MINUTES: On motion.by-Letson and seconded by "Worthy, the Minutes of th,e,Huntington Beach. Planning Commission of May 21 and May 28, 1963, were accepted as transcribed-by:the Secretary. TENTATIVE TRACT MAP NO 3274_'- Revised= Continued Number of Lots: 77 Subdivider: Capital Returns, Inc. Total Acreage: 6.6 Engineer: 'Huntington Engineering Corp. Located south.•of Detroit Avenue and approximately 1240 feet west of Beach Boul6vard, and legally described as being a proposed subdivision of Lots 5 to 10 and all of Lots 1 to 4, Block 203, Vi6ta Del Mar Tract, and a portion -of the SE4 of Section 11-6-11. The Subdivisio n,Committee Report was read by th.e Secretary. The hearing was reopened to the audience. Harry LeBard, 308 California Avenue, addressed the Commission and requested more information regarding the proper fill of the property in question. Assistant City Engineer Bill Hartge, addressed the Commission and stated -that theground will be raised to elevation required. William Duncan, representing the applicant, addressed the Commission and explained"the proposed development Mrs. Miller, 411 Delaware Street, addressed the Commission and vigorously opposed the multiple development. There being no further comment, the hearing was closed. Commission discussion was held. The Secretary informed the Commission that it is the intent of this proposed subdivision to create a development based on the condominium concept of a planned community. He further pointed out that it is proposed to form some type of,a property ownerls' association with provisions for maintenance 'of the areas of common ownership by'th,e association.- M.** Page #2 Minutes: H. B. Planning Commission Tuesday, June 4, 1963 A MOTION WAS MADE BY BAZIL AND SECONDED BY CRABB TO APPROVE TENTATIVE TRACT MAP NO 3274 - REVISED, WITH THE FOLLOWING CONDITIONS: 1. The Revised"Tentative"Map,received June 3, 1963, shall be the approve& map. 2. Vehicular access rights to Delaware Street, except for the two proposed driveways, shall be dedicated to the City. 3. All of, -that portion'of!Delaware Street within .the boundaries of the Tentative Map shall be, -dedicated and at least one-half of the right-of-way shall be improved to City Staneards. 4. All private streets sh.all.be at least 32 feet in paved width within a 34'foot R/W and shall be improved with the curb, gutter, and paving to -City Standards. The one passageway shown as 25 feetrwide,shall be at least 26 feet in paved width- 5. Disposal of runoff water and any necessary easements, shall, meet the approval of the City Engineer and the tract shall participate in the drainage district assessment -of $1250" per acre, •6. Sewer, water,'fire hydrant and street lighting systems shall be installed -throughout the tract and shall be approved by the City Engineer. 7. Approval of the tract shall be subject to approval of"Variance No 585 by the City Council. 8. Adequate provisinns shall be°made to assure perpetual main- tenance of all common areas and the roads and driveways. Such provisions shall be submitted,to and be approved by the Planning Director and City Attorney prior to recordation of any portion of the tract. 9. All rights for,development and construction of any -structures within the common area not included in,the approved develop- ment plan shall be dedicated to the City. 10. All provisions of the park and recreation site requirements as set forth in"Section 9751.2l'of the Huntington Beach Ordinance Code shall be complied with. ` 11. A MOTION WAS MADE BY WORTHY AND SECONDED BY MILLER TO APPROVE TENTATIVE TRACT MAP NO 5189 WITH THE FOLLOWING CONDITIONS: ,I. All vehicular access to the tract shall be from Fernhill Circle and vehicular access rights to Graham Street and Heil Avenue shall be •dedicated ,to the _City. 2. The dedication and improvement of Fernhill Circle shall 'be completed to -City Standards. 3. It was pointed out that Hamilton Avenue is indicated on the Master Plan of Arterial Streets and Highways as a 100 foot Primary Highway; therefore, the additional dedication will be necessary unless the proposed amendment to the Plan is adopted by the City Council. TheSecretary further read a letter submitted by the Orange County Health.Department stating that the Department has received a letter f rom'the'' developer and the Talbert'Water District agreeing to comply with. the required standards for irrigation of farm lands in'the vicinity with sewer effluent." Pereira & Associates, addressed the Commission and explained the existing conditions of the subject tract and the adjacent land uses., therefore, recommending that this area be designated for single family use as indicated on the Tentative Tract Map No 5202. e Robert Kruger, Attorney representing the applicant, addressed the,Commission and stated that private beaches will be provided for within the proposed development. There. being no other, comment, the hearing was closed. Commission discussion was held. Located on the east side of Oak Lane and approximately 280 feet south of Cypress Avenue and legally described as Lot 4, Block D, Tract No 436, and the west half of Lot 5, Block D, Tra ct 436 The hearing was opened - to the audience-;' there being no comment',it was closed. Commission discussion was held. It was noted that the subject property is adjacent to an R-3 on the south and R-2 on the east. The Secretary pointed out to the Commission -that the Master`Plan Studies show a medium density in the area. ' RESOLUTION NO 339 A Resoluti6h of -'the 'City Planning Commission Recommending Approval of Zone Case No 339,for a R-2 Zone Rather than the Requested R-3 Zone to the City Council. A MOTION WAS MADE BY CRABB AND SECONDED BY BAZIL TO -ADOPT RESOLUTION NO 339 RECOMMENDING AN R-2,.ZONE RATHER THAN A R-3 ZONE ;TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: . 1. The proposed Master Plan of Land Use, Study Area II, has the area indicated for medium density development. 2. The,property to• th.e- east is presently zoned R-2. 3. A R-2 Two Family Residence District would conform to the proposed Master Plan of Land Use and would also conform to the existing pattern of development. Located south of Atlanta Avenue and approximately.1710 feet east of Beach Boulevard, and legally described as Lot 4, Tract No 811. The hearing was opened. to, the audience; there being no comment, it was closed., The Commission held a lengthy discussion. It was noted that the Master Plan of Land Use indicates this general area for Light Industrial Use. A MOTION WAS MADE BY CRABB AND SECONDED BY BAZIL TO ADOPT RESOLUTION NO 340,RECOMMENDING DENIAL OF ZONE CASE NO 340 TO,THE CITY COUNCIL,FOR THE FOLLOWING REASONS: 1. The proposal is not in accord with the adopted Master Plan of Land Use, Study Area I, which. indicates industrial development for the area. 2. If the zone Base were approved, it would be spot zoning which. is not good planning practice. ROLL CALL VOTE: AYES: Crabb, Bazil, Kaufman, Chairman Stang. NOES: Miller, Worthy, Letson. ABSENT: None. THE RESOLUTION WAS ADOPTED. ZONE CASE NO.342 Change of Zone from R-1 C. E. McManus Single Family Residence District to R-3 Limited Multiple Family Residence District. Located at the intersection of Lake Street and Crest Avenue, and legally described as Lot.35, Block 705, Wesley Park Section. The hearing was opened to the audience;' Mr, C. E. McManus, applicant,'addresse'd the Commission and requested that`th.e proposed R=3 be'approved. There being no other comment, the hta.ring was closed. The Secretary pointed out to the Commission that the subject zone case is a minor adjust- ment since the applicant has two lots, one zoned R-1 and the other R-3. RESOLUTION NO 342 A Resolution of the City 'Planning Commissions Recommending Approval of Zone Case No 342 to the City Council. A MOTION WAS MADE BY LETSON AND SECONDED BY WORTHY TO ADOPT RESOLUTION NO 342 RECOMMENDING APPROVAL OF ZONE CASE NO 342 TO THE CITY COUNCIL FOR THE FOLLOWING REASON: 1. The parcel of land involved is one of two lots under one ownership, one of which is zoned R-3 Limited Multiple Family Residence District and the other R-1 Single Family Residence District. Several instances of'such. speculation were mentioned where the property has not been used for several years after its rezoning, usually for.commercial use..
