OCTOBER 20, 1964 COMMISSIONERS PRESENT: Crabb, Letson, Bazil, Kaufman, Worthy, Larkin. COMMISSIONERS ABSENT: Miller. Chairman Kaufman called the regular meeting of the Planning Commission to order at 7:30 P.M. in the City Hall. On motion by Crabb and seconded by Letson, the meeting was adjourned to the new Council Chamber, Civic Center in Memorial Hall. COMMISSION -RECONVENED Commission reconvened at 7:35 P.M. MINUTES: On motion by Crabb and seconded by Worthy, the Minutes of the Huntington Beach Planning Commission of September 29, 1964, were accepted as transcribed and mailed by the Secretary. TENTATIVE. TRACT MAP NO 5766 Number of Lots: 44 Subdivider: William I. Rousey Total Acreage: 9.79 Engineer: Hal Raab Surveying Located south of Garfield Avenue, 1320 feet east of Beach Boulevxd and legally described as being a proposed subdivision of the W2, N E4, NW4, Section 1-6-11; Excepting the south 675 feet. The Subdivision Committee Report was read by the Deputy Secretary. The hearing was opened to the audience; there being no comment, the hearing was closed. A MOTION WAS MADE BY CRABB AND SECONDED BY BASIL TO APPROVE TENTATIVE TRACT MAP NO 5766 UPON THE FOLLOWING CONDITIONS: 1. The Tentative Map received September 18, 1964, shall be the approved layout. 2. The minimum frontage on cul-de-sac and knuckle lots shall be 45 feet. 3. A 10 foot school walkway shall be provided between Lots 10 and 11. Said walkway shall be designated as Lot "A" and said walkway shall be improved to City Standards. 4. A 10 foot utility easement shall be provided at the north end of "C" Street. 5. The lot line between Lots 33 and 34 shall be realigned to eliminate the angular configuration at the southern terminus of both lots. 6. R-1: The S'ly 730 feet of the W'2j NE4, NW4, Section 27-5-11. Richard Harlow, Plan- ning Technician, presented several sketches illustrating possible street patternsbetween the R-1 and R-3 zones. The hearing was opened to the audience. Hal Smith, representing the applicant, addressed the Commission and stated that this request was based on the adopted Master Plan of Land Use. There being no other comment, the hearing was closed. The Commission held a discussion. It was noted that the immediate area is master planned for a medium density development along Warner Avenue to the depth of approximately 460 feet and property south of the 460 foot depth is master planned for low density develop- ment. RE"QOLUTION NO 483 A Resolution of the City Planning Com- mission Recommending Approval of Zone Case No 483 as modified to the City Council. A MOTION WAS MADE BY CRABB AND SECONDED BY BAZIL TO ADOPT RESOLUTION NO 483 RECOMMENDING APPROVAL OF ZONE CASE NO 4831 AS MODIFIED, TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. The adopted Master Plan indicated -medium density develop- ment along Warner Avenue to an approximate depth of 400 feet. 2. Adjoining property on the west is zoned R-3. Located at the southwest corner of Banning Avenue and Bushard Street and legally described as a portion of the NW�4, Section 19-6-10. Further legal description on file in the Planning Department Office. The Deputy Secretary read the Staff Report. The hearing was opened to the audience. Richard Dach, Long Beach, addressed the Commission and objected to the proposed service station. Mr. J. B. Sutton, 22022 Newport Circle, addressed the Commission and also spoke in opposition to the subject use permit. Ralph Allen, representing the applicant, addressed the Commission and explained the developer's plans. He further stated that service stations are permitted in the C-4 Highway Commercial District subject to issuance of a Use Permit. the hearing was closed. There being no other comment, It was the consensus of the Commission that the requested use is permitted in the C-4 Zone subject to review by the Planning Commission and that the intent of the zone is being fulfilled. A MOTION WAS MADE BY BAZIL AND SECONDED BY WORTHY TO APPROVE USE PERMIT NO 256'UPON THE FOLLOWING CONDITIONS: 1. Banning Avenue shall be dedicated 40 feet from centerline. 2. Bushard Street shall be dedicated 42 feet from centerline.': 3. Improve Banning Avenue and Bushard Street to City Standards. 4. Drainage fees shall be paid. 5. The Deputy Secretary pointed out to the Commission that the property involved was intended to be divided into separate parcels; therefore, a subdivision should be filed prior to the Planning Commission rendering a decision. He stated that if the property is subdivided and developed with four units per lot, as proposed, a use permit would not be required. It was the consensus to continue Use Permit No 257 to October 27, 1964, to give the Staff time to discuss the matter with the applicant. The applicant agreed to a one week continuance. A MOTION WAS MADE BY BAZIL AND SECONDED BY WORTHY TO CONTINUE THE HEARING ON USE PERMIT NO 257 TO OCTOBER 27, 1964, WITH THE CONSENT OF THE APPLICANT. COMMUNICATION: The Deputy Secretary read a letter submitted by Millet & King, requesting the condition of Tentative Tract No 3849 requiring a block wall be built along the railroad right-of-way and the north side of the school site (Lots 566 and 567) be amended to allow a solid wood fence. The hearing was opened to the audience. Jack King, engineer for the subdivider of Tract No 3849, addressed the Commission and stated that a uu od fence has already been constructed along the railroad and along the north side of the school site. The Commission held a lengthy discussion. A MOTION WAS MADE BY BAZIL' AND SECONDED BY WORTHY TO: (1) ALLOW THE EXISTING SOLID WOOD FENCE ALONG THE RAILROAD RIGHT-OF-WAY TO REMAIN; (2) REQUIRE CONFORMANCE TO THE APPROVED TENTATIVE MAP ON ALL OTHER FENCES ALONG THE RAILROAD RIGHT-OF-WAY, AND (3) CONTACT WESTMINSTER SCHOOL DISTRICT AND ASK FOR THEIR COMMENTS ON THE EXISTING WOOD FENCE TO THE NORTH OF LOTS 566 AND 567. USE VARIANCE NO 763 The Deputy Secretary informed Applicant: American the Commission that an off - "Lutheran Church street parking layout was submitted for approval by the Planning Commission. He stated that the Staff recommends approval with the following conditions: 1. All off-street parking facilities shall meet the adopted Planning Commission Standards. 2. Street lighting shall be installed to City Standards. 3. Drainage fees shall be paid. 4. The main entrance or west drive opening shall be 30 feet wide. 5. A 6 foot masonry wall shall be constructed during the first increment of development along the west, north and east property lines; except along the east property line said wall shall be 42 inches high in the front yard setback. 6. All necessary street improvements shall be installed to City Standards during the first increment of development. 7. The water and fire hydrant systems shall be approved by the Director of Public Works and the Fire Chief. 8. The 10 foot drive along the south and east property lines shall be 25 feet wide. 9. Approval of the off-street parking layout shall be for the blue shaded portion only. All remaining off-street parking facilities shall meet the adopted Planning Com- mission Standards. C011,1UNICATION: O!.ANGE COUNTY PLANNING CONITISSION The Deputy Secretary read a communication submitted by the Orange County Planning Commission regarding Use Variance No 5434 which would permit construction of a three unit apartment on a parcel of land containing less than the required area in the R-4 Suburban Residential District. The Commission reviewed the application. It was the unanimous recommendation that the request be denied because three units on 2700 square foot of lot area will overbuild the lot and a parking ratio of 1:1 is inadequate. DISCUSSION: The Deputy Secretary informed the Commission that a variance for 50 foot streets, sidewalks adjacent to the curb, roll -curbs and variable lot sizes was granted to Deane Brothers on Tract No 5575. He stated that the variance was granted as an experi- ment and construction has progressed to a point where the Planning Commission should take a look at the project and either approve or disapprove various modifications to the Sub- division and Zoning Ordinance. A MOTION WAS WADE BY LETSON AND SECONDED BY CRABB TO MEET AT TRACT NO 5575 ON TUESDAY, OCTOBER 27, 1964, AT 4:30 P.M.' STANDARDS FOR PLANNED RESIDENTIAL DEVELOPMENTS: The Deputy Secretary pre- sented suggested amendments to the Policy Statements for Planned Residential Developments. The Commission reviewed the amendments and by a unanimous vote approved said amendments and recommended that they be transmitted to the City Council fo'r their information: THE MOTION CARRIED. AMENDMENT TO PLANNING COMNiISSION BY-LAWS The Deputy Secretary read a proposed amendment to the Planning Commission By -Laws regarding Section 6 - "meetings". He pointed out that the amendment would change the meeting place of `the Planning Commission from Council Chamber of the City Hall to Council Chamber of the Civic Center. A MOTION WAS MADE BY WORTHY AND SECONDED BY BAZIL TO ADOPT THE REVISION OF SECTION 6 - "MEETINGS" TO READ AS FOLLOWS: All meetings of the Commission shall be open and public. Regular meetings shall be held on the first and third Tuesday of each month at the hour of 7:30 P.M. in the Council Chamber, Civic Center. DIVISION OF LAND NO 234 To allow the Division of Applicant: Broadway -dale Stores Land into three separate parcels. Located on the north side of Edinger Avenue, bounded on theceast by Beach Boulevard and on the Est by the P.E. Railroad. Planning Commission, October 20, 1964 57 COMMUNICATION: WESTMINSTEI: PLANNING COMMISSION The Deputy Secretary read a communication submitted by the Westminster Planning Commission regarding Site Plan SP-15 to rezone approximately 66 acres of land from 100-M2-203000 to R-1, R-2 and C-2 or more restrictive zones. The Commission reviewed the application. It was the unanimous recommendation that the entire parcel should be zoned R-1 because surrounding properties in Huntington Beach are zoned R-1 and the preferred location for commercial corners is at mile intervals or at the intersections of primary and major highways. A MOTION WAS MADE BY BAZIL AND SECONDED BY CRABB TO INSTRUCT THE DEPUTY SECRETARY TO WRITE A LETTER TO THE WESTMINSTER PLANNING COMMISSION RECOMMENDING AN R-1 ZONE FOR THE ENTIRE PARCEL. DISCUSSION: The Deputy Secretary informed the Commission that members of the Garden Grove Planning Department have agreed to present the results of their study on high rise development to the Planning Commission on October 27, 1964.
