HomeMy WebLinkAbout1963-10-0730 MINUTES Council Chamber, City Hall Huntington Beach, California Monday, October 7, 1963 Mayor Lambert called the regular meeting of the City Council of the City of Huntington Beach to order at 7:30 o'clock P.M. The Pledge of Allegiance was given by all pre- sent in the Council Chamber, The Invocation was given by Rev. Richard LeGros, Assistant Minister, First Christian Church, Huntington Beach. Councilmen present: Gisler, Welch, Lambert Councilmen Absent: Wells, Stewart Dept. Reports On motion by Welch, seconded by Gisler, the Rec'd & Filed reports of the Chief of Police, the City Treasurer, the City Collector and the Chamber of Commerce Manager, were approved and ordered filed. Motion carried. LDS Church To Use Mem. Hall December 7, 1963, and Motion carried. On motion by Gisler, seconded by Welch, Council granted permission to the Latter Day Saints Church to use Memorial Hall for a dinner and bazaar on directed the Clerk to waive the fees therefor. Girl Scouts On motion by Gisler, seconded by Welch, Council. To Self. Calendars granted permission to the Santiago Girl Scout �.y Council to conduct a Girl Scout Calendar Sale from November 2 thru November 16, 1963, in the City subject to their registering with the Police Department. Motion carried. United Share Fund On motion by Welch, seconded by Gisler, Council Req_._Ref. to P.D. referred a United Share Fund, Inc. request to solicit funds in the City, to the Chief of Police for study and report. Motion carried. Letters Pres. The Clerk presented letters from Howard G. Complaints Trabant, 8041 Yorktown Street, City, and Mr. Walter W. Johnson, 8081 Yorktown Street, City., registering complaints against the possibility of rental units being moved in on property located at 8075 Yorktown Street. U.C. Cleveland The Director of Building and Safety distri- Buildini,, Director buted maps and photographs of the area and structure involved and stated that the units would be brought up to Building Code standards. Stanley_5cherer Mr. Stanley Scherer addressed the Council and stated that he was the owner of the property and the unit to be moved on to the property at 8075 Yorktown Street in the City, and requested that Council take favorable action at this meeting. Granted Welch, seconded by Gisler, Council granted Mr. Scherer's request conditioned on the meet- ing of requirements of the Building and Planning Departments and the posting of necessary bonds. Rubin Dobkin On motion by Gisler, seconded by Welch, Request Granted Council deferred the second reading of Ordin- ance No. 1008 covering Zone Case No. 351 until the first meeting in November, as requested by Mr. Rubin Dobkin, 18211 Newland Street, City. Motion carried. Run. & Sons on motion by Gisler, seconded by Welch, Lic. ReS. Denied Council denied a request for reconsideration of the application of Kunin & Sons, Inc., Los Angeles, for a business license to operate in Huntington Beach. Motion carried. Rep. Hanna On motion by Welch, seconded by Gisler, Beach Erosion a letter from Representative Richard T. Hanna concerning the Orange County Beach Erosiai Program was received and ordered filed, and the City Administrator was directed to write Mr. Hanna that the City will continue to cooper- ate and assist in this program. Motion carried. Carlos Mercado On motion by Welch, seconded by Gisler, C1aira Pres. Council denied a Verified Claim for personal injuries filed by Don C. Thamer, Santa Ana, Attorney, on behalf of Carlos Mercado, P.O. Box 57, City, and refer- red it to the City Attorney and the City's insurance carrier. Motion carried. Henry J. Gaudet; S. T. On motion by Welch, seconded by Gisler, Wakeling Claims Pres. Council denied Verified Claims for personal injuries filed by Henry J. Gaudet on behalf of his son Dewain Gaudet, and S. T. Wakeling on behalf of his son, and referred them to the City Attorney and the City's insurance carrier. Motion carried. Robert Morton On motion by Welch, seconded by Gisler, Re: Ord, 1007 a communication from Mr. Robert A. Morton, Long Beach, requesting that an application f rezoning of property on Oak Street be postponed, was received and ordered filed. Motion carried. Motion carried. FI.B. Youth Athletic On motion by Gisler, seconded by Welch, the Assn. Req. Granted request of the Women's Auxiliary of the Huntington Beach Youth Athletic Association for permission to hold "bake sales" at different public locations to raise money for Huntington Beach Pop Warner Football ,Teams, was granted. Henry Novak Mr. Henry Novak, owner of the fishing boat "Neptune' operating from. the Huntington Beach Pier, addressed the Council to inquire whether they would consider reassigning the lease on the barge, if he were to purchase the operation from the present owners. No action was taken by the Council on this matter. John Mangano Mr. John J. Mangano, 5661 Clark Drive, City, addressed the Council concerning the Douglas Space Center dedication on November 14, 1963, and requested that Council adopt a Resolution and issue a proclamation making November 14th a "Salute to the Space Age" day. S. D. Caplan S. D. Caplan, Garden Grove, addressed the the Council and requested that City to con- demn property for street purposes only, on Gothard Street in the City. Pr6cedure The City Attorney and City Engineer recommended that this right-of-way be obtained through eminent domain proceedings. Proceed with Eminent Domain eminent domain suit, with carried. On motion by Welch, seconded by Gisler, Council directed the Director of Public Works and the City Attorney to proceed with the filing of an all costs to be borne by Mr. Caplan. The Clerk read notice of public hearing on Zone Case No. 361, as published in the Huntington Beach News on September 19, 1963, setting the hour of 7:30 o'clock P.M., or as soon thereafter as . possible, on Monday, the 7th day of October, 1963, in the Council Chamber of the City Hall, Huntington Beach, California, as the time and place for a public hearing for the purpose of considering a petition for a change of zone from: A-1-X General Agricultural District, as adopted by Interim ordinance No. 668; to: R-3 Limited Multiple Family Residence District. No Written Protests The Clerk informed the Council that they had been provided with copies of the Planning Director's transmittal and the Resolution of the Planning Commission recommending approval of Zone Case No. 361, and stated that he had received no written protests to the Zone Change or to the recommendation of the Planning Commission. Res. #370 day and hour set for a public hearing on Resolution No. 370 of the City Planning Com- mission, recommending approval of Zone Case No. 370 providing for an amendment to the Master Plan of Streets and Highways, deleting the plan- ned extension of Delaware Street from Atlanta Avenue to Ocean Avenue, and directed the Clerk to read the legal notice. Public Hearing Mayor Lambert announced that this was the Resolution #1846 day and hour set for a public hearing on Resolution No. 1846 of the City Council, declaring its intention to vacate a portion of Yorktown Avenue in the City and giving notice of hearing on said vacation, and directed the Clerk to read the legal notice. The Clerk read notice of public hearing on Resolution No. 1846 of the City Council, as published in the Huntington Beach Dews on September 5,1963, setting the hour of 8:00 o'clock P.M., on Monday, the 7th day of October, 1963, in the Council Chamber of the City Hall, Huntington Beach, California, as the time and place for a public hearing for the purpose of considering said Resolution of In- tention to vacate a portion of Yorktown Avenue in said City. No Written Protests The Clerk informed the Council that they had been provided with copies of Resolution No. 1846 of the City Council, and stated that he had certified the Affidavit of Posting by the Street Superintendent, and that no written protests to Resolution of Intention No. 1846 had been received. Works stated that the bids had been examin- ed and the low bid of Bay Sierra Company of Huntington Beach in the amount of $118,186.50 had been found to be in order, and that he recommended the acceptance of this bid and rejection of all other bids, and the return of bid bonds to the unsuccessful bidders upon execution of the contract. Contract- Awarded On motion by Welch, seconded by Gisler, Bay Sierra Co. Council awarded the contract for the constr- uction of the Harry A. Overmyer Memorial Municipal Reservoir, Unit No. 2 to Bay Sierra Company of Huntington Beach for the sum of $118,186.50; rejected all other bids, and authorized the return of bid bonds to unsuccessful bidders upon the execution of the contract. Pre-Zonin- The Clerk presented a transmittal from the Ord. No. 1009 City Planning Director of ordinance -No. 1009 which provided for pre -zoning of areas out- side of the City prior to annexation. On motion by Welch, seconded by Gisler, Approved Council approved the proposed Ordinance pro- viding for pre -zoning, and directed the Clerk to give it a first reading under Ordinances and Resolutions later in the meeting. The Clerk presented a communication from the Pump Station Deputy Director of Public Works informing Coun- cil that the storm drain Pump Station constr- ucted in connection with Tract No. 3903, had been completed in accord- ance with plans and specifications, and recommending that Council ac- cept the improvements. Pump Sta, Impr. On motion by Welch, seconded by Gisler, Accepted Council accepted the Banning Avenge Storm Drain Pump Station constructed in connection with Tract No. 3903. Motion carried, -7- (10/7/63) 3� Page #8 - Minutes October 7 1963 Warner .Ave. R/K The Clerk presented a communication from Crossi.n7 the Director of Public Works, informing Council that the Public Utilities Commission had recommended the installation of flashing signals at the Warner Avenue railroad crossing, and the Pacific Electric Railway had agreed to share costs equally with the City in this matter; and recommending that the City participate in this installation. Ra ilway Council concurred with the Public Works Director's recommendation and instructed him to prepare an agreement between the City and the Pacific Electric Railway to accomplish such installation. Deputy Director of Public Works of an in- voice from Pylon, Inc, in the amount of $22,185.00 as a Progress Payment on Water Well No. 2, and recommendin that Council approve this payment. Py,_an Inc. On motion by Welch, seconded by Gisler, Rut, Auth. Council authorized the payment of Progress Payment No. 1 on Water Well No. 2 to Pylon Inc. in the amount of $22,185.00. Motion carried. Sully Miller The Clerk presented a transmittal from the Prod;, mt. Director of Public Works of an invoice for Progress Payment No, 2 from Sully Miller Contracting Company in the amount of $51,415.59 for improvements on Bolsa, Bolsa Chica, and Rancho Streets; and recommending that Council approve this payment. The Clerk presented a communication from Trans. of Funds the Director of Public Works transmitting Resolution No. 1861, authorizing the trans- fer of funds in the amount of $1,700 from the Planned Local Drainage Area Number 5 Fund to Southern California Edison Company for the acquisition of right-of-way for Storm Channel C5-SC2. Res. No. 1861 On motion by Welch, seconded by Gisler, Adopted Resolution No. 1861 - "A RESOLUTION OF THE CITY COUNCIL OF HUNTINGTON BEACH AUTHORIZING THE EXPENDITURE OF MONEY FROM THE PLANNED LOCAL DRAINAGE AREA NO. 5 FUND," which had heretofore been submitted to the Council and read by them, was passed and adopted by the following roll call vote: AYES: Councilmen: Gisler, Welch, Lambert NOES: Councilmen: None ABSENT: Councilmen: Wells, Stewart Subdivision A-rm+Ls. On motion by Welch, seconded by Gisler, Tracts #k4858-67 Council accepted Monument Bond No. 498879 and Improvement Bonds No. 498841 thru No. 498850, issued by General Insurance Company of America, and directed the Clerk to file same; and accepted the Subdivision Agreements for Tracts #4858 thru #4867, and authorized the Mayor and City Clerk to execute same on behalf of the City. On motion by Welch, seconded by Gisler, Tract #4881 Council accepted Monument Bond No. 1123383 issued by the Traveler's Indemnity Company and directed the Clerk to file same; and accepted the Agreement in Lieu of Improvement Bond and the Subdivision Agreement for Tract #4881, and authorized the Mayor and City Clerk to execute same on behalf of the City.
