seconded by Gisler,
Reclassified Council authorized the establishment of
the position of Meter Reader in Range 31,
and the position of Service Man and Collector in Range 35; and auth-
ori-zed the reclassification of Mr. Merle Hall from Water Meter Repair-
man, Range 32-D to Service Man and Collector, Range 35-B, and George
W. Clemons from Maintenance Man, Range 29-B to Meter Reader, Range
31-A; and authorized the allocation of two Meter Readers in the Water.
Department; all allocations and reclassifications to be effective on
the effective date of the Ordinance creating same. Motion carried.

Survey - City Hall The Administrator presented the results of
Ofiice Space a survey which had been made regarding the
possible changes in the Council Chamber of
City Hall, for use as office space. He recommended that Council
consider eliminating any changes, and authorize the construction of
another building in the yard of the City Hall, to house the Planning
or Building Department.
Engr. Auth. to Prep. On motion by Stewart, seconded by Wells,
,Plans & Specs,, Council authorized the City Engineer to
" prepare plans and specifications for a new
building to be placed adjacent to the Police Department Building,
with a capacity sufficient to house the Planning or Building Depart-
ment. Motion carried,
Expansion of Lifeguard The Administrator informed the Council
Bldg. Presented that the problem of expansion of the Life-
guard Building had failed to receive action
at the previous meeting, and requested further consideration of.this
matter.

Sell Property - Pres. Church for the Council to consider the pur-
chase of a parcel of property adjacent to
their proposed church site, and adjacent to a proposed elementary
school, was presented.
Admin. to Negotiate - Following some discussion on the matter,
Price & Report a motion was made by Stewart, seconded
by Gisler, that the matter be referred to
the City Administrator to negotiate with the Wintersburg Church on
the purchase price of such property, and report back to Council.
Motion carried.
Admin. Report - The Administrator presented a report from
Mr. Elmer Russell Dr. Fier to the Deputy District Attorney,
concerning the -condition of Mr. Elmer
Russell, former Patrolman who is seeking reinstatement. Mr. Miller
informed the Council that he had not received a report from the
State Workmans' Compensation Department in this matter.
Mr. Elmer Russell Mr. Elmer Russell addressed the Council,
Reg. Reinstatement and informed them that the State Compens-
ation Claim had been denied. He stated
his doctor had informed him he could go back to normal work, provid-
ing there was no heavy lifting, and requested that Council consider
reinstating him to his position in the Police Department.
Re 127. Deferred On motion by Stewart, seconded by Gisler,
3/62 the request of Mr. Russell was deferred to
the meeting of December 3rd, 1962. Motion
carried.
Councilmens Comp. The Administrator informed the Council
Legal Opinion Pres. that the City Attorney had prepared an
opinion regarding the inequity in Council-
mens compensation, at the request of Councilman Stewart. Mr.
Miller read the opinion to the Council.
Councilmens Pay $125 After considerable discussion on the matter,
Per Mo. Retroact. a motion was made by Gisler, seconded by
Stewart, that Council, approve and file
the opinion of the City Attorney and direct the City Auditor and
Treasurer to pay all Councilmen 125.00 per month, to be effective
retroactively from April lb, 1962. Motion carried.
