C011HISSIONERS ABSENT: None. Chairman Kaufman called the regular meeting of the City Planning Commission to order at 7:30'P.M. RECESS CALLED: A recess of the Commission was called at 7:35 P.M. because of the general election being conducted in the Council Chambers. COMMISSION RECONVENED: The meting was reconvened at 8:05 P.M. by Chairman Kaufman. TENTATIVE TRACT MAP NO 5755 6: 5756 - Continued Number of Lots: 170 (Residential) Subdivider: S. V. Hunsaker 5 (Common) Total Acreage: 28.5 Engineer: Brown Engr. Cp. Located approximately 1,000 feet south of Adams Avenue on the west side of Bushard Street and legally described as a proposed subdivision of a portion of the NW4, Section 7-6-10. The Deputy Secretary read a letter submitted by S. V. Hunsaker requesting a two.week continuance to allow the developer and the school district to agree on the location of a future school site. The Deputy Secretary read a letter submitted by the Huntington Beach Elementary School District which stated that the school board had decided to abandon the school site within 'Tract 5755 and a revised master plan showing school sites for the district will be submitted to the Planning Department at a later date. The hearing was opened to the audience. The following property owners addressed the Commission and vigorously objected to the proposed development: Joan Leister, 9352 Nautilus Drive, Nancy Getchell, 9422 Nautilus Drive, Hector Langlar, 9392 Nautilus Drive, Bradley Slater, 9262- Nautilus Drive, Thomas Cooper, 9382 Nautilus Drive, and Richard Derby, 9121 Mediterranean Drive. A petition of protest signed by 270 property owners of the adjacent area was presented to the Planning Commission. Thomas Cooper, 9382 Nautilus Drive, addressed the Commission and asked questions pertaining to the sewer system, street lighting, trash collection and type of parking facilities that would be constructed within the project. There being no other comment-, the hearing was closed. Albert To allow the storage of heavy equip - mat and incidental maintenance equipment in the A-1-X General Agricultural District. Located on, the east side of Stewart Street and 145 feet north of Clay Avenue and legally described as Lot 19, Block C, Garfield Street Addition. The Staff Report was read by the Deputy Secretary. The hearing was opened to the audience. James T. Albert, applicant, addressed the Commission and stated that he did not object to any conditions recommended by the Staff. ' There being no other comment, the hearing was closed. • A MOTION WAS MADE BY WORTHY AND SECONDED BY LETSON TO APPROVE USE VARIANCE NO 765 UPON THE FOLLOWING CONDITIONS: 1. Use Variance No 765 shall become null and void N ovember 3, 1969. 2. A front yard setback of 20 feet shall be provided for the office building, 3. The open storage area shall be enclosed with a 6 foot chain link fence. 4. Failure to abide by and faithfully comply with all conditions attached to the granting of UV #765 shall constitute grounds for the revocation of said Use Variance by the City Council. Planning Commission, November 3, 1964 USE VARIANCE NO 766 AT)plicant: L. E. Gates To allow the construction of a nursing home in the R-2 Two Family Residence District. Located on the . south side of Newman Avenue, 410 feet west of Newland Street and legally described as the West 250 feet of the N2j NE4, SE4, SW4, Section 25-5-11. The Deputy Secretary read the Staff Report. The hearing was opened to the audience. Jerry Daniel addressed the Commission and questioned several conditions suggested in the Staff Report. Bill Hartge, Deputy Director of Public Works, addressed the Commission and suggested that an easement on the north side of the property should be pro- vided to allow for a future street extension to the north. There being no other comment, the hearing was closed. It was the consensus of the Commission that approval of Use Variance No 766 would be in order because the property is adjacent to a church site and cemetery. A MOTION WAS MADE BY CRABB AND SECONDED BY MILLER TO APPROVE USE VARIANCE NO 766 UPON THE FOLLOWING CONDITIONS: 1. Newman Street shall terminate in a cul-de-sac. Additional right-of-way shall be provided through an easement agreement at the east end of said cul-de-sac. Said easement agreement shall be approved by the Department of Public Works and it shall provide for a future street extension to the north when required. 2. Newman Street shall be dedicated and improved to City Standards. 3. Street -trees and street lights shall be 'installed to Department of Public Works Standards. 4. Drainage fees shall be paid. 5. Five percent of the parking lot shall be landscaped and permanently maintained. 6. All yard requirements of the R-2 zone shall be complied with except a 10 foot rear yard setback shall be allowed along the south property line as depicted on,the plot plan. 7. A 6 foot masonry wall shall be constructed along the west, south and east property lines. Said wall shall not exceed 42 inches in the front yards. 8. A new plot plan shall be submitted for approval by the Planning Department. 9. Failure to abide by and faithfully comply with all conditions attached to the granting of UV #766 shall constitute grounds for the revocation of said Use Variance by the City Council. Located at the northwest corner of Beach Boulevard and Warner Avenue in the C-1 N6ighborhood Commercial District and legally described as'Tract 194, Block A. Lots 151 through 162 and Lots 131 through 136. The -Staff Report was read by the Deputy Secretary. The hearing was opened to the audience,, there being no comment, it was closed. A MOTION WAS MADE BY BAZIL AND SECONDED BY WORTHY TO APPROVE USE VARIANCE NO 767 UPON THE FOLLOWING' CONDITIONS: 1. The subject sign shall not exceed 35 feet in height. 2. All applicable provisions of the Building Code and the Huntington Beach Ordinance Code shall apply. 3. Failure to abide by and faithfully comply with all condi- tions attached to the granting of UV #767 shall constitute grounds for the revocation of said Use Variance by the City Council. To waive the 68 foot minimum require- ment for 90 degree off-street parking to permit 65' foot wide parking area in the C-4 Highway Commercial District. Located 140 feet north of Yorktown Avenue and 135 feet west of Beach Boulevard and legally described as a portion of Block 2508 and the E'ly 100 feet of Block 2507, East Side Villa Tract. A precise landscape plan shall be submitted to the Planning Department for approval. 5. Parking space number 12 on Parcel 1 shall be relocated to permit total clearance of the driveway'approach from Beach Boulevard. 6. The driveway on Parcel 1 shall have a minimum width of 25 feet. 7. The parking space on Parcel 2 which extends into the driveway, perpendicular to Yorktown Avenue, shall be relocated to permit -total clearance of said driveway, 8. All yard requirements of the C-4 Zone shall be compied with, however, the required 5 foot interior side yard need not be provided. 9. A 6 foot masonry wall shall be constructed along the west property line. Said wall shall not exceed 42 inches in' the front yard. 10. A 6 foot masonry wall shall be'constructed along the east property line between the service station and proposed motel. Said wall shall not exceed 42 inches in the front yard. 11. Located approximately 990 feet east of Beach Boulevard and 660 feet south of Ellis Avenue and legally described as the E2, SE4, NW4, SW4, Section 36-5-11. The Staff Report was read by the Deputy Secretary. The hearing was opened to the audience. Vernon Clark and Douglas Waterman, applicant representatives, addressed the Commission and explained the proposal. There being no further comment, the hearing was closed. Planning Commission, November 3, 1964 A MOTION WAS MADE BY MILLER AND SECONDED BY LARKIN:: TO APPROVE USE PERMIT NO 258 UPON THE FOLLOWING CONDITIONS: 1. Provide sufficient public right-of-way and improve to City Standards at least two travel lanes from the project to Ellis Avenue or wait for the formation of the proposed improvement district. 2. Dedicate to City Standards the proposed Chapel Lane,and Modale Drive adjacent to the project or wait for the formation of the proposed improvement district. 3. Construct a sewer system within the project to Building Department Standards or connect to the system proposed for construction under the improvement district. 4. Construct a water and fire system and connect to an adequate source of supply meeting approval of the Director of Public Works and Fire Chief. 5. Submit a plan of grading and bank protection for approval by the Director of Public Works and the Director of Building and Safety. 6. Submit a plan for approval by the Director of Public Works which solves the drainage problem on the property. 7. Install street trees and street lights to Department of Public Works Standards. 8. Building exits and sidewalk widths shall be approved by the Fire Department. 9. A•minimum turning radius of 25 feet shall be provided for 90 degree parking spaces.- 10. A 6 foot planting area in the center of the parking bays shall be installed and permanently maintained. 11. Landscaping shall be installed substantially as indicated on the plot plan. 11 12. Failure to abide by and faithfully comply with all conditions attached to the granting of UP #258 shall constitute grounds for the revocation of said Use Permit by the City Council. Henricksen Change of Zone from R-3 Limited Multiple Family Residence District and R-4 Multiple Family Residence District to C-3 General Business District with setback provisions. Located on the east side of Fifth Street and on the north and south side of Orange Avenue and legally described as follows: From R-3 to C-3: Lots 16, 17, 18, 19, 20, and 21, Block 404 Main Street Section. From R-4 to C-3: Lots 22, 245 26 and 28, Block 304, Huntington Beach Tract. The hearing was opened to the audience; there being no comment, the hearing was closed. RESOLUTION NO 484 A Resolution of the City Planning Com-, mission Recommending approval of Zone Case No 484'to the City Council. A MOTION WAS MADE BY WORTHY AND SECONDED BY BAZIL TO ADOPT RESOLUTION NO 484 RECOMMENDING APPROVAL -OF ZONE CASE NO 484 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. The preliminary land use studies for Study Area V indicate commercial development for this general area. 2. The property to the north, east and south is presently zoned C-3 . The hearing was opened to the audience; there being no comment, it was closed. The Deputy Secretary informed the Commission that the subject zone change from A-1-X to R-1 is routine. -RESOLUTION NO 486 A Resolution of the City Plannin , Com- mission Recommending Approval of Zone Case No 486 to the City Council. A MOTION WAS MADE BY LARKIN AND SECONDED BY MILLER TO ADOPT RESOLUTION NO 486 RECOMMENDING APPROVAL OF ZONE CASE NO 486 TO THE CITY COUNCIL FOR THE FOLLOWING REASON: 1. This change of zone involves an approved single family tract development soon to be constructed. ROLL CALL VOTE: AYES: Crabb, Let -son, Bazil, Kaufman, Worthy, Miller, Larkin NOES: None. USE PEL MIT NO 257 - Continued Applicant: Mont,�omery - Stellrecht To allow the construction of a 20 unit apartment project in the R-2 Two Family Residence District to -extend more than 150 feet from a public street. Located on the west side of Newland Street and approximately 720 feet north of Talbert Avenue and legally described as the East 264 feet of the North 300 feet of the S2, N 2 E2, SE 4, SW4, Section 25-5-11. The Deputy Secretary read the Staff Report. - The hearing was opened to the audience. James Montgomery, applicant, addressed the Commission and stated that there were no objections to the conditions suggested in the Staff Report. There being no other comment, the hearing was closed. A MOTION WAS MADE BY WORTHY AND SECONDED BY MILLER TO APPROVE USE PERMIT NO 257 UPON THE FOLLOWING CONDITIONS: 1. A division of land shall be filed. 2, Newland Street shall be dedicated and improved to City Standards. 3. Street lights and street trees shall be installed on Newland Street to City Standards. 4. A 6 foot block wall shall be constructed along the north and west property lines. 5. A 6 foot concrete block wall shall be constructed to City Standards along Newland Street adjacent to all houses that back -on to Newland Street. 6, Vehicular access rights shall be dedicated to the City on Newland Street, except at the "Drive Approach" and at the "Paved Easement". -8- 11/3/64 70 Wage #9, Minutes: H. A copy of the recorded easement shall be submitted to the Director of Public Works and Building Department for their approval.' 8. Sewer and water plans shall be submitted to the Director of Public Works,and Building Department for their approval. 9. Drainage fees shall be paid. 10. The amount, size, and location of off-street parking facilities shall -meet the R-2 Zone requirements. 11. All dwelling units shall be two bedroom only. 12. The 114 Car Garage" that takes access from the "Paved Easement" shall be re -located to a central point on said easement. 13. All yard requirements of the , R-2 Zone shall be complied with. This condition shall include 15 foot rear yards and 15 feet- between main dwellings. 14. Failure to abide by and faithfully comply with all condi- tions attached to the gr)nting of Use Permit No 257 shall constitute grounds for the revocation of said Use Permit by the City Council. DEF INIrIONS: SIGNS The Deputy Secretary informed the Commission that the proposed amendment to Article 970 was tabled at the last meeting for further study and discussion. Discussion was held and it was the consensus to, continue said amendment for further study. A MOTION WAS MADE BY KAUFMAN AND SECONDED BY BAZIL TO CONTINUE THE HEARING PERTAINING TO THE PROPOSED AMENDMENT TO ARTICLE 970 "SIGNS" FOR FURTHER STUDY. ROLL CALL VOTE: AYES: Crabb, Letson, Bazi1, Kaufman, Worthy, Miller, Larkin. NOES: None. ABSENT: None. THE MOTION CARRIED. COMMUNICATION: NEWLAND RANCH The Deputy Secretary read a communication submitted by Mrs. Gilbert Turnbull-, Chairman of the Philanthropy Committee, Junior Woman's Club of Huntington Beach, requesting an all effort be made to preserve the Newland Ranch House and restore it as a historical monument. The Commission considered the request and by unanimous vote recommended.to the City Council that every effort be -made to preserve the Newland Ranch House as a historical monument in its present location or some other suitable location. Planning Commission, November 3, 1964. 71 PROPOSED AMENDMENT TO HUNTINGTON BEACH ORDINANCE CODE: The Commission discussed proposed amendments to the Huntington Beach Ordinance Code which incorporate into each district a basis for measuring setback lines and thereby eliminating Section 9788, "Establishment of Setback Lines." It was the unanimous decision of the Planning Commission to approve said amendments and recommend them to the City Council for adoption. THE MOTION CARRIED. DEPUTY SECRETARY Kenneth A. Reynolds, Deputy Secretary, suggested to the Commission that a letter of appreciation be sent to Ray Henson and Marshal Linn, members of the Garden Grove Planning Department, for their presentation on high rise developments to the City Planning Commission. ON MOTION BY CRABB AND SECONDED BY BASIL, THE DEPUTY SECRETARY WAS INSTRUCTED TO WRITE A LETTER OF APPRECIATION TO MR. HENSON AND MR. LINN FOR THEIR PRESENTA- TION. THE MOTION CARRIED.
