Monday, July 20, '1964
Mayor Shipley called the regular meeting of
the City Council of the City of Huntington Beach to order at 7:30
o'clock P.M.
The Pledge of Allegiance was given by.all
present in the Council Chamber.
The Invocation was given by Rev. Arlie
Starn, Minister of the Church of God, Huntington Beach.
ROLL CALL Councilmen Present: Welch, Gisler, Stewart, Lambert,
Shipley
Councilmen Absent: None
MINUTES APPROVED On motion by Lambert, seconded by Gisler,
the minutes of the regular meeting of
July 6, 1964, and the regular adjourned meeting of ,July 13, 1964,
were approved as transcribed and mailed. Motion carried.
4J1b DEPT REPORTS On motion by Stewart, seconded by Welch,
the reports of the Chief of Police, City
Collector, City Treasurer, and Chamber of Commerce:Manager were
approved and ordered filed. Motion carried.
9 ALASKA MALAMUTE SLED DOG A letter from David Sanders, 17452 Marken
ASSN REQ LAKE PARK FAC Lane, City, requesting use of -Lake Park
facilities from: 1:-OO1ap.M. to 7 :00 P.M. on
Sunday, August 16, 1964, to hold a family picnic and' puppy match for
the Alaskan Malamute Sled Dog Association, was presented for Council
consideration.
On motion by Lambert, seconded by Gisler,
Council granted permission to the Alaskan Malamute Sled Dog Associ-
ation to hold a picnic and puppy match in Lake Park on August 16,
1964, subject to posting insurance as required by City Policy.
Motion carried.
DRAKE - LTTR PROTEST On motion by Welch, seconded by Stewart,

Circle, Westminster, calling attention to
the dangerous sport of skimming on plywood boards on public beaches,
was received and ordered filed. Motion carried.

Association calling attention to a dangerous
traffic situation at the corner of Cannery Street and Hamilton
Avenue, was referred to the Traffic Engineer for study and report.

TRAFFIC SIGNS a letter from Ben and Willi Barnum, 201 -
Teuth Street; City, regdesting Council to
authorize the installation of "Yield" right-of-way or stop signs in
the area bordered by Main Street, Seventeenth Street and Ocean
Avenue, was referred to the Traffic Engineer and `the Director of
Public Works for study and report to Council. Motion carried.
�0 HB SAFETY COUNCIL On motion by Welch, seconded by Gisler, a
RE: SAFETY OF BEACH BLVD letter from the Huntington Beach Safety
Council, recommending that the City take
steps to correct hazardous conditions as a result of speed and
traffic on Beach Boulevard, was referred to the Traffic Engineer and
the Director of Public Works for study and report to the Council.

Hostess Service of Arcadia, concerning the
denial of a business license for their concern to operate in the
City, was referred to the City Attorney to answer. Motion carried.
##HUNT CONT TOWN ASSN On motion by Lambert, seconded by Stewart,
�41REQ CONTROL OF TRAFFIC a letter and petition from the Huntington
Continental Townhouse Association requesting
the City to control traffic within their area, was received by the
Council. Motion carried.
BERLINER - RE: On motion by Welch, seconded by Gisler, a
RESTRICTIONS ON PROPERTY letter from Norman S. Berliner, Attorney of
Los Angeles, concerning the restrictions
placed by the Subdivider on property designated as "American Pre-
Fabs, Inc., - Tract 4026" as per map recorded in Book 142, Pages
25 and 26, Miscellaneous Records, Orange County; was referred to the
City Administrator and City Attorney to answer and show conditions
stipulated in acceptance of the tract. Motion carried. „
061PUBLIC HEARING On motion by Lambert, seconded by Stewart,
DENIAL TENT TRACT MAP #5613 Council ordered a public hearing for
Monday, August 3, 1964, at 7:30 o'clock
P.M. or as soon thereafter as possible, on an appeal from Dale H.
H;My, Attorney, to a denial by the City Planning Commission of
Tentative Tract Map No. 5613, and directed the Clerk to publish
notice of same. Motion carried.
ST DIV BEACHES & PARKS A letter from the State Division of Beaches
REQ WATER FOR PARK and Parks, requesting Council to waive the
requirements of an area being in the City
in order to receive water, in connection with the Bolsa Chica State
Park was presented for Council consideration.
On motion by Stewart, seconded by Gisler,
the City Administrator, City Clerk, and Director of Public Works
were directed to work with the State Division of Beaches and Parks
to endeavor to annex the area into the City in order to serve them
with water. Motion carried.
,rOSLATTON - LTTR On motion by Welch, seconded by Gisler, a
OF APPRECIATION letter from M�. Robert C. Slatton, City,
expressing thanks for solving some legitimate
complaints which had been made on behalf of the residents of the
Slater Avenue and Queens Lane vicinity, was received and ordered
filed. Motion carried.
to RALPH - SUBSIDIZATION On motion by Lambert, seconded by Welch,
OF CHAMBER OF C%1MERCE a letter from Mr. Zoe E. Ralph, 8341
Friesland, City, concerning the subsidization
of the Chamber of Commerce by the City, was referred to the City
Administrator to be answered. Motion carried:
o4BOXER CLUB - SA VAL A letter from the Boxer Club of Santa Ana
REQ USE OF L P FAC Valley, requesting use of Lake Park on
Sunday, November 8, 1964, for a boxer puppy
match, and also requesting permission to hold -another dog obedience
class across from Lake Park, was presented for Council consideration.
On motion by Stewart, seconded by Gisler,
Council granted permission for the Boxer Club of Santa Ana Valley to
use Lake Park on November 8, 1964, for the Boxer Puppy Match, and
also granted permission to hold a dog obedience class across from
Lake Park on property leased by the City, subject to their posting
the necessary insurance required by City Ordinance. Motion carried.

q� MATTSON PROTEST - EXCESS On motion by Welch, seconded by Stewart,
WATER IN NEIGHBORHOOD a letter from Mrs. Mattson, 17201 Ash
Street, City, protesting the excess water
running from the apartment houses in the neighborhood, was referred
to the Director of Public Works for investigation and report.
Motion carried.
�35 OV LITTLE LEAGUE A letter from the Ocean View Little League
REQ PERM FOR CARNIVAL requesting permission to hold a carnival
in the City, and requesting that fees for
same be waived, was presented for Council consideration.
Mrs. Milne, Talbert Avenue, City, addressed
the Council and gave them facts regarding the proposed carnival and
stated that other clubs were being invited to participate in the
conduct of this carnival. She informed the Council that their group
would handle all the money and that the shows they intended to use
were the Kemsley Shows.
On motion by Stewart, seconded by Gisler,
Council granted permission to the Ocean View Little'League to hold
the carnival with fees waived, subject to prior approval by the
Police Department and adequate insurance as required by City
Ordinance, being posted prior to the issuance of business license.
Motion carried.
cif PEYKE PROTEST OF On motion by Welch, seconded by Lambert,
NEW ZONING ORD, a letter from Francis L. Peyke and Yunker,
Morton and Dolley, Inc., protesting a
restrictive new zoning ordinance being considered by the Council,
was received and ordered filed. Motion carried.
PLANNING CONSULTANTS On motion by Lambert, seconded by Gisler,
a letter from Adrian Wilson and Associates
of Santa Ana, requesting consideration of Council of their firm as
architects, engineers and planners, was received and ordered filed.
Motion carried.
TAYLOR - REQ WAIVE OF USE On motion by Stewart, seconded by Welch,
); 91 PERMIT ON PROPERTY a letter from Oscar.G. Taylor, P.O. Box
725, City, petitioning Council to waive
the requirements of a Use Permit as required in the development of
his property located on the northeast corner of Walnut Avenue and
Fourteenth Street, was received and ordered filed. Motion carried.
SUPVR BAKER - ROOM TAX The Clerk read a letteCITY HAS ADOPTED ORD Supervisor, commentingrr ontheom Dadoptionvid L. Bofe� a
room tax by various cities and unincorpa-
rated areas of Orange County. Since Huntington Beach has already
adopted an Ordinance relating to this tax, on motion by Stewart,
seconded -by Gisler, the communication from Mr. Baker was received
and ordered filed, and the Clerk was directed to notify Mr. Baker
of the action. Motion carried.
"CLAIM AGAINST On motion by Lambert, seconded by Gisler,
CITY - WRIGHT a claim for property damage filed on behalf
of Mr. Robert Wright, 7891 Cypress Street,
City, for the loss of tools from his pickup truck, which was held in
custody by the Police Department on April 19, 1964, was denied and
referred to the City Attorney and the city's insurance carrier to
handle. Motion carried.
MOSSMAN - REQ-CARNIVAL Mr. Ira Mossman, addressed the Council and
WRONG CITY requested permission to hold a carnival at
Ralphs Market at the corner of McFadden and
Brookhurst Street. Mr. Mossman was informed that the territory he,
referred to was probably in the City of Garden Grove or Fountain
Valley, and no action was taken on this matter.

A)SEAHAVEN HO ASSN Mr. Wes Warvi, President of the Seahaven
REQ BEAUTIFICATION SIGNS Homeowners Association, addressed the
Council and informed them that a committee
had been appointed by their association to conduct a contest for the
improvement of property. He requested permission on behalf of the
homeowners Association to install 4" x 15" signs with the wording
"Area Beautification Award for Best Street" in three areas served by
their association. Mr. Warvi informed the Council that the signs
would be attached to street sign posts if permitted and would remain
up for a period of from one to three months.
On motion by Lambert, seconded by Stewart,
Council granted the request of the Seahaven Homeowners Association
for the installation of the beautification signs to be erected under
the supervision of the Department of Public Works. Motion carried.
,)'PUBLIC HEARING Mayor Shipley announced that this was the
ZC 457 - APPROVED day and hour set for a public hearing on
Resolution No. 457 of the City Planning
Commission, recommending approval of Zone Case No. 457, on property
situated at the southwest corner of Garfield Avenue and Brookhurst
Street, and directed the Clerk to read the legal notice.
The Clerk read notice of public hearing on
Zone Case No. 457, as published in the Huntington Beach News on
July 9, 1964, setting the hour of 7:30 o'clock P.M., or as soon there-
after as possible, on Monday, the twentieth day of July, 1964, in the
Council Chamber of the City Hall, Huntington Beach, California, as the
time and place for a public hearing for the purpose of considering a
petition for a change of zone to regulations of the Districting
Ordinance, from: Al-Y General Agricultural District as adopted by
Interim Ordinance No. 672, to: C2 Community Business District, with
setback provisions.
The Clerk informed the Council that they
had been provided with copies of the Planning Director's transmittal
and the Resolution of the Planning Commission, recommending approval
of Zone Case No. 457, and stated that he had received no communications
or written protests to the Zone Case or to the recommendation of the
Planning Commission.
Mayor Shipley declared the hearing open.
There being no one present ' to speak on the
matter, and there being no protests filed, either oral or written,
the hearing was closed by the Mayor.
On motion by Stewart, seconded by Gisler,
Council approved the recommendation of the Planning Commission, and
directed the City Attorney to prepare an Ordinance effecting the
change of zone to C2.with setback provisions in Zone Case No. 457.
Motion carried.

written, the hearing was closed by the Mayor.
On motion by Welch, seconded by Lambert,
Council approved the recommendation of the Planning Commission, and
directed that the City Attorney prepare an Ordinance effecting the
change of zone to C4 with setback provisions in Zone Case No. 459.

ZC 463 - APPROVED day and hour set for a public hearing on
Resolution No. 463 of the City Planning
Commission, recommending approval of Zone Case No. 463, on property
located north of Talbert Avenue, east of Beach Boulevard and south
of Slater Avenue, and directed the Clerk to read the legal notice.
The Clerk read notice of public hearing on
Zone Case No. 463, as published in the Huntington Beach News on
July 9, 1964, setting the hour of 7:30 o'clock P.M. or as soon
thereafter as possible, on Monday, the twentieth day of July, 1964,

directed the City Attorney to prepare an Ordinance effecting the
change of zone to R1, R2 and R3 in Zone Case No. 463. Motion

No. 464 of the City Planning Commission,
recommending approval of Zone Case No. 464 oon property situated on
the west side of Newland Street and south of Atlanta Avenue and'
directed the Clerk to read the legal notice.

9, 1964, setting the hour of 7:30 o'clock P.M., or as soon thereafter
as possible, on Monday, the twentieth day of July, 1964, in the Council

and place for a public hearing for the purpose of conidering a
Resolution of Intent, as adopted by the City Planning Commission for
a change of zone from: M1-A-0 Restricted Manufacturing District and
RA-0 Residential Agricultural District, to: RA-0 Residential

The Clerk informed the Council that they

and the Resolution of the Planning Commission, recommending approval
of Zone Case No. 464, and stated that he had received no communica-

of the Planning Commission.

Council approved the recommendation of the Planning Commission and

change of zone to M1-A-0 in Zone Case No. 464. Motion carried.

Resolution No. 465 of the City Planning
Commission recommending denial of Zone Case No. 465, on property
situated east of Bolsa Chica Street on the south side of Heil
Avenue, and directed the Clerk to read the legal notice.

Zone Case No. 465 as published in the Huntington Beach News on July 9,
1964, setting the hour of 7:30 o'clock P.M., or as soon thereafter as
possible, on Monday, the 20th day of July, 1964, in the Council Chamber

for a public hearing for the purpose of considering a petition for a
change of zone to regulations of the Districting Ordinance from: R2

with setback provisions.
The Clerk informed the Council that they

Mayor Shipley declared the hearing open.
Mr. George Kachickas, 17071 South Pacific
Avenue, Sunset Beach, owner of the property, addressed the Council
to give them facts about the development of same and to request that
the change of zone be granted.
Mr. Howard Miller, 5181 Heil Avenue, City,
addressed the Council and presented.a petition with seven names
opposing the change of zone, giving reasons for -the opposition.

Mr. George Kachickas again addressed the
Council and informed them that the property included in the zone
change requested, was not the housing developments of the people
making the protests.

PUBLIC HEARING Mayor Shipley announced that this was the
UV #663 REFER BACK TO PC day and hour.set for a public hearing on
an-a3peel to the denial by the City Council
of Conditional Exception UV 663 to allow the construction of a
planned residential development of 242 living units in the R4-Y
Suburban Residential District, and in the Al-Y General Agricultural
District, on property located on the east side of Cannery Street,
north of Indianapolis Avenue, and directed the Clerk to read the
legal notice.
The Clerk read notice of public hearing on
the appeal to the denial of UV No. 663 by the City Council as
published in the Huntington Beach News on July 9, 1964, setting the
hour of 7:30 o'clock P.M. or as soon thereafter as possible, on
Monday, the twentieth day of July, 1964; in -the Council Cumber of
the City Hall, Huntington Beach, California, as the time and place
for a public hearing to reconsider the denial by the Huntington
Beach City Council of Conditional Exception - No. 663.
The•Clerk.read a letter from S. V. Hunsaker
and Sons, requesting the City Council to reconsider Use Variance
No. 663 which had been disapproved on June 15, 1964,
Mayor Shipley declared the hearing open.
Mr. Wplly Nickel, Planning Coordinator for
S. V. Hunsaker and Sons, addressed the Council and reviewed the
action on.this parcel to date.
Mr. Richard Derby, 9121 Mediterranean Drive,
City, member of the Seahaven Homeowners Association, addressed the
Council and stated that their association was on record as being
against higher density in the area.
Following this, a discussion was held by
members of the Council on the authority of tha Council to act without
sending revisions back to the Planning Commission for further
consideration.
Mr. Warren Hall, 9381 Nantucket Drive, City,
member of the Glenmar Homeowners Association, addressed the Council
and stated that his group was against the granting of this Use
Variance.
Mr..Wes Warvi, 10401 Kakui Drive, President
of the Seahaven Homeowners Association, addressed the Council and
stated 'that his association protested the granting of this Use
Variance.

Mr. Norman Alexander, 19832 Bershire Lane,
City, President of the Huntington Continental Townhouses Association,
addressed the Council and stated that he lived in the development
which was only a half mile away from the area in question in which
there were 1,010 units in condominium development. Mr. Alexander
said that it was his feeling that this was entirely too many units
and created a density of population which was out of reason.
Mr. Derby again addressed the Council and
stated that they were all aware of the fire problems which exist in
areas where the streets are so narrow and the houses so close together,
and stated that the problem would continue to exist in the proposed
development.
Mr. Wally Nickel again addressed the Council
to answer some of the statements and charges made by -those who had
spoken in opposition to the granting of the Use Variance
Mrs. Phyllis Fox, 9381 Nautilus Drive,
addressed the Council and asked whether Police enforcement can be
maintained in these condominium developments.
She was answered by the Chief of Police, who
informed Mrs. Fox of the measures which were required in order to
insure police enforcement in these areas.

a tract map. He stated that the Council has authority to add or
delete conditions on the Variance.

connected therewith, be referred back to the Planning Commission for
further consicfation on the revised width of streets proposed by

last meeting, representing 22 property owners.

order which had been issued by the Superior Court of Orange County
against further processing of this annexation had not been listed,

of selling frozen food and freezers in the City, was presented for

This matter had been referred to the Police
Department, the City Administrator and City Clerk for study at the
meeting of July 6, 1964.
On motion by Welch, seconded by Lambert,
Council authorized the issuance of the license to Superior Food
Distributors, directing the City Administrator and City Clerk to
inform the applicant of some of the problems related to the conduct
of this type of business, and the requirements of the Ordinance Code
concerning soliciting, before issuing such license. Motion carried.
On motion by Stewart, seconded by Gisler,
Council directed that if the Ordinance Code does not cover revocation,
such business license can be revoked for violation of the business
license ordinance. Motion carried.

HAZARDOUS TRAFFIC COND Chief of Police making a report on a hazardous
situation at the intersection of Cannery Street
and Hamilton Avenue, which had been reported to the Council by Marshall
E. Papke, 9162 Christine Drive, City, at the meeting of July 6, 1964.
Chief of Police Seltzer informed the Council
that he had made a recommendation to the Director of Public Works
regarding this situation a short time before.
On motion by Stewart, seconded by Gisler,
Council referred the matter to the Public Works Department for
investigation and action on their part. Motion carried.

the Lifeguard Chief, the Recreation Director and the City Adminis-
trator as the committee to study the offer which had been made and

BTW SCHOOLS & CITY Recreation Director of Agreements between
the City and the Ocean View School District,
the Huntington Beach Union High School District, the Fountain Valley
School District, the Westminster School District, and the Huntington
Beach Elementary School District, covering cooperational recreation,
programs at the various school playgrounds.
On motion by Lambert, seconded by Stewart,
Council approved the agreements between the City and the various
schools and authorized the Mayor and City Clerk to execute the

GENERAL TELEPHONE CO Inc., of a grant of easement from the City
.of Huntington Beach to the General Telephone
Company in property on which is located the Huntington Driftwood,
Inc. Mobile Home Park, was presented for Council consideration.
On motion by Lambert, seconded by Welch,
Council approved the grant of easement and authorized the Mayor and
City Clerk to execute the documents on behalf of the City. Motion
carried.
IJb WOCWB REQ FOR A letter from the City Clerk requesting
$6,000 INCREASE M & 0 Council authorization for an increase of
$6,000.00 in the City's deposit in the
West Orange County Water Board Maintenance and Operation Fund was
presented for Council consideration.
On motion by Lambert, seconded by Stewart,
Council authorized payment of $6,000.00 to the West Orange County
Water Board Maintenance and Operation Fun d as additional deposit
for the City. Motion carried.

LIC FOR PALMISTRY application for a business license submitted
by Mr. Steve Adams for the business of
palmistry at 474 Ocean Avenue, City, was presented for Council
consideration.
On motion by Lambert, seconded by Stewart,
Council authorized the issuance of a license for palmistry to Mr.
Steve Adams at 474 Ocean Avenue, City. Motion carried.

MRS SHIRLEY C RENFRO The City Administrator informed the Council

selected for promotion to the position of
Accounting Clerk in Range 30-A with approval of the Council, and
recommended that the promotion be authorized.
On motion by Gisler, seconded by Welch,
Council authorized the promotion of Mrs. Shirley C. Renfro to
Accounting Clerk, Range 30-A, effective July 16, 1964. Motion

MISS SHERRY ANN GRANDT The Administrator -informed the Council that
f-2-'EMP TYPIST -CLERK Miss Sherry Ann Grandt had -been selected to
fill the position of typist -clerk in
Range 26-A which was vacated by Mrs. Renfro's promotion and recom-
mended that Council approve her employment.
On motion by Gisler, seconded by Welch,
Council authorized the employment of Miss Sherry Ann Grandt as
typist -clerk in Range 26-A, effective July 16, 1964. Motion carried.
MTG - HB FWY ASSN Mr. Miller informed the Council that he had
7/22/64 - WESTM received a communication for Supervisor
.14,11 Baker requesting the City to send repre-
sentative to a meeting of the Huntington Beach Freeway Association
to be held on July 22, 1964, at the Keystone Savings and Loan
Building in Westminster.
On motion by Lambert, seconded by Gisler,
Council authorized Mayor Shipley, Councilman Stewart, Public Works
Director and the City Administrator to attend the meeting of the
Huntington Beach Freeway Association on July 22, 1964. Motion
carried.
,�PAYROLL REGISTER On motion by Stewart, seconded by Gisler,
the payroll register for July 10, 1964, was
approved on recommendation of the Finance Committee. Motion carried.
WARRANT REGISTER On motion by Stewart, seconded by Gisler,
