Mayor Shipley called the regular adjourned
meeting of the City Council
of the City of Huntington Beach to order
at 7:30 o'clock P.M.
The Pledge of Allegiance was given by all
present in the Council
Chamber.

PAYROLL REGISTER
On motion by Stewart, seconded by Gisler,
Council approved the Payroll Register for
June 25, 1964, on recommendation of the Finance Committee. Motion
carried.
o WARRANT REGISTER
On motion by Stewart, seconded by Gisler,
Council approved the Warrant Register for
June 29, 1964, subject
to examination and approval of the Finance
Motion carried.

� REQ TO BLOCK OFF
The Mayor presented a request from Mrs. Joan
STREET GRANTED
Eades, 6461 Roberts Drive (Prestige Homes),
requesting that their block on Roberts Drive
be closed between 4:30
and 10 P.M. on the Fourth of July, for a
neighborhood party.
On motion by Gisler, seconded by Welch,
Council granted permission
to Mrs. Eades and residents of Robert
Drive to close their street
to thru traffic for a neighborhood party
on the Fourth of July
between 4:30 and 10 P.M. Motion carried.
ORAL COMMUNICATIONS
�9nHELEN SUSMAN Mrs. Helen Susman addressed the Council on
H B PLAYHOUSE behalf of the Huntington Beach Playhouse,
Inc. and requested that the Clerk read a
letter from Building Director Cleveland to the Playhouse group. The
Clerk read the letter regarding a request for approval of temporary
sanitary facilities and waiver of building permit fees on a barn
being improved on Huntington Beach Company Ranch property for play
rehearsal purposes.
On motion by Stewart, seconded by Welch,
Council granted permission for use of temporary sanitary facilities
as requested, with a one-year time limit stipulated, anddirected
/that building fees be waived. Motion carried.
47 GEORGE ARNOLD Mr. George Arnold, 525 Acacia Street, City,
PARADE REQUEST addressed the Council and requested per-
mission to pass out candy from a,bicycle
in the parade on July Fourth, stating that such permission had been
refused him by the parade committee, because of the danger of hitting
children. Mr Arnold was asked to meet with Mr. Mark Downing, Chairman
of the Committee, to work out a possible solution.

PANE CRANDALL Mrs. Jane Crandall, 211 Walnut, City,
,4 TITER COMPLAINT addressed the Council to issue a complaint
regarding parking meters located in front
of°her residence on Walnut Avenue, stating that her family had 2
cars and no place to park them. Assistant City Administrator Castle
explained the summer parking problems which exist, and referred Mrs.
Crandall to the Police Department for possible solution.

6th & 7th St The,Director of Public Works addressed_ the
METERS DENIED Council and informed them that he had
studied a request from a resident that
parking meters be installed on portions of 6th & 7th Streets, near
Ocean Avenue, and recommended that the request be denied.
On motion by Lambert, seconded by Welch,
Council denied the request for parking meters on portions of 6th
and 7th Streets, near Ocean Avenue, on recommendation of the
Director of Public Works. Motion carried.
AWATER WELL NO 3 The Clerk presented a communication from
IFORCE ACCOUNT the Director of Public Works presenting
informal bids received for the construction
and installation of Water Well No. 3
through use of force account; recommending acceptance of a low bid
from A. H. Famularo, for the engineering construction in the amount
of$5,300, and from Baum for the electrical construction in the amount
of $2,527; and further recommending that the bid of Scott Brothers
for sewer encasement in the amount of $1,000, or a bid in a lesser
amount for this item, be approved.
On motion by Lambert, seconded by Gisler,
Council directed the Director of Public Works to proceed with the
construction of Water Well #3, as recommended. Motion carried.

0HIBATA RANGE A motion was made by Welch and seconded by
�,RRETRO - 12/1/63 Gisler, to make the employment of George
Shibata in Range 47-C retroactive to Decem-
ber 1, 1963, with pay 8b this range to start on July 1, 1964,
Councilman Welch withdrew his motion and Councilman Gisler his
second, prior to action being taken on the motion.
On motion by Welch, seconded by Gisler,
Council adopted Resolution No. 2002 - "A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF HUNTINGTON BEACH AUTHORIZING THE APPOINTMENT
OF THE ASSISTANT CITY ATTORNEY AT A COMPENSATION GREATER THAN THE
MINIMUM COMPENSATION FIXED AND DETERMINED BY ORDINANCE, RETROACTIVE
TO DECEMBER 1, 1963,4' which had heretofore been submitted to the
Council and read by them, was passed and adopted by the following
roll call vote:

0 FIRE DEPT The Clerk presented a letter from the Fire
PROMOTIONS Chief requesting promotion of James
Gerspach, William Andrew, Robert Schuler,.
William Hermstad, James Lacy and Oakley Lauer to Fire Engineer,
Range 38 in the appropriate step, and further requesting the re-
classification of Mrs. Carrie A. Cowling as Principal Clerk, Range
33-C, all to be effective July 15, 1964.
On motion by Lambert, seconded by Welch,
Council approved the promotions of James Gerspach, William.Andrew,
Robert Schuler, William Hermstad, James Lacy and Oakley Lauer to
Fire Engineer, Range 38 in the appropriate Step; and directed the
City Attorney to,prepare an Ordinance amending the Ordinance Code
and allocating the position of one Principal Clerk in the Fire
``yy����Department. Motion carried.
�'"F.D. HOSEMEN The Clerk presented a letter from the Fire
EMPLOYED Chief requesting permission to employ Don
Shusta, Gary Wheeler, Frank Kelley, William
Swan, Gary Holdgr, Edward Vasile, Kenneth Van Doren, William Perry
and Larry Webb as Fireman Hoseman, Range 37-A, effective July 1, 1964.
On motion by Lambert,seconded by Gisler,
Council authorized the employment of the above named men as Fireman
Hoseman in Range 37-A, effective July 1, 1964. Motion carried.
BRAD HOUGH EMP The Clerk presented a letter from Acting
S�P.D. - TRIAL Chief of Police Seltzer, requesting per-
mission to employ Bradley Hough on a trial
basis to fill the vacancy in the Police Department created by the
death of Policeman Charles Martin.
On motion by Lambert, seconded by Gisler,
Council authorized the employment of Bradley Hough on a one year
trial basis, in Range 37, Step A, effective July 1, 1964. Motion
carried.
J�D INTERVIEWS On motion by Stewart, seconded by Lambert,
DEFERRED Council deferred action on a request from
the Acting Chief of Police for permission
to interview police candidates for positions allocated in the Police
Department budget, until the Poliwe Chief appointment was made.
Motion carried.
10 ORDINANCE 1073 The Clerk gave Ordinance No. 1073 a first

CITY OF HUNTINGTON BEACH RELATING TO PARK-
ING METER FINES; DECLARING AN EMERGENCY TO EXIST AND AMENDING SECTION
6541.3 OF THE HUNTINGTON BEACH ORDINANCE CODE."
RENTAL AGMT - COUNTY The Assistant City Administrator presented
OLD FIRE STATION BLDG a revised lease between the City of Hunting-
ton Beach and the County of Orange on the
civic center fire station building increasing the amount of the
monthly rental, and recommended that Council approve the rental
agreement as revised, and authorize its execution.
4W On motion by Stewart, seconded by Gisler,
Council approved ,the revised lease between the City and County of
Orange for the rental of the civic center fire station building, and
authorized..the Mayor and City Clerk to execute same on behalf of the
City. Motion carried.

BIDSON PAINT At the Council meeting of June 15, 1964,
STRIPING MACHINE Council deferred action on the bids for
a line -striping paint machine, for study.
The Purchasing Agent presented a recommendation from the Director of
Public Works and the Purchasing Department, recommending the purchase
of the Mark -Rite Model 10,000 Imperial, manufactured by Unimasco,
Inc. of Gardena, California, as said machine was the only machine
meeting the requirements of the City. The following bids were pre-
sented:

On motion by Welch, seconded by Gisler,
Council authorized the Purchasing Agent to purchase a line -stripe
paint machine from Unimasco, Inc, in the amount of $ 9,172.80,
including all applicable taxes. Motion carried.
�BIDS - STREET The Purchasing Agent presented bids on a
SWEEPER street sweeping machine for the Street
Department, requesting approval of the
purchase of the machine offered by the low bidder, Wayne Sweeper Co.,
and informing ouncil that the Director of Public Works also recommends
purchase of this machine. The bids presented were as follows:
Mobil Sweeper - (2-Engine)
Wayne Sweeper - (Single Engine)
$ 10,050, Plus tax
$ 9,675, Plus tax
On motion by Gisler, seconded by Stewart,
Council authorized the Purchasing Agent to purchase a street
sweeping machine from Wayne Sweeper for the low bid of $9,675, plus
%�ax. Motion carried.
VACATION DAY The Assistant City Administrator presented
h PPR - MR ARGUELLO a communication from Frank B. Arguello,
Finance Director, requesting permission to
take one day vacation on July 6, 1964.
.. On motion by Stewart, seconded by Gisler,
Council approved the request of Mr. Arguello, and granted him one
vacation day to be taken July 6, 1964. Motion carried.
V,0 PUBLIC HEARING Mayor Shipley announced that this was the
Z C 418 WITHDRAWN day and hour set for a public hearing
on Resolution No. 418 of the City Planning Commission, recommending
denial of Zone Case No. 418 on property situated at the northwest
corner of Goldenwest Street and Heil Avenue, and directed the Clerk
to read the legal notice.
The Clerk read notice of public hearing on
Zone Case No. 418, as published in the.Hunting�on Beach News on
June 4, 1964, setting the hour of 7:30 o'clock P.M,, or as soon
thereafter as possible, on Monday, the 29th day of ,dune, 1964, in
the Council Chamber of the City Hall, Huntington Beach, California,
as the time and place for a public hearing for the purpose of
considering a petition for a change of zone to regulations of the
Districting Ordinance, from: A-1-X General Agricultural District,
as adopted by Interim Ordinance No. 668; to: R-2 Two Family Residence
District.

The Clerk informed the Council that they
had been provided with copies of the Planning Director's transmittal
and'the Resolution of the Planning pommission, recommending denial
of Zone Case No. 418, and stated that he had received a communication
from Lon E. Peek, Sr., Applicant, requesting withdrawal4.of Zone
Case No. 418.
Mayor Shipley declared the hearing open.
Their being no one present to speak on the
matter, and there being no protests filed, either oral or written,
the hearing was closed by the Mayor.
On motion by Stewart, seconded by Gisler,
Council approved the withdrawal of Zone Case No. 418. Motion carried.
RECESS TO A motion was made by Welch, seconded by
MEMORIAL HALL Gisler, to move the meeting to Memorial
Hall. The motion and second were withdrawn.
Attorney Dale Heinly of Santa Ana, addressed
the Council and demanded that the hearing be held in the Council
Chamber.
City Attorney Plunkett informed the Council
that they had a legal right to move the meeting.
Wes Warvi addressed the Council on behalf
of the Homeowners Associations, and requested that opportunity be
given for everyone to be heard.
On motion by Welch, seconded by Gisler,
Council adjourned to Memorial Hall for the balance of the meeting,
for convenience of the public. Motion carried.
Mayor Shipley called a recess of the Council
at 8:35 P.M. to move the meeting to Memorial Hall.
RECONVENED The Meeting was reconvened at 8:43 P.M. in
Memorial Hall, by the Mayor.
Y%-' PUBLIC HEARING Mayor Shipley announced that this was the
Z C 455 - WITHDRAWN day and' hour set for a public hearing
on Resolution No.-455 of the City Planning
Commission, recommending approval of Zone Case No. 455, on property
situated south of Garfield Avenue on the east side of Cannery Street,
and directed the Clerk to read the legal notice.
The Clerk read notice of public hearing on
Zone Case No. 455, as published in the Huntington Beach News on June
18, 1964, setting the hour of 7:30 o'clock P.M., or as soon there-
after as possible, on Monday, the 29th day of June, 1964, in the
Council Chamber of the City Hall, Huntington Beach, California, as
the time and place for a public hearing for the purpose of consider
ing a petition for a change of zone to regulations of the Districting
Ordinance, from: R-4-Y Suburban Residential District, as adopted by
Interim Ordinance No. 672, to: R-2 Two Family Residence District.
The Clerk informed the Council that they
had been provided with copies of the Planning Director's transmittal
and the Resolution of the Planning Commission, recommending approval
of Zone Case No. 455, and stated that he had received a communication
from Voorheis-Trindle-Nelson, Inc. - authorized agents for Dorothy
E. Lamb, et al, requesting withdrawal of Zone Case No. 455.
Mayor Shipley declared the hearing open.
There being no one present to speak on the
matter, and there being no protests filed, either oral or written,
the hearing was closed by the Mayor.

Council approved the withdrawal of Zone Case No. 455. Motion carried.
PUBLIC HEARING Mayor Shipley announced that this was the
V ZC 441 - APPROVED day and hour set for a public hearing on
Resolution No. 441 of the City Planning
Commission, recommending approval of Zone Case No. 441, proposing
to amend the Master Plan of Land Use, covering property locat d
generally north of Ellis Avenue, west of Goldenwest Street an3
South of Bolsa Avenue, and directed the Clerk to read the legal
notice.
The Clerk read notice of public hearing on
Zone Case No. 441, as published in the Huntington Beach News on
June 4, 1964, setting the hour of 7:30 o'clock P.M., or as soon
thereafter as possible, on Monday, the 29th day of June, 1964, in
the Council Chamber of the City Hall, Huntington Beach, California,
as the time and place for a public hearing for the purpose of
considering an amendment to the Master Plan of Land Use by adopting
an amendment entitled "Master Land Use Plan - Study Area III,"
The Clerk informed the Council that they had
been provided with copies of the Planning Director's transmittal and
the Resolution of the Planning Commission, recommending approval of
Zone Case No. 441, and stated that he had received no communications
or written protests to the Zone Case or to the recommendation of
the Planning Commission.
Mayor Shipley declared the hearing open.
There being no one present to speak on the
matter, and there being no protests filed, either oral or written,
the hearing was closed by the Mayor.
Planning Director Warner addressed the
Council and gave a resume' of the Planning Qommission's reasons for
recommending approval of this amendment to the Master Plan of Land
Use.
On motion by Lambert, seconded by Welch,
'Council concurred with the recommendation of the '.'Planning Commission,
and approved Zone Case No. 441, and directed the Attorney to pre-
pare a Resolution amending the Master Plan of Land Use. Motion
carried.
PUBLIC HEARING Mayor Shipley announced that this was the
ZC 448 - DENIED day and hour set for a public hearing on
Resolution No. 448 of the City Planning
Commission, recommending denial of Zone Case No. 448, located on
three lots situated between Sandra Lee Street and Marina View Way,
north of Los Patos Street, in the Sunset Heights area, and directed
the Clerk to read the legal notice.
The Clerk read notice of public hearing on
Zone Case No. 448, as published in the Huntington Beach News on
June 4, 1964, setting the hour of 7:30 o'clock P.M., or as soon
thereafter as possible, on Monday, the 29th day of June, 1964, in
the Council Chamber of the City Hall, Huntington Beach, California,
as the time and place for a public hearing for the purpose of con-
sidering a petition for a change of zone to regulations of the
Districting Ordinance from: R-1 Single Family Residence District,

�OPUBLIC HEARING Mayor Shipley announced that this was the
Z C 454 - DENIED day and hour set for a public hearing on
Resolution No. 454 of the City Planning
Commission, recommending,approval of Zone Case No. 454, on property
situated between Warner Avenue and Sandra Lee Street, north of Los
Patos Street, in the Sunset Heights Area, and directed the Clerk to
read the legal notice.
The Clerk read notice of public hearing on
Zone Case No. 454, as published in the Huntington Beach News on
June 4, 1964, setting the hour of 7:30 o'clock P.M., or as soon
ther after as possible, on Monday, the 29th day of June, 1964, in
the after
Chamber of the City Hall, Huntington Beach, California,
as the time and place for a public hearing for the purpose of con-
sidering a petition for a change of zone to regulations of the
Districting Ordinance, from: R-1 Single Family Residence District,
to: R-3 Limited Multiple Family Residence District.
The Clerk informed the Council that they
had been provided with copies of the Planning Director's transmittal
and the Resolution of the Planning Commission, recommending approval
of Zone Case No. 454, and read 22 protests which he had received
concerning said Zone Case.
Mayor Shipley declared the hearing open.
The following citizens addressed the Council
to protest the requested R-3 zoning in their area:

Chester Osgood, Jr., 4592 Orion Street
Laura Tinkler, Block J - Sunset Heights area
Howard Payne, 16721 South Pacific Coast Highway, Sunset Beach
Gerald Jones - Block M - Sunset Heights area
Kent Wilson, Long Beach
Mr. Roberts, Seal Beach, addressed the
Council to inquire as to the allowances in R-3 Zones.
Mr. Jack Koebig of Garden Grove, and Mr.
Joe Evans of 16121 Sims Street, City, addressed the Council request-
ing that the Zone Change be granted.
There being no one further present to speak
on the matter, and there being no further protests filed, either oral'
or written, the hearing was closed by the Mayor.
Planning Director Warner addressed the
Council and gave a resume' of the Planning Commissions reasons for
intitiating the change of zone.
On motion by Lambert, seconded by Stewart,
Council overruled the Planning Commission and denied Zone Case No.
454. Motion carried.

#,WUBLIC HEARING Mayor Shipley announced that this was the
�'UNIF BLDG CODE day and hour set for a public hearing on
Ordinance No. 1064 of the City Council,
proposing to adopt the "Uniform Building Code, 1964 Edition, Volume
1, International Conference of Building Officials", by reference,
and directed the Clerk to read the legal notice.
The Clerk read notice of public hearing on
Ordinance No. 1064 as published in the Huntington Beach News on June
4, 1964, setting the hour of 7:30 o'clock P.M., or as soon thereafter
as possible, on Monday, the 29th day of June, 1964, in the Council
Chamber of the City Hall, Huntington Beach, California, as the time
and place for a public hearing for the purpose of considering
Ordinance No. 1064, "An Ordinance of the City of Huntington Beach
adopting the "Uniform Building Code, 1964 Edition, Volume 1, Inter-
national Conference of Building Officials"; by reference: providing
regulations relating to buildings and structures within the City of
Huntington Beach; providing for issuance of permits and collection
of fees therefor; declaring and establishing fire districts; providing
penalties for the violation therof and repealing all Ordinances and
parts of Ordinances in conflict therewith."
The Clerk stated that he had received no
communications or written protests to the proposed adoption of Ordinance
No. 1064.
Mayor Shipley declared the hearing open.
There being no one present to speak on the
matter, and there being no protests filed, either oral or written,
the hearing was closed by the Mayor.
On motion by Stewart, seconded by Lambert,
Council directed the Clerk to proceed with the first reading of
Ordinance No. 1064. Motion carried.
Oki PUBLIC HEARING Mayor Shipley announced that this was the
APPEAL - UP 239 day and hour set for a public hearing on
an appeal to the granting by the City
Planning Commission of Use Permit - UP #239, filed by Mr. Arthur
J. Aune, Attorney for Mark Downing Ford, Inc., on property located
on the west side of Beach Boulevard, approximately 600 feet south of
Main Street, and directed the Clerk to read the legal notice.
The Clerk read notice of public hearing on
an appeal to the granting by the City Planning Commission of Use
Permit - UP #239, as published in the Huntington Beach News on June
4, 1964, setting the hour of 7:30 o'clock P.M., or as soon thereafter
as possible, on Monday, the 29th day of June, 1964, in the Council
Chamber of the City Hall, Huntington Beach, California, as the time
and place for a public hearing for the purpose of considering an appeal
to the granting by the Planning Commission of Use Permit - UP #239,
to regulations of the Districting Ordinance, to allow the sale and/or
exchange;'Of new and used cars with minor repair shop in the C-4
Highway Commercial District.
The Clerk informed the Council that they
bad been provided with copies of the appeal filed by Mark Downing
Ford Company, and read five letters requesting the Use Permit be
allowed, stating that he had received no further communications or
written protests to the Use Permit.
Mayor Shipley declared the hearing open.
Mr. Mark Downing, 8632 Laura Circle, City,
addressed the Council and requested that the Use Permit be denied.

Attorney Arthur J. Aune, Santa Ana, address-
ed the Council and requested that the Use Permit be denied; and if
not, that stringent restrictions be imposed to protest the rights of
adjacent property owners.
Don Jones of Paul Jones Realty, addressed
the Council and requested that the Use Permit granted be allowed.
Otto Tyson, 9341 Greenwich Drive, City,
addressed the Council and stated that he favored allowing UP #239.
Mr. Charles Diercksmeier, Realtor, 19871
Chesapeake, City, addressed the Council and request that Use Permit
#239 be granted.
There being no one further present to speak
on the matter, and there being no further protests filed, either
oral or written, the hearing was closed by the Mayor..
On motion by Stewart, seconded by Lambert,
Council upheld the Planning Commission and granted Use Permit - UP
#239. Motion carried.
RECESS Mayor Shipley called a recess of the
Council at 10:05 P.M.
RECONVENED. Council was reconvened at 10:25 P.M. by
the Mayor.
�A PUBLIC HEARING Mayor Shipley announced that this was the
Z C 453 - APPROVED day and hour set for a public hearing on
Resolution No. 453 of the City Planning
Commission, recommending approval of Zone Case No. 453, on property
bounded by Yorktown Avenue, Brookhurst Street, Adams Avenue and
Bushard Street, and directed the Clerk to read the legal notice.
The Clerk read notice of public hearing
on Zone Case No. 453, as published in the Huntington Beach News on
June 4, 1964, setting the hour of 7:30 o'clock P.M., or as soon
thereafter as possible, on Monday, the 29th day of June, 1964,
in the Council Chamber of the City Hall, Huntington Beach, California,
as the time and place for a public hearing for the purpose of con-
sidering an amendment to the Master Plan of Land Use by adopting an
amendment entitled "Master Land Use Plan - Revised - Study Area I''.
The Clerk informed the Council that they
had been provided with copies of the Planning Director's transmittal
and the Resolution of the Planning Commission recommending approval
of Zone Case No. 453; read communications from Sylvan Y. Allen,
Homebuilders Association, Southwest Savings & Loan Association,
Van Nuys Savings and Loan Association, and California Federal Savings,
protesting the proposed amendment to the Master Plan; and stated that
he had received no further protests to the Zone Case or to the
recommendation of the Planning Commission.
Mayor Shipley declared the hearing open.
Dale Heinly, Attorney representing Sub-
stantial Homes, Ltd. addressed the Council and stated that his client
had borrowed money to purchase property covered in Zone Case #453 on
the assurance of the R-2 Zoning previously allowed by the Council.
Mr. Heinly requested that protests to his clients development be
limited to those residents within 300' of the property involved.
Mr. Hy Tan, Fullerton, Architect for
Substantial Homes, Ltd. presented plans for proposed development
and facts concerning proposed density.

and requested that Council overrule the Planning Commission and deny
the change of zone.

the cluster development of Substantial Homes, Ltd. and requested

There being no one further present to speak on the matter,
and there being no further protests filed, either oral or written,
the hearing was closed by the Mayor.
Planning Director Warner addressed the Council and gave
a resume' of the Planning Commission's reasons for approving the
proposed amendment to the Master Plan in Zone Case No. 453.
On motion by Lambert, seconded by Stewart,
Council approved-rhe recommendation of the Planning Commission, and
directed the City Attorney to prepare a Resolution adopting the Master
Land Use Plan - Revised - Study Area I, in Zone Case No. 453. Motion'
carried.
ADJOURNMENT On motion by Gisler, seconded by Stewart,
the regular adjourned meeting of the City
