COMMISSIONERS ABSENT: Bazil. MINUTES: On Motion by Crabb and seconded by Miller, the Minutes of the Huntington Beach Planning Commission of February 18, 25, and�March 3, 1964, were accepted as transcribed and mailed by the Secretary. TENTATIVE TRACT MAP NO 5483 - Continued Number of Lots: 255 Subdivider: Huntington Harbour Corp. Total Acreage: 77.561 Engineer: Moffatt & Nichol, Engrs. Located south of Edinger Avenue and west of Saybrook Lane and legally described as being a sub- division of a portion of fractional Section 19 and Section 20-5-11. The Secretary read a report submtted by Bill Hartge, Deputy Director of Public Works; regarding the future right -of -way , of ,Edinger Avenue. The hearing was opened to the audience. Martin Fenton, representing the Huntington Harbour Development, addressed the Commission and stated that there were no ob- jections to the conditions stipulated in the Subdivision Report. There being no other comment, the hearing was closed. A MOTION WAS MADE BY CRABB AND SECONDED BY LETSON TO APPROVE TENTATIVE TRACT MAP NO 5483 WITH THE FOLLOWING CONDITIONS: 1. Approval of this tract shall be subject to approval of Conditional Exception UV #690 by the City Council. If said Exception is not so approved, all lot sizes and widths and all street widths shall comply with City Standards. 2. All waterways shall be deeded in.fee to the City. 3. The tract shall be annexed to the Harbor Maintenance District now being formed. 4. Edinger Avenue shall be dedicated and improved to a width of 56 feet south of centerline, exclusive of the service .road. 5. AYES: Crabb, Letson, Kaufman, Worthy, Miller, Larkin. NOES: None. ABSENT: Bazil. THE MOTION CARRIED. ZONE CASE NO 419 - Continued Change of Zone from R-1 Applicant: Huntington' Single Family Residence Harbour Corporation District to R-3 Limited Multiple Family Residence District and C-3 General Business District with setback provisions. Located at the northeast and southeast corners of Admiralty Drive and Pacific Coast Highway 101 Alt., and legally described as a portion of Section 19-5-11. The Secretary read a communication submitted by the Huntington Harbour Corporation regarding the confirmation of certain understandings and representations that have been made.with respect to develop- ment of the 38 acre parcel which had been designated for future commercial use on the Huntington Harbour Master Plan. Also a petition of protest, signed by the owners of 15 parcels in Tracts No 4499 and 4677, was read by the Secretary. The hearing was opened to the,audience. W. C. Payne, Jr., resident of Huntington Harbour, addressed the Commission and vigorously opposed the subject zone change. Also the following property owners addressed -the Commission and protested: Robert James, . 3302 Bounty Circle, Dr. Harold Santis, 3301 Bounty -Circle, Richard Wesenberg, 3442 Gilbert Lane, James Walsh, Admiralty Drive, Mrs. Florence Stalnaker, 3291 Bounty Circle and John De Totroc, resident of Huntington Harbour. There being no further comment, the h--aring was closed. The Commission held a lengthy discussion. RESOLUTION NO 419 A Resolution of the City Planning Com- mission Recommending Approval of a Portion of Zone Case No 419 for C-4 Zone and Further Recommending Denial of the Portion of Zone Case 419 for R-3 to the City Council. A MOTION WAS MADE BY MILLER AND SECONDED BY WORTHY TO ADOPT RESOLUTION NO 419 RECOMMENDING APPROVAL OF A PORTION OF ZONE CASE NO 419 FOR A C-4 ZONE AND FURTHER RECOMMENDING DENIAL OF THE PORTION OF ZONE CASE NO 419 FOR R-3 FOR THE FOLLOWING REASONS: -3- 3/.17/64 Page #4 Minutes: H. USE VARIANCE NO 706 To allow the construction Applicant: Huntington of a temporary marine Harbour Corporation fueling facility in the R-1 Single Family Residence District. Located north- westerly of Pacific Coast Highway and Admiralty Drive in the Huntington Harbour Development and legally described as being a portion of Fractional Section 19-5-11. The hearing was opened to the audience. Martin Fenton_', representing the Huntington Harbour Corporation, addressed the Commission and requested that the subject variance be approved for 5 years. There being no other comment, the hearing was closed. It was noted that the proposed development does conform to the proposed commercial area. A MOTION WAS MADE BY WORTHY AND SECONDED BY MILLER TO APPROVE'USE VARIANCE NO- 706 WITH THE FOLLOWING CONDITIONS: 1. Use Variance shall expire on March 17,°1969. 2. All structures and marine fueling facilities shall -6aeet ,, the approval of the Fire Department. ROLL CALL VOTE: AYES: Crabb, Letso n, Kaufman, Worthy, Mille r, ,Larkin. NOES : None. ABSENT: Bazil. THE MOTION CARRIED. USE VARIANCE NO 707 To allow the construction Applicant: Huntington of a marina and marina Harbour Comer oration parking lot in the R-1 Single Family Residence District. Located north- east and southwest of the intersection of Edgewater Lane and Davenport Drive in the Huntington Harbour Development and legally described as being a portion of Lot 173 and all of Lot C in Tract 4880, and Lots 285 and 286, Tract 5360. The hearing was opened to the audience. Martin Fenton, representing Huntington Harbour Corporation, addressed the Commission and explained the proposed plans. There being no further comment, A Lengthy discussion was held by the Commission. The Planning Director pointed out to the Commission that there were several.problems involved in the development of the marina and the marina parking lot. It was the concensus to continue the hearing for further study and a submittal of a redesign of the proposed construction. The Subdivision Committee Report was read by the Secretary. The hearing was opened to the, audience, Jack Cornier, representing the subdivider, addressed the Commission and stated that there were no'objections to the conditions stipulated in the Subdivision Report. Mr. Wes Morgan, representing the Homeowners Associ- ation, addressed the Commission and spoke against the subject zone change. Also.speaking in opposition were Ron Eddy, 19601 Waterbury Lane and Louis Pritchard, 19401 Waterbury Lane. The speakers also requested that the case be continued in order that the homeowners association, now being formed, could make a recommendation. Ralph Van Buskirk, representing the applicant, addressed the,Commission and spoke in favor of the subject zone change. There being no further comment, the hearing was closed. It was noted that the Master Plan of Land Use indicates an R-1 Zone on most of the tract but with some medium density area around the commercial corner. The Secretary further informed the Commission that if the subject case is approved, the tentative tract map should be revised to comply with the R-2 requirements. It was noted that the amended Master Plan, approved by the Commission,and heard by the City Council, indicates about half of the subject property as low density or an R-1 development and only about half the requested amount of R-3. Tim'Talbert, representing a property,owner to the north addressed the Commission and stated his client had no objections. Jack Realey, 18431 Goodwin Lane, addressed the'Commission and opposed the requested zone change. There being no further comment, the hearing was closed. Commission discussion was held. A MOTION WAS MADE BY CRABB AND SECONDED BY MILLER TO ADOPT RESOLUTION NO-'432 RECOMMENDING APPROVAL OF ZONE -.CASE NO 432 TO THE CITY COUNCIL. ROLL CALL VOTE: AYES: Crabb, Letson, Kaufman, Worthy; Miller, Larkin. NOES: None. ABSENT: Bazil. THE RESOLUTION WAS ADOPTED. ZONE CASE NO 433 - Prezoning Change of Zone from A Rlicant: Ruth E Heil County Al General Agri- cultural District to C-2 Community Business District and C-3 General Business District both with setback provisions and to R-3 Limited Multiple Family Residence District. Located at the southeast corner of Edinger Avenue and Beach Boulevard and legally described as: Proposed C-2: The North 200 feet of the East 190 feet of the N2, NW4, Section 24-5-11. Proposed C-3: The West 702 feet of the NZ, NW4, Section 24-5-11. Proposed R-3: The N2j NW4 of Section 24-5-11, EXCEPTING the West 702 feet and the North 200 feet of the East 190 feet. Jim Saterwaite, 1641 Judy Circle, Westminster', addressed the Commission and opposed the subject zone change. He further questioned the possibility of de - annexing from the City -of Westminster. The following property owners in the.adjacent area addressed the Commission and vigorously opposed the subject zone change: Thomas Clark, Wells Road, Ron Houston,.8480 We11s Road,.Don Sneider, 8411 Wells Road, and Earl Erickson, 16281 Teri Street. Robert Heil, representing the applicant, addressed the.Commission and spoke in favor. Mr. Fletcher further submitted a communication in -opposition to the intended zone change. The Chairman requested that the Secretary read said petition to the Commission. There being no other comment, the hearing was closed. The Commission held a lengthy discussion. The Secretary pointed out to the Commission that any R-3 development will necessitate careful study adjacent to an existing single family development. RESOLUTION NO 433 A Resolution of the City Planning Com� mission Recommending -Approval of -a Portion of Zone Case 433 for an R-2 Rather than the Requested R-3 and also Recommending Approval of a Portion of Zone Case 433 for C -2 Rather than the Requested C-3 Zone to the City Council. A MOTION WAS MADE BY MILLER AND SECONDED BY LARKIN TO ADOPT RESOLUTION NO 433 RECOMMENDING APPROVAL OF A PORTION OF ZONE CASE NO 433 FOR AN R-2 RATHER THAN THE REQUESTED R=3 AND FURTHER RECOMMENDING APPROVAL FOR C-2 RATHER,THAN THE REQUESTED C-3 ZONE TO'THE CITY COUNCIL FOR THE FOLLOWING REASON: 1.
