MINUTES: On motion by Worthy and seconded by Miller, the Minutes of the Huntington Beach.Planning Commission of April 2, 1963, were accepted as transcribed and mailed by the Secretary. TENTATIVE TRACT MAP NO 5057 Revised ° NUMBER OF LOTS: 16 Subdivider: Empire Financial C orp. Total Acreage: 3.7 Engineer: Huntington Engr.,Corp. Located approximately 330 feet west of Beach Boulevard, north of Slater Avenue, and legally described as being a proposed subdivision of a portion of the. W2 of the E z of the S z of the SE-4 of the NE4 of Section 26-5-11. The Secretary informed the Com- mission that next on the agenda is a Use Variance covering the subject property. The Subdivision Committee Report was read by the Secretary. It was the concensus that an action be deferred until Use Variance #564 had been considered. A MOTION WAS MADE BY CRABB AND SECONDED BY BAZIL TO DEFER ACTION ON THE TENTATIVE TRACT NO 5057 UNTIL AFTER USE VARIANCE #564 HAD BEEN CONSIDERED. William Duncan, Huntington Engineering Corporation, addressed the Commission and spoke in favor of the proposed multiple residential`development. There being no other comment, the hearing was closed.. Commission discussion was held. The Secretary informed the Commission that this is a.case of.a tract being proposed for multiple family use and where the property does not divide..out evenly for minimum size lots. He further pointed.out that the developer is requesting lots 42 feet narrower than the minimum required in order to get one additional lot. A MOTION WAS MADE BY BAZIL AND SECONDED BY WORTHY TO APPROVE USE VARIANCE NO 564 UPON THE FOLLOWING CONDITIONS: 1. There shall be a 20 foot alley extended across the north side .of Lot. 16. 2. The revised Tentative Map, dated April, 1963, shall be -the approved layout. 2. Approval of this tentative map shall be subject -to approval of UV #564. If UV #564 is not approved, all lots within the tract shall comply with City Standards. 3. A standard alley intersection corner cut=off shall be pro- vided at the southwest corner of Lot 3. 4. The corner cut-offs at the intersection of alleys with streets need not be provided. 5. The alley along the east side of the tract shall be ex- tended to "A" Street along the north line of Lot 16. 6. All Standard Subdivision requirements shall be complied with- 7. Total Acreage: 2 Engineer: R. G. Kempa & Assoc. Located on the west -side of Delaware'Street, south of 17th.Street and legally described as Block 2604, East Side Villa Tract. The Subdivision Committee Report was read by the Secretary. The hearing was opened to the audience.._ Mr. Guy Green, Chief Land Planner for R. G. Kempa & Associates, Inc., addressed the Commission and opposed the Subdivision Committee's recommendations. Bill Winky, attorney for the subdivider, addressed the Commission and spoke in favor of the proposed development.. There being no other comment, the hearing was closed. The Secretary informed the Commission that the next item on the agenda is a conditional exception covering the Tentative Map of Tract No.5105. Commission discussion was held at length.. It was the concensus that the hearings on Tentative Tract Map No 5105 and Conditional Exception,.UV #556, be continued to the next regular Planning Commission meeting. The hearing was opened to the audience." George Gillette, attorney for the applicant, addressed the Commission and spoke in favor of the proposed hospital. Mr. Lloyd Mannes, applicant, addressed^the Commission and explained the project and offered to answer any questions. Gerald Lance, 213 Main Street, addressed the Commission and spoke against the proposed hospital. John Rothenburgh, representing the applicant, addressed the Commission and explained the pro- posed construction of the hospital. He further pointed out that the proposed hospital will'.have three emergency rooms and a 24 hour emergency service which will operate seven days a week. There being no other comment, the hearing was closed. Commission discussion was held. Dale Heinly, attorney for the applicant, addressed the' Commission and' spoke in favor of the proposed mobile home park. Mr. Art Wolfe, 6301 W arner Avenue, addressed the Commission and opposed the size of lots per mobile home. S. D. Caplan, developer, addressed the Commission and ppoke in favor. R. B. Call, 17172 Palmdale Street, addressed the Commission and opposed the erosion of industrial property since it is such. property that will stabilize the economic base of the city in the coming years. There being no 'further com- ment, the hearing was closed. Commission discussion was held. Assistant City Engineer, Bill Ifartge, addressed the Commission and stated that if the subject variance is approved, the following conditions should be added to the variance: 1. Soil test report, and recommendation by a Soil Engineer shall be submitted prior to -issuance of building permit. 2. Drainage easement across the property shall be provided per requirements of the City Engineer. 3. Participate in drainage district at cost of approximately 1650 per acre. 4. Dedicate and improve Gothard Street to City Standards*. 5. Construct a 6 ft masonry wall designed to City requirements around the proposed trailer park. 6. The Secretary informed the Commission that the subject zone case has been continued from the March 19, 1963,-meeting. The Planning Director read a communication submitted by the Ocean View Homeownerst Association opposing the zone change. Also submitted were three petitions signed by 174 homeowners protesting the subject zone case.` The Staff Report was read by the Secretary. The hearing was opened to the audience. Attorney Dale Heinly, representing the applicant, addressed the Commission and spoke in favor. Also precise drawings were presented and explained to the Commission. Donald'Lewis, 8241 Lambert. Drive, addressed the Commission and stated that he is speaking on behalf of all homeowners within the Westmont Tract protesting the subject zone case. The following homeowners also opposed the zone change: Gordon Ballard, 8341 Terry Drive; Mrs. Merchant, 16741 Jeffrey Circle; Ken Spicer, Irby Lane; Fred Phillips; 8141 Bryant Drive; Mr. Roy Gould, 8302 Lambert Drive; 10 Page #7 Minutes: H. RESOLUTION NO 322 A Resolution of the City Plan- ning Commission Recommending Denial of Zone Case No 322 to the, -City Council. A MOTION WAS MADE BY BAZIL AND SECONDED BY KAUFMAN TO ADOPT RESOLUTION NO 322 RECOMMENDING DENIAL OF ZONE CASE NO 322 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. The proposed Master Plan of Land Use, Study Area II, indicates this area for low density development. 2. There is no justification for introducing multiple family development in this area. ROLL CALL VOTE: AYES: Crabb, Letson, Bazil, Kaufman, Worthy, Miller, -Chairman Stang. NOES: None. ABSENT: None. THE RESOLUTION WAS ADOPTED. Located at the northwest corner.of Gothard Street and Warner Avenue and legally described as a portion of the Wz of the SE4 of the SW4 of Section 23-5-11. Commissioner Worthy stated he would abstain from participation because of his interest in the property. The Staff Report was read by the Secretary. The hearing was opened to the audience. Attorney Don Jones, representing the applicant, addressed the Commission and spoke in favor of the subject •zone 'change. Carlos Reeves, 213 Main Street, addressed the Commission and also spoke in favor of th.e zone change. R. B. It was noted that the property in this case is situated adjacent to the community of-Wintersburg and is in the midst of the Central Industrial District. The Secretary informed the Commission that the next agenda item is a proposed amendment to -the Master Plan of Land Use, Study Area II, which. includes the subject property. He further stated that the plan shows the suggested route of the Huntington Beach. Freeway passing through. this property with, industrial use on the east and high. density residential use on the west. STUDY AREA II The Secretary presented the ZONE CASE NO 328 INITIALED BY RESOLUTION proposed amendment to the OF INTENT Master Plan of Land Use encompassing that portion of the city lying within the area generally north. of Ellis Avenue, east,of Goldenwest Street and south of Edinger Avenue. Commissioner Worthy abstained from participation because of interest in the general area. The hearing was opened to the audience. Harlow Keating, 17601 Newland Street, addressed the Commission and objected to single family use fronting on Newland Street south. of Slater Avenue. Roger Watson, 17081 Beach. Boulevard, addressed the Commission and questioned th.e prapase+d amendment since his property on Beach. Boulevard is presently zoned C-4. The Chairman informed Mr. Watson that his property, will not be affected in any way if the proposed am endment,sh.ould be adopted. . , I Page #9 Minutes: H. B. The hearing Robert B aker, resident on Bolsa- Chica Street, addressed the Commission and asked if Bolsa Chica Street could be slightly rerouted in order to miss the existing homes located just south of Warner Avenue. There being no other comment, the hearing was closed. Commission discussion was held. It was the concensus that the suggested highway plan amendments will provide for better traffic circulation within and adjacent to th.e city. USE VARIANCE NO 557 To allow the existing subdivision Applicant: George Holstein directional sign to remain at its present location for one year. Sign to be reduced to 10 x 40 feet. Located at the southeast corner of Heil .Avenue and Beach Blvd., and legally described as being 40 feet south, of the north, line of the SW4 of Section .24-5-11 and being 132 feet east of the west line of the SW-4 of Section 24-5-11, in the C-4 Highway Commercial District. The Staff Report was read by the Secretary. The hearing was opened to the audience. George DeBay, representing the applicant, addressed th.e Commission and spoke in favor of the proposed directional sign. There being no other comment, the hearing was closed. Commission discussion was held. The,Secretary informed the Commission that the request is now to allow the existing sign to remain where it is which, is less than a 50 ft setback from Beach Boulevard and that the applicant will reduce the sign area to 400 square feet as allowed. A MOTION WAS MADE BY CRABB AND SECONDED BY BAZIL TO APPROVE USE VARIANCE NO 557 WITH THE FOLLOWING CONDITIONS: 1. The approval of UV #557 will be subject to 50 ft setback on Beach Boulevard. 2. Located approximately 135 feet west of Ross Lane and north of Camel Circle, and legally described as Lot 33, Tract No 3430, also known as 8671 Camel Circle. The Secretary pointed out to the Commission that both. the front and rear yard requirements are involved in this case. He further stated that the front yard adjustment involves a 6 ft fence,'12 feet from the,property line, a portion of which. is solid and a portion to be open decorative block. . The Secretary informed the Commission that a variance is necessary to establish a church in the'R-1 zone. It was also pointed out that the plan, as presented, is quite reasonable and as much separation as possible is being provided for the adjoining single family homes. A MOTION WAS MADE BY WORTHY AND SECONDED BY CRABB TO APPROVE USE VARIANCE NO 559 WITH THE FOLLOWING CONDITIONS: 1. Complete the street improvements on -Springdale Street to City Standards. 2. Provide the number of off-street parking spaces as required by the Code at the time of construction of each. new addition and design the parking arrangement to adopted standards. The Secretary read the Staff Report. The hearing was opened to the audience; there being no comment, it was closed. The Secretary pointed out to the Commission that the' porch. will- no"t be enclosed and there will be no obstruction of vision at the intersection.
