Miller, the Minutes of the Hunting-
ton Beach Planning Commission of November 13, 19, and 2'6, 1963,
were accepted as transcribed and mailed by the Secretary.

'The Planning Director informed the
Commission that no plan has been filed similar•to the subject
proposal previously discussed at zoning hearings. He further
pointed.'out,to the Commission that the matter has been con-
tinued for approximately seven months and any plan•which may
be filed will have to have the full 30 day consideration and
the requested continuance •will not serve any purpose of saving
time for the developer.

The Vice -Chairman informed
the Commission that Commissioner Stang has submitted his
resignation as a Chairman of the City Planning Commission to
the City Council because _of his acceptance of the position as
the Superintendent of the Water Department with the City of
Huntington Beach. The Vice -Chairman read a Resolution expressing
appreciation to Commissioner Edward Stang.

The Subdivision Committee
Report was read by the Secretary. He further informed the
.Commission that the next two items on the agenda, Use Variance
No 664,and Zone Case No 394 covering the subject property,
will be considered later in the meeting.
It was the consensus that
action on the tract map should be deferred until Use Variance
No 664 and Zone Case No 394 have been considered.
CONDITIONAL EXCEPTION To allow: (1) 50 foot R/W
USE VARIANCE NO 664 streets. (2) 10 foot minimum
&,Pplicant: Deane Bros. front yard setbacks including
walls up to approximate
house plate line in height.
However,; in the event of straight -in driveways, the garage
will have a setback not less than 20 feet. (3) 6000 square feet
average area for lots but in no event less than 5000 square
feet. (4) Total of'8 foot side yards setback with not less
tan three feet on one side. (5) 15 foot minimum rear yard

The hearing was opened to the
audience: Jim Deane, applicant, addressed the Commission
and explained the proposed development.
Deputy Director of Public
Works, Bill Hartge, addressed the Commission and read a
lengthy report regarding the standard 60 foot street•right-
of-way. He further stated that if variance UV No 664 should
be granted for a right-of-way less than the standard 60 ft.,
the location of hydrants, street lights, and street signs
should be accurately determined prior to such a variance to
provide a minimum of a 4 ft walkway.
James Haldrick addressed the
Commission and spoke in favor of the proposed development.
There being no further comment,,
the hearing was closed.
A lengthy discussion was held
by the Commission.
A MOTION WAS MADE BY LETSON AND,;
SECONDED BY WORTHY TO RECOMMEND APPROVAL OF CONDITIONAL
EXCEPTION NO 664 TO THE CITY COUNCIL UPON THE FOLLOWING
CONDITIONS:
1. 50 foot right-of-way streets.
2. 10 foot minimum front yard setbacks for fences not over
6 feet in height and for garages with a side approach;
however, for garages which are entered directly from the
street, a minimum of 20 foot setback will be provided.
3. 15 foot minimum front yard setback for fences over 6 feet
in height.
4. 6000 square foot average area for lots in each, block but
not less than 5000 square feet in any one lot.-
5. A minimum of 3 foot side yard on one side of a lot provided
the abutting side yard of the adjoining lot is not less
than 5 feet.
6. 15 foot minimum rear yard setback on irregular shaped lots
and on other lots only where a front patio is provided. ,
7. All utilities shall be installed underground.
8. A full grown tree shall be planted in the front yard of
each lot.
9. Conditional Exception No UV 664 is to apply only to that
portion of Tentative Tract 5419 north of Indianapolis Ave.

A FURTHER MOTION WAS MADE BY
CRABB AND SECONDED BY LETSON TO APPROVE TENTATIVE TRACT MAP NO
5419 UPON THE FOLLOWING --CONDITIONS:
1. That portion of the tract in the vicinity of the school
site designated Lot 26, Block T, shall be re -designed to.
provide for a rectangular park site of approximately 22
acres.
2. That portion of the tract in the vicinity of "All Drive and
"'AAA" Drive shall be re -designed for better orientation
and separation between the single family and multiple
family areas.
3. Lots 24 to ,34, Block F, shall be reserved for a park site.
4. Lot 1, Block W, shall be used as a private recreational
club.
5. The final maps of the tract shall be calculated so that
zone boundaries will coincide with property lines.
6. If Conditional Exception No UV 664 is not approved by the
City Council, approval of this tentative map shall be void.
7. No portion of this tract shall be recorded until such time
as further approval by the Planning Commission is secured
certifying that a solution has been found to the problem
of a public health. hazard due to irrigation of nearby farm
lands with, sewer effluent.
8. All standard subdivision requirements that are applicable
shall be complied with.
9. A tier of lots for single family use shall be added along
the north side of "All Drive and "AAA" Drive.
10. Approval of this tentative map shall apply only to that
portion of the tract north. of Indianapolis Avenue.

audience. James F. Deane, applicant, addressed the Com-
mission and explained the, future development.
There being no other comment,
the hearing was closed.
A lengthy discussion was held
by the Commission. The Planning Director pointed out to the
Commission that the Master Plan of Land Use indicates a
medium density development for the area south of Adams Avenue
and east of Newland Street and that R-2 Two Family Residence
District would be more advisable. He further pointed out that
the requested C-2 Zone which is situated in the middle of
a single family tract of homes is not considered desirable
because of the potential uses permitted. It is intended that
the parcel proposed for C-2 zoning would be used as a private
recreation club for the residents of the tract.
RESOLUTION NO 394 A Resolution of the City Planning Com-,
mission Recommending Approval of a
Portion of Zone Case No 394 to the
City. Council.

SECONDED BY CRABB TO ADOPT RESOLUTION NO 394 RECOMMENDING
APPROVAL OF A PORTION OF ZONE CASE NO 394 FOR AN R-2 RATHER'
THAN THE REQUESTED R-3 AND FURTHER RECOMMENDING DENIAL OF
A PORTION OF ZONE CASE NO 394 TO THE CITY COUNCIL FOR THE
FOLLOWING REASONS:
1. Commercial zoning in the middle of a single family tract
is not considered good planning practice.
2. The C-1 zoning is at the -mile intersection which'is in
conformance with the Master Plan of Land Use.
3. The area outlined for rezoning to R-3 is indicated on the
Master Plan of Land Use for a medium density development.

A MOTION WAS MADE BY MILLER
AND SECONDED BY WORTHY TO -APPROVE TENTATIVE TRACT -MAP NO 5430
UPON THE FOLLOWING CONDITIONS:
1. All rights for placement.of any structures on the area of
common ownership other than are shown on the approved
plot plan shall be dedicated to the City.
2. Provisions shall be made to perpetually guarantee adequate
maintenance of all areas of common ownership and such
provisions shall be approved by the Planning Director and
City Attorney.
3. If Conditional Exception No UV 659 is not approved by the
City Council, approval of this tentative map shall be void.
4. The total building coverage shall not exceed 40% of the
site exclusive of streets, vehicular accessways and
unenclosed parking.
5. There shall be at least 200 square feet in the designated
recreation area for each dwelling unit.
6. One side of all streets shall be, posted for no parking
and such.prohibi$ion shall be strictly enforced by the
Homeowners Association and such, prohibition shall be included
in the deed restrictions of the tract.
7. Any standard°subdivision requirements that may be appli-
cable shall be complied with.
8. The improvement of the private streets shall include a
standard curb and gutter on each side.
9. A complete soils report by an approved soils engineer
shall be submitted to the Director of Public Works and
shall include recommendations for type of construction
based on the soils encountered.

The Commission held a lengthy
discussion. The Planning Director pointed -out to the Com-
mission that the Master Plan of Land -Use indicates a low
density development for the area and a Tentative Tract Map
No 4805 has been approved by the Commission -for single family
use.
It was the concensus that the
requested R-4 Zone does not comply with the adopted Master
Plan of Land Use.
RESOLUTION NO 393 A Resolution of the City Planning Com-

Council.

The hearing was opened'to
the audience. George Tamaka, adjacent property owner, addreseed
the Commission and requested a block wall between his property
and the proposed apartments in case the subject variance is
granted.
There being no other comment,
the hearing was closed.
It was noted that the apparent
intent is to subdivide the parcel into four lots with' a four-'-
plex on each lot. It was further pointed out by the Secretary
that the subject parcel contains a little over 34,000 square
feet or enough area.for 11 units rather than the requested 16
units. The Secretary pointed out to the Commission that the
Master Plan of Land Use indicates low density development but
the proposal is for high density.

addressed the Commission and explained the problem was due

Therefore, the lot length as determined by the Title Company
included 7 z feet or one half of the alley. This fact came
out when the forms for the building footing obviously did not
conform to the required 6 f t setback from the alley.

Street, addressed the Commission and vigorously objected to
the proposed construction.

The Planning Director informed
the Commission that the proposed Planned Residential Development
apparently is to be a rental project and individual units are
not to be sold. He further stated that the proposed develop-
ment is -arranged in such a manner that the development could
be sold as a condominium in the future. It was noted that the
proposed density conforms'quite-closely to the Master Plan.
The Planning Director further pointed out to the Commission
that the walking distance from carports to the units in some
cases is approximately 350 to 400 feet which might result in
constant parking on Edwards Street and Warner Avenue where it
would be more convenient.
The hearing was opened to
the audience'.' Wally Nickle, planning coordinator for the
developer, addressed the Commission and stated that he under-
stood the problem and requested continuance to December 17,
1963, in order to submit a new design revision which would
improve these problems.
