COMMISSIONERS ABSENT: Kaufman, Miller. MINUTES: On motion by Worthy and seconded by Crabb, the Minutes of the Huntington Beach .Planning Commission of July 7, 1964, were accepted as transcribed and mailed by the Secretary. TENTATIVE TRACT MAP NO 5560 - Continued Number of Lots: 137 SUBDIVIDER: C-D Development Co. Total Acreage: 12.37 ENGINEER: Jennings-Halderman-Hood Located approximately 540, feet west of Brookhurst Street and approximately 724 feet north of Hamilton Avenue and legally described as being a proposed subdivision of a portion of the SZ, NEy., Section 18-6-10. The Staff Report was read by,the Secretary. The Secretary informed the Commission that the next item on the agenda is a variance, pertaining to Tentative Tract No 5560. It was the concensus to continue Tentative Tract No 5560 since said tract pe rtains.to Use Variance No 743 to be considered by the,Commission. CONDITIONAL EXCEPTION - UV #743 To allow the construction Applicant: Decon Corporation, of a planned residential development in the R-2 Two Family Residence District and R-3 Limited Multiple Family Residence District. Located approximately 540 feet west of Brookhurst Street and approxi- mately 724 feet north of Hamilton Avenue and legally described as being a portion of the S2j NE4, Section 18-6-10. The Staff Report was read by the Secretary. The hearing was opened to the audience. Leonard Poes, representing the applicant, addressed the Commission and displayed a sketch of the proposed development. He further stated that there were no objections to the conditions suggested by the Sub- division Committee. the hearing was closed. There being no other,comment, The Commission held a lengthy discussion regarding the Master Plan for the area. It was the concensus to continue the hearing on Tentative Tract Map No 5560 and Use Variance No 74,3 to give the developer time to submit a general plan for the entire project. NOES: None. ABSENT: Kaufman, Miller. THE MOTION CARRIED. ZONE CASE NO 451 - Continued Change of Zone from Applicant: Marell Homes, Inc. R-:4-X Suburban Resi- dential District as adopted by Interim Ordinance No 668 to R-2 Two Family Residence District. Located approximately 310 feet south of Slater Avenue and east of Jefferson Street and legally described as the Stly 141.045 feet of Lot 16, Tract No 439; EXCEPTING that portion thereof lying within Tract No 4682. The Secretary read a letter submitted by George McCracken, President of Marell Homes, Inc., requesting withdrawal of the subject zone case. The Secretary -informed the Commission that the City Council approved Change of,Zone No 463 to an R-2 for the entire area including the parcel in question. A MOTION WAS MADE BY CRABB AND SECONDED BY BAZIL TO APPROVE THE REQUEST OF THE APPLICANT TO WITHDRAW ZONE CASE NO 451. ROLL CALL VOTE: AYES: Crabb, Letson, Bazil, Worthy, Larkin. NOES: None. ABSENT: Kaufman, Miller. THE MOTION CARRIED. ZONE CASE NO 471•- Change of Zone Applicant: -Alco Pacific Construction _ from A-1-X General Agricultural Dis- trictas adopted by Interim Ordinance No 668 to R-1 Single Family Residence District. Located at the northeast corner of Springdale Street and.Slater Avenue and legally described as Tentative Tract No 5601. The Secretary read a communication submitted by Hitoshi Mukai, 17301 Edwards St., requesting that if the subject zone case is approved, the developer be required to construct a six foot block wall along the southerly boundary of Mr. Mukails property. The hearing was opened to the audience; there being no comment, the hearing was closed. The Secretary informed the Commission that there is an approved subdivision map for single family homes'on the land and that the proposed change will eliminate uses that would be incompatible -with the pro- posed use of the land. There is an approved subdivision on the land. 2. The proposed change will eliminate uses that would be incompatible withtthe proposed use of the land. Located approximately 1100.feet east of Beach Boulevard on the north side of Ellis Avenue and legally described as a portion of the SW4, NW4, Section 36-5; 11. Further legal description on file in the Planning Department Office. The Secretary read seven petitions of protest submitted by the following property owners of the adjacent area: L. L. Ghirardi, 18392 Goodwin Lane, W. G. Ghirardi, 18391 Goodwin Lane, Raymond Leblanc, 18393 Goodwin Lane, Mr. and Mrs. Lloyd S. Gilbreath, Jr., Mrs. Jack K..Realey:, Mr. and Mrs. Jack Myers, Mr. and Mrs. L. L. Camp, Mr. and Mrs. M. DeGroat, and.Mr. and Mrs. Alex McNeill. the audience. The hearing was opened to Lowell Zehnder, applicant, addressed the Commission and explained the proposed develop- ment. Lloyd Gilbreath, Jr., 18441 Goodwin Lane, addressed the Commission and read a petition of protest signed by twelve property -owners and further -requested -that the names of said property owners be made a part of record: M. Bud Higgins, Fire Chief, addressed the Commission and stated that the Fire Department will require a minimum of 40 foot street width for adequate fire protection within the proposed project. Dedicate and improve Ellis Avenue across the entire parcel to City Standards. 2. The water system and fire hydrants shall meet the approval of the Fire Chief . - 3. The turn -around within the development shall meet.the approval of the Director of Public Works and the Fire Chief, 4. There shall be no windows facing onto the,adjacent single family residence tract on the west side of the proposed development. 5. Mellon, 6961 Lenis Circle,'addressed the Commission and opposed the subject request, G. S.. Mason, representing the,Richfield Oil Corp.,. addressed the Commission and spoke in favor. Lo- cated approximately 1320 feet east of Beach Bdialevard and 660 feet south of Ellis Avenue and legally described as, being a portion of the S2j NE4, SW4,Section 36=5-11. Further legal on file in the Planning Department Office. The Staff Report was read by the Secretary. the audience. Street, Los Angeles, addressed the improvement district. The hearing was opened to Victor Illig, 3219 Humboldt the Commission and questioned Bill Hartge, Deputy Director of Public Works, addressed the Commission and informed the Commission on progress of the proposed assessment district in the area. Wallace Mitchell,-8351 Laura Circle, agent for the applicant, addressed the Com- mission and spoke in favor of the proposed development. There being no other comment, the hearing was closed. The Planning Director in- formed the Commission that on July 2, 1963, a Use Variance, No UV 586, was approved by the Commission for this same pro- ject. He further pointed out that more than a year has elapsed which renders that variance null and void, hence this new application was required to renew the project. It -was noted that several points of the layout could be improved. MISCELLANEOUS: EXTENSION OF TIME - TENTATIVE TRACT MAP NO 5243 The Secretary read a communication submitted by R. L. Stuckey, engineer for the developer of Tract No 5243, requesting a one-year extension of the approval of, Tentative Tract No 5243 in which to record the final map of said tract. A MOTION WAS MADE BY CRABB AND SECONDED BY BAZIL TO RECOMMEND APPROVAL OF EXTENSION OF TIME FOR TRACT NO 5243 TO THE CITY COUNCIL., ROLL CALL VOTE: AYES: Grabb, Letson, Bazil, Larkin. AREA VARIANCE NO 741 The Secretary informed Applicant: Frank Cracchiolo the Commission that the applicant has requested reconsideration of a previously approved Area Variance No 741 to allow a_11 foot. rear yard setback in deviation to the required 20 feet. The, Secretary .pointed out that,- the r requested revision will .provide a 14 foot. rear, yard setback and the applicant will have adequate remaining rear yard. COMMUNICATION: The Secretary read a legal notice submitted by the Westminster City Planning Commission for a change of zone from M-1 Light Industrial District and B-1 Buffer Zone to R-2 Group Dwelling District or a more restrictive zone.
