Mr. John Welsh, applicant,
addressed the Commission and spoke in favor of granting the
subject division •of -land.
There being. -no other comment,
the hearing was closed. .
The Secretary informed the
Commission that the original size of the property in this
case was 75 ft x 195.5 ft and a small house was built at the
east end. He further stated that about a year ago a 48 ft x
75 ft lot.containing the house was sold -leaving a parcel 75
ft x 147.5 ft.._. It -was noted that the 48 ft x 75 ft lot is
not a legal building site since no division of land -was filed
and the parcel contains only 3600 square feet.

The hearing was opened to
the audience. --John Prins,'repre'senting-,the.applicant,.
addressed the Commission and explained why the property was.,
divided as such.. He -stated that it was originally the appli-
cant's intention to,lease property to various -tenants but two
of their prospects wanted to purchase sites rather than -lease. -
There being no further
comment, the hearing was closed.
Commission:discussion was
• held. The Secretary informed the Commission that this is
the property upon which Use Permit fora restaurant and
Dairy Store were considered previously. He further pointed
out that two of -the -three parcels involved contain less than.
the 100 ft width required in the C-4 .zone.

MINUTES: On motion by Letson and seconded by
Miller, the Minutes of the Huntington
Beach. Planning Commission of January 15, 1963, and January 29,
1963, as corrected, were accepted as transcribed and mailed by
the Secretary.
TENTATIVE TRACT MAP NO 3898 - REVISED
Number of Lots: 175 Subdivider: Holland Homes, Inc.
Total Acreage: 37.6 Engineer: Millet, King & Assoc.
Located at the northeast corner of
Banning Avenue and Cannery Street and legally described as being
a subdivision of a portion of the SWk of Section 18-6-10.
The Subdivision Committee Report was
read by the Secretary.
The hearing was opened to the audience.
Jack King, representing the subdivider,
addressed the Commission and stated that there were no objections
to the conditions contained in the Subdivision Committee report.

A MOTION WAS MADE BY WORTHY AND
SECONDED BY KAUFMAN TO APPROVE TENTATIVE TRACT MAP NO 3898 -
REVISED, UPON THE FOLLOWING CONDITIONS:
1. Th.e revised layout dated February 1, 1963, shall be the
approved map.
2. A 6 ft chain link type fence shall be constructed along the
Flood Control Channel R/W.
3. A walkway and pedestrian bridge across the Flood Control Channel
shall be provided near the northeast corner of the tract and
a masonry wall 6 ft high. shall be constructed along each. side
of the walk except where abutting the front yards of adjoining
lots where such. wall shall not exceed 42 inches.
4. The rear and exterior side of all reverse corner lots shall
be fenced with. a 6 ft masonry wall in accordance -with
Planning Commission standards.
5. No portion of this tract shall be recorded until such. time as
further approval by the Planning Commission is secured certi-
fying that a solution has been found to the problem of a -
public health. hazard due to irrigation of nearby farm lands
with. sewer effluent.

The hearing was opened to the
audience. Kenneth Carlson, representing the applicant,
addressed the Commission and stated that all conditions meet
with. approval of the developer.
Harold Pedersen, Superintendent of
the Ocean View Elementary School District, addressed the
Commission and.requested that a reasonable access to the
school site be provided.
There being no further comment,
the hearing was closed.
A MOTION WAS MADE BY BAZIL AND
SECONDED BY CRABB TO APPROVE TENTATIVE TRACT MAP 4039, 6TH
REVISED, UPON THE FOLLOWING CONDITIONS:
1. The tentative map shall be revised to provide a suitable
school site unless the proposed site adjacent to the tract
.is suitable to the School District and the County Counsel
as to-.locat-ion and feasibility -of clearing_,title.
2. Disposal of runoff water to be by pump -station, drainage
channel and other necessary facilities suitable to the
City Engineer.
3. The proposed drainage channel shall be fenced with. a 6 ft
masonry wall adjacent to lots within the tract.

4. All cul-de-sacs shall have a 50 ft property line radius.

shall be submitted to the City Engineer prior to recordation
of any part of the tract.
7. All provisions of the park and recreation site requirements
as set forth. in Section 9751.21 of the Huntington Beach
Ordinance Code shall be complied with.
8. A petition for rezoning for the intended use of the tract
shall be filed approximately at the time or recording a
final map.
9. All Standard Subdivision Requirements shall be complied
with.

ZONE CASE NO 290 - Continued
Applicant: Huntington Beach
Estates
Change of Zone from C-1
Neighborhood Commercial District
and-R-4-X Suburban Residential
District to R-1 Single Family
Residence District and C-2 Community Business District with
setback provisions. Located on the north side of Slater
Avenue and extending from Beach Boulevard to Newland Street
and legally described as being a portion of the northwest
quarter of Section 25-5-11 and all of Tract No 4009 in the
City of Huntington Beach. Further legal description on file in
the Planning Department Office.
The Staff Report was read by
the Secretary.
The hearing was reopened to the
audience; there being no comment, it was closed.
A lengthy discussion was held
by the Commission. It was noted that a strip about 200 feet
deep along Beach Boulevard is presently zoned C-1. The
request is to change this to C-2 and to extend the zoning to
a depth. of about 560 feet.
The Secretary pointed out that
the acreage is split about in half by an existing.public street
which creates two 5 acre parcels with most of their frontage
on the local street.
It was noted .that this could
create a rather detrimental problem for the future residents
of the adjoining tract.

audience. Harold Madrich., owner of a home within the
Huntington Village tract, addressed the Commission and vigor-
ously protested to the subject zone change. He further stated
that the area should be kept as an R-1 zone.
Jay Lawyer, representing the
applicant, addressed the Commission and spoke in favor of the
proposed development.
J. H. Wison, 5871 Heil Avenue,
addre-ssed the Commission and stated that he would rather see
that the property is developed into single family use than
multiple residences.

There being no other comment,
Commission discussion was held.
It,was noted that to the south is a 3 acre parcel zoned R-3
which is abutting the golf course and is being subdivided but
upon which. no construction of buildings has started. It was
also pointed out by the Secretary that in the area to the north.
are new single family homes. To the west are a few scattered
homes and on -the east is the golf course. The Commission
felt that a limited type of multiple family use would be
quite acceptable at this site.

1. A multiple zone such as R-3 would provide_ for too great a
density for the area.
2. An R-2 zoning would be more compatible with. the surrounding
area.

and stated that the requested R-5 is not intended for a
trailer park but he.plans to construct a.medical building._
Cecil Johnson, representing
Mrs. Ellen Williams, addressed the Commission and opposed the
zone change.
Mr. Bishop, resident -of -Glen
Mar tract, addressed the Commission and stated that he is
opposed to a trailer park but not to a professional building.
Mr. Van Emerin, homeowner
x&h.in th.e Glen Mar development, addressed the ,Commissi.on and
spoke in favor of the medical center.
Mrs. Peter Willis, also a
resident within the tract,,addressed the Commission and
vigorously opposed the requested medical center.
There being no further comment;
the hearing was closed.
The Commission held a lengthy
discussion. It was noted that the requested R-5 consists of
three lots which.''were-originally approved as part of the
single family tract but have been used as a parking lot for
the adjoining model homes.

SECONDED BY LETSON TO ADOPT RESOLUTION NO 306 RECOMMENDING
DENIAL OF ZONE CASE NO 306 TO THE CITY COUNCIL FOR THE
FOLLOWING REASONS:
1. There are too many uses permitted in -the R-5 district for
• the particular neighborhood.
2. The establishment of an R-5 district would be considered
as an extension of commercial activity too far into the
single family neighborhood.

Commission discussion was held.
It was felt that there is a great deal of potential development
in the area in the near future, some of which the Commission
questioned the compatibility of a trailer park. It was further
noted that this potential plus the fact that there are no sewer
or water lines within a half mile, makes the requested R-5 zone
very premature.

A MOTION WAS MADE BY CRABB AND
SECONDED BY MILLER TO ADOPT RESOLUTION NO 307 RECOMMENDING DENIAL
OF ZONE CASE NO 307-TO THE CITY COUNCIL FOR THE FOLLOWING REASONS:
1. There is a great deal of potential development in the area
in the near future, some of which., it is felt, would be
incompatible with a trailer park and other R-5 zone uses.
2. There are no sewer or water lines within a half mile which.
makes the requested R-5 zone very premature.

The Staff Report was read by
the Secretary.
The hearing was opened to'the
audience. Ray Mercardo, representing the applicant, addressed
the Commission and spoke in favor of the proposed R-5 zone.
There being no other comment,
the hearing was closed.
The Secretary informed the
Commission that the property involved in this case is located
just 660 feet east of the property which was the subject of the
previous hearing. He further pointed out that in general the
circumstances are the same as that case and the Staff opinion
of the proposal being premature is also the same.
The Secretary further in-
formed the Commission that the next item on the agenda is a
variance covering the subject property for a trailer park
presumably in order that construction could be underway while
the zone change is being completed.
It was the concensus that
the Staff should study the entire area and a report be made to
the Commission at an early date.

Audience. Ray Mercado, representing the applicant, addressed
the Commission and spoke in favor of the proposed -Trailer Park.
There being no other comment, the hearing was closed.
The -Commission held a lengthy
discussion. It was noted that in this particular plan all
points of access'to Talbert Avenue and Goldenwest Street are
potentially very hazardous due to the contour of these streets.

the application requests a multitude of uses while the plot

discussion. It was noted that the property consists of a

further pointed out that 6 ft masonry walls are included in

crowded.

Drive; Mr. Whitcomb, 6572 Limerick Drive; Mr. J. E. Statham
6501 Limerick Drive; and Mr. Ken Turlis, 6502 Limerick Drive;
and-Mr.-J. N. Boyd, 6582 Limerick Drive.
Mr. Craig Jewett,. applicant,
addressed the Commission and explained the proposed project.
Also a petition of protest was
submitted to .the Secretary of the Planning Commission signed
by 25 homeowners within the Stardust Homes Tract.

There being no -further comment,
Commission discussion was held
at length.. It was pointed out by the Secretary that the
proposed restaurant is a permitted use in the7C-4 zone. Also
the -setback, parking, etc. all meet City Standards except for
the size of the lot. The lot is 55 ft. wide. instead of the
100 ft minimum required in the C-4 zone and it has a 15 ft
driveway easement on the west side.
The Secretary informed the
Commission that the next.application,on the agenda is for a
site just north of the -service station and Item 26 on the
agenda -is a division of land involving all of these sites.
