Mayor Lambert called the regular adjourned
Council of the City of Huntington Beach to order
The Pledge of Allegiance was given by all
present in the Council Chambers.
Councilmen Present: Wells, Gisler, Stewart, Welch, Lambert
Councilmen Absent: None
David Gay Req. The Clerk presented a communication from Mr.
Lease Agrmt. Trans. David E. Gay requesting Council approval of
a transfer of his lease agreement on a Pier
concession to Mr. J. William Olson, of San Pedro.
Request Approved On motion by Wells, seconded by Gisler, Coun-
Trans. to J. Wm. Olson cil approved the request of Mr. Gay and direct-
ed the City Attorney to prepare a lease agree-
ment with Mr. J. William Olson on the same terms as those"cbntained in
the agreement with Mr. Gay. Motion carried.
HBES Req. The City Administrator read a letter from the.
Barricades on 6th St� Huntington Beach Elementary School requesting
that Council authorize the closing of Sixth
Street from Orange Street to the alley between Sixth and Magnolia Street
on Monday thru Friday during school hours for a six week period, due
to the necessity of their having to use the facilities of the First
Baptist Church as a temporary school until additional class rooms would
be ready.
Closing of 6th Street On motion by Welch, seconded by Stewart,
Authorized Council authorized the closing of Sixth Street
from Orange Street to the alley during school
hours on Monday thru Friday as requested by the Elementary School
District. Motion carried.
Mervin B. Johnson— Pro. Mr. Jack King representing Mervin B. Johnson,
King -Tracts 5201,5251 Developer, addressed the Council to protest
the requirement for procuring a business license
to develop Tracts 5201 and 5251. Mr. King informed the Council that
they had paid Park and Recreation Fees required by the Council and
stated that he did not feel they should be obligated to obtain a business
license to develop these Tracts.
City Attorney City Attorney Plunkett informed Mr. King that
Plunkett the Council had adopted an Ordinance making
it necessary to procure a business 'license
for subdividing property within the City and stated that Council had
authorized refund of the fee paid for Parks and Recreation following
the obtaining of such business license.
No Action Taken No action was taken by the Council.
Councilman Wells Councilman Wells requested and received
Abstains from Action permission to abstain from consideration
of a public hearing on a change of zone on
property covered by Zone Case No. 351, due to a conflict of interests
and retired from the Council Chambers.
Public Hearing Mayor Lambert announced that this was the
Zone Case #351 day and hour set for a public hearing on an
appeal by the Crest Homeowners Association
to a change of zone on property covered by Zone Case No. 351, which
had been granted by the Council at the meeting of August 5, 1963, and
requested the Clerk to read the legal notice.

The Clerk read notice of public hearing on
the appeal to the granting of a change d zone in Zone Case No. 351 as
published in the Huntington Beach News on August 22, 1963, setting the
hour of 7.30 o'clock P.M. or as soon thereafter as possible, on Thurs-
day the 5th day of September, 1963, in the Council Chambers of the
City Hall, Huntington Beach, California, as the time and place'for a
public hearing for the purpose of_consi'dering scuh appeal.
Hearing Opened Mayor Lambert then declared the hearing open.
Mr. James W. Parker Mr. James W. Parker, 8411 Santana Circle,
City, President of the Crest Homeowners Assoc
iation, addressed the Council and introduced members of the Crest
Homeowners Association Council.
Ap2eal Stated Mr. Parker then presented the appeal of his
group to the change of zone granted by the
Council at the meeting of August 5, 1963, and requested Council to
reverse their decision in allowing this change of zone.
Mr. Rubin Dobkins Mr. Rubin Dobkins, owner of the property in-
cluded in Zone Case No. 351, addressed the
Council and informed them that there were some discrepancies in the
facts presented by Mr. Parker, and further stated that he believed
the Zone Change granted by the Council was equitable in view of the
facts presented.
Hearing Closed There being no one further to speak on the
matter, the hearing was closed by the Mayor.
Motion to Rescind On motion by Welch, seconded by Lambert,
Action - Fails Council directed that the original recommend-
ation of the Planning Commission be sustained
and that former action of the Council in granting the change of zpne
in Zone Case No. 351 be rescinded. When put to vote, the matter
received a two to two vote, and the Mayor declared the motion to be
lost.
Sunset Beach San. Dist. Mr. Raymond Ribel, Engineer for Sunset
Reg. to Tie into HB Li_.ne_sBeach Sanitary District, addressed the Coun-
cil regarding disposal of sewage in the Sun-
set Beach Area. Mr. Ribel presented facts to show that he believed
it would be to the advantage of the City of Huntington Beach, to the
Huntington Harbour Corporation, and to the Sunset Beach Sanitary
District, if the District were permitted to contract with the City to
use their lines through a negotiated agreement, and dispose of their
sewage in this manner.
Dist. #11 Board Mayor Lambert and Councilman Stewart, repre-
Members Opposed sentatives of the City on the Board of County
Sanitation District No. 11, informed the
Council that they opposed the City entering into any such agreement
until the Sunset Beach Area had been annexed to the City of Huntington
Beach.
Mr. Fred Belcher Mr. Fred Belcher, Superintendent of the Sun-
S.B. San. Dist. Supt. set Beach Sanitary District, stated that he
felt that removal of the treatment plant
near the corner of Warner Avenue and Highway 101-A would be of much
value to Huntington Harbour and the City of Huntington Beach, and that
he believed the City would be in a better position to negotiate for
annexation of the area if they took part in such an agreement.
Mr. Richard Moody Mr. Richard Moody, Director of the Sunset
SSB. San. Dist. Dir. Beach Sanitary District, addressed the Coun-
cil and stated that he believed cooperation
between the City and the District would accomplish considerably more
than any demand for annexation of this territory.

On motion by Welch, -seconded by Gisler, the
regular adjourned meeting of the City Council
of the City of Huntington Beach adjourned to
1963, at 7:30 o'clock F.M. Motion carried.
