MINUTES: On motion by Worthy and seconded by Crabb, the Minutes of the Huntington Beach Planning Commission of May 7, 1963, were accepted as transcribed and mailed by the Secretary.. TENTATIVE TRACT MAP NO 3274 - Revised Number of Lots: 75 Subdivider: Capital Returns, Inc. Total Acreage: 6.6 Engineer: Huntington Engn., Corp. Located 'south of Detroit Avenue and approximately 1240 feet west of Beach. Boulevard, and legally described as being a proposed subdivision of Lots 5 to 10 and all of Lots 1 to 4, Block 203, Vista Del Mar Tract, and a portion of the SE4 "of SEction 11-6-11. The Secretary read a letter submitted by the Engineer for the subdivider requesting that Tentative Tract Map No 3274 be continued to the June 4, 1963, meeting. Located'west of Gothard Street and approximately 400 feet north of Slater Avenue, and legally described as follows: All of Tract Nos 263, 264, 265, 273, 274; EXCEPTING THEREFROM the west 162.50 feet of the north 225.00 feet and all of Tract No 275, EXCEPTING THEREFROM the west 162.50 feet. The Secretary ,informed the Commission that the* subject case has been continued from previous meetings in,order to work out the problem of dedication of right-of-way on Gothard Street. The hearing was reopened to the audience. .Dale Heinly, attorney for the applicant, addressed the Commission and stated that the applicant is willing to dedicate the required right-of-way for Gothard Street or post a bond. He further stated that the sub- divider agrees with.all the suggested pondi.tions. There being no other comment, the hearing was closed. The Secretary read a communi- cation submitted by Keate Worley, Assistant City Attorney, re- garding a proposal for City -Developer joint project to condemn property on Gothard Street. The Staff Report was read by the Secretary. The hearing was reopened to the audience. Robert S. Gardner, applicant, addressed the Commission and explained the project. He further stated that there were no objections to the conditions contained in the Staff Report. There being no further comment; the hearing was closed. -Commission discussion was held. Dedicate the right -of -'way for "A" Street to total of 45 feet in width. 3. Install street improvements to'City Standards on Beach Boulevard, Robidoux and "All Streets. 4. Construct a 6 ft masonry wall along the south and east property lines abutting the existing residential uses. 5. Widen the driveway on Robl:doux Street for two=way traffic. 6. A MOTION WAS MADE BY KAUFMAN AND SECONDED BY CRABB TO ADOPT RESOLUTION NO 336 RE- COMMENDING APPROVAL OF ZONE CASE NO 336.TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. The adoption -of the proposal will provide a transition be- tween the present agricultural activities in the Talbert, Valley and future development. 2. The uses permitted inthese zones are essentially the same as those presently being conducted.` 3. This proposal -,includes -changing -those portions of the southeast industrial area, that are indicated on the Master Plan of Land Use, Study Area I, for use's other than industrial. Located at the southwest corner of Heil Avenue and Goldenwest Street and legally described as Lot 85, Tract 4381. The Secretary read a letter submitted by Jeanette Collins, secretary to Lon,NE. Peek, 7801 Bolsa Avenue, Westminster, California, stating that Mr. Peek is opposed to the subject zone case. John A. Murdv, III, addressed the Commission and offered to answer questions. Mr. Mellon, 6961 Lenis Circle, addressed the Commission and opposed to-the'gasoline,station being built back of his home. Also Mr. Wm. Buckley,'Richa rd Varner, and Mrs. Marnett Peek, homeowners within the area, stated their opposition. There being no further comment, the hearing was' closed. Commission discussion was held. RESOLUTION NO 337 A Resolution of the City Planning Commission Recommending Approval of Zone Case No 337 to the City Council. A MOTION WAS MADE BY WORTHY AND -SECONDED BY -MILLER TO ADOPT RESOLUTION NO 337 RECOMMENDING APPROVAL OF ZONE CASE 337 TO THE CITY COUNCIL -FOR THE FOLLOWING REASONS: 1. The property was designed for a use other than single family development when th.e,subdivision map was first approved. 2., ,The property was considered for commercial zoning twice prior to the proposal and was turned down due to the premature nature of the proposals. One year has lapsed since this time and since then 246 homes have been occupied and another 85 homes under construction. This in itself indicates a need for such a facility. Fire Chief Higgins - addressed the Commission and stated that'if•the proposed room addition is granted it will have to'meet the building code requirements. Mrs. M.,Stinchfield, 3428 Lime Street, Riverside, addressed the Commission and opposed the subject variance. Mrs. Manthei, applicant, addressed the Commission and stated that the'property needs leveling before any buildings can be erected. Also speaking in opposition were the following property owners: Lawrence C.-'Newman, 275 E 18th St., Costa Mesa; Carl Tunstall, Ronald Road; Guy F. Zukie, 7762 Ronald Road; Mrs. Archibald, Huritington'Beach; and Donald L. Maher,' 7792 Ronald Road. - There being no other comment, the hearing was closed. De Lange, 16511 Loire Circle, addressed the Commission and questioned the additional dedication of right-of-way. -There being no further comment, the hearing was closed. There being no other comment, the hearing was closed. COMMUNICATION: The Secretary read a communication submitted by Mr. Aben J. Shefin, Quality-Bilt Homes, requesting 19 ft x 20 ft'gross parking spaces on a lot 25 ft wide in deviation to the required 10 ft x 20'ft covered parking area. Planning Commission Tuesday, May 21, 1963 EXCEPTION AND USE PERMIT REVOCATION Commissioner Crabb raised the question of how many Exceptions and Use Permits had been granted in past years that had never been used. It was felt that many,exceptions could be activated which. -would create serious problems now that the City has grown so much and will continue to grow. It was the concensus that a list of such applications should be prepared for the Commission to consider recommending their revocation to the Council under the provisions of Section 9248 and the Staff was so instructed. Discussion was also held regarding -the possibility of amending the Code -'to provide an -automatic invalidation -of Exceptions and Use Permits if they are .not used within one year of their _approval. The Commission agreed that such a provision would be desirable and the Staff was instructed to prepare a draft of such. an amendment. HUNTINGTON HARBOUR CONSTRUCTION Assistant City Engineer Hartge requested the Commissions opinion of allowing Huntington Harbour to construct homes -on the edge of drainage easements rather than providing the normal five foot setback. No conclusion was reached. WIDTH OF PRIVATE STREETS Fire Chief Higgins explained his problems with private streets and driveways which are too narrow for emergency equipment. He requested that the Commission'give careful consideration of streets in con- dominium projects.
