Monday, April 20, 1964
Mayor Lambert called the regular meeting of
the City Council of the City of Huntington Beach to order at 7:30 P.M.
The Pledge of Allegiance was given by all
present in Council Chamber.
The invocation was given by Rev. Virgil
Painter of the General Baptist Church, Huntington Beach.
ROLL CALL Councilmen Present: Gisler, Stewart, Welch, Lambert
Councilmen Absent: Wells
MINUTES APPROVED On motion by Stewart, seconded by Gisler,
Council approved the minutes of the regular
meeting of April 6, 1964, as transcribed and mailed. Motion carried,
�yG DEPT, REPORTS On motion by Stewart, seconded by Welch, the
reports of the Chief of Police, City
Collector and Chamber of Commerce Manager for March, 1964, were
received and ordered filed. Motion carried.
-0s3 NO CANVASS OF Mayor Lambert informed the audience that
BALLOTS TONIGHT there would be no canvass of election
ballots, swearing in of new officers, or
election of a new Mayor at this meeting, as the City Council had been
served with a temporary restraining order prohibiting said canvass.
,,9q7 CAL PODIATRY ASSN On motion by Stewart, seconded by Gisler,
Council granted permission to the California
Podiatry Association, Orange County Division, to hold a Five -Mile
Walkathon on the City beach on Saturday, May 16, 1964 at 1:00 P.M.,
under the supervision of the Police Department and Lifeguard Depart-
ment. Motion carried,
a,°z MC GO-FERS CLUB On motion by Gisler, seconded by Stewart,
SOLICITATION Council granted permission to the Midway
City Go-Fers 4-H Club to sell tickets in
the City to their benefit hamburger fry on June 6th, beginning May
8, 1964. Motion carried.
VILLAGE VIEW SCHOOL On motion by Gisler, seconded by Stewart,
SOLICITATION Council granted permission to the Village
View School 8th Grade Class to sell candy as
a fund raising project in the City, between May llth and May 18th,
1964, under supervision of the Police Department. Motion carried.
COLDWELL - BANKER On motion by Stewart, seconded by Gisler,
�s HEIL ANNEXATION Council received and ordered filed the
communication from.-Coldwell-Banker &
Company, expressing their appreciation to the City for their support
on the recent annexation of the Heil property into the City.
Motion carried,
E & G ENGINEERS On motion by Stewart, seconded by Gisler,
WEED ABATEMENT Council received and ordered filed the
request from E & G Engineers, Inc, to
contract for the City's weed abatement program. Motion carried.
HB HIGH SCHOOL EMP On motion by Stewart, seconded by Gisler,
�9 LAKE PARK CLUBHOUSE Council granted the request of the Hunting-
ton Beach Union High School District Em-
ployees' Association to use the Lake Park Clubhouse on Saturday,
May 16, 1964, and directed the Clerk to waive the fees therefor.

0109 FIRST CHRISTIAN CHURCH On motion by Stewart, seconded by Gisler,
TRAFFIC PROBLEM the letter from the First Christian Church,
1207 Main Street, City, informing Council
of the congested traffic condition existing at the intersection of
Main Street and Adams Avenue on Sunday mornings, was referred to the
City Administrator and Chief of Police for study and possible solution.
Motion carried.
y02 OV LITTLE LEAGUE On motion by Stewart, seconded by Gisler,
SOLICITATION Council granted permission to the Ocean
View Little League to sell candy in the
City during the month of May, as a fund raising project. Motion
carried.
�� E & M AMUSEMENTS The Clerk presented a communication from
LICENSE REOUEST E & M Amusement Rentals of Long Beach, re-
questing permission to set up their rides
at the Fantastic Fair Store parking lot on April 23, 24, 25 & 26th,
and further requesting that Council consider reducing the fees for
said license or permit.
On motion by Gisler, seconded by Welch,
Council granted permission to the E & M Amusement Rentals of Long
Beach to set up their rides on the dates requested, subject to
payment of the regular license fees, receipt of a letter from
Fantastic Fair approving the use of their parking lot, and a
Certificate of Insurance naming the City as Co -Insured in the
amounts stipulated by Council. Motion carried.

CHARLES STONE Under Oral Communications, Charles Stone,
15452 LaSalle Lane, City, addressed the
Council and read a clarification of his position regarding the out-
come of the Municipal Election held April 14, 1964.
BERRIEN E. MOORE Berrien E. Moore, Attorney, 14527 South
ATTORNEY e Western Avenue, Gardena, addressed the
Council to state his clients' position,
as a matter of record, regarding the restraining order served on
the City Council to prevent the canvass of election results at
this meeting.
Mayor Lambert declared that any statements
W. Moore might make would be out of order, inasmuch as Council had
been formally served, and informed Mr. Moore that he would have his
opportunity to speak before the Judge in Court on Friday afternoon.

The Clerk informed the Council that they
had been provided with copies of the Planning Director's transmittal
and the Resolution of the Planning Commission, recommending approval
of a portion for C-4 and denial for the portion requested for R-3
in Zone Case No. 419, and stated that he had received no communica-
tions or written protests to`the Zone Change or to the recommendation
of the Planning Commission.
Mayor Lambert declared the hearing open.
Martin Fenton of Huntington Harbour Corp-
oration addressed the Council and presented maps and charts of the
area involved in the Zone Case, and requested Council approval of
the R-3 portion recommended for denial by the Planning Commission.
Courtney Mathews of William Perrera Asso-
ciates, Architects and Planners for Huntington Harbour Corporation,
gave a resume' of the projected plans from the maps and charts;
and requested that the entire Zone Case be considered for approval.
W. S. Payne, 3342 Bounty Circle, City,
addressed the Council and objected to the change of a portion of the
Zone Case to R-3, and also stated objections to sales misrepresenta-
tion regarding a Yacht Club in Huntington Harbour.
Don Byrnes, Huntington Harbour Corporation
Sales Manager, addressed the Council and refuted statements made by
Mr. Payne concerning the building of a Yacht Club in Huntington
Harbour.
Mr. Payne again addressed the Council and
read a document signed by 25 residents of Huntington Harbour
regarding the development of the land.
Mr. Martin Fenton addressed the Council to
refute statements made in the document road by Mr. Payne.
Mr. Dick Wesenburg, 4301 Bounty Circle,
City, addressed the Council and briefly stated that all he wished
was a fair deal.
Mr. Bob James, 3302 Bounty Circle, City,
addressed the Council and stated that he would not have purchased a
home -in Huntington Harbour if he had thought there was a possibility
of multiple or high density dwelling units in the area.
Mrs. Stan Stallnaker, 3291 Bounty Circle,
City, addressed the Council to protest the R-3 portion of the Zone
Case.
Mr. Potts, 16701 Peale, City, addressed the
Council and stated that he was perfectly happy in his Huntington
Harbour and was pleased with his dealings with Huntington Harbour
Corporation.
Mr. Jan Ho, 3331 Bounty Circle, City,
addressed the Council and informed them that he paid $5,000 extra
to see the activity of the Yacht Club across the channel, and
protested the proposed zone change.
There being no one further present to speak
on the matter, and there being no further protests filed, either
oral or written, the hearing was closed by the Mayor.
Planning Director Warner addressed the
Council and gave a resume' of the Planning Commission's reasons for
recommending approval of the C-4 portion of the Zone Case, and
denial of the R-3 portion of Zone Case No. 419.

On motion by Stewart, seconded by Gisler,
Council concurred with the recommendation of the Planning Commission,
and directed the City Attorney to prepare an Ordinance effecting
the change of Zone to C-4 in Zone Case 419, and denied the portion
requested for R-3. Motion carried.
RECESS Mayor Lambert called a recess of the
Council at 8:50 P.M.
RECONVENED Council was reconvened at 9:07 P.M. by the
Mayor.
PUBLIC HEARING Mayor Lambert announced that this was the day
ZC 426 APPROVED and hour set for a public hearing on Res-
olution No. 426 of the City Planning
Commission, recommending approval of Zone Case No. 426, on property
located at the Northwest and Southeast corners of Slater Avenue and
Springdale Street, and directed the Clerk to read the legal notice.

Zone Case No. 426, as published in the Huntington Beach News on April
9, 1964, setting the hour of 7:30 o'clock P.M., or as soon thereafter
as possible, on Monday, the 20th day of April, 1964, in the Council
Chamber of the City Hall, Huntington Beach, California, as the time
and place for a public hearing for the purpose of considering a
petition for a change of zone to regulations of the Districting
Ordinance from: A-1-X General Agricultural District, as adopted by
Interim Ordinance No. 668, to: R-1 Single Family Residence District.
The Clerk informed the Council that they
had been provided with copies of the Planning Director's transmittal
and the Resolution of the Planning Commission, recommending approval
of Zone Case No. 426, and stated that he had received no communications
or written protests to the Zone Case or to the Resolution of the
Planning Commission.
Mayor Lambert declared the hearing open.
There being no one present to speak on the
...matter, and there being no protests filed, either oral or written,
the hearing was closed by the Mayor.
On motion by Stewart, seconded by Welch,
Council approved the recommendation of the Planning Commission,
and directed the City Attorney to prepare an Ordinance effecting the
change of zone in Zone Case No. 426. Motion carried.
PUBLIC HEARING Mayor Lambert announced that this was the
ZC 428 - APPROVED day and hour set for a public hearing on
Resolution No. 428 as modified, of the City
Planning Commission, fecommending approval of Zone Case No. 428, as
modified, on property located between Edwards and Goldenwest Streets,
south of Slater Avenue, and directed the Clerk to read the legal notice.

representing Aries Homes, and requested that the decision of the
Planning Commission be upheld.
There being no one further present to speak
on the matter, and there being no protests filed, either oral or
written, the hearing was closed by the Mayor.
Planning Director Warner addressed the
Council and gave a resume' of the Planning Commission's reasons
for recommending approval of Zone Case 428. as modified.
On motion by Welch, seconded by Stewart,
Council approved the recommendation of the Planning Commission, and
directed the City Attorney to prepare an Ordinance effecting the
change of zone, as modified, in Zone Case No. 428. Motion carried.
PUBLIC HEARING Mayor Lambert announced that this was the
ZC 429 APPROVED day and hour set for a public hearing on
Resolution No. 429 of the City Planning
Commission, recommending approval of Zone Case No. 429, on property
located west of Beach Boulevard and north of Taylor Avenue, and
directed the Clerk to read the legal notice.
The Clerk read notice of public hearing on
Zone Case No. 429, as published in the Huntington Beach News on
April 9, 1964, setting the hour of 7:30 o'clock P.M., or as soon
thereafter as possible, on Monday, the 20th day of April, 1964,
in the Council Chamber of the City Hall, Huntington Beach, California
as the time and place for a public bearing for the purpose of con-
sidering a petition for a change of zone to regulations of the
Districting Ordinance from: R-4-X Suburban Residential District,
as adopted by Interim Ordinance No. 668, to: C-4 Highway Commercial
District, with setback provisions.
The Clerk informed the Council that they
had been provided with copies of the Planning Director's transmittal,
and the Resolution of the Planning Commission, recommending approval
of Zone Case No. 429, and stated that he had received no communica—
tions or written protests to the Zone Case or to the Resolution of
the Planning Commission.

situated between Speer and Slater Avenues, west of Beach Boulevard

Zone Case No. 430, and stated that he had received a request that said
zone case be set for public hearing from Fred Sanders, 20857 Mesa
Rico Boulevard, Covina, and that he had received no further communi-
cations or protests to the Zone Case or to the Resolution of the
Planning Commission.
Mayor Lambert declared the hearing open.
There being no one present to speak on the
matter, and there being no protests filed, either oral or written,
the hearing was closed by the Mayor.
Planning Director Warner addressed the
Council and gave a resume' of the Planning Commission's reasons
for recommending denial of Zone Case No. 430.
On motion by Welch, seconded by Gisler,
Council concurred with the recommendation of the Planning Commission,
and denied Zone Case No. 430. Motion carried.

Resolution No. 431 of the City Planning
Commission, recommending approval of Zone Case No. 431, on pro-
perty located north of Ellis Avenue and east of Beach Boulevard,
and directed the Clerk to read the legal notice.

April 9, 1964, setting the hour of 7:30 o'clock P.M., or as soon
thereafter as possible, on Monday, the 24th day of April, 1964, in

as the time and place for a public hearing for the purpose of con-
sidering a petition for a change of zone to regulations of the
Districting Ordinance, from: R-4-X Suburban Residential District,
as adopted by Interim Ordinance No. 668, to: R-2 Two Family

,Abi PUBLIC HEARING Mayor Lambert announced that this was the
ZC 432 - APPROVED day and hour set for a public hearing on
Resolution No. 432 of the City Planning
Commission, recommending approval of Zone Case No. 432 proposing to
amend the Master Plan of Streets and Highways as relating to the 17th
Street and Garfield Avenue alignment, and to change the clarification
of Hamilton Avenue from a secondary highway to a primary highway,
and directed the Clerk to read the legal notice.
The Clerk read notice of public hearing on
Zone Case No. 432, as published in the Huntington Beach News on
April 9, 1964, setting�thehour of 7:30 o'clock P.M., or as soon
thereafter as possible, on Monday, the 20th day of April, 1964, in
the Council Chamber of the City Hall, Huntington Beach, California,
as the time and place for a public hearing for the purpose of con-
sidering an amendment to the Master Plan of Streets and Highways as
it related to the alignment of Seventeenth Street and Garfield
Avenue, and to change the classification of Hamilton Avenue from a
Secondary Highway to a Primary Highway.
The Clerk informed the Council that they
had been provided with copies of the Planning Director's transmittal
and the Resolution of the Planning Commission, recommending approval
of Zone Case No. 432, and stated that he had received no communica-
tions or written protests to the Zone Case or to the Resolution of
the Planning Ummission.
Mayor Lambert declared the hearing open.
There being no one present to speak on the
matter, and there being no protests filed, either oral or written,
the hearing was closed by the Mayor.

Council approved the recommendation of the Planning Commission,
and directed the City Attorney to prepare a Resolution effecting
the change of zone in Zone Case No. 432. Motion carried.
PUBLIC HEARING Mayor Lambert announced that this was the

Resolution No. 433 of the City Planning
Commission, recommending approval of Zone Case No. 433 on property
situated at the southeast corner of Beach Boulevard and Edinger
Avenue, and directed the Clerk to read the legal notice.

on Zone Case No. 433, as published in the Huntington Beach News on
April 9, 1964, setting the hour of 7:30 o'clock P.M., or as soon
thereafter as possible, on Monday the 20th day of April, 1964, in the
Council Chamber of the City Hall, Huntington Beach, California, as
the time and place for a public hearing for the purpose of consider-
ing a petition for pre -zoning from: County A-1 General Agricultural
District, to; C-2 Community Business District, and C-3 General
Business District, both with setback provisions, and to R-3 Limited
Multiple Family Residence District.
The Clerk informed the Council that they
had been provided with copies of the Planning Director's
transmittal and the Resolution of the Planning Commission, recommend-
ing approval of Zone Case No. 433, and stated that he had received
no communications or written protests to the Zone Case or to the
Resolution of the Planning Commission.

Mr. Jim Crowles of Coldwell-Banker Company,
addressed the Council representing the Heil family and requested
the R-3 zone as petitioned for.
J. Fletcher, 1841 Wells Road, Westminster,
addressed the Council and opposed any multiple development in said
area, requested the Clerk to read a prepared document of questions
of the Westmont Tract Homeowners for the Planning Commission.
Mr. Robert Heil., 1414 West McFadden, Santa
Ana, addressed the Council and requested Council consideration of
the R-3 zone petitioned for.
There being no one further present to speak
on the matter, and there being no further protests filed, either oral
or written, the hearing was closed by the Mayor.
Planning Director Warner gave a resume' of
the Planning Commission's reasons for recommending approval of the
C-2 and R-2 zone rather than the R-3 petitioned for, in Zone Case No.
433.
On motion by Stewart, seconded by Welch,
Council approved the recommendation of the Planning Commission, and
directed the City Attorney to prepare an Ordinance effecting the
Change of zone to C-2 and R-2 in Zone Case No. 433. Motion carried.
PUBLIC HEARING Mayor Lambert announced that this was the day
���ZC 434 - APPROVED and hour set for a public hearing on Res-
olution No. 434 of the City Planning Com-
mission,airecommending approval of Zone Case No. 434, on property
situated on the north side of Warner Avenue west of Bolsa Chica
Street, and directed the City Clerk to read the legal notice.

the hour of 7:30 o'clock P.M., or as soon -thereafter as possible,
on Monday, the 20th day of April, 1964, in the Council Chamber of

pre -zoning from: County C-2 General Business District, to: City
C-2 Community Business District, with setback provisions.
The Clerk informed the Council that they
had been provided with copies of the Planning Director's transmittal

of Zone Case No. 434, and stated that he had received no communications
or written protests to said Zone Case or to the Resolution of the
Planning Commission.

Planning Director Warner addressed the
Council, gave a resume' of the Planning Commission's recommendation,
and informed the Council that approximately 2/3 of the property
involved in the Zone Case requested for withdrawal, belonged to
Mr. Chikasawa, and the remainder to Mrs. Alva Gibson, and recommended
that Council approve the withdrawal of the Chikasawa property and
refer the Gibson portion back to the Planning Commission for re-_
consideration.
On motion by Welch, seconded by Stewart,
Council approved the withdrawal of the Chikasawa property from
Zone Case No. 436, and referred the remainder of the Zone Case back

Variance, stating that the tax return would not favor the City of
Huntington Beach.
Mr. Ray Deeble, Fullerton, addressed the
Council, representing his mother who owns property in the adjacent
area, and protested the granting of said Use Variance.
Mr. Tim Talbert, owner of the property
involved, addressed the Council and requested favorable considera-
tion of the Council to allow Use Variance #702.
John Marvi of Coldwell-Banker & Company,
addressed the Council and stated that use for horse stables would
be detrimental to the area.
Norm Worthy, 801 13th Street, City,
addressed the Council and stated that he was in favor of a horse
stable as a recreational facility, and that stables are usually
located along river beds.
Mr. Nelson Olman, 8501 LaMar Drive, City,
addressed the Council and requested that Use Variance 702 be
allowed.
Mr. Nelson Mauer, 821 Main Street, City,
addressed the Council and stated that he was in favor of Use
Variance 702 to allow a horse stable in the City.
Mrs. Ann Menees, 1541 New Castle Drive,
City, a City Recreation Commissioner, addressed the Council and state,
that private recreational facilities should be encouraged in the City,
and requested that Council consider allowing Use Variance 702.
Mr. George Arnold addressed the Council
and stated that he was in favor of a horse stable by the river bed.
There being no one further present to speak
on the matter, and there being no further protests filed, either
oral or written, the hearing was closed by the Mayor.

ing that Council approve the agreement and authorize it execution.

approved the recommendation of the Director of Public Works, and author-
ized the Mayor and City Clerk to execute the consent to the Agreement

CHILD GUIDANCE The Clerk presented a request from the Huntington

CANNERY CHG OPPOSED the Orange County Street Naming Committee
requesting Council to consider a change in
the name of Cannery Street to Magnolia Street to conform with the
Magnolia Street alignment throughout the County. This matter was
deferred from the meeting of April 6, 1964.
On motion by Stewart, seconded by Welch,
Council opposed the recommendation of the Orange County Street
Naming Committee to change the name of Cannery Street to Magnolia
Street in the City, inasmuch as the City already has an existing
Magnolia Avenue. Motion carried.
BEACH MASTER PLAN The Clerk presented a communication from
66 BEACH WALL the Chamber of Commerce requesting that
Council direct the Planning Commission
Staff to start work on a new Beach Master Plan, and that the City
immediately remove the block wall on the north side of the City
beach parking pad from 1st Street to Beach Boulevard. This matter
was deferred from the meeting of April 6, 1964.

ayz HDQ FIRE STA The Clerk presented a transmittal from
BARRETT CHG ORD #5 Jordan & Endsley of Change Order #5 for
the Headquarters Fire Station being altered
by James J. Barrett Construction Company, for additional demolition
and 22" to 42" asphalt paving in place of V asphalt paving specified
for a total amount of $969.07.
On motion by Welch, seconded by Gisler,
Council approved Change Order #5 on the alterations to the Head-
quarters Fire Station by James J. Barrett Construction Company, and
authorized the Mayor and City Clerk to execute the document on
behalf of the City. Motion carried.
9� NOTICE OF COMPLETION The Clerk presented a communication from
HD9 FIRE STA - BARRETT Jordan and Endsley informing Council that
the Headquarters Fire Station alteration
had been completed in accordance with -the plans and specifications,
and recommending that a Notice of Completion be -filed by the City.
On motion by Stewart, seconded by Welch,
Council directed the City Clerk to file a Notice of Completion on
alteration to the Headquarters Fire Station by James J. Barrett
Construction Company, said completed work was accepted by minute
action of the Council at their regular meeting held April 6, 1964.

be inhabited or uninhabited, and recommended that this matter be
referred to the City Planning Commission for study, before Council

WASHINGTON D. C. that Stanley G. Anderson of Seal Beach,
State Vice President of the National Rivers
and Harbors Congress, has invited a delegation from the City of
Huntington Beach to attend and participate in the.51st Annual National
Convention at the Mayflower Hotel in Washington, D.C., from June 2nd
thru 5th, 1964. The Administrator stated that he would further contact
Mr. Anderson to inquire as to the deadline for reservations.
SC DIABETES ASSN On motion by Gisler, seconded by Stewart,
�02 SOLICITATION Council granted permission to the Southern
California Diabetes Association to solicit
funds door-to-door throughout the month of May, 1964, with the
stipulation that all solicitors register with the Police Department.

USE OF BEACH STAGE The City Administrator presented a letter
97 DENIED BAND - from Mr. Charles Harding of La Mirada,
requesting permission for a six member
teenage band to practice on the amphitheater stage and use the
electrical outlets for their instruments.
On motion by Gisler, seconded by Welch,
Council denied the request from Mr. Harding for a youth band to
practice on the beach stage. Motion carried.
S, C EDISON CO The City Administrator informed the Council
POLE EASEMENT that he had received a request from the
Southern California Edison Company for an
easement to locate a pole guy wire anchor at the northeast corner of
the new Fire Headquarters building.
On motion by Stewart, seconded by Gisler,
Council directed the City Attorney to draw up an easement from the
City to the Edison Company for Council approval. Motion carried.
Ong DYKE WATER The City Administrator informed the Council
PUB APPL that the City's purchase of Dyke Water
Company's 163 customer enterprise in
Huntington Beach is now ready to go into escrow and ready for
application for authorization by the Public Utilities Commission, and
recommended that the Mayor and ity Clerk be authorized, by minute
order, to execute a joint application to the Public Utilities
Commission.
On motion by Gisler, seconded by Welch,
Council directed the Mayor and City Clerk to execute a joint appli-
cation with Dyke Water Company to the Public Utilities Commission,
for the purchase of the Huntington Beach customer enterprise.

ALL ZONE MTG Council granted permission to the Chief of
Police to attend the Attorney Generals All
