MINUTES: On motion by Letson and seconded by Crabb, the Minutes of the Huntington Beach Planning Commission of January 2, and January 8, 1963, were accepted as transcribed and mailed by the Secretary. TENTATIVE TRACT MAP NO 4954•- Continued Number of Lots: "6 Subdivider: Stanley -Bell Total Acreage: 5.66 Engineer: Voorheis-Trindle- Nelson, Inc. Located south of Warner Avenue, approximately 1320 feet west of Newland Street, and legally described as being a subdivision of portion of the NW-4 of the NW4 of Section 25-5-11. The Subdivision Committee Report was read by the Secretary. The hearing was opened to the audience; the re being no comment, it was closed. A MOTION WAS MADE BY LETSON AND SECONDED BY CRABB TO APPROVE TENTATIVE TRACT MAP NO 4954 UPON THE FOLLOWING CONDITIONS: 1. The revised tentative map dated January 10, 1963, shall be the approved layout. 2. Approval of the tentative'map shall not imply approval of Lot 6 for multiple family use. 3. Drainage fees for the tract shall be $930 per acre. 4. All Standard Subdivision Requirements that are applicable shall be complied with. Planningg Commission .Tuesday, January 15, 1963 ZONE CASE NO 304 - Continued Change of Zone from A-1-X Applicant: Frank Cracchiolo General Agricultural District as adopted by Interim Ordinance No 668 to R-2 Two Family Residence District. Located on the west side of Ash Street and approximately 400 feet south of.Cypress Avenue, and legally described as the El of Lot 5, Block D, Tract No 436. The hearing was reopened to' the audience. Mr. Janes-Ieler, 17108 Ash. Street, addressed the Commission and -.spoke -in favor -©f _an R-3 zone. E.- R.. Markson, representing the Alpha Beta Acme -Markets, Inc., addressed the Commission and stated that the area does not have sufficient -supply of water and that the streets are not improved. He also pointed out that the sewer system is inadequate. He was opposed to the zone change. I Mr. Frank Cracch.iolo, applicant, addressed the Commission and spoke in favor. C. L. The Secretary pointed out to the Commission that several properties in the community are developed with,, limited multiple family use though. -the majority of lots contain single family homes. RESOLUTION 'NO - 304 ' ' - :'-A Resolution of , the City Planning Commission Re- commending Approval of Zone Case No 304 to the City, Council. ' A MOTION WAS MADE BY WORTHY AND SECONDED BY CRABB TO ADOPT RESOLUTION NO 304 RECOMMENDING APPROVAL OF ZONE CASE NO 304 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. THE RESOLUTION WAS ADOPTED. ZONE CASE NO 305 Change of Zone from C-2 Com- Applicant: Williamson munity Business District to R-3 Park Company Limited Multiple Family Residence District. Located on the east side of Cannery Street and approxi- mately 450 feet south of Adams Avenue, and legally described as the S'1y 260 feet of Lot 82, Tract No 4284. The Staff Report was read by the Secretary. The hearing was opened to the audience. Mr.'Phil Susman, 9071 Mediterranean Drive, addressed the Commission and opposed the subject zone change.' E. D. Fox, 20131 Shorewood Circle, addressed the Commission'and also protested the zone change. Also the following property owners within the tract stated their opposition: Mrs. King, 20092 Shorewood Circle, Mr. Terry O'Connor, 9141 Mediterranean Drive, W. D. Genn, 20082 Shorewood Circle, Mr. McGroom, 9001 Mediterranean Drive, Rita Provost, 9001 Mediterranean Drive, Paul Rio, 9131 Mediterranean Drive, Dennis Barnes, 9001 Mediterranean Drive, Harold Perion, 20072 Shorewood Circle. James 'F . Deane, developer of Sea - haven, addressed the Commission and spoke in favor. He further stated that the proposed R-3 zone would be a good buffer zone between commercial and single family use. Rudy Woodruff, Voorheis-Trindle- Nelson, representing the subdivider, addressed the Commission and also spoke in favor of the proposed zone change. There being no further comment, the hearing was closed. Commission discussion was held at le ngth. RESOLUTION NO 305 A Resolution of the City Planning Commission Recommending Approval of Zone Case No 305 to the City Council. - 3 - Page #4 Minutes - H. B. Planning Commission Tuesday, January 15, 1963 A MOTION WAS MADE BY MILLER AND SECONDED BY LETSON TO ADOPT RESOLUTION NO 305 RECOMMENDING APPROVAL OF ZONE CASE NO 305 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. A multiple zone such. as R-3 would provide for a good transition between the commercial property and residential property in the area. 2. A division of land for the property was approved with the intention of multiple family development for paid parcel. 3. The property is abutting a primary highway to the west which will provide for easy accessibility to and from the parcel. ROLL CALL VOTE: AYES: Letson, Bazi1, Kaufman, Worthy, Miller, Chairman Stang. USE VARIANCE NO 505 - Continued Applicant: Huntington Harbour Corporation _ To allow the construction of general uses permitted in the C-2 zone -plus the following marina -related uses: (1) Boat sales, boat building and repair, boat launching, boat storage, boat mooring facilities of any type, including piers, docks, wharves, slips or ramps. (2) Boat fuel and service facilities. (3) Boat and marine stores, supplies, parts and accessory shops. (4) Private boat and/or beach. clubs, restaurants, service stations (auto- mobiles). Located north. of Warner Avenue and approximately 900 feet west of Algonquin Street in the R-1 Single Family Residence District. Douglas, President of Huntington Harbour Corporation, requesting a continuance of Use Variance a . No 505 to th.e next regular meeting. Planning Commission Tuesday, January 15, 1963 ORAL COMMUNICATION: Mr. Mac Bangoy, President of the Goldenwest Homeowners Association, addressed the Commission stating that the Association is' opposed to the proposed construction of apartment units at the southwest corner of Goldenwest and Brunswick. He further stated that the people would be too transient and they would not take care of the premises as an individual property owner. Mr. Haynes, homeowner within the tract, addressed the Commission and vigorously protested the multiple development. Carol Shapiro, also a homeowner within the tract, protested the proposed multiple development. It was noted that the property involved has been zoned R-5 for about two years and that multiple family use is permitted in that zone. The City Attorney advised the Commission that there was nothing the Planning Commission could do and it was his suggestion that the Association retain legal Counsel and consider an injunction. USE VARIANCE NO 510 To allow the assembly and sale Applicant: M. M. McCallen of boats in the R-4-0 Multiple Family Residence District combined with. oil production. Located south of Walnut Street and west of 22nd Street and legally described as Lots 11, 13, 15, and 17, Block No 122, Seventeenth. Street Section. The Staff Report was read by the Secretary. The hearing was opened to the audience. Mr. Worth Potts, 511 13th Street, lessee of the property, addressed the Commission and spoke in favor of the subject variance. There being no further comment, the hearing was closed. Commission discussion was held. The Planning Director informed the Commission that the property involved is situated in the midst of a very active section of oil field and is the only property within several blocks which contains a building. He further stated that the existing corrugated iron building has been used intermittently for a variety of use and has been vacant a large part of the time. It was further noted that a few months ago this property was rezoned from M2-0 along the general area west of 17th. Street. It was also noted that since there has been no development take place in the area, and it appears that new uses will be slow in - 5 - 390 Page #6 Minutes - H. B. A MOTION WAS MADE BY BAZIL AND SECONDED BY WORTHY TO APPROVE USE VARIANCE NO 510 UPON THE FOLLOWING CONDITION: 1. The Use Variance shall expire January 15, 1965. USE VARIANCE NO 511 To allow single family Applicant: Warren Gibbons Co. residences, one story units on Lots 11 25 35 4, 55 6, and 7, Tentative Tract No 4954, and thirteen single story fourplex garden apartments on Lot 8 as per Tentative Tract No 4954, in the Al-X General Agricultural District. Located south of Warner and approximately 1320 feet west of Newland Street, and legally described as portion of the NW-4- of the NW4 of Section 25-5-11. Further legal description on file in the Planning Department Office. The Staff Report was read by the Secretary. The hearing was opened to the audience. Mr. Keith Robert, 8152 Blaylock Place, addressed the Commission and spoke in favor of the subject variance providing that th.is will set a precedent for the adjoining five acre parcel. Jim Galloway, 17101 Rotterdam Lane, addressed the Commission, and spoke in favor of th.e multiple development. The landowner on the west side of the proposed development addressed the Commission and requested that a 6 ft block wall fence be constructed along th.e entire west line including the R-1 lot except 42 inches in height in the front yard setback. Warren Gibbons, applicant, addressed the Commission and stated that he does not object to the construction of the 6 ft block wall as requested. Marilyn E. Roberts, 8152 Blaylock Place, addressed the Commission and stated that as long as all the conditions are met she is in favor for the proposed development. S"� 391 Page #7 Minutes - H. B. BY LETSON TO APPROVE USE VARIANCE NO 511 UPON THE FOLLOWING CONDITIONS: 1. The variance shall not be effective until the final tract map o� Tract No 4954 is recorded. 2. No building permits for construction of the multiple family units shall be issued unless building permits for the five single family homes have been issued. 3. A 6 ft masonry wall shall separate the multiple family area from the areas adjoining on the east, south and west, and shall extend along the west side of the proposed R-1 development. Located north. of Heil Avenue and east of Bolsa Chica Street, and legally described as portion of the SW4 of the NW4 of Section 21-5-11. Further legal description on file in the Planning Department Office. The Staff Report was read by the Secretary. The hearing was opened to the audience. Dr. Adrian 0. Hubbell, applicant, addressed the Commission and explained the proposed project and displayed pictures of the proposed buildings. Mr. Roland Hornsby, Huntington Engineering Corporation, addressed the Commission and discussed the drainage layout. Robert Baver, 1585 Hummingbird Lane, addressed the Commission and questioned the drainage problems. Mr. Horst U. Merg, 16311 Saratoga Lane, addressed the Commission and stated that the block wall should be higher so that the property owners of Tract 3752 - Huntington Village would have more privacy. - 7 - 39.2 Page #8 Minutes - H. Planningg Commission Tuesday, January 15, 1963 Earl Stepping, 16401 Saratoga Lane, addressed the Commission and stated that he is not opposed to the trailer park as long as the drainage layout is solved. Harold Kengee, addressed the Commission and asked about the street improvements. Assistant City Engineer, Bill Hartge stated that Bolsa Chica Street will be a 120 ft wide major highway in the near future. Alvin Graham, developer of a trailer park located at the northeast corner of Springdale and Graham Streets, addressed the Commission and spoke in favor of the proposed trailer park. He further stated that a trailer park of this nature has its own rules and regulations. Mr. Francis L. Zeal, 16321 Saratoga Lane, addressed the Commission and requested that the laundry room be moved at least -two trailer spaces away from the R-1 zone. There being no further comment, the hearing was closed. Commission discussion was held. The Planning Director informed the Commission that the property involved in this case was zoned R-5 early in 1960 with the express purpose of developing a.trailer park. He further stated that the size of the trailer sites are well over the minimum, the Code requires dedication and improvements of the adjoining streets and a 5 ft masonry wall surrounding the park, and the R/W for re -aligning the flood control channel along Bolsa Ch.ica has been deeded to and accepted by the City. A MOTION'WAS MADE BY BAZIL AND SECONDED BY CRABB TO APPROVE USE PERMIT NO 211 UPON THE FOLLOWING CONDITIONS: 1. A 6 ft block wall fence shall be constructed around the whole trailer park. 2. The laundry room shall be relocated.at least 2 trailer spaces away from the R-1 Single Family Residence District. 3. CO114UNICATION: The Secretary read a letter siib- lhMILTON STREET mitted by the Planning Director of Costa Mesa, California, stating that the Costa Mesa City Council has approved the name change of Hamilton Avenue east of the Santa Ana River to Victoria Street. It was the consensus that the Planning Director contact the Orange County Street Naming Committee to request their consideration.in this matter and submit an early recommendation to the Planning Commission. - 9 - 394 Page #10 Minutes - H. He further stated that England Street has now been dedicated and fully improved creating a non -conforming building because of a 7 ft front yard.-- It was further noted that the applicant wishes to divide the property to create further non-conformance by virtue of an undersize parcel for the four units. The lot would contain 7590 sq ft instead of the required 8000 square feet. COMMUNICATION ORANGE COUNTY HEALTH DEPARTMENT RE: TRACT NO 4852 - Portion of Tentative Tract 4744. The Secretary read a letter submitted by the Orange County Health Department dated January 14, 1963, stating that an agreement has been reached between -the subdivider and the Talbert Water District to comply with the operating standards established by the Health Department and recommends approval of Tract No 4852 which is a portion of Tentative Tract Map No74744 being located at the northeast corner of Yorktown and Bushard Streets. A MOTION WAS MADE BY KAUFMAN AND SECONDED BY CRABB TO APPROVE TENTATIVE TRACT MAP NO 4744 UPON THE FOLLOWING CONDITIONS: 1. The layout dated May 24, 1962, shall be the approved map. 2. A 6 ft chain link type fence shall be constructed along the Edison Co R/W and Flood Control Channel. 3. Bushard Street shall be improved to City Standards across the Edison Co. and Flood Control Channel rights -of -way. 4. CO11MUNI CATION : ZONE CASE NO 301 The Secretary read a communication submitted by the City Clerk stating that the City Council has referred to the Planning Commission the request of the applicant to re -consider Zone Case 301 for an R-3 zone instead of the requested C-2 Community Business - District. The property is located at the southeast corner of Heil Avenue and Graham Street, A MOTION WAS MADE BY KAUFMAN AND SECONDED BY CRABB TO SET THE MATTER FOR PUBLIC HEARING ON FEBRUARY 5, 1963. ROLL CALL VOTE: AYES: Crabb, Letson, Bazil, Kaufman, Worthy, Muller, Chairman Stang. NOES: None. ABSENT: None. THE MOTION CARRIED. COMMUNICATION: The Secretary read a letter submitted by Mr. F. L. Shermer,requesting a determination as to whether a certain use is permitted in the C-1 Neighborhood Commercial District. Mr. Shermer requested that such a determination be made in the case of a proposed automotive upholstry shop at the northeast corner of Beach Boulevard and Warner Avenue. The Planning Commission considered the request and determined the proposed use would be similar to other C-1 uses provided such is conducted entirely ui thin a building. A MOTION WAS MADE BY KAUFMAN AND SECONDED BY LETSON TO RECOMMEND THAT THE CITY COUNCIL APPROVE THE ODMMISSION'S DETERMINATION THAT AN AUTOMOTIVE UPHOLSTRY SHOP IS SIMILAR TO PERMITTED USES IN THE C-1 ZONE PROVIDED SUCH IS CONDUCTED ENTIRELY WITHIN A BUILDING. - 12 - 397 Page #13 Minutes - H. PROPOSED DUMP SITE: WARNER AVENUE AND BOLSA CHICA STREET The Planning Director advised the Commission that a variance application had recently been referred to the City by the Orange County Planning Commission for estab- lishment of a dump site on the east side of Bolsa Chica Street and about 600 feet south of Warner Avenue. The Planning Director noted that the application had been received just after a Commission meeting and was scheduled for hearing prior to another meeting of the City Planning Commission, therefore, he had replied to the County Planning Commission stating the conditions he would have recommended to the City Planning Commission if the matter was considered for approval. The conditions were: 1. All standard practices followed by the County in their cut and cover operations should be followed. 2. Approval should be for a maximum of 2 years in order that the situation could be re -appraised at that time. 3. Bolsa Chica is planned as a major arterial highway extending south of Warner Avenue even though not yet included on the Master Plan of Arterial Highways and the right-of-way should be dedicated 60 feet from centerline and a bond posted to guarantee future improvement. 4. Plant and maintain adequate screen planting on all four sides of the site. The matter was discussed at length by the Commission and it was the concensus that this is an opportunity to eliminate an eyesore in the area. It was felt that a limited time should be considered since there are several major developments planned in the immediate vicinity.
