The Deputy Secretary read a letter submitted by Gerald J. Chazan, general partner for Huntington Beach Shopping Center, requesting that Tract No 5385 be withdrawn. A MOTION WAS MADE" BY BAZIL AND SECONDED BY WORTHY TO GRANT THE REQUEST FOR WITHDRAWAL OF TENTATIVE TRACT MAP NO 5385. ROLL CALL VOTE: AYES: Crabb, Letson, Bazil, Kaufman, Worthy, Miller, Larkin. A MOTION WAS MADE BY LETSON AND SECONDED BY MILLER TO APPROVE TENTATIVE TRACT MAP NO 5717 UPON THE FOLLOWING CONDITIONS: 1. The Tentative Map dated July, 1964, shall be the approved map. 2. The Deputy Secretary read a lengthy letter of protest signed by 254 property owners within the area. The Staff Report was read by the Deputy Secretary. the audience. The hearing -was opened to Ernest,Belcher, applicant, addressed the Commission and stated that he has conformed to many of the conditions suggested by the Staff at the previous meeting. He further explained the proposed development. Richard A. Poper, architect, addressed the,Commission and explaine d'the proposed develop- ment. 'He offered to.display various sketches of the proposed planned development. ,.,The following property owners addressed the Commission and 'spoke in opposition; Jerry Gallian, 6231 Corrine Circle; Adolf Berry, 6021 Doyle Drive;.John Baker; 6041 Doyle Drive; Donald Fogg, 16731 Busby Lane; Donald Cousins, 9351 Cape Cod Drive; Don Caster, 6171 Gumm Drive; Charles Cooper, 16592 Busby Lane; Mr. Swanson, 6262 Heil Avenue; and Roger Neigh, 16671 Greenview Lane. the hearing was closed. There being no other comment, The Commission held a lengthy discussion. Commissioner Bazil questioned the applicant regarding a 200 ft by 200 ft "holdout" parcel located at the intersection of Springdale Street and Heil Avenue. USE VARIANCE NO 753 To allow the estab- lishment of , a � dance studio in an existing single family dwelling. Located on, the east side of Beach Boulevard and south of Sterling Avenue in the R-1 Single Family Residence District and legally described as Lot 3, Tract No 2416, also known as 18212 Beach Boulevard. The Staff Report was read by the Deputy Secretary. The hearing was opened to the audience. The applicant addressed the Commission and.gave his reasons for the request. There being no' other comment, the hearing was closed. , The Deputy Secretary informed the Commission that a request of this nature would constitute a grant of special privilege and it will not be. compatible with adjacent development. He further pointed out that there are deed restrictions on the tract which prohibit any commercial activity, off-street parking for a commercial use in a single family tract will cause problems and -the single dwelling,would require an extensive amount of work in order to meet Building Code requirements for a commercial: structure. ZONE CASE NO 475 Change -of Zone from R-1 Applicant:- Huntington Single Family Residence Harbour Corporntion District to R.-1-0-1 Combining Oil District. Located at the intersection of Algonquin Street and Warner Avenue and legally described as being a portion of the NE4,. NW4, Section 29-5-11. Further legal description on file in the Planning Department Office. The Deputy Secretary read six letters of protest. The Staff Report was read by the Deputy Secretary. The hearing was opened to the audience. Martin Fenton, representing Huntington Harbour Corporation, addressed the Commission and gave his reasons for the request., Robert Lurie, Sunset Beach, addressed the Commission and opposed the subject zone change. John Richardson, representing the Grover Collins Gas and Oil Company, addressed the Com- mission and explained the operation of the proposed drilling site. There being no further comment, the hearing was closed. The Deputy Secretary in- formed the Commission that part of Parcel 1 extends into existing Warner Avenue R/W and that the applicant has anti- cipated the realignment of Warner Avenue. Bill Hartge; Deputy Director of Public Works, pointed out to the Commission that a deed for the realignment has been received by the City. RESOLUTION NO 475 A. R-solution of the City Planning Com- mission Recommending; Approval of Zonv Cave Ulo 475 to the City Council. A MOTION WAS MADE BY MILLER AND SECONDED BY LARKIN TO ADOPT RESOLUTION NO 475 RECOMMENDING APPROVAL OF ZONE CASE NO 475 TO THE CITY -COUNCIL FOR THE FOLLOWING REASONS: 1. The property is situated in an area which is known to have successful oil production. 2. The 110-1" Combining Oil District was designed to be applied under these circumstances, because limitations of tle 110-1" Zone make oil drilling and residential development compatible. -6- 9/l/64 22 Page #7 Minutes: H. COMMUNICATION: RE: TRACT NO. 4663 The Deputy,Secretary. read a letter submitted by Armet and Associates requesting deletion.of Condition No. 1 which states, "No portion of Tract No. 4663 shall be recorded until the proposed improvement district in the area is.formed and the contract iszlet for construction of the district facilities." The Commission reviewed the condition and it was their unanimous recommendation that said request be.denied, because all future development and zoning has been predicated on formation of the district. COMMUNICATION: The Deputy Secretary read a letter.sub- mitted by Cody Investment Co., Inc., requesting that the Commission consider R-3 zoning for the property located on the south side of Ellis Avenue, 600 feet east of Beach Boule- vard. It was the unanimous opinion of the Commission-that,the request be denied because all future development and zoning has been predicated on formation of the improvement district.
