Planning Commission Tuesday, April 21, 1964 TENTATIVE TRACT MAP NO 5523 Number of Lots: 202 Subdivider: Zeimer & Lezinsky Total Acreage: 31.1 Engineer: Voorheis-Trindle- Nelson, Inc. Located 2648 feet south of Adams Avenue on the east side of " Brookhurst Street and legally described as being a proposed subdivision of Lots 1, 2, J.A. Day Tract. The Subdivision Committee Report was read by the Secretary. The hearing was opened to the audience. Ron Wells, representing the applic'ant, addressed the Commission and offered to answer questions. Charles Palmer, Huntington Beach Elementary School District, addressed the Commission and requested that the Master Plan should be upheld. Robert Dingwall, 19791 Estuary Lane, addressed the Commission and stated that the subject property should be kept to low density as indicated on the Master plan. Frank Dray, designer, representing the applicant, explained the concept of the proposed plan. There being no further comment, the hearing was closed. The Commission held a lengthy discussion. A MOTION WAS MADE BY CRABB AND SECONDED BY MILLER TO APPROVE TENTATIVE TRACT MAP NO 5523 UPON THE FOLLOWING CONDITIONS: 1. The Revised Tentative Map dated April 17, 196'4, shall be the approved layout. 2. Approval of this Tentative Map shall be null and void unless UV 716 is approved. 3. A 6 ft chain link fence or equivalent shall be constructed along the Southern California Edison Company R/W. 4. All provisions for a community association and for per- petual -maintenance of the common areas and recreation areas .shall -be approved by the Planning Department and City,Attorney. 5. All private driveways shall comply with adopted Planning Commission Standards as to width, corner radii and turning radius. 6. All rights for construction of any structure not shown on the approved plot plan shall be dedicated to the City, 7. Bill Hartge, Deputy Director of Public Works, addressed the Commission and,requested that Condition #9 read'as follows: All private streets shall meet the structural standards of the Director of Public Works. There being no other com- ment, the hearing was closed. It was noted that the de- sign of the proposed project is basically a "cluster type development" which seems to be acceptable with a few modifications. A MOTION WAS MADE BY BAZIL AND SECONDED BY CRABB TO RECOMMEND APPROVAL OF USE VARIANCE NO 716 TO THE CITY COUNCIL WITH THE FOLLOWING CONDITIONS: 1. Lighting systems shall be installed.on all private drives and common areas with illumination at leat equal to lighting on public streets. 2. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 3. Landscaping shall be installed throughout the common areas and a plan of such landscaping shall be'submitted for approval by the Planning Commission. 4.T Recreation facilities shall be installed .within, the detveclopment- and a plan specifying such -facilities shall be submitted for approval by the Planning Commission. 5. All private streets shall meet the structural standards of the Director of Public Works. 10. The width of all private streets shall meet the standards adopted by the Planning Commission. 11. The C.C.&R's shall contain a provision requiring owners and tenants to abide by the rules of the Association for use of the recreation areas, parking, etc., and such provision shall provide penalties for violation. 12. The C.C. & R's for the project, the Articles of Incorporation and By-laws of the propEed Association shall be approved by the Planning Director and City Attorney. 13. In the event the project is recorded and constructed in Sections, each section shall provide rec;=reation facilities meeting Planning Commission Standards. 14. The recreation areas and facilities shall be reserved for the exclusive use of the residents'of this project and their non-paying guests. 15. Clayton Staples, engineer for the subdivider, addressed the Commission and stated that there were no objections to the'suggested conditions. M. E. Robert Dingwall, 19791 Estuary Lane, addressed the Commission and vigorously protested the subject variance. Victor Brandewie, 8221`.. Atlanta Avenue, addressed`the Commission and questioned various requirements. - Richard Derby, 9121 Mediterranean Drive, addressed the Commission and objected to substandard lot size in the proposed development. There being no other comment, the hearing was closed. The Commission held a lengthy discussion. A MOTION WAS MADE BY BAZIL AND SECONDED BY WORTHY TO APPROVE TENTATIVE TRACT MAP NO 5575 WITH THE FOLLOWING CONDITIONS: 1. If Conditional Exception No UV 714 is not approved by -the City Council, approval of this tentative map shall be void. 2. No portion of this tract shall be recorded until such time as further approval by the Planning Commission is secured certifying that a solution has been found to the problem of a public health hazard due to..irrigation of nearby farm lands with sewer effluent. 3. The Secretary pointed out to the Commission that this variance accompanies Tentative Tract No 5581 and is for the purpose of creating a so-called "Planned Development". He further pointed out that the density is well within the limits established by the Commission for an R-3 zone being between 10 and 11 units per acre. A MOTION WAS MADE BY WORTHY AND SECONDED BY BAZIL TO RECOMMEND APPROVAL OF USE VARIANCE NO 715 TO THE CITY COUNCIL WITH THE FOLLOWING CONDITIONS: 1. Lighting systems shall be installed on all private drives and common areas'with illumination at least equal to .lighting on public streets. 2. No other structures than those shown on the approved plot plan shall be constructed within the project. 3. Planning Commission Tuesday, April 21, 1964 ZONE CASE NO 440 Proposed amendment to the Initiated by Resolution Huntington Beach Ordinance of Intent Code regarding 110111, 110211, and 110311, Oil Combining Districts. The Secretary informed the Commission that this proposal will add provisions for more restrictive oil districts to.the Code. He further pointed out that the proposal will not affect the existing 110" Oil Combining District which presently covers most of the City.
