COMMISSIONERS ABSENT: Crabb, Letson. TUESDAY, MAY 26, 1964 Adjourned Meeting. MINUTES: INDUSTRIAL ZONING - Atlanta and Newland The Planning Director displayed a map of a suggested zone change on property at the southwest corner of Atlanta Avenue and Newland Street. It was explained that there had been a mixup in legal descriptions in the several previous zone cases in this area.and that a further change is necessary to complete the zoning as originally intended. It will be necessary to re -zone a portion of the area from M-1-A-0 to R-A-O and a small strip of land from R-A-O to M-1-A-0. THE MOTION BY BAZIL WAS SECONDED BY MILLER TO ADOPT THE NECESSARY RESOLUTION OF INTENT TO INITIATE THE SUGGESTED CHANGE OF ZONE. ROLL CALL VOTE: AYES: Bazil, Kaufman, Worthy, Miller, Larkin. NOES: None. ABSENT: Crabb, Letson. THE RESOLUTION WAS ADOPTED. ZONING STUDY - Beach Boulevard and Slater Avenue area Associate Planner Kenneth Reynolds presented studies of the Master Plan and Zoning plan for the area bounded by Beach Boulevard, Slater Avenue, Newland Street and Talbert Avenue. The studies had been requested by the Commission as a result of a request for an R-2 Zone within this area. A letter from the Ocean View School District was read which indicated that an additional school site will probably be needed in this area in the future. Deputy Director of Public Works Bill Hartge discussed the problems of sewage disposal from this area and indicated that several alternate_ solutions are possible. Some type of additional sewer capacity will probably be needed regardless of the type of future development within the study area. It was the concensus of the Commission that the studies were suitable for consideration at a public hearing. THE MOTION BY KAUFMAN WAS SECONDED BY MILLER'TO ADOPT THE NECESSARY RESOLUTIONS OF INTENT TO AMEND THE MASTER PLAN OF LAND USE -.STUDY AREA II and TO INITIATE A CHANGE OF ZONE TO EFFECTUATE THE MASTER PLAN AS SUGGESTED -BY THE STUDY. ABSENT: Crabb, Letson, THE RESOLUTION WAS ADOPTED. ZONE CASE NO 451 - Marell Homes The Planning Director explained that this zone case had been continued from the last meeting of the Commission for consideration of studies presented as the previous agenda item. It was the concensus that the zoning of this parcel would be affected by the zoning of the general area and that the zoning of the entire area should be considered. THE MOTION BY WORTHY WAS SECONDED BY BAZIL TO DEFER ACTION UNTIL JUNE 16,, 1964. ROLL CALL VOTE: AYES: Bazil, Kaufman, Worthy, Miller, Larkin. NOES: None. ABSENT: Crabb, Letson. THE MOTION CARRIED. DISCUSSION - Use Permits for apartments The Planning Director' requested the opinion of the Commission as to reasonable re- quirements that could be applied to Use Permits for large apartment projects. It was explained that the Staff needs this type of information to assist in ansye ng�,-inquiries received at the office. It was the concensus of the Commission that the Staff could point out the past actions of the Commission in such cases but that any firm policy would be dependent upon the Council action on the revised "R" Zones and the new requirements contained therein. USE VARIANCE NO UV 5355 - Orange County The Planning Director presented Use Variance No UV 5355 referred to the Commission by the Orange County Planning Commission. The application is for construction of apartments on 6th Street in Sunset Beach. After a lengthy dis- cussion, THE MOTION BY BAZIL WAS SECONDED BY WORTHY TO RECOMMEND TO THE COUNTY PLANNING COMMISSION THAT UV 5355 BE DENIED FOR THE FOLLOWING REASONS: 1. The density is greater than that permitted even under County R-3 Zone. 2. One parking space per unit is inadequate. 3. Excessive amount of building on an extremely small lot. 5. It appears rather obvious that the plan was designed in such a way that by simply locking two doors an extra two units could be created and by very minor additions on the thrid floor still another two units could be created to make a total of eight units. ORDINANCES re OUTDOOR ADVERTISING STRUCTURE Associate Planner Kenneth Reynolds briefly reviewed the past ordinance- recommendations for limitations and gradual elimination of non -conforming advertising structures and signs. It was noted that the previously proposed ordinances had not, -been adopted by the Council. After discussion, it was the concensus that because of the great many non -conforming signs it would be well to give consideration to a provision for amortization of existing signs and their eventual removal. The Staff was instructed to prepare a draft of such provisions for future consideration. MASTER PLAN OF LAND USE - STUDY -AREA III _J�11- The Commission considered the revis!W'oVTVfi_1e'�ter Plan of Land -Use - Study Area III which had been continued from a previous meeting. RESOLUTION NO.441 A Resolution of the City Planning Com- mission Recommending approval of Zone Case No 441 to the City Council. THE MOTION BY BAZIL WAS SECONDED BY WORTHY TO ADOPT RESOLUTION -NO 441 RECOMMENDING ADOPTION OF ZONE CASE 441 TO THE CITY COUNCIL. ROLL CALL VOTE: AYES: Bazi1, Kaufman, Worthy, Miller, Larkin. NOES: 'None. ABSENT: Crabb, Letson. THE RESOLUTION WAS ADOPTED. Planning Commission Tuesday, May 26, 1964 STANDARDS FOR CONDOMINIUM AND PLANNED DEVELOPMENT -PROJECTS The Commission discussed the reports from the Orange County Planning Study Committee of suggested standards for condominium and planned development projects. There was also considerable discussion on various types of developments and whether or not projects should be approved which subdivide the land into small lots. It was the concensus that the matter warrants further serious con- sideration. The Commission also reviewed the adopted policy standards -of requirements for condominium and planned developments. THE MOTION BY WORTHY WAS SECONDED BY MILLER TO AMEND THE STANDARDS BY ADDING PROVISIONS TO RE QUIRE CONCRETE CURBS ON ALL PRIVATE STREETS, ALL UNDERGROUND UTILITIES, ADEQUATE LIGHTING OF ALL COMMON AREAS AND A REVIEW OF CC & R's BY THE PLANNING DEPARTMENT AND CITY ATTORNEY. INTERPRETATION OF S 9421.14 A letter was read re- questing an interpretation of S 9421.14 regarding pre-school day nurseries in the C-4 Zone. The section provides that educational institutions are permitted. THE MOTION OF KAUFMAN WAS SECONDED' BY WORTHY THAT THE PROVISIONS OF S 9421.14 ARE INTERPRETED TO INCLUDE PRE-SCHOOL DAY NURSERIES.
