MINUTES: On Motion by Letson and seconded by Worthy, the Minutes of the Huntington Beach Planning Commission of March 17 and 31, 1964, were accepted as transcribed and -mailed by the Secretary. TENTATIVE TRACT MAP NO 4663 Number of Lots: 40 Subdivider: Cody & Lansing Invest, Co. Total Acreage: 10 Engineer: Nat Neff Engineering Co. Located 660 feet east of Beach Boulevard on the south side of Ellis Avenue and legally described as being a subdivision of the W2, E2, NW4, SW4, Section 36-5-11. The Subdivision Committee Report was read by the Secretary. The hearing was opened to the audience; there being no comment, the hearing was closed. A MOTION WAS MADE BY WORTHY AND SECONDED BY BAZIL TO APPROVE TENTATIVE TRACT MAP NO 4663 WITH THE FOLLOWING CONDITIONS: 1. No portion of the tract shall be recorded until the pro- posed improvement district in the area is formed and the contract is let for construction of the district facilities. 2. No dwelling unit, which is dependent upon any of the facilities to be constructed by the proposed improvement district, shall receive final inspection for occupancy until such district improvements have been accepted by the city. 3. The Subdivision Committee Report was read by the Secretary. The hearing was opened to the audience. Frank Ring, representing the subdivider, addressed the Commission and displayed various sketches of the proposed development. Art Van Dyke, 16652 Cooper Lane, addressed the Commission and objected to the proposed development. There being no other comment, the hearing was closed. A lengthy discussion was held by theCommission. It was noted that the proposed multiple development would be located in the midst of single family subdivisions. Zardo, 16632 Cooper Lane, addressed the Commission and presented a petition, signed by 343 property owners opposing the subject variance. He further pointed out the increase in population density will result in overcrowding the,Ocean View Elementary School District. Frank King, representing the applicant,.addressed the Commission and further explained the proposed project. There being no further comment, the hearing was closed. It was noted that the proposal calls for a total of 108 dwelling units where the maximum under a standard subdivision would be approximately 60 units. Located on the south side of Garfield Avenue and east of Cannery Street and legally described as follows: PARCEL I: (Proposed R-2) The North 1120 feet of the NW4, NW4, Section 6-6-10; EXCEPTING THEREFROM the North 860 feet of the West 758 feet of the NW4, NW4 of said Section. PARCEL II: (Proposed R-1) All of the SA, NW4 of Section 6-6-10 and the North 1127.30 feet of the NW4, SW4 of said Section 6. The hearing was opened to -the audience. Ralph Van Buskirk, representing the applicant, addressed the Commission and explained the proposed development. Wes Warvi, president of the Huntington East Homeowners Association, addressed the Commission and presented a petition signed by 365 property owners objecting to the zone change. There being no other comment, the hearing was closed. A MOTION WAS MADE BY MILLER AND SECONDED BY BAZIL TO ADOPT RESOLUTION NO1427 RECOMMENDING APPROVAL OF ZONE CASE NO 427 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. This proposal is in conformance with the adopted Master Plan for this area. 2. The proposed R-2 Zone will be separated from the R-1 areas by a 200 foot powerline easement and a flood control channel., AYES: Crabb, Bazil, Kaufman, Worthy, Miller, Larkin. NOES: 'Ietson. ZONE CHANGE NO 438 Change of Zone from R-:1 Single Applicant: Roy D Mason Family Residence District to C-2 Community Business District with setback provisions. Located on the south side of Heil Avenue and approximately 200 feet east of Bolsa Chica Street and legally described as a portion of Section 21-5-11. Lengthy legal description on file in the Planning Department Office. The hearing was opened to the audience. Grover Dixon, representing the applicant, addressed the Commission and spoke in favor. There being no other comment, the hearing was closed. A lengthy discussion was held by the Commission. It was the concensus that the requested commercial zone would extend too far from the main street intersection. RESOLUTION NO.438 A Resolution of the City Planning Com- mission Recommending Denial of Zone Case 438 to the City Council. A MOTION WAS MADE BY BAZIL AND SECONDED BY CRABB TO ADOPT RESOLUTION NO 438 RECOMMENDING DENIAL OF ZONE CASE NO 438 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. 'There is sufficient commercial land already zoned in this area. 2. The requested zoning would extend commercial property too far from the main street intersection. Located on the south side of Slater Avenue and the east side of the Southern Pacific Railroad R/W and legally described as: The Eli, NW4, NW4, SE4, Section 26-5-11, ALSO the SW4, NW4, SE4, of said Section 26. The Secretary read a letter submitted by Mr. and Mrs. Shrader, favoring the proposed zone change. The hearing was opened to the audience. Ralph Van Buskirk, representing the applicant, addressed the Commission and spoke in favor. There being no other comnent, the hearing was closed: The Commission held a lengthy discussion. It was noted that the property is situated in the midst of an M-1 zoned area, and further, the request is not in conformance with the adopted Master Plan of Land Use. RESOLUTION NO 439 A.Resolution of the City Planning Com- mission Recommending Denial of - Zone Case 439 to the City Council. A MOTION WAS MADE BY WORTHY AND SECONDED BY MILLER TO ADOPT RESOLUTION NO 439 RECOMMENDING DENIAL'OF ZONE CASE NO 439 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. This property abuts an industrial tract which makes it undesirable for residential development. 2. The small amount of industrially zoned area in the city should not be further depleted. 3. The Commission held a discussion regarding the portion of the building to be constructed within the corner -cut-off,' thereby interfering with the sight angle required for traffic safety. A MOTION WAS MADE BY BAZIL AND SECONDED BY KAUFMAN TO APPROVE AREA VARIANCE NO 709 WITH THE FOLLOWING CONDITION: 1. The applicant shall maintain a site angle of 25 ft x 25 ft measured from property line at the corner of Indianapolis Avenue and Florida Street. H. Cole. The hearing was opened to the audience. Mrs. Yarnell, 7812 Franklin Drive, addressed the Commission and opposed the subject variance. Also speaking in opposition was Mr. F. H. Cole, 752 Main Street. Ray Mercado, representing the applicant, addressed the Commission and stated that the request is the best use for the site. He further spoke in favor of granting the subject variance. There being no further comment, the hearing was closed. The Secretary pointed out to the Commission that the minimum lot area for trailer park is 2.5 acres and the maximum density is 12 spaces per acre. COMMUNICATION: FOUNTAIN VALLEY SCHOOL DISTRICT RE: SCHOOL SITE NO 20 The Secretary read a letter submitted by the Fountain Valley School District requesting a school site approval in the area south of Garfield Avenue and between Cannery and Bushard Streets. The Commission felt the proposed school site location was suitable since it had been designed into the proposed subdivision. THE MOTION CARRIED. COMMUNICATION: The Secretary read a letter submitted by Mr. Clarence A. Morrison, Jr.; requesting an interpretation of the C-1 Zone regarding the sale of ice cream from a truck. After lengthy discussion it was the concensus that a business could not be operated from a truck because the Code requires that all businesses - --be conducted wholly within a permanent building: A MOTION WAS MADE BY LETSON AND SECONDED BY BAZIL TO DENY THE REQUEST OF THE APPLICANT. Planning Commission Tuesday, April 7, 1964 COMMUNICATION: The Secretary read a letter submitted,by Mr. J. E. Drury, requesting the establishment of a temporary quarters for an auto agency on Beach Boulevard without installing the required street improvements. The Commission considered the request and it was the concensus that if such a request were to be considered, it would have to be in the form of a Variance application and a public hearing would be necessary. DISCUSSION: The Secretary presented a request for pre -zoning from the Broadway Island property owners to the Commission. Several property owners desire to 'annex to the City but could not get all of the property owners to `sign the petition for pre -zoning. Therefore, the request was for the Commission to initiate the zone change and to include all properties proposing to annex. It was the unanimous opinion of the Commission that if such a request were to be considered, it would have to be in the form of an application for a change of zone by the property owners who wished to be included in a pre -zoning. COMMUNICATION: EXTENSION OF TIME, TENTATIVE TRACT MAP NO 5128 DEVELOPER: The Meredith Company The Secretary read a letter sub- mitted by Robert J. Gulino, engineer for the developer, requesting an extension of one year to enable the developer to record the Tract No 5128. A MOTION WAS MADE BY BAZIL AND SECONDED BY WORTHY TO APPROVE THE REQUEST OF THE APPLICANT WITH THE FOLLOWING CONDITION: 1.
