MINUfES: On motion by Letson and seconded by Worthy, the Minutes of the Huntington Beach Planning Commission of previous meeting of October 27, 1964, were accepted as transcribed and mailed by the Secretary. USE VALIANCE NO 745 - Continued Applicant: Lon E. Peek To allow the construction. of a " trailer park in the A-1-X General Agricultural District. Located at the northwest corner of Heil Avenue and Goldenwest Street and legally described as follows: PARCEL I: The SE4, NEk, Section 22-5-11. PARCEL II: The Ez, E2, SW4, NEk, Section 22-5-11. The Deputy Secretary read a letter submitted by the applicant requesting withdrawal of UV #745. Martin Boxstaller, 6912 Lenis Circle, addressed the Commission and questioned whether or not,.the applicant would be able to submit a new application for a similar request. Chairman Kaufman informed Mr. Box- staller that inasmuch as the applicant has withdrawn his application he has the privilege of applying for a new variance at any time. The Tentative Map revised November 10, 1964, and received November 12, 1964, shall be the approved layout.- 2. Lighting systems shall be installed on all private drives with illumination at least equal to lighting on public streets and all lighting on private drives and common areas shall be approved by the Director of Public Works. 7. All public streets shall comply with City Standards. 8. Prior to completion of Tentative Tract 5562, Bushard Street shall be improved to City Standards across the Edison Company Right-of-way. 9. Private street structural sections shall comply with Planning,Commission Standards. 10. All utilities shall be installed underground. 11. The location of rubbish collection areas shall meet the approval of the Director of Public Works. 12. All rights for construction of any structure not shown on the approved plot plan shall be dedicated to the City. 13. All provisions for a community association and for per- petual maintenance of the common area and recreation area shall be approved by the Planning Department and City Attorney. 14. Design of ingress and egress points on Bushard Street shall be approved by the Department of Public Works. 15. All Standard Subdivision requirements that are applicable sh shall be complied with. The Deputy Secretary read the Staff Report. The hearing was opened to the audience. The development plan dated November 4, 1964, shall be the approved"plan. 2. The CC&Rls shall contain at least the following provisions: a. Recreation areas within the development shall be reserved for the exclusive use of residents within the project and their non-paying guests. b. Owners and/or tenants shall be required to abide by Association rules and the re shall be penalties for violation of said rules. 4. Joe Dray, representing the subdivider, addressed the Commission and stated that there were no objections to the conditions recommended by the Subdivision Committee. There being no other comment; the hearing was closed. A MOTION WAS MADE BY WORTHY AND SECONDED BY LARKIN TO APPROVE TENTATIVE TRACT MAP NO 5786 UPON THE FOLLOWING CONDITIONS: 1. The Tentative Map received November 3, 1964, shall be the approved layout. 2. The property line radius of all cul-de-sac streets shall be 50 feet. 3. The minimum frontage of lots on knuckles shall be 45 feet. 4. The drainage easement shall be 10 feet wide. 5. Commission discussion was held. It was the consensus to refer Tentative Tract 5786 to the City Council for decision because public waterways are included in the revision to acreage. RESOLUTION NO 488 A Resolution of the City Planning Com- mission l:ecommendina Approval of `Lone Case No 488 to the City Council. A MOTION WAS MADE BY CRABB AND SECONDED BY MILLER TO ADOPT RESOLUTION NO 488 RECOMMENDING APPROVAL OF ZONE CASE NO 488 TO THE CITY COUNCIL FOR THE FOLLOWING REASON: 1. To permit the drilling of one or more oil or gas wells into subsurface strata underlying the Huntington Harbour real estate development in deviation to the uses permitted in the R-1 Single Family Residence'District. Located at the southeast corner of Warner Avenue and the possible southerly prolongation of Algonquin Street and legally described as a portion of the NE4, NW4, Section 29-5-11. Further legal description on file in the Planning Department Off ice. The Deputy Secretary read two letters of protest submitted by adjacent property owners. The Staff Report was read by the Deputy Secretary. The hearing was opened to the audience. John Richardson, representing Grover Collins Gas and Oil Company, addressed the Commission and explained the operation of the proposed drilling site. Robert Krueger, Attorney for Huntington Harbour Corporation, addressed the Commission and explained the lease -agreement between"Huntington Harbour.,. Corporation and C. H. Hartke and others. Jerry Jones, representing a group of homeowners in the adjacent area, addressed the Commission and objected to the proposed oil drilling operation. Martin Fenton, representing Huntington Harbour Corporation, addressed the Commission and spoke in favor of the subject variance. There being no other comment, the hearing was closed. The Deputy Secretary informed the Commission that Huntington Harbour petitioned for a change of zone to R1-01 two months ago on the same property. At that time the Commission recommended approval; however, the City Council overruled the Commission's recommendation and denied the change of zone. -8- 11/17/64 Page #-9, Minutes: H. B. AREA VARIANCE NO 772 Applicant: Alco-Pacific Construction To allow a 10 ft front yard setback in deviation to the required 15 ft front yard setback in'the R-1 Single Family Residence District. Located at the northeast corner of Slater Avenue and Springdale Street and legally described as Lots 2, 4, 7, 24, 31, 34, 36; 37, 40, 46, 49, 52, 53, 57, 58, 67, 68 and 75, Tract No 5637. The hearing was opened to the audience. John Ballew, representing the applicant, addressed the Commission and offered to answer questions. the hearing was closed. There being no other comment, The Deputy Secretary informed the Commission that the requested 10 foot front yards are on lots with curved driveways. He stated that the same type of request was granted as an experiment on Tract No 5575 and apparently the 'idea has been accepted by the Planning Commission. A MOTION WAS MADE BY BASIL AND SECONDED BY CRABB TO APPROVE AREA VARIANCE NO 772 UPON THE FOLLOWING CONDITION: 1. All lots with a 10 ft front yard shall have a curved driveway. Located on the north side of Warner Avenue and 250 feet east of Goldenwest Street and legally described as Lots 31 and 32, Block C, Tract No 392. the Staff Report. Talbert Corporation To allow the construction of a restaurant, cocktail lounge and a retail use in the C-4 Highway Commercial District. Located 130 feet west of Beach Boulevard on the north side of Adams Avenue and legally described as the west 150 feet of Block 1708, East Side Villa Tract. The Deputy Secretary read the Staff Report. The hearing was opened to the audience. Francis Herrera, representing the applicant, addres-sed the Commission and spoke in favor of the proposed commercial development. There being no other comment, the hearing was closed. A MOTION WAS MADE BY BAZIL AND SECONDED BY WORTHY TO APPROVE USE PERMIT NO 259 UPON THE FOLLOWING CONDITIONS: 1. Adams Avenue shall be dedicated and improved to City Standards. 2. Street lights and street trees shall be installed to Department of Public Works Standards. 3. Only one driveway shall be provided and the location of said driveway shall be approved by the Department -of Public Works. 4. All off-street parking shall be to Planning Commission Standards. 5. Five percent of the parking lot shall be landscaped and permanently maintained. 6. A new plot plan shall be submitted for approval by the Planning Department. Said plot plan shall include all data required on the "Supplement to Petitions" and it shall include an off-street parking layout to Planning Commission Standards with provisions for the required landscaping. DIVISION OF LAND NO 236 Ap licant: Dr. James M. Hobbs (Mormon Church) To allow the division of land into two separate parcels. Located 600 feet north of Talbert Avenue on the west side of Newland Street and legally described as: PARCEL I: The North 300 feet of the West 224 feet of the East 264 feet of the S 2j NE4, SE4, SW4, Section 25-5-11. PARCEL II : The SZ, NE4, SE4, SW4, Section 25-5-11; excepting therefrom the North 300 feet of the West 224 feet of the East 264 feet. The hearing was opened to the audience; there being no comment, the hearing was closed. A MOTION WAS MADE BY WORTHY AND SECONDED BY CRABB TO RECOMMEND APPROVAL OF DIVISION OF LAND NO 236 TO THE CITY COUNCIL UPON THE FOLLOWING CONDITIONS: 1. Newland Street shall be dedicated and improved to City Standards. 2. Street lights and street trees shall be installed on Newland Street to City Standards. 3. Drainage fees shall be paid. 4. The 30 foot strip connecting Parcel #2 to Newland Street and the designated 10 foot easement along the south line of Parcel # 1 shall be improved as a street to Department of Public Works Standards.- Said 30 foot strip and 10 foot easement shall be perbetually maintained as a mutual vehicle accessway to both Parcel #1 and Parcel #2. 5. Division of Land No 236 shall not be effective until an agreement is signed and recorded agreeing to the conditions listed above. Gates, requesting that an amendment to Use Variance No 617 be made which would permit erection of an electric sign as part of his nursing home in the R-2 Zone. Larry Gates, applicant, addressed the Commission and stated that he did not realize that an additional application was required to permit the construction of the sign. Chairman Kaufman informed Mr. Gates that he is required by ordinance to file an application before he can construct the electric sign.
