MINUTES: On motion by Worthy and seconded by Miller, the Minutes of the Huntington Beach Planning Commission of May 5,' 1964, were accepted as transcribed and mailed by the Secretary. ZONE CASE NO 418 - Continued Applicant: Lon E. Peek, Sr. Change of Zone from A-1-X General Agricultural District as adopted by Interim Ordinance No 668 to R-2 Two Family Residence District. Located at the northwest- corner of Heil Avenue and Goldenwest Street and legally described as: PARCEL I: The SE4, NE4, Section 22-5-11. PARCEL II: The E2j E2, SW4, NE4, Section 22-5-11. ZONE CASE NO 453 Proposed amendment to INITIATED BY RESOLUTION the Master P1an'of Land OF INTENT Use, Study Area I, as it affects the area bounded by Yorktown Avenue, Brookhurst Street, Adams Avenue and Bushard Street. The Secretary informed the Commission that there were no written communications submitted. He further read the Staff Report. The hearing was opened to the audience. The following property owners addressed the Commission and spoke in favor of the proposed amendment to the Master Plan:' Don Eddy,.19601 Waterbury Lane, Wes Warvi, 10141 Kukui Drive, Ray Gashall,�9411 Waterbury Lane, Harry Dunbar, 9602 Sailfish Drive, Henry Figge., Hyannis , Drive,;and Mrs. Evelyn Cornell, speaking in behalf of the Glen Mar Homeowners' Association. Sylvan Allen, attorney for the Substantial Homes, Ltd., addressed theCommission and requested that the subject zone case be'continued. He further spoke in favor of medium density for the subject area. Charles Miller, Assistant Superintendent of Fountain Valley School District, addressed the Commission and pointed out the potential enrollment which would result from the R-2 zoning. He further informed the Commission that the Fountain Valley School District ha.d to purchase an additional 5 acres of land to enlarge a 15 acre school site previously purchased on the basis of low density development. Leon Ruderman, repre- senting Substantial Homes, Ltd., addressed theCommission and spoke in favor of medium density. There being no further comment, the hearing was closed. Commission discussion was held at length: The Secretary informed the Commission that the Department of Public Works advised that existing sewers do not have the capacity for the population,density proposed on this property. Commissioner Crabb suggested that the north half of the quarter section be adopted as low density and the south half of the quarter section of said property be kept as medium density. The driveway widths be increased to 20 feet. 2. The turning 'radius to the rear driveway be -:increased.'' 3. There should .be the installation of either wet. or dry standpipe water lines to the rear of the proposed development. It was the concensus of the Commission'to continue the hearing on Use Permit No 241 to June 2, 1964, to'give the applicant a chance to submit,'a revision of the plot plan. Don Tryon, 8271 Newman Avenue; addressed the Commission and objected to the proposed construction. W. T. Gibbs, 8311, also opposed the multiple development. Robert Stellrecht, applicant, addressed the Commission and exp1a,inne4-the future' dedication for Newman Avenue. Mr. Flectcher',8282 Darsy Drive, addressed the Commission and questioned various' problems regarding the dedication and the access to the pm perty. There being no 'further comment, the hearing was closed. The Secretary informed the Commission that the proposed multiple family -development will consist of 27 separate detached buildings, so that in effect, it is.a development of 27 two bedroom single family dwellings on slightly less than 2 acres. -10- 5/19/64 Page #11 Minutes: H. No building permits shall be issued until such time as sufficient dedication for Newman Avenue is made to provide adequate access to the site meeting the approval of the Director of Public Works. 2. Dedicate and improve Newman Avenue to City Standards across the entire parcel. 3. Participate in sewer, water and drainage assessment districts. 4. Provide 12 off-street parking spaces per unit and z guest parking space per unit. 5. The improvement of Newman Avenue to provide access to the site shall be approved by the Director of Public Works. 6. A water system and fire hydrants shall be installed as approved by the Director of Public Works and Fire Chief. 7. A 40 foot turn -around shall be provided at the south end of the proposed driveway. Located south of Yorktown Avenue and approximately 1320 feet east of Brookhurst Street and legally described as Lots 30, 32, 98 and 99, Tract No 4884. The hearing was opened to the audience; there being no comment, the hearing was closed. The Secretary pointed out to the Commission that the subject variance is a routine case of rear yard -variances on cul-de-sac lots in a new tract. Martin Fenton, representing the Huntington Harbour Corporation, addressed the Commission and spoke in favor of the proposed construction of a marina and marina parking lot. MISCELLANEOUS: TENTATIVE TRACT MAP NO 5575 - Deane Brothers The Planning Director read a letter submitted by the Orange County Health Department stating the Department has received a letter from the developer as follows: "Deane Brothers hereby not if ie s the Health Department that we will not enter into any agreement which allows the use of sewer effluent on the Signal property within a distance of 600 feet of any occupied -homes in Tract No 5575 and other tracts to be developed'on this property". The Planning Director stated that in view of this information, the Health Department can see no necessity for the jointly signed statement of the developer and the Talbert Water District since no reclaimed sewage is to be spread within 600 feet of any occupied home in Tract No 5575. Clarence Graham, representing Deane Brothers, addressed the Commission and submitted a letter regarding the subdi vider's agreement that Tentative Map No 5419 will be ineffective as of the time of approval of Map No 5575 and will remain ineffective unless a request is made that the Planning Commission reconsiders it and if the Commission does, then reapprove said Map No 5419. The Commission held a discussion. It was the concensus to refer the letter to the City Attorney for decision on wording of the request. Approval of this tentative map shall not be effective until the City Attorney approves any agreement not to proceed with Tract No 5419 unless further approval by the Planning Commission is secured. 5. The lots within each block shall average 60 feet in width and 6000 square feet and the minimum lot shall be 50 feet in width and 5000 square feet. DISCUSSION: 'RE: TENTATIVE TRACT MAP NO 5430 - Fernhill Homes The Secretary displayed a map of Tract 5430, being'a planned development at the northwest corner of Graham Street and Warner Avenue. The approval of the tentative -map included a requirement for a maximum of 40% building coverage exclusive of vehicular accessways. It was noted that the plan had been modified in an attempt to meet the maximum coverage condition but that' the coverage was about 43%.
