None. MINUTES: On motion by Letson and seconded by Crabb, the Minutes of the Huntington Beach Planning Commission of January 15 and 21, 1964, were accepted as transcribed and mailed by the Secretary. TENTATIVE TRACT MAP NO 5405 - Continued Number of Lots: 18 Subdivider: Balboa Shores Corp. Total Acreage: 4.8 Engineer: Huntington Engr. Corp. Located approximately 656 feet north of Talbert Avenue on the west side of Newland Street and legally described as being a proposed subdivision of the S2, NE4, SEk, SW4, Section 25-5-11. The Secretary read a letter sub- mitted by William Duncan, engineer for the subdivider, requesting withdrawal of Tentative Tract Map No 5405. THE MOTION BY CRABB WAS SECONDED BY BAZIL TO APPROVE THE REQUEST OF THE APPLICANT. ROLL CALL VOTE: AYES: Crabb, Letson, Bazil, Kaufman, Worthy, Miller, Larkin'. NOES: None. ABSENT: None. The hearing was re -opened to the audience. Wally Nickel, representing the applicant, addressed the Commission and objected to suggestione'd conditions regarding street widths, distance between buildings and type of improve- ment on proposed public streets. A lengthy discussion was held by the Commission. Bill Hartge, Deputy Director of Public Works, informed the Commission that a meeting with the developer and his engineer was held and that arrangements have been made to acquire the necessary easements and rights -of -way to con- struct the drainage facilities. It was the concensus that the development should be restricted to low density as shown on the adopted Master Plan. However, due to a portion of the property being still zoned County R-4; it was felt that the density should not exceed that allowed by the zoning. A MOTION WAS MADE BY LETSON AND SECONDED BY CRABB TO APPROVE TENTATIVE TRACT MAP NO 5464 WITH THE FOLLOWING CONDITIONS: 1. The Revised Tentative Map, dated January, 1964, and received February 3, 1964, shall be the approved map. 2. The water system shall be approved by the City Engineer and Fire Chief. 3. A fence or wall shall be constructed along the south side of the tract, -except at Harbor'Isle Lane. 4. The flood control channel shall be fenced to Flood Control District Standards. 5. The business license fee shall be based on the number of dwe l lin g units. 6. All rights for construction of any structure not shown on the approved plot plan shall be dedicated to the City. 7. There shall be no occupancy of any dwelling unit of the development until the tract is recorded. 8. All applicable standard subdivision requirements shall be complied with. 9. There shall be a maximum of 242 residential lots within the Tract. 10. All public streets shall comply with City Standards. 11. Located on the east side of Cannery Street approximately 1024 feet south of Adams Avenue and legally described as being a portion of the NW4 of Section 7-6-10. The hearing was re -opened to the audience; there being no comment, it was closed. Located north of Talbert Avenue approximately 990 feet west of Beach Boulevard and legally described as a portion of the S z, SE4, SE 4, Section 26-5-11. The Staff Report was read by the Secretary. The hearing was reopened to the audience. Harold Minyard, applicant, addressed the Com- mission and stated that the suggested conditions are satis- factory. Walter Engstrom, 7812 Ronald Road, addressed'theCommission and requested that the telephone poles be moved back in the existing alley parallel to Ronald Road to give more room for traffic flow. A MOTION WAS MADE BY IE TSON AND SECONDED BY WORTHY TO APPROVE USE VARIANCE NO 676, WITH THE FOLLOWING CONDITIONS: 1. Dedicate and improve Talbert Avenue to City Standards including the adjacent 175 foot parcel which has been part of this property. 2. Provide a 25 foot wide public alley along the west side of the property and improve it to City,Standards. 3. Participate in the drainage assessment district- at a cost of �1650 per acre. 4. Approval of this application shall be void unless the proposed 30 foot common driveway along the east side of the project is perpetually guaranteed by mutual easements. 5. Eliminate the two buildings and parking area projecting into the recreation area leaving a total -of 72 dwelling units on the site. 6. The Planning Director pointed out to the Commission that the subject property and most surrounding property in the general area is zoned R-2 and existing improvements are constructed to R-1 and R-2 standards. RESOLUTION NO 400 A Resolution of the City Planning Com- mission Recommending Denial of Zone Case .400 to the City Council. A MOTION WAS MADE BY BAZIL AND SECONDED BY WORTHY TO ADOPT RESOLUTION NO 400 RECOMMENDING DENIAL OF ZONE CASE NO 400 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. The hearing 'was reopened to the audience; there being no comment, it was closed. The Commission held a lengthy discussion. It was noted that this request is; not in conformance to the adopted Master Plan. RESOLUTION NO 405 A Resolution of the City Planning Com- mission Recommending Denial of Zone Case 405 to the City Council. ZONE CASE 1\10.411 The Planning Director presented the Study Area III - Revised proposed amendment to the revised Master Plan of Land Use encompassing that portion of the City lying within the area generally north of Ellis Avenue, west of Goldenwest Street and south of Bolsa Avenue. The hearing was opened to the audience. Martin Fenton, representing the Huntington Harbour Corporation, addressed the Commission and objected to any designation of the proposed freeway since the amended Master Plan shows the freeway within the Huntington Harbour development. John Horner, representing Aries Homes, Inc., addressed the Commission and objected to specific zoning plans for a portion of the area at,Slater and Edwards Street-. Dick LaRue, 17081 Beach Boulevard, addressed the Commission and suggested that strip zoning on any major highway should be approved. There being no other comment, the hearing was closed. The Commission held a lengthy dLcussion. It was the concensus that the plan should be discussed further at a study session of the.Commission. THE MOTION CARRIED. ZONE CASE NO 396 - Continued Change of Zone from County Applicant: Aries Homes, Inc. A-1 General Agricultural District to R-3 Limited Multiple Family Residence District. Located on the west side of Graham Street approxi- mately 660 feet south of Warner Avenue and legally described as a portion of the NJ, NW4, Section 28-5-11. John Horner, representing the applicant, addressed the Commission and requested that an R-3 be granted. There being no other com- ment, the hearing was closed. It was noted by theCom- mission that the revised Master Plan of Land'Use includes the subject property in a medium density area. The Secretary informed the Commission that directly east is a parcel of some 40 acres which was petitioned for an R-3 but the Commission recommended an R-2 zone. RESOLUTION NO 396 A Resolution of the City Planning Com- mission Recommending Approval of Zone Case' No 396 for, an R-2 Zone rather than an R-3 Zone to the City Council. This is a prezoning -request and approval of -this appli- cation is subject to annexation to the City. The Secretary read the Staff Report. The hearing was opened to the audience; there being no comment, the hearing was closed. It was noted that the adopted Master Plan of this area and the revised plan indicates a medium density development for this area east of a proposed freeway alignment. The Staff Report.was read by the Secretary. The hearing was opened to the audience. Guy Green, representing the proposed purchasers, addressed the Commission and spoke in favor of the requested R-3 Zone. There being no other comment, the hearing was closed. The Commission held a lengthy discussion. The Planning Director pointed out to the Com- mission that the adopted Master Plan recognizes the future need of a prime commercial development for this area and also recognizes that the only opportunity is at the southwest corner of the Bolsa Chica Road and Warner Avenue intersection. The Commission also noted that.the property is directly under the takeoff pattern from the Sunset Heights airport. It was the concensus that this request was not in conformance to the Master Plan of Land Use. RESOLUTION NO 412 A Resolution of the City Planning Com- misgion Recommending Denial of Zone Case 412 to the City Council. A MOTION WAS MADE BY WORTHY AND SECONDED BY CRABB TO ADOPT RESOLUTION NO 412 RECOMMENDING DENIAL•OF ZONE CASE NO 412 TO THE CITY COUNCIL FOR THE FOLLOWING REASON: 1. Kenneth Hepler, applicant,'addressed the Commission and gave reasons for the request. There being no other comment, the hearing was closed. It was noted that the subject case is very similar to "many others previously approved by theCommission and that the applicant will have an adequate rear yard area. The Secretary read one letter and five separate petitions of protest signed by 100 property owners in the immediate area. the Secretary. Dr. Siggers, applicant, addressed the Commission and gave his reasons for the request. There being no further . comment, the hearing was closed. George McCracken, applicant, addressed the Commission and stated that he wishes to enclose the patio for the privacy of tenants and safety of children. There being no further comment, the hearing was closed. It was noted that the proposed fences will not block the sight distance at the street intersections. The Planning Director presented'a Resolution from the Huntington'Beach Elementary School District regarding zone changes of`certain industrial acreage within the Huntington Beach Elementary School District. It also recommended that industrial acreage be increased to a minimum of 800 acres and -be -maintained above that amount. The Planning Director informed the Commission that the'City Council had''requested9 a joint meeting between the Council, the School Districts, and the Planning Commission to consider a definite zoning program. Planningg Commission Tuesday, February 4, 1964 COMMUNICATION: The Secretary read a legal notice submitted by the Fountain Valley Planning Commission, regarding a change of zone on property located at the northeast corner of Newland Street and Slater Avenue from R1-1 Single Family Residence District,(1 acre minimum) to R-1 Single Family Residence District. After discussion, the I Planning Commission agreed there was no objection to Zone Case No Z-76. HUNTINGTON CONTINENTAL ASSOCIATION The Chairman of the Commission proposed a joint meeting with the Huntington Continental Association on February 25, 1964. The purpose of the meeting is to discuss problems encountered in the Huntington Continental, development . The Chairman requested George Shibata, Assistant City Attorney, who has been working with the Association, to contact the directors of the Association and invite them to the Commission Study Session on February 25, 1964. TENTATIVE: TRACT MAP NO 5360 - Huntington Harbour The Planning Director informed the Commission that the Huntington Harbour Corporation had requested re -approval of Tentative Tract No 5360 to include Lots No 1, 2, and 283, said lots were originally designated for a proposed beach site. The Council had not accepted the offer of Huntington Harbour to sell these lots for beach purposes. HUNTINGTON HARBOUR WATERWAYS PLAN The Secretary presented a map of the existing and proposed waterways within Huntington Harbour which had been referred to the Commission by the Council. It was not known whether the plan was presented because of negotiations with Orange County Water District or whether the plan was supposed to be a Master Plan.
