HomeMy WebLinkAbout1964-07-13379 rIIZLot v Council Chamber, Huntington Beach, Monday, July 13, City Hall California 1964 Mayor Shipley called the regular adjourned meeting of the City Council of the City of Huntington Beach to order at 7:30 o'clock P.M. The Pledge of Allegiance was given by all present in the Council Chamber. ROLL CALL Councilmen Present: Gisler, Stewart, Lambert, Shipley Councilmen Absent: Welch PAYROLL REGISTER On motion by Stewart, seconded by Gisler, Council approved the Payroll Register for July 13, 1964, on recommendation of the Finance Committee. Motion carried. HEIL ANNEXATION The Clerk presented a Resolution No. 1959 HEARING DEFERRED of the City Council on proposed annexation of Uninhabited Territory designed as "Heil Annexation." He informed the Council that since the Superior Court of Orange County had issued a restraining order against the City of Huntington Beach to temporarily prevent any further action in this annexation, and since such restraining order had not been dissolved, the hearing could not be held and should be continued to the meeting of July 20, 1964. On motion by Lambert, seconded by Stewart, Council deferred the public hearing of Resolution No. 1959 of the City Council on the proposed annexation of territory designated "Heil Annexation," to the meeting of July 20, 1964. Motion carried. ,�JJ FINAL ADOPTION The Clerk presented a transmittal from the TRACT MAP #5581 City Planning Director, submitting final form of Tract Map #5581 for adoption: Developer: Security Fore Corporation, Costa Mesa; Engineer: Moote, Kempa & Galloway, Inc; Location: South side of Atlanta Avenue, 545 feet east of Beach Boulevard; Legal Description: Being a proposed subdivision of a portion of the W2 of the NEk of Section 13-6-11; Number of Lots: 330; Total Acreage: 32.488; that the map had been certified by the City Engineer and the Planning Director to be true and correct in accordance with provisions of the City Subdivision Code. The City Council may accept dedication as shown on the map and in addition approve the final map, subject to the following conditions: The City Clerk's signature shall be with- held pending the submittal and completion on the enumerated requirements. 1. Deposit of fees for water, sewer, drainage, engineering and inspections. 2. Bond for improvements. 3. Signature of agreement. 4. Certificate of Insurance. 5. Approval from County Surveyor. 6. Bond for monuments. The City Attorney presented a resume' of facts concerning Tentative Tract Map No. 5581, and an opinion informing Council that all City Ordinance Code requirements had been met, and that the Tentative Map should therefore be approved. -1- (7/13/64) Page #2 - Minutes, July 13, 1964 On motion by Lambert, seconded by Stewart, Council accepted the dedications as shown on Final Tract Map #5581, and adopted the map subject to compliance with conditions stipulated by the Planning Commission. Motion carried. SECURITY FORE On motion by Lambert, seconded by Stewart, DEED ACCEPTED Council accepted a deed for a D-1 Channel right-of-way, from Atlanta Avenue southerly 1300', from Security Fore Corporation to the City. Motion carried. �Io PUBLIC HEARING Mayor Shipley announced that this was the ��-UV #727 UPHELD day and hour set for a public hearing on an appeal to the granting of Use Variance -- UV #727 by the City Planning Commission, to allow the construction of a hospital center, on property located at the southeast corner of Newman Street and Beach Boulevard, and directed the Clerk to read, the legal notice. The Clerk read notice of public hearing on Use Variance - UV #727, as.published in the Huntington Beach News on June 18, 1964, setting the hour of 7:30 o'clock P.M., or as soon thereafter as possible, on Monday, the thirteenth day of July, 1964, in the Council Chamber of the City Hall, Huntington Beach, California, as the time and place for a public hearing for the purpose of considering an appeal to the granting by the Planning Commission of Use Variance - UV #727, to regulations of the Districting Ordinance, to allow the construction of a hospital center, with medical facilities, in the R4-X suburban Residential District. The Clerk read letters submitted for and against the granting of the Use Variance. Mayor Shipley declared the hearing open. Mr. Brad Mock addressed the Council and requested that the meeting be recessed to Memorial Hall to accomodate the standing crowd. On motion by Stewart, seconded by Gisler, Council recessed and moved to Memorial Hall at 7:55 P.M. Motion carried. Council was reconvened at 8:05 P.M. by the Mayor. Mr. William Power, of Power, Inc., applicant for UV #727 addressed the Council and gave a resume' on the proposed hospital, stating that he felt, that as a private enterprise, they should be allowed to continue with the plans which will give the City the hospital they need at the time they need it. On motion by Lambert, seconded by Gisler, Council upheld the decision of the�Planning Commission and granted Use Variance - UV #727 to Powers; Inc, to allow the construction of a private hospital in the City, by the following roll call voter AYES: Councilmen: Gisler, Stewart, Lambert, Shipley NOES: Councilmen: None ABSENT: Councilmen: Welch , ADJOURNMENT On motion by Lambert, seconded by Gisler, TO 7/15/64 the regular adjourned meeting of the City Council of the City of;Huntington Beach adjourned to Wednesday, July 15, 1964, at 7:00 1.M.
