The hearing was opened to the audience; there being no comment,,it was closed. The Planning Director informed the Commission that 'no plans have been yet submitted to indicate what type of development is proposed. Commission discussion was held. It was noted that the proposed R-1 zone falls within the adopted Master Plan -of Land Use. RESOLUTION NO 397 A Resolution of the City Planning Com- mission Recommending approval of Zone Case No 397 to the City Council. The hearing was openal to the audience. Wally Nickle, representing the applicant, addressed the Commission and explained the proposed develop- ment. John Vincent, representing adjacent property owners on the south side of the subject pm perty, addressed the Commission and stated that if'the sub- ject case is approved, a 6 foot block wall fence should be constructed to separate the properties. A MOTION WAS MADE BY CRABB AND SECONDED BY WORTHY TO APPROVE USE VARIANCE NO 662 UPON THE FOLLOWING CONDITIONS: 1. A 6 ft masonry wall shall be constructed on the south and -west sides of the subject property. 2. A 3 ft masonry wall or fence shall be constructed along Edwards Street and Warner Avenue, except for the recreation areas which can have open_-ings . 3. The water system shall meet the requirements of the Fire Chief. 4., Dedicate and improve Edwards Street and -Warner Avenue to City Standards,. 5. Particip&e in drainage assessment district at cost of $1650 per acre. 6. A soil report shall be submitted to Director of Public Works for approval. 7. The,size and arrangement of all street parking shall ,comply with City Standards. 8. All parking compounds shall be screened. 9. Medeiros of a room addition to en- croach to within 13 feet of the rear property line in deviation to the required 20 ft rear yard setback in the R-1 Single Family Residence District. Located approximately 360 feet west of Hammon Lane and on the north side of Spa Drive and legally described as Lot 21, Tract No 4365, also known as 5631 Spa Drive. The Secretary read a petition signed by 12 property owners in the immediate area favoring the subject variance. The hearing was opened to the audience;.there being no comment, the hearing was closed. USE VARIANCE NO 667 To allow the construction Applicant: Bennie L. of six units on 11,750 Steverson square feet of ground area in the R-2 Two Family Resi- dence District. Located at the northwesterly corner of 15th Street and Acacia Avenue and 1e gally described as Lots -1, 3�., 5, and 7, Block 615, Huntington Beach Tract. The Staff Report was read by the Secretary. The hearing was opened to the audience. John Felhoelter, 605 14th Street, 'addressed the Commission and opposed the subject variance. Ben Steverson, applicant, addressed the Commission and spoke in favor of the proposed variance. There being no other comment, the hearing was closed. The Secretary pointed out to the Commission that the subject property is 250•s.quare feet short of enough area for the sixth unit. It was the concensus that a policy has been previously set to comply with.the ordinance code. A MOTION WAS MADEBY BAZIL AND SECONDED BY CRABB TO DENY USE VARIANCE NO 667. THE MOTION CARRIED: USE VARIANCE NO 668 To allow the use of a building Applicant: Ernest J. White to be used for transmission service in the C-1 Neighbor- hood Commercial District. Located on the west side of Beach Boulevard and approximately 132 feet north of Slater Avenue and legally described as the north 132 feet of the south 264 feet of the E z of the SE-4 of the SE4 of the NE-4 of Section 26F5-11. A MOTION WAS MADE BY MILLER AND SECONDED BY CRABB TO APPROVE USE VARIANCE NO 668 UPON THE FOLLOWING CONDITIONS: 1. Use Variance No 668 shall expire December 17, 1964. 2. All surplus parts shall be kept inside of the building. 3. All parking shall be confined to the rear of the,property. The Secretary informed the Commission that the location is a drilling island sur rounded by.the Sanitation District -property. Deane Jim Deane, applicant, addressed the Commission and stated that he wishes to with- draw the subject letter. His engineers had found a solution to the problem and the letter was no longer necessary. DIVISION OF LAND NO 208 To allow the Division of, Applicant: Gearhart -Moffett Land into four separate parcels. Located at the northwest c orner of Newman Avenue and Van Buren S,reet. A MOTION WAS MADE BY BAZIL AND SECONDED BY WORTHY TO RECOMMEND APPROVAL OF DIVISION OF LAND NO 208 UPON THE FOLLOWING CONDITIONS: 1. Install street improvements on Newman Avenue and Van Buren Street, including curbs and gutters, paving, sidewalks, street lights and trees. 2. Dedicate -the right -of -way for Van Buren Street to a width of 30 feet from centerline across Parcels I, II, III, and IV. 3. Dedicate the right-df-way,.for Newman Avenue to a width of 30 feet from centerline across Parcel IV. 4. Participate in the drainage assessment district at a cost of $930 per acre. 5. Dedicate and improve to City Standards an alley on the west side of Parcels I, II, III, and IV and on the north side of Parcel I. 6. Install sewer -and water lines to City Standards. 7. COMMUNICATION: FOUNTAIN VALLEY PLANNING COMMISSION RE: ZONE CASE #Z-75 AND PRECISE PLAN NO 18. The Secretary read a -legal notice submitted by the Fountain Valley Planning Commission regarding a change of zone on property located on the south- east corner of Newland Street and Talbert Avenue from R1-1 to CP, Cl and M1 or more restrictive districts. Planning Commission Tuesday, December 17, 1§63 A MOTION WAS MADE BY CRABB-AND SECONDED.BY MILLER TO INSTRUCT THE SECRETARY TO WRITE A LETTER TO.THE.FOUNTAIN.VALLEY PLANNING COMMISSION RECOMMENDING DENIAL OF ZONE CASE NO Z-75 FOR THE FOLLOWING REASONS: 1. The adopted Master P1an's of Land Use of both Huntington Beach and Fountain Valley'indicate single family develop- ment in this general area. 2. Existing zoning and existing development west of Newland Street is all R-1 'Sirigle Family. 3. The existing single family homes along Newland Street face the subject property and to have commercial and industrial development across the street would be ex- tremely detrimental. 4. The use of these homes as single family dwellings will not change by virtue' of the zoning and deed restrictions. 5. Commercial development, and even more particularly, industrial development will destroy the value of these homes. ` 6. Worthy, Vice -Chairman The Planning Commission further discussed the second legal noticeregarding Precise Plan #18 regarding the design and development of a service station on property located at the northeast corner of Garfield and Cannery. It was the concensus,that both corners of the subject intersection within the city of Huntington Beach will be developed to commercial use in the future. Planningg Commission Tuesday, December 17, 1963 COMMUNICATION: OCEAN VIEW SCHOOL DISTRICT RE: SCHOOL SITE NO 9 The Secretary read a letter submitted by the Ocean View School District regarding a school site approval #9 located west of Nichols Street, approximately 1000 feet south• of Warner Avenue. A MOTION WAS MADE BY LETSON AND SECONDED BY MILLER TO APPROVE SCHOOL SITE #9 AND TO INSTRUCT THE SECRETARY TO,WRITE A LETTER TO OCEAN VIEW SCHOOL DISTRICT ADVISING THEM OF THE FOLLOWING MATTERS TO BE ACCOMPLISHED AT THE TIME OF SCHOOL CONSTRUCTION: 1. Dedicate•additional right-of-way on Nichols Street to -make a total of 30 feet from centerline. 2. Dedicate 30 feet of right-of-way on Oak Street to complete the full 60 foot width. 3. Fully improve both Nichols Street and Oak Street to City Standards across the site. 4. ABSENT: None. THE MOTION CARRIED. COMMUNICATION: FOUNTAIN VALLEY SCHOOL DISTRICT RE: SCHOOL SITE NO 19. The Secretary read a letter submitted by the Fountain Valley School District requesting a school site approval in the area south of Garfield Avenue and west of Cannery Street. The Commission unanimously recommended approval of the proposed school site location with the understanding that the precise size and shape of the site will be subject to adjustment to the mutual benefit of the' District and developers of surrounding property. Himrod, president of the Newland Investment Co., addressed the Commission and req_uested'the parkway planting.plans in'Tract No 5030-as - previously submitted be approved. A MOTION WAS MADE BY BAZIL AND SECONDED BY CRABB TO APPROVE THE REQUEST OF.THE APPLICANT. ROLL CALL VOTE: AYES: Crabb, Letson;. Bazil, Miller, Worthy, Vice -Chairman Kaufman. NOES: None. ABSENT: None. THE MOTION CARRIED. COMMUNICATION; The Secretary read a letter submitted by Paul C. Jones, City Clerk.,requesting the Consideration of a proposed annexation of an area roughly bounded on the north by Heil Avenue, on the east by Graham Street, on the south by an extension of Los Patos Avenue and on the west by Bolsa Chica and Roosevelt Streets. It was the unanimous recommenda- tion of the Planning Commission that the Council proceed with annexation of all or any part of this territory. STREET IMPROVEMENTS: The Secretary requested clari- fication of the Commission intent as to when the street improvements are to be installed as required on a Division of Land. It was the concensus that a Division of Land was not effective until the conditions had been met. The Assistant City Attorney was requested to investigate -methods of ensuring that the conditions are met before property divisions are consumated. REVISIONS OF "R" ZONES: Associate Planner Ken Reynolds briefly reviewed suggested modifications of the controversial portions of the proposed "R" Zone revisions. It was the concensus that the matter would be discussed at the next study session. ELECTION OF OFFICERS: Election of officers was held pursuant to Section 2, By -Laws of the City Planning Commission of the city of Huntington Beach. -12- 12/17/63 27Q Page #13 Minutes: H. B. Planning Commission Tuesday, December 17, 1963 Nominations for Chairman were. opened. Vice -Chairman Henry S. Kaufman,was nominated for Chairman by.Commissioner Bazil. There being no further nomination, on motion by Bazil, duly seconded and carried, the nominations .for Chairman were closed. On motion of Bazil duly seconded and carried, the Secretary was instructed to cast an unanimous ballot for Dr. Henry-,S. Kaufman as. Chairman for the year 1964. The nominations were opened for Vice -Chairman. Commissioner Letson was nominated for Vice -Chairman by Miller. There being no further nominations, on motion by Miller duly seconded and carried, the nominations for:Vice-Chairman were closed. On motion of Miller duly seconded and carried, the Secretary was instructed to cast an unanimous ballot for Letson as Vice -Chairman for the year 1964.
