Bazil-. On motion by Worthy and seconded by Letson, the Minutes of the Hunting- ton Beach Planning Commission of November 6th, 1962, were accepted as transcribed and mailed by the Secretary. TENTATIVE TRACT MAP NO 3849 - REVISED Number of Lots: 568 Subdivider: A. L. Gindling Total Acreage: 122 Engineer:. . Millet, King & Assoc. Located at the northeast corner of Bolsa Avenue and Springdale Street and legally described as being a portion of the W2 of.Section 10-5-11.- , The Subdivision Committee Report was read by the Secretary. Commission discussion was held. A MOTION WAS MADE BY LETSON AND SECONDED BY WORTHY TO APPROVE TENTATIVE TRACT MAP NO 3849 - REVISED UPON THE FOLLOWING CONDITIONS: 1. The revised Tentative Map dated October.17,-1961, shall be the approved tentative map. 2. Walkways 10 feet wide shall be provided from the ends of cul-de-sacs to Edwards Street and Springdale Street. 3. Lot "A" shall be improved to City Standards including a 6 ft masonry wall on each side except along the front yard of abutting lots, where such wall shall not exceed 32 ft in height nor',be less than 2 feet in height. 4. The improvement of Springdale'Street and Edwards Street shall include the railroad right-of-way. , : - 5. If the adjoining property in the City of Westminster owned by the subdivider is zoned for residential use, "B" Drive may be extended to the east boundary of the tract. 6. Located on the north side of Utica Avenue and 130 ft west, of Beach Boulevard and legally described as follows: The west 50 feet of the east 200 feet of Block 2108 of the Eastside Villa Tract in the city. of Huntington Beach - The Staff Report was •read by the Secretary. The hearing was opened to the audience; there being no comment, it was closed. Commission discussion was held. It was noted that the property adjoining on the west was recently zoned R-4 to allow apartment construction which is now under way. The Secretary pointed out to the Commission that at that time the owners wished to hold the subject pro- perty for part of a motel development. Since the property is not directly abutting Beach. Boulevard but has access only from Utica Street, it appears that multiple family use is quite reasonable. RESOLUTION NO 288 A Resolution of the City Plan- ning Commission Recommending Approval of Zone Case No 288 to the City Council. A MOTION WAS MADE BY KAUFMAN AND SECONDED BY.CRABB TO ADOPT RESOLUTION NO 288 RECOMMENDING APPROVAL OF ZONE CASE NO 288 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. The property is adjoining an R-4 zone on the east. 2. The property is easily accessible from a major highway located 130 feet to the east. ROLL CALL VOTE: AYES: Crabb, Letson, Kaufman, Worthy, Miller, Chairman Stang. NOES: None. ABSENT: Bazil. THE RESOLUTION WAS ADOPTED. ZONE CASE NO 289 CHANGE OF ZONE from R-4-X Applicant - Theo. J. Bose Suburban Residential District, as adopted by Interim Ordinance No 668,-and C-1 Neighborhood Commercial District to C-3 General Business District, with setback provisions. Located at the northwest corner of Beach Boulevard and Newman Avenue and legally.dpscribed as follows: The south one=half-of-Lots 18 and 19 and the -south -one-half of the west 30 feet of .Lot 20, all in Tract No 411, city of Huntington Beach. The Staff Report.was read by the Secretary. - 2 - 338 Page #3 Minutes - H. B. Planning Commission Tuesday, November 205 1962 The hearing was opened to the audience. Mr. Bose, applicant, addressed the Commission and stated that all property owners adjacent to his property did agree to the proposed zone change. He further stated that there were many old houses which were undesirable to be lived in. Mr. Tayloe, nearby property owner, addressed the Commission and spoke in favor of the proposed zone change._ There being no further com- ment, the hearing was closed. A lengthy discussion was held. It was noted that the owner is requesting a C-3 zone for the entire parcel and the application indicates that the owner wants to construct an automotive service center immediately west of the existing service station. The Commission felt that the C-1 zone, which was established prior to annexation of the area to the city, was established to keep Beach Boulevard development along the lighter types,of business. A MOTION WAS MADE BY KAUFMAN AND SECONDED BY CRABB TO RECOMMEND DENIAL FOR C-3. After further discussion, the motion was withdrawn with consent of the second. RESOLTUION NO-289 A Resolution of the City Planning Commission Re- commending Denial of the C-3 Zone and recommending Approval of.C-1 to the City Council. A MOTION-WAS'MADE BY KAUFMAN AND SECONDED BY CRABB TO RECOMMEND DENIAL OF'THE'C-3 AND TO RECOMMEND THE ZONE BE CHANGED TO C-1 TO THE CITY'COUNCIL FOR.' THE FOLLOWING'REASON: 1. All the uses permitted in*the C-3 zone would not be com- patible with the surrounding lighter types of business development in the area and a lighter,.more•restrictive zone could possibly be applied to the property. Single 'Family Residence District to R-3 Limited Multiple Family Residence District on property located west of Delaware Street and approximately 122 ft north of Ellis Avenue and legally described as that portion of the SE4 of the NE4 of Section 35-5-11 and a portion of Lot No 3 of Tract No 7, city of Huntington Beach. Further_ legal description on file in the'Planning-Department Office. The Staff Report was read by the Secretary. The hearing was opened to -the audience. Mr. -Dan Herring;.18412 Delaware Street, --Huntington Beach, presented -a petition of 44 signatures protesting the zone change. Mrs. Rose Ellimson,-7671 Yukon Drive, objected to the proposal. Mr. Oliver Broomhead, adjacent property owner, protested -the zone change'. Mr. James Ford,-1,8442 Delaware St., also pro- tested the porposed multiple family development. Ray Mercado, representing the applicant, addressed the Commission and spoke in favor of the zone change. He further stated that the applicant is .requesting only an additional 22 ft of the R-3 zone. Further protest was voiced by the following property owners: Harry .Payne, Yukon Drive; Mrs. Hill, Manitoba Lane; Dan Davidson, and G. Bunch, Yukon Drive, Mr. Ed Atkins, 18421 Delaware St. Mr. Ted Bolty•, representing the Erico, Inc., addressed the Commission,and spoke in favor explaining their development plans. - 5 - Page #6 Minutes - H. It was noted that part of this case involves an adjustment in district boundary of 22 feet.and,part of it in volves extending the R-3 zone up Delaware Street to the existing single family homes. It was,.the concensus of the Commission that the additional 22 feet of depth for the Rc3 from .Ellis Avenue was reasonable since this would allow for the.widening of Ellis Avenue. It was felt that the extension of the R-3 northward along Delaware Street would not be compatible with the existing tract. RESOLUTION NO 293 A Resolution of the City Planning Commission Recommending Partial Approval of Zone Case No 293 to the City Council. A MOTION WAS MADE BY KAUFMAN AND SECONDED BY CRABB TO ADOPT RESOLUTION NO 293 RECOMMENDING PARTIAL APPROVAL OF ZONE CASE NO 293 TO THE CITY COUNCIL AS FOLLOWS: 1. The additional 22 feet in depth from Ellis Avenue be granted. 2. The portion extending north along Delaware Street be denied. Located at the southwest corner of Yorktown Avenue and Bushard Street and legally described as future final tract 4350 in the city of Huntington Beach.' The Staff Report was read by the Secretary. The Secretary informed the Com- mission that this case is a routine rezoning to R-1 for a single family tract that will soon be under construction. RESOLUTION NO 294A Resolution of the City Planning Commission Recommending Approval of Zone Case No 294 to the City Council.. .. There is an approved tentative map within the area that has been designed to -meet the requirements of the R-1 zone. 2. Seymore Goldman, 16707 Warner Avenue, addressed the Commission and opposed the zone change on grounds that the existing R-1 should remain around the golf course. Randall Hammer, 5415 Old Pirate Lane, Huntington Beach, addressed the Commission and stated that the R-1 has a high potential and was opposing the R-5 zone.. - = Carlos Reeves, representing the .owner; addressed the Commission and spoke in favor of"the proposed R-5 zone.' He stated that the professional offices would face on Warner Avenue and apartments would be situated on.the;rear of the property. - Dick Ferris, 1242 West Lincoln, Anaheim, addressed the Commission and stated that he was one of the property•owners of the land in question and spoke in favor of the proposed R-5. There being no further comment, the hearing was closed. A lengthy discussion was held by the.Commission. "It was the concensus that the zone change should -be continued to the'December 4, 1962, meeting and the area -be given more consideration and study for future zoning. S."Tayloe, representing the Holly Sugar Co., addressed the Commission and spoke in favor of the proposed transfer "station. Mr. Bill Lewis, representing the applicant, offered to answer any questions. Mr. Tayloe asked Mr. Lewis if the general public -will be allowed to use the refuse station for dumping rubbish. Mr. Lewis stated that the public would not be allowed to do so. There being no further comment, the hearing was closed. The Commission held a lengthy discussion. The Planning Director stated that the proposed transfer station will have acce5s'orily from Gothard Street which will keep the major portion of the truck traffic within the industrial area. Ira Sheldon, 8047 Slater Avenue, addressed the Commission and stated that the property is too small for such a use. Mrs. Ira Sheldon,addressed the Commission and stated that the proposed car wash will be only 200 feet away from her property and she vigorously pro- tested. Bill Moody, representing the applicant, addressed the Commission and gave'a lengthy explanation of the proposed car wash. There being no further comment, the hearing was closed.
