TENTATIVE TRACT MAP NO 5331 - Continued - Revised Number of Lots: 410 _ Subdivider: Aries Homes, Inc. Total Acreage: 86.8 Engineer: Voorheis-Trindle-Nelson, Located 660 feet south of Warner Avenue on the west side of Springdale Street and legally described as being a proposed subdivision of a portion of the N2 of Section 28-5-11. The Secretary read'a letter sub- mitted by Robert J. Gulino, engineer for subdivider, requesting continuance of,Tract No 5331 to February 18, 1964. Hunsaker & Sons Engineer: Brown Engineering Located 1024.8 feet south of Adams Avenue on the east side of Cannery Street and legally described as proposed subdivision of portions of the NW-4 of Section 7-6-10. The Planning Director informed the Commission that the next item on the agenda is a Use Variance covering the subject case and it should be considered at the same time. The Staff report was read by the Secretary covering Tract No 5464 and Use Variance No 663. 1/21/64 293 Page #2 Minutes: H. B. Planning Commission Tuesday, January 21, 1964 The hearing was opened to the audience. Wally Nickel, representing the applicant, addressed the Commission and explained the proposed development. He further spoke in favor. Richard Derby, 9131 Mediterranean Drive, addressed the Commission and opposed the proposed multiple development stating that this would be detrimental to the schools, traffic and the single family housing in the area. Michael Toab, 9162 Mediterranean Drive, addressed the Commission and also objected to the high density development for the same reasons Mr. Derby stated. Wally Nickel addressed the Commission and stated that the layout of the development wont be developed to much more than an R-2 density. He further stated that approximately 3 parking spaces shall be provided for each unit. There being no other comment, the hearing was closed. A lengthy discussion was held by the Commission. Bill Hartge, Deputy Director of, Public Works, addressed the Commission and stated that his department will have to recommend denial of the proposed development unless the drainage problem of the area is solved. He informed the Commission that a pump station will have to be constructed to serve the general area and that a drainage easement is necessary to be obtained from the tract to the proposed pump s tat ion. It was the concensus to continue the hearing on Tract No 5464 to February 4, 1964, to give the Commission opportunity to study the problems resulting in the construction of a previous condominium development ftnd to give the subdivider time to work out the drainage problems with the Department of Public Works. Hunsaker & Sons of a planned residential development consisting of 274 living units in the R-4-Y Suburban Residential District and in the A-1-Y General Agricultural District as adopted by Interim Ordinance No 672. Located on the east side of Cannery Street approximately 1024 feet south of Adams Avenue and legally described as'being a portion of the NW4 of Section 7-6-10. The Secretary read a petition of protest signed by 52 property owners in the adjacent tract. The hearing was opened to the audience. Wally Nickel, representing the applicant, addressed the Commission and talked at length giving his reasons why the subject variance should be granted. There being no other comment, the hearing was closed. A MOTION WAS MADE BY BAZIL AND SECONDED BY WORTHY TO CONTINUE THE HEARING ON USE VARIANCE NO 663 TO FEBRUARY 4, 1964, WITH THE CONSENT OF THE APPLICANT. Single Family Residence District to R-2 Two Family Residence District on property located approximately 400 feet west of Newland Street and on the south side of Newman AVenue and'legally' described as the West 250 feet of the N2j NE4, SE4, SW4, Section 25-5-11. The Staff Report was read by, the 'Secretary. The hearing was opened to the audience; there being no comment, the hearing was closed. Commission held a lengthy discussion. It was noted that the subject property is adjacent to an existing R-2 District to the south and a church site to the east. RESOLUTION NO 408 A Resolution of the City Planning Com- mission Recommending Approval of Zone Case No 408 to the City Council. Planningg Commission Tuesday, January 21, 1964 ZONE CASE NO 409 Change of Zone from M-1 Light Applicant: Aries Homes, Inc. Industrial District to C-4 Highway Commercial District with setback provisions and R-3 Limited Multiple Family Residence District on property located on the northeast corner of Banning Avenue and Bushard Street. Lengthy legal description on file in the Planning Department Office. The Secretary read the Staff Report. The hearing was opened to the audience. Wm. Lyon, president of Aries Homes, addressed the Commission and requested that the proposed multiple and commercial zones be granted. There being no other comment, the hearing was closed. A long discussion was held by the Commission. The Planning Director pointed out to the Commission that the Master Plan of Land Use indicates a medium density development for the subject area and that R-2 Two Family Residence District would be more advisable. He further stated that the Master Plan at the northeast corner of Banning Avenue and Bushard Street does not indicate the corner for any kind of commercial use. RESOLUTION NO 409 A Resolution of the City Planning Com- mission Recommending Approval of Zone Case No 409 for an R-:2 rather than the requested R-3 and C-4 zones to the City. Council. A MOTION WAS MADE BY BAZIL AND SECONDED BY CRABB TO ADOPT RESOLUTION NO 409 RECOMMENDING APPROVAL OF ZONE CASE NO 409 FOR AN R-2 FOR THE ENTIRE PARCEL RATHER THAN THE REQUESTED R-3 and C-4 ZONES TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. The Master Plan of Land Use for the property indicates a medium density. residential use. 2. Adjacent property had been denied commercial zoning on two occasions. AREA VARIANCE NO 675 To allow the construction of a Applicant: Edwin Webber room addition to encroach 62 feet into the 20 ft rear yard setback in the R-1 Single Family Residence District. Located at the northwest corner of Newland Street and Rembrandt Drive and legally -described as Lot 65, Tract No 3862. .The Staff Report was read by the Secretary. Minya rd of 80 units rather than D. Garth Edmunds the 62 units allowed under the Present R-4-X Suburban Residential District as adopted by Interim Ordinance No 668. Located north of Talbert Avenue approximately 990 feet west of Beach Boulevard and legally described as a portion of the S2 of the SE4, SE4, Section 26-5-11. The Staff Report was read by the Secretary. The hearing was opened to the audience. S. C. Newman, 7742 Ronald Road, addressed the Commission and objected to the proposed development. Harold Minyard, applicant, addressed the Commission and requested that the variance be granted. Also speaking in opposition were the following property owners: Donald L. Maher, 7792 Ronald Road, Charles Tunstall, 7772 Ronald Road,and Walter Engdtro, 7812 Ronald Road. Carlos Reeves, 213 Main Street, addressed the Commission and spoke in favor of the proposed multiple development. James Schuler, designer of the proposed development, addressed the Commission and spoke in favor. There being no further comment, the hearing was closed. A lengthy discussion was held by the Commission. The Planning Director pointed out to the Commission that the subject parcel contains sufficient area for 62 units but the request is for a total of 80 units or almost 1/3 more than the zoning calls for. He further pointed out that the project, as proposed, has a 55% building coverage factor, after deducting the 2 acres of paving, which is largely due to the extra units requested. ROLL CALL VOTE: AYES: Crabb, Letson, Bazil, Worthy, Miller, Larkin, Kaufman. NOES: None. ABSENT: None. THE MOTION CARRIED. USE PERMIT NO 233 To allow the construction of a Applicant: Alamo Stations service station in the C-4 Highway Commercial District. Also to eliminate the requirement of a masonry wall between tl-e C-4 and R-3 Zones as the full depth of the C-4 zone is not being developed at this time. Located on the west side of Beach Boulevard approximately 460 feet north of Ellis Avenue and legally described as a portion of Section 35-5-11. the Secretary. The Staff Report was read by The hearing was opened to the audience. Stanley Dugmore, secretary for Alamo Stations, addressed the Commission and explained why the applicant is re:Vesting the elimination of constructing the required masonry wall between the Commercial and residential zones. The Construction superintendent for Alamo Stations addressed the Commission and explained the project stating that the applicant has a permit issued by the Fire Department to install the necessary underground tanks. There being no other comment, the hearing was closed. Commission held a lengthy dis- cussion regarding the provisions of the Huntington Beach Ordinance Code which requires a 6 foot masonry wall between commercial and residential zones. A MOTION WAS MADE BY CRABB AND SECONDED BY BAZIL TO APPROVE USE PERMIT NO 233 WITH THE FOLLOWING CONDITIONS: 1. Construct a 6 foot masonry wall along the full length of the -designated limits of the proposed station to within 56 feet off the front property line except for two 20 foot driveways extending to the rear of the station. 2. Participate in the drainage assessment district at a cost of $1000 per acre. 3. Make the necessary provisions for drainage on Beach Boulevard suitable to the City Engineer. 4. Planningg Commission January 21, 1964 MISCELLANEOUS: ZONE CASE NO 406, Applicant: Fuller & A=twood The Secretary read a communi- cation submitted by the City'Clerk regarding an appeal of denial by the Planning Commission and heard by the City Council at the meeting of January 20, 1964, of the change of zone from R-4 (County) to C-2 on property located south of Pearce Avenue and west of Bolsa Chica Street which has a pre -zoning request filed by J. Stanley Fuller and Stanford Atwood. Folldwing the closing of the hearing, the Council continued the Zone Case and ordered it referred back to the Planning Commission for further consideration, without fee. The hearing was reopened to the audience. Stanley Atwood, applicant, addressed the- Com-mission and requested that an R-5 be granted. There being no other comment, the hearing was closed. Commission considered the matter and after considerable discussion with the applicant, it was the concensus that a multiple family zone is best suited f'or the area': The Commission unanimously recommended that the City Council approve an R-3 Limited Multiple Family Residence District for the property. A MOTION WAS MADE BY CRABB AND SECONDED BY LETSON TO RECOMMEND APPROVAL OF ZONE CASE NO 406 FOR AN R-3 TO THE CITY COUNCIL. ROLL CALL VOTE: AYES: Crabb, Letson, Bazil, Worthy, Miller, Larkin, Kaufman. NOES: None. ABSENT: None. THE MOTION CARRIED. SUGGESTED RE -CODIFICATION OF DIVISION 9, HUNTIN GTON BEACH ORDINANCE CODE. The Planning Director in- formed the Commission that for quite some time the Planning Department has recognized the need for a re -codification of Division 9 of the Huntington Beach Ordinance Code which consists of the zoning and subdivision ordinances, -because of the many amendments enacted over the years, it has become very dis+= organized which makes it difficult to use. The Commission considered the matter at length and it was their unanimous recommendation that the re -codification be done. -7- 1/21/64 299 Page #8 Minutes: H. B. MASTER PLAN OF LAND USE - STUDY AREA I - REVISED PLAN The Planning Director presented a revision of the previously adopted Master Plan of Land Use - Study Area I to the Commission. It was the concensus that the revised plan was acceptable for holding the required public hearing. A MOTION WAS MADE BY LETSON AND SECONDED BY MILLER TO SET THE MATTER FOR PUBLIC HEARING ON FEBRUARY 18, 1964. ROLL CALL VOTE: AYES: Crabb, Letson, Bazi 1, Worthy, Miller, Larkin,: ,Kaufman. NOES: None. ABSENT: None. THE MOTION CARRIED. REZONING OF _INDUSTRIAL :'PROPERTY IN STUDY AREA I The Planning Director suggested that the remaining industrial zones in the southeast area should be rezoned since there has-been so much residential zoning and uses established in the area. The areas to be considered would be those which have been changed on the Master Plan of Land Use. ON MOTION BY CRABB AND SECONDED BY LARKIN, THE SECRETARY WAS INSTRUCTED TO SET A PUBLIC HEARING AT AN EARLY DATE. ROLL CALL VOTE: AYES: Crabb, Letson, Bazil, Worthy, Miller, Larkin, Kaufman. REVIEW OF POLICY STATEMENTS FOR PLANNED DEVELOPMENTS Assobiate Planner Kenneth Reynolds reported to -the Commission that the policy statements on planned developments have been in effect since May of last year. In the months since that time, several design criteria have been discussed by the Commission and the Staff. -8- 1/21/64 Page #9 Minutest H. B. Off-street parking requirements in accord with the revised "Rn Zone requirements. 3. -150 feet maximum walking distance between dwelling units and garage.
