Monday, September 21, 1964
Mayor Shipley called the regular meeting of
the City Council of the City of Huntington Beach to order at 7:30
o'clock P.M.
The Pledge of Allegiance was given by all
present in the Council Chamber.
The Invocation was given by Rev. Virgil
Painter, General Baptist Church, Huntington Beach.
J�ROLL CALL Councilmen Present: Welch, Gisler, Lambert, Shipley
-Councilmen Absent: Stewart
jSUPVSR BAKER REQ Supervisor Baker addressed the Council and
17CITY SUPPORT requested City support of Proposition A and
B on the November ballot, by the adoption of
a Resolution urging the support of other Cities for the passage of a
bond issue.
On motion by Welch, seconded by Lambert,
Council directed the City Attorney to prepare a Resolution in support
of Proposition A and B on the November ballot. Motion carried.
US SURFING CHAMP Norman Worthy, Recreation Director of the
DIGNITARIES PRES City, addressed the Council and gave a"
resume' of the Surfboard Championships held
in the past, and introduced Ron Maury who presented the visiting
dignitaries from Hawaii: Stan Moncrieff, Kemo McVey, and Duke
Kahanamoku.
Mayor Shipley presented a "Key to the City"
to former Olympic Champion Duke Kahanamoku.
MINUTES APPROVED On motion by Lambert, seconded by Welch,
the minutes of the regular adjourned
meeting of September 14, 1964, the regular meeting of September 8,
1964, and the corrected page #6 of the minutes of January 6, 1964,
were approved as transcribed, corrected and mailed. Motion carried.
V- DEPT REPORTS On motion by Welch, seconded by Lambert,
the reports of the Chief of Police,
b Collector, Treasurer and Chamber of Commerce Manager, were approved
and ordered filed. Motion carried.
�,ITRAFFIC SIGNAL On motion by Lambert, seconded by Welch, a
REQ - HOMEOWNERS request from the Seahaven Homeowners
Association for placement of crosswalks
and traffic signals at the intersection of Cannery and Adams, was
referred to the Chief of Police and Traffic Engineer for study and
report. Motion carried.
REQ FOR TRASH On motion by Welch, seconded by Lambert, a
,15CANS OY BEACH letter from John Kelsey, City, requesting
that trash cans be placed on the beach at
llth, 15th, 16th and 23rd Streets, was received and ordered filed.

p EVANGELICAL CHURCH The Clerk presented a letter from the
(�1 REQ REC & FILED Evangelical Free Church, City, requesting
the use of Lake Park Clubhouse on the same
basis as they have been -allowed the use of Memorial Hall, for the
_interim period between the time they will not be able_ to use
Memorial Hall and the completion of their church.
On motion by Lambert, seconded by Gisler,
Council received the communication and ordered it filed, inasmuch as
arrangements have been made whereby the Evangelical Free Church will
be able to continue renting Memorial Hall space during the interim
period. Motion carried.
JR C of C REQ The Clerk presented a letter from the
'g FIREARMS CODE Junior Chamber of Commerce suggesting that
the law regarding firearms be changed so as
to include "No shotguns within 4 mile of housing or roadways."
On motion by Welch, seconded by Gisler,
Council referred the suggestion concerning a firearms code amendment
to the Chief of Police and City Administrator, for study and report.
Motion carried.
WARNER REQ On motion by Welch, seconded by Gisler,
abbe REC & FILED a letter from Willis C. Warner requesting
reconsideration of his letter of September
8, 1964 for payment of accumulated overtime accrued during his
employment as City Planning Director, was received and ordered
filed. Motion carried.

RES ELIM SALES The Clerk presented a letter from the City
TAX ON CERT ITEMS of Garden Grove transmitting a copy of
their Resolution requesting the elimination
of the State Sales Tax on capital items purchased by political
subdivisions and urging the City's support.
The Clerk read Resolution No. 2049 - "A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH
REQUESTING THE ELIMINATION OF STATE SALES TAX ON CERTAIN ITEMS."
On motion by Lambert, seconded by Gisler,
Council directed that copies of Resolution No. 2049 be mailed to the
California League of Cities in Orange County, and adopted Resolution
No. 2049 by the following roll call vote:
AYES: Councilmen: Welch, Gisler, Lambert, Shipley
NOES: Councilmen: None
ABSENT: Councilmen: Stewart
C of C REQ The Clerk presented a letter from the
XMAS DECORATIONS Chamber of Commerce - Retail Merchants
Division, requesting that the City set
aside $1800 from the budgeted Celebration Account for Christmas
decoratiors to be displayed on the four blocks on Main Street.
On motion by Gisler, seconded by Lambert,
Council referred the request of the Chamber of Commerce to the City
Administrator and Finance Director for study. Motion carried.

A BOLSA CHICA HOMEOWNERS On motion by Lambert, seconded by Welch, a
OPP AIRPORT ACQ letter from the Bolsa Chica Homeowners
k� opposing the possible acquisition of land
for expansion of the Meadowlark Airport was received and filed for
future reference. Motion carried.
SIDEWALK R/W Mr. Jim DeGaulle, City, addressed the Cau;icil
EAST SIDE regarding the sidewalk right of way on the
east side of the City, which was presented
at the meeting of September 8, 1964.
The Director of Public Works reported that
first indications show that this problem is serious, and requested
additional time to study the matter further.
k BENGE REQ TO Mr. John Miller, 2432 Newport Boulevard,
q1 VARY ENGR REQ Costa Mesa, addressed the Council
representing Mr. Clyde Benge of the City,
and submitted a letter which was read by the Clerk, requesting
Council consideration to vary a curb radius in the development of
his property located at 2502 Delaware Street.
On motion by Lambert, seconded by Welch,
Council referred Mr. Benge's request to the Director of Public Works
for study. Motion carried.
11COMPLAINTS - Mr. Geofge Arnold, 527 6th Street, City,
Q GEO ARNOLD addressed the Council to register complaints
concerning dirty streets and alleys in the
downtown area, and regarding the watering of the trees on Main Street.
rPUBLIC HEARING Mayor Shipley announced that this was the
r ZC 475 DENIED day and hour set for a public hearing on
Resolution No. 475 of the City Planning
Commission, recommending approval of Zone Case No. 475, on property
situated 140' north of Los Patos Avenue on the west side of the
southerly prolongation of Algonquin Street, and directed the Clerk
to read the legal notice.
The Clerk read notice of public hearing on
Zone Case No. 475, as published in the Huntington Beach News on
September 10, 1964, setting the hour of 7:30 o'clock P.M., or as soon
thereafter as possible, on Monday the 21st day of September, 1964, in
the Council Chamber of the City Hall, Huntington Beach, California,
as the time and place for a public hearing for the purpose of consider-
ing a petition for a change of zone to regulationsof the Districting
Ordinance from: R1 Single Family Residence District, to: R1-0-1
Combining Oil District.
The Clerk informed the Council that they
had been provided with copies of the Planning Director's transmittal
and the Resolution of°the Planning Commission recommending approval
of Zone Case No. 475, and stated that he had received a communication
from James E. John, Alice John, and Blaine Daniels opposing said oil
District, and a communication from Huntington Harbour Corporation
supporting same, and that he had received no further communicatiorscor
written protests to the Zone Case or to the recommendation of the
Planning Commission,
Mayor Shipley declared the hearing open.
Mr. Bob Lurie, 18865 South Pacific, Sunset
Beach, addressed the Council to oppose the proposed R1-0-1 District.
John Richardson, addressed the Council
representing the Grover Collins Oil Corporation, an independent oil
operator, and informed them that the drilling restrictions placed on
them by the Huntington'Harbour Corporation were greater than those
imposed by the City Ordinance, for the protection of the residents
of the area.

Mr. Gerald Jones, 17171 Sims Street, City,
addressed the Council and stated that the residents of that area had
worked for.annexation and Assessment District formation to improve
their property, and opposed the planned oil operations near their
property.
Mr. Ken Hemphill, 5351 LaCasava, Long Beach,
addressed the Council and stated that he was against oil operations
in R1 zoned property.
Mr. Martin Fenton of Huntington Harbour,
addressed the Council and stated that Huntington Harbour Corporation
did not object to oil operations at said location. He -informed the
Council that mineral rights for their area are held by the
individuals from whom Huntington Harbour purchased the land.
There being no one further present to speak
on the matter and there being no further protests filed, either oral
or written, the hearing was closed by the Mayor.
On motion by Gisler, seconded by Lambert,
Council overruled the recommendation of the Planning Commission and
denied Zone Case No. 475. Motion carried.
%b PUBLIC HEARING Mayor Shipley announced that this was the
ORD 1085 APPROVED day and hour set for a public hearing on
0 the proposed adoption of Ordinance No. 1085
of the City Council, authorizing, under Vehicle Code Section 21107.5,
that the provisions of the California Vehicle Code be applicable to
the private streets within the areas commonly known as the
Huntington Continental Townhouses #1 and Huntington Continental
Townhouses # 2, and directed the Clerk to read the legal notice.
The Clerk read notice of public hearing on
the proposed adoption of Ordinance No. 1085, as published in the
Huntington Beach News on September 10, 1964, setting the hour of
7:30-o clock P.M., or as soon thereafter as possible, on Monday the
21st day of September, 1964, in the Council Chamber6f the City Hall,
Huntington Beach, California, as the time'and place for a public
hearing for the purpose of approving for adoption Ordinance No. 1085
of the City Council, allowing regulation of traffic and parking by
the Fire Department and Police Department on private property in
areas known as Huntington Continental Townhouses #1 and Huntington
Continental Townhouses #2.
The Clerk informed the'Council that they
had been provided with copies of Ordinance No. 1085, and stated that
he had received no communications or written protests to the adoption
of said Ordinance by the City Council.
Mayor Shipley declared the hearing open.
There being no one present to speak on the
matter, and there being no protests filed, either oral or written,
the hearing was closed by the Mayor.
All Councilmen stipulated that they had
read Ordinance No. 1085 in its entirety and were aware of the
contents thereof.
On motion by Lambert, seconded by Gisler,
the oral first reading of Ordinance No. 1085 - "AN ORDINANCE OF THE
CITY OF HUNTINGTON BEACH PROVIDING FOR ENFORCEMENT ON PRIVATE
PROPERTY: ADOPTING S. 21107.5 OF DIV. 11 OF THE VEHICLE CODE OF THE
STATE OF CALIFORNIA 1963,.DECLARING AN EMERGENCY TO EXIST: AND
.ADDING._-` ARTICLE 601 AND SECTIONS THEREOF TO THE HUNTINGTON BEACH
ORDINANCE CODE," was waived. Motion carried.

'APUBLIC HEARING Mayor Shipley announced that this was the
RES. N0. 2023 day and hour set for a public hearing on
Resolution No. 2023 of the City Council,
giving notice of proposed annexation to the City of Huntington Beach
of that certain uninhabited territory designated as "Sunset Beach
#3 Annexation," and directed the Clerk to`read the legal notice.
The Clerk read notice of public hearing on
Resolution No. 2023 of the City Council, as published in the Huntington
Beach News on August 13th and August 20th; 1964, setting the hour of
7:30 o'clock P.M., or as soon thereafter as possible, on Monday, the
21st day of September, 1964, in the Council Chamber of the City Hall,
Huntington Beach, California, as the time and place for a public
hearing for the purpose of considering Resolution No. 2023 of the
City Council, giving notice of proposed annexation to the City of
Huntington Beach of that certain uninhabited territory described as
"Sunset Beach #3 Annexation," and giving notice of time and place
for hearing of protests thereto.
The Clerk informed the Council that they
had been provided with copies of Resolution No. 1959 of the City
Council; and that he had received a letter from Nevin R. Shade
concerning the Sunset Beach Sanitary District in the area to be
annexed, and questioning the term "uninhabited" referred to in the
Resolution. The Clerk also presented a letter explaining the
technical definiation of an inhabited area asset forth in the Govern-
ment Code, and further explaining the method of merging with County
Sanitation District No. 11, after annexation.
He then read the Clerk's Certification
certifying that the names of the property owners affixed to the
petition for annexation represents'more than twenty-five percent
by area and assessed valuation; further certifying that not more
than 11 registered voters reside itt the area proposed to be annexed.
Mayor Shipley declared the hearing open.
Mr. Jack Kelly and Dr. Ashley of Sunset
Beach addressed the Council and stated that they were in favor of the
annexation.
Mr. W. D. Wallace of Long Beach addressed
the Council and stated that he was a property owner in the area to
be annexed and failed to receive notice of the proposed annexation.
The Clerk informed Mr. Wallace that notices were sent all residents
at the address listed on the latest.:assessment roll.
There being no one further present to speak'
on the matter, and there being no further protests filed, either oral
or written, the hearing was closed by the Mayor.
On motion by Lambert, seconded by Welch,
Resolution No. 2050 - "A RESOLUTION OF THE CITY OF HUNTINGTON BEACH
MAKING A DETERMINATION OF THE PROTESTS MADE AT THE TIME OF HEARING
ON "SUNSET BEACH NO. 3 ANNEXATION," which had heretofore been
submitted to the Council and read by them, was passed and adopted
by the following roll call vote:
AYES: Councilmen: Welch, Gisler, Lambert, Shipley
NOES: Councilmen: None
ABSENT: Councilmen: Stewart
On motion by Lambert, seconded by Welch,
Council directed the City Attorney to prepare an Ordinance annexing
the territory included in the "Sunset Beach #3 Annexation." Motion
carried.

PUBLIC HEARING Mayor Shipley announced that this was the
ASSESS DIST 6302 day and hour set for a public hearing on
Resolution No. 2045 of the City Council,
propposing to make certain changes in work in Assessment District No.
63R - Sandra Lee Improvement District, and directed the Clerk to
read the legal notice.
The Clerk read notice of public hearing on
Resolution No. 2045 of the City Council, as published in the
Huntington Beach News on September 10, 1964, setting the hour of
7:30 o clock P.M'., or as soon thereafter as possible, on Monday, the
21st day of September, 1964, in the Council Chamber of the City Hall,
Huntington Beach, California, as the time and place for a public
hearing for hearing protests to Resolution No. 2045 - Sandra Lee
Improvement District - Assessment District No. 6302.
Mayor Shipley declared the hearing open.
There being no one present to speak on the
matter, and there being no protests filed, either oral or written,
the hearing was closed by the Mayor.
On motion by Lambert, seconded by Gisler,
Council deferred action on Resolution No. 2045 of the City Council
regarding changes in work in Assessment District No. 6302 - Sandra
Lee Improvement District, until October 5, 1964. Motion carried.
HEARING ON The.Clerk presented the matter of an appeal
11/01 TENT TRACT 5590 by Aliso Homes of conditions on Tentative
Tract Map #5590, stipulated by the Planning
Commission. He then read a letter from the Director of Public Works
informing Council that the matter was resolved in a manner agreeable
to Aliso Homes and the City,,and recommended approval of same.
On motion by Lambert, seconded by Gisler,
Council approved Tentative Tract Map #5590, excepting therefrom, the
Planning Commission approval of Item No. 3 regarding dedication and
improvement of the Edwards Street frontage labeled Not a Part."
Motion carried.

The Purchasing Agent informed the Council
that the bids received had been reviewed, and he recommended the
purchase of one Cab and Chassis for the Water Department from the
low bidder, Beach City Dodge Company, Huntington Beach, for the bid
price of $1536.09, including sales tax; and he further recommended
the purchase of two trucks for the Engineering and Water Departments
from the low bidder, Mel Burns Ford, Long Beach, for the bid price
of $1653.75 each, including sales tax.

On motion by Welch, seconded by Gisler,
Council approved the purchase of one Cab and Chassis for the Water
Department from Beach City Dodge Company, City, for $1536.09,
including tax; and the purchase of two trucks for the Engineering
and Water Departments from Mel Burns Ford, Long Beach for $1653.75
each, including tax; and rejected all other bids. Motion carried.

possible, and directed the Clerk to publish notice of same. Motion
carried.

9� WAVE GAGE The Clerk presented a communication from
AEROJET - GEN the Director of Public Works transmitting a
request from the Aerojet-General Corporation
to mount a wave gage on the pier for two weeks in October, together
with a recommendation that it be approved and the City be furnished
with adequate insurance.
On motion by Lambert, seconded by Gisler,
Council granted permission to Aerojet=General Corporation to mount a
wave gage on the pier for 2 weeks in October, with the stipulation
that the City be furnished the necessary insurance. Motion carried.

The Clerk presented a Reimbursement Agree-
ment between Oka Brothers and the City for
off site storm drains in conjunction with

Council approved Reimbursement Agreement No. 110 between Oka Brothers
and the City, and authorized the Mayor and Clerk to execute same on
behalf of the City. Motion carried.
REMODELING The Clerk presented a transmittal from the
MEM HALL BLDG Director of Public Works of a copy of a
plan for the remodeling of Memorial Hall
for office space, at an estimated cost of $20,000.
On motion by Lambert, seconded by Welch,
Council approved the plan for remodeling of Memorial Hall for office
space, and directed the Director of Public Works to proceed with the
work. Motion carried.
E R STANG On motion by Lambert, seconded by Welch,
Po' WATER CONF Council approved the request of the Director
of Public Works to allow E. R. Stang to
attend the fall conference of the American Water Works Association
in San Diego, on October 27th to 30th, 1964, with transportation by
City vehicle and reasonable expenses allowed. Motion carried.
PUBLIC HEARINGS On motion by Lambert, seconded by Welch,

� 33 No. 1086 - Uniform Heating & Comfort Cooling
Code, and Ordinance No. 1087 - Uniform Plumbing Code, for October 5,
1964, at 7:30 o'clock P.M., or as soon thereafter as possible, and
directed the Clerk to publish notice of same. Motion carried.
LIBRARY BOARD The Clerk presented a letter from Mayor
(� REAPPOINTMENTS Shipley reappointing Mrs. Berta Tovatt to
the Library Board to fill the unexpired
term of Mr. Raymond Beem, which terminates in June, 1966; and the
appointment of Mr. David Wickersham to the Library Board of Trustees
for a three year term, ending September, 1967; and requesting Council
confirmation of same.
On motion by Lambert, seconded by Gisler,
Council confirmed the Mayors appointments of Mrs. Tovatt and Mr.
Wickersham to the Library Board. Motion carried.
PD REQ DET The Clerk presented a letter from the Chief
1 AUTO -EQUIPPED of Police requesting authorization for the
purchase of a new automobile for the
Detective Bureau - a fully equipped standard sedan with automatic
transmission.
On motion by Lambert, seconded by Gisler,
Council directed the Purchasing Agent to advertise for bids for a
new automobile for the Detective Bureau. Motion carried.

473: AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY RECLASSIFYING
SECTIONS 9061.33 (Sectional District Map 21-5-11) and 9061.11
(Sectional District Map 2-6-11)."
All Councilmen stipulated that they had
read Ordinance No. 1090 in its entirety and were aware of the
contents thereof.

the oral first reading of Ordinance No. 1090 was waived. Motion
carried.
ORD 1091 - ORAL The Clerk presented Ordinance No. 1091 -
O�P-lst READING WAIVED "AN ORDINANCE OF THE CITY OF HUNTINGTON
BEACH RELATING TO DUST AND INDUSTRIAL WASTE:
ADDING ARTICLE 313 AND NEW SECTIONS THEREOF TO THE HUNTINGTON BEACH
ORDINANCE CODE."

contents thereof.
On motion by Lambert, seconded by Gisler,

�gTRAFFIC STUDIES City Administrator Doyle Miller informed
�o TO BE MADE Council that he had received a request from
Donald Lawson, Safety Chairman of the
Schroeder School for crossings and safety markings at the corner of
Cornell Drive and Columbia Lane.
. On motion by Lambert, seconded by Gisler,
Council referred the request for pedestrian crossings at the corner
of Cornell Drive and Columbia Lane, to the Traffic Engineer for
study and report. Motion carried.
The City Administrator then presented a
request from Ralph T. Miller, Principal of the Robinwood School,
requesting that cross walks be painted on McFadden Avenue at the
corner of Andaman Lane, for the safety of the children using the
front entrance of the school grounds coming from Bolsa Park Tract.
On motion by Lambert, seconded by Gisler,
Council referred the request for pedestrian crossings at the corner
of McFadden Avenue at Andaman Lane, to the Traffic Engineer for
study and report. Motion carried.

attend a seminar on IBM Data Processing

The City Administrator informed the Council

that he had made some study of the matter
of the City Ordinance controlling the
discharge of firearms,
and recommended that the City Attorney be
directed to study the matter further.
On motion by Lambert, seconded by Welch,
Council directed the City Attorney to study the City Ordinance Code
controlling the discharge of firearms, and report his recommendations
to Council. Motion carried.
