Monday, May 6, 1963
Mayor Lambert called the regular meeting of
the City Council of the City of Huntington Beach to order at 7:30
o'clock P.M.
The Pledge of Allegiance was given by all
present in the Council Chamber.
The invocation was given by Rev. Ralph Jason
of the First Baptist Church of Huntington Village.
Councilmen Present: Wells, Gisler, Stewart, Welch, Lambert
Councilmen Absent: None
Res- of Conc ae ldation Mayor Lambert made' a presentation to Mr.
Chas. Stedma�� Charles Stedman of the Meadowlark Volunteer
Fire Department of a Resolution of Commen-
dation for his action in saving the life of Mr. John F. Kennedy, a
citizen of Huntington Beach.

had been elected as officials for the City
in the annual "Youth in Government" program which was sponsored by
the Huntington Beach Elk's Lodge and the High School. '

Lodge, who spoke briefly and introduced the
various students. The Students went onto the Council floor and met
their elected counterparts and occupied the positions which they held
for a feW minutes, after which they took seats in the Council Chamber.

Council received the reports of the City
Engineer, Building Director, Fire Chief, Life
Recreation Director, and ordered them filed. Motion
Mem. Hall Req, The Clerk presented a letter from the Evan -
Evan. Free Church gelical Free Church of Huntington Beach re-
questing use of Memorial Hall as temporary
quarters for their services beginning Sunday, June 16, 1963.
Permission Granted On motion by Welch, seconded by Gisler,
Council granted permission to the Evangelical
Free Church of Huntington Beach to use Memorial Hall on a temporary
basis on Sundays, beginning June 16, 1963, and directed the Clerk to
collect a fee of $50.00 per month for such use. Motion carried.
4-H Go -Fern Req. To On motion by Stewart, seconded by Gisler,
Sell Tickets ;ranted Council granted permission to the Midway
City Go -Fern 4-H Club to sell tickets for
their annual Hamburger Fry on June 1, 1963 in the north end of Hunt-
ington Beach. Motion carried.
Boy Scouts Req. To On motion by Welch, seconded by Wells,
Sp'.7. '[i_ckets Grali_t ed Council it granted permission for the Boy
n"" �-"�_ Scouts and Cub Scouts of the Orange Empire
Council to sell tickets for their annual Scout-O-Rama between April
26 and May 25, 1963 subject to registration with the Police Depart-
ment. Motion carried.

M.S. Req. To Solicit On motion by Wells, seconded by Stewart, Council
Funds Granted granted permission to the National Multiple
Sclerosis Society of Los Angeles, to solicit
funds in the City during the Multiple Sclerosis Hope. Chest campaign
between May 12th and June 22nd, 1963, subject to registration of solicit-
ors with the Police Department. Motion carried.
L. A. Epilepsy Soc. The Clerk presented a communication from the

ing permission to place canisters in business
places in the City during the month of July,
Request Withdrawn City Administrator Miller reported to the Council
that he had received word from this organization
that they had requested permission thinking that they were contacting
the City of Huntington Park rather than Huntington Beach, and stating
that they wish to withdraw their request. No action was taken by the
Council.
Ruben Dobkias The Clerk presented a letter from Mr. Ruben
Reg. Zone Change Dobkins, requesting Council to initiate a
zone change on property at 18211 Newland Street,
to make it conform to the original Orange County zone classification
of R-4, Suburban Residential District.
Rei. to Adrian. Following some discussion on the matter, a
Planni_nZ_Director motion was made by Welch, seconded by Gisler,
that the request of Mr. Dobkin be referred to
the City Administrator and the Planning Director. Motion carried.
Appeal to U.P. #213 A letter from Mr. Gerald Lance, 219 Geneva
Gerald Lance Street, City, appealing a decision of the
Planning Commission in their approval of Use
Permit - UP #215, was presented for Council consideration.
Public Hearing Ord. On motion by Stewart, seconded by Wells,
Appeal to i;P #215 Council ordered a public hearing for Monday,
- May 20, 1963, at 7:30 o'clock P.M., or as
soon thereafter as possible, on the appeal to the decision of the
Planning Commission in their approval on Use Permit - UP #215, and
directed the Clerk to publish notice of same. Motion carried.
Mr. & Mrs. Strixner A letter from Mr. & Mrs. George Strixner,
Compliant -Flooded Alley 212 Knoxville, City, requesting Council to
give consideration and take action regarding
the flooding of the alley behind their property, was presented for
Council consideration.

Mr. Springer Req. The Clerk presented a letter from Mr. Robert

purpose of exhibiting a surfing film to the public for profit.
Permission Granted On motion by Stewart, seconded by Gisler,
Mem. Hall - 5/23 Mr. Springer was granted use of Memorial
Hall on May 23, 1963 at a rental of $50.00,
plus fee for necessary police protection as required by the City Clerk.

Rodden Claim A claim for damages from O'Brien and Dumhart,

Council denied the claim of Mrs. Fleischer

To Use Sound System
The Clerk presented a letter from Huntington
Beach Post No. 133 of the American Legion,
requesting use of Memorial Hall, with fees
June 2nd, 1963.
On motion by Stewart, seconded by Gisler,
Council granted permission for the American
Legion to use Memorial Hall on the dates
the Clerk to waive the fees therefor. Motion

mission to use a sound system on Friday, May
3rd and Saturday, May 4th, 1963, to advertise a school fair. Motion

May 25, 1963 Association, informing Council of the second
Annual California Fire Show to be held at
the Orange County Fair Grounds on May 25, 1963, and requesting Council
to designate and proclaim that day as Orange County's Firemens' Day,
was presented for Council consideration.
May 25: 1963 On motion by Stewart, seconded by Gisler,
f= Orane Co. Firemens` Day Council authorized the designation of May
25th, 1963 as Orange County Firemens' Day.

Letter of Appr.- On motion by Welch, seconded by Stewart, a
H.B. Masonic Lodge communication from the Huntington Beach
Masonic Lodge No. 380, F & A M, expressing
their thanks for the City's cooperation in furnishing platforms for
use in the ceremonies of laying the cornerstone of the John R. Peter-
son School on April 21, 1963, was received and ordered filed. Motion
carried.
Mrs. Helen Susman Under Oral Communications, Mrs. Helen Susman,
H.B.Players Request 16582 Landau Lane, City, addressed the Council
and requested permission for the Huntington
Beach Players to use Memorial Hail for rehearsals on various dates during
May and June.

the filing of assessment in the Washington Avenue -Patterson Way
Improvement District, Assessment District No. 6201, as published in
the Huntington.Beach News on April 18th and April 25th, 1963, setting
the hour of 8:00 o'clock P.M., on Monday the 6th day of May, 1963,
in the Council Chambers of the City Hall, Huntington Beach, California
as the time and place for a public hearing when and where all persons
interested in the work done under said contract or in said assessment,
would be heard by the City Council of the City of Huntington Beach.

R.V. Hearons Mr. R. V. Hearons, 18391 Patterson Way, City,
Pretest addressed the Council and protested the
amount of the assessment made against his
property, and the method of determining same.
Mr. ;Dorn Stevens Mr. Don Stevens of the Engineering firm of
Soathwo-rth _& Stevens Southworth & Stevens of Costa Mesa, who had
Y been employed to spread the costs in this
improvement district, addressed the Council and explained the method
used in such spreading. He informed the Council and the protestant
that approved methods had been used, comparable to those used in many
other districts.
Mr. Hearons Mr. Hearons again addressed the Council and
stated that he believed part of the mis-
understanding in this matter came from the fact that the petition
originally carried an estimated price per front foot which was far
too low, and he recommended that in the future, such estimations be
kept at a level which would normally cover any costs incurred by the
property owners.
Mr. Varella Mr. Edward Varella, 3542 Washington Street,
City, addressed the Council and stated that
he was not protesting the assessment made against the property owners,
but that he wished to file a protest to the fact that many of the
families in his area did not understand the requirements for partici-
pation in such district when they signed the petition therefor, and
that many of them were not in a financial position to pay these
special assessments.

Discussion This matter received considerable discussion
by the Council.
Mrs. Stinson Mrs. Mary E. Stinson, 17142, 17142 Nichols
Propert2 Not Involved Street, addressed the Council in the same
regard, and was informed by Councilman Stewart
that her property was not involved in this Assessment District.
Mrs. Frances Andrada Mrs. Frances Andrada, 8081 LaPalma Street,
Re . Ex lan.ation addressed the Council and stated that she
could not understand why their property had
been assessed for 2 laterals and 75' frontage when she actually had
only one lateral and 65' frontage.
Mr. Stevens To Mr. Stevens informed Mrs. Andrada that he
Investi ate would study the matter and give her his
findings the following day.
Mr. Joseph Apple Mr. Joseph M. Apple, 8071 Ellis, addressed
Protest the Council and informed them that he was
not protesting the amount of the assessment,
but that he felt that the method used in spreading such costs was not
equitable.
Hearina Closed There being no one further to speak on the
matter, Mayor Lambert declared the hearing
closed.
Res. #1764 On motion by Stewart, seconded by Welch, all
Ado ted objections to the assessment were overruled,
and Resolution No. 1764 - "A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, CONFIRMING ASSESS-
MENT IN THE WASHINGTON AVENUE-PATTERSON WAY IMPROVEMENT DISTRICT,
ASSESSMENT DISTRICT NO. 6201," which had heretofore been submitted to
the Council and read by them, was passed and adopted by the following
roll call vote:

ABSENT: Councilmen: None
Public Hearing, Mayor Lambert announced that this was the
Res. #1741 day and hour set for a public hearing on
Resolution No. 1741 of the City Council
giving notice of proposed annexation of uninhabited territory des-
ignated as "Newland No. 2 Annexation", and requested the Clerk to
read the legal notice.
The Clerk read notice of public hearing as
published in the Huntington Beach News and the Westminster Herald on
April 4th and April llth, 1963, setting the hour of 8:00 o'clock P.M.
on Monday, the 6th day of May, 1963, in the Council Chambers of the
City Hall, Huntington Beach, California, as the time and place for a
public hearing for the purpose of hearing any persons owning property
within the area proposed to be annexed having any objections to the
proposed annexation,

Huntington Beach; said notice having given notice of public hearing,
setting the hour of 8:00 o'clock P.M., on Monday, May 6, 1963, in
the Council Chambers of the City Hall, Huntington Beach, California,
as the time and place when and where all property owners having ,any
objections to the proposed removal of the weeds, rubbish, refuse
and dirt, may object and be heard with due consideration.

Council Reconvened Council was reconvened at 8:55 o'clock P.M.
by the Mayor.
Public Mayor Lambert announced that this was the
P.C. Res. #320 day and hour set for a public hearing on
Resolution No. 320 of the City Planning
Commission, recommending denial of Zone Case No. 320 on property
situated south of Slater Avenue and West of Beach Boulevard, and
stated that the hearing had been opened at the meeting of April 15,
1963, and continued to this meeting.

Zone Case #320 On motion by Welch, seconded by Lambert, Council
Denied denied the petition for change of zone in Zone
Case No. 320. Motion carried.
Public Hearing Mayor Lambert announced that this was the day
Res. #308 and hour set for a public hearing on Resolu-
tion No. 308 of the City Planning Commission,
recommending approval of a portion of Zone Case No. 308, and further
recommending denial of a portion thereof, on property situated at the
northeast corner of Goldenwest Street and Talbert Avenue, and requested
the Clerk to read the legal notice.
The Clerk read notice of public hearing on
Zone Case No. 308 as published in the Huntington Beach News on April 18,
1963, setting the hour of 7:30 o'clock P.M., or as soon thereafter as
possible, on Monday, the 6th day of May, 1963, in the Council Chamber
of the City Hall, Huntington Beach, California, as the time and place
for a public hearing for the purpose of considering a petition for a
change of zone from: A-1-X General Agricultural District as adopted
by Interim Ordinance No. 668, and M-1 Light Industrial District, to:
R-5 Professional, Motel and Trailer Park District.
Nat Neff Engr. Req. The Clerk informed the Council that they had

Company that afternoon,.requesting withdrawal of their letter of appeal.

addressed the Council and requested permission
to withdraw the letter of appeal which they had filed.

on the matter, and their being no further
protests filed, the hearing was closed by the Mayor.
Zone Case #308 Portion On motion by Welch, seconded by Stewart, Coun-

denied that portion of the Zone Case recom-
mended for denial by the Commission, and directed the City Attorney to
prepare an Ordinance effecting the zone change in that portion approved
by the Planning Commission. Motion carried.

P.C. Rec. #315 and hour set for a public hearing on Resolution
No. 315 of the City Planning Commission, rec-
ommending approval of a portion of Zone Case No. 315, for an R-2 Zone
rather than an R-3 Zone, and further recommending denial of a portion
of said zone case on property situated on the north side of Taylor
Avenue and east of Edwards Street, and requested the Clerk to read
the legal notice.
The Clerk read notice of public hearing on
Zone Case No. 315 as published in the Huntington Beach News on April 18,
1963, setting the hour of 7:30 o'clock P.M,., or as soon thereafter as
possible, on Monday, the 6th day of May, 1963, in the Council Chamber
of the City Hall, Huntington Beach, California, as the time and place
for a public hearing for the purpose of considering a petition for a
change of zone from: A-1-X General Agricultural District as adopted
by Interim Ordinance No. 668, to: R-3 Limited Multiple Family Resi-

ning Director's transmittal and the Resolution of the Planning Com-
mission, and stated that he had received no written protests to the
zone change or the recommendation of the Planning Commission.

STATING THE RESULT OF THE CANVASS OF

ELECTION HELD APRIL 30, 1963.
WHEREAS, the City Council of the City of Huntington Beach,
California, by Resolution No. 1730, duly called and provided for the
holding of a special election in said city on April 30th, 1963, for
the purpose of submitting to the qualified voters of said city the
proposition set forth in said ordinance and hereinafter stated; and
WHEREAS, notice of said election was duly and regularly
given in time, form and manner as provided by law, and said election
was on said date duly held at the polling places designated in said
ordinance, and the votes cast thereat were canvassed and the returns
thereof made at the time and in the manner and form provided by law;
and
WHEREAS, on this 6th day of May, 1963, at the hour of 7:30
o'clock P.M., said City Council has duly assembled at its usual place
of meeting and has canvassed the returns of said election;
NOW, THEREFORE, the City Council of the City of Huntington
Beach, California, DOES HEREBY RESOLVE, DETERMINE AND ORDER as follow
Section 1. That the special election for the purpose of

Delegates to Sacramento The City Administrator informed the Council
Assembly Bill115:1. that Assembly Bill No. 1151 would be heard
by the Ways and Means Committee on Thursday,
May 9, 1963, at 1:30 P.M., and ask whether Council would wish to send
delegates to this hearing. Councilmen Wells and Welch, Chamber of
Commerce Manager Gallienne, and City Attorney Plunkett indicated that
they would be able to attend the meeting.

Welch, Mayor Lambert or City Attorney
Plunkett, and Chamber of Commerce Manager Gallienne and any others

to attend the hearing with reasonable expenses and transportation

Contract Presented The City Administrator informed the Council
Claude Jones & City that a contract between Assistant Director
of Civil Defense Claude Jones and the City
had been prepared by the City Attorney.

Eff. May 19 1963 _ Council approved the contract to employ
Mr, Claude Jones as Assistant Director of
Civil Defense effective May 19, 1963, and authorize the Mayor and
City Clerk to execute the document on behalf of the City. Motion

Agreement Tres, To The City Administrator presented an agree -
Renovate Edison Bldg. ment between Jordan and Endsley and the City
for Engineering and Architectural work re-
quired in the renovation of the Southern California Edison Building
recently acquired by the City,

A&ree. Accepted the agreement between Jordan & Endsley and
the City was accepted and the Mayor and the
City Clerk were directed to execute same on behalf of the City. Motion

P.D. Req. to Purch. The City Administrator presented a request
3-Wheel Scooter from Police Chief Robidoux for permission to
purchase a three wheel Cushman Scooter to be
used by the Parking Control Officer.

Robidoux in attending the State Attorney General All Zone Meeting in
