Mayor Shipley called --the regular meeting of the City Council of they

The Clerk presented ar request .lr on the Board of Supervisors for the City

the County n permit on as Deno fee basis," for work on the -remodeling of

the Federated American Indians to conduct a fund drive by radio and

and J. E. John, expressing appreci.ati.€rn for the € ecision of the Council
in refusing to grant an pail variance to Huntington Harbour, was received
and ordered filed. Motion carried.
Ti hl� HIGHWAYS CODE - PROPOSED 1...E€AISLATIO
On motion by Stewart, seconded by Gisler, a. letter from Ala A. Sturges,
.legal consultant to Senator John Schmitz, proposing a meeting to dis-
cuss legislation to take from, -the Highway Commission power which it
derives from the various sections of the Streets & Highways Code, was
received and ordered filed. Motion carried.

The Clerk presented a copy of a letter from the 5-Points Merchants
Association to the Huntington Beach Police Department, expressing con-
cern of the undesirable element being brought in to replace the br'aceros
and requesting police protection.
Can motion by Welch, seconded by Stewart, the copy of the letter from the
5-Point-_ Merchants Association, was referred to the Chief of Police.
Motion carried.
The Clerk presented a petition from the Senior Citizens, requesting the
City to provide n place to meet, other than lake Park k Clubhouse, as the
membership of the group has increased and than present facilities are no
.longer adequate.
On motion by Welch, seconded by Gisler, Council appointed Mayor Shipley
as a committee of one, to work with the Senior Citizens in resolving
their facilities problem. Motion carried.
On motion by Lambert, seconded by Gisler, Council granted permission to
the Westminster High School Girl's athletic Association to solicit door-
to-door to sell candy bars from February 17, 1965 to March :$, .1.96 , to
help support their Association. Motion carried.

The Cletk presented a .letter of protest from Voorheis-Tr°1_ndle-Nelson, Inca
on behalf of Luxury Homes, protesting Condition Number 6 - "Providing a
walkway, etc,'," imposed when a one year extension of time was granted.
NIr. Names Crosby, Fngineer9 with Varorheis-Tr=indle-Nelson, lncc , addressed
the Council and requested -that Condition Number 6 be € odified to delete
the walk -way between Lot 12 and 13, and place said walkway on the south
line of Lot 1.
On motion by Lambert, seconded by Gisler., Council approved the request
of Mh-. Crosby and granted the modification to Condition No. 6 on Ten-
tative Tract Map # 331, to delete the walk -way between. Lot 12 and 13,
and place said walkway on -the south line of Lot 1. Motion carried.
CAN RED CROSS
On motion by Welch, seconded by Stewart, Council_ granted permission to
the Huntington Beach Branch of the American Red Cross to solicit; 'for
lands in the City during the month of March, 1965. Motion carried.
AL, IFIANK
The Clerk presented a request from the United California Baal m Edinger
and Beach Office --- for the use of a trailer as temporary office space.
from March lst to September 30th, at which time they expect to have
their building completed.
Mr. John by Higley, 6142 Sydney Drive, City-, Manager of the Edinger
Branch of the United California Bank-, addressed -the Council and re-
quested permission to use -the trailer for approximately six months.
Can motion by Stewart, seconded by Gisler, Council granted permission
to the United ted California Bank to use a trailer for temporary office
space for a period of six months, subject to the posting of a $1,000
bond for removal of same. Motion carried.

On motion. by Welch, seconded by. Lambert, an application for business
license to conduct the business of food and freezer safes, was re-
ceived eived and ordered filed. Motion carried.
%.'�502 - PROTEST TO GRANTING
n motion, by Stewart, seconded by Gisler, a letter signed by four
property owners on Nautilus Drive, City, protesting the granting of
Zone Case No, 502 by Council. on February 1, 1965, from RA Residential
Agricultural District to RI Single Family Residence District, was re-
ceived and ordered filed. Motion carried.

S RESIGNATION OF HARRY IETSON FROM PLANNING COMNfISSION
The Clerk read a letter from Harry Letson, tendering his resignation
from the City Planning Commission, effective February 16, 1965, due
to business coiwittments.
On motion by Lambert, seconded by Gisler, Council accepted the res-
ignation of Harry Letson from the Planning Commission, with regrets,
and directed the Clerk to prepare a service plaque for presentation
to Mr. Letson, Motion carried.
�4-,SE�MTH S. LAWSON 11PPOINTED TO SERVE, ON PLANNING COMMISSION
On motion by Stewart, seconded by Welch, Council appointed Kenneth
S. Lawson as a Planning Commissioner, to fill the term vacated by
Harry Letson which expires on October 16, 1967. Motion carried.
REPORT OF' P. ACQUISITION
Acting Planning Director Kenneth Reynolds addressed the Council and
gave a report on the status of Parks in the City, and presented an
evaluation sheet with an inventory of the 13 parks located in the
City to date"
IC1 GLEN YLU HOMEOWNERS - PROTEST CONDOMINIUM DEVELOPMENTS
Mr. Mark Porter, 19842 Providence Lane, City, addressed the Council
on behalf of the Glen Mar Homeowners and protested recent actions of
the City Planning Commission in approving several condominium devel-
opments in the area of the Glen Mar Homes, and protested the granting
of Use Variance 780 by the City Council,

Mr. James Montgomery, 8082 Brush Drive, City, addressed the Council
and requested City participation in the installation of an 8" water
line.
The Public Works Director informed the Council that it was his rec-
ommendation that the City not participate at this time, as funds were
not available, but that arrangements could be made for reimbursement
as new homes tie into the line.
Mr, Montgomary requested waiver of fees and was informed by Mr. IvIieeler
that fees were not necessary in this case, and that a Reimbursement
.Agreement would cover same.
HUINTINGTON HARBOUR - BLDG PERMIT 224 - UV 761
Mr. Martin Fenton, representing Huntington Harbour Corporation, ad-
dressed the Council)and submitted a letter and modified drawings
acceptable to the Huntington Harbour Homeowners regarding issuance
of Building Permit #42224.
On motion by Stewart, seconded by Gisler, Council accepted the plot
plan, as modified, from Hunting -ton Harbour-, in conjunction with Use
Variance - UV #761 in Tract No. 5202, and directed the Building
Director to Issue Building Permit #224. Motion carried.
A b BELOCATION PROTEST - RALPH QUICK
Mr. Ralph Quick, 8101 LaPalma Avenue, City, addressed -the Council and
protested suspected irregularities in buildings moved onto property
adjacent to his b.ome, and stated that he felt the Ordinance Code was
being violated.
Mr. Cleveland, Building Director, requested a copy of fir. Quick's ".
letter for follow up. The Building Director and Councilmen were di-
rected to meet and investigate the matter at their earliest convenience.

LAUV 780 m JACK HALL PROTEST
Mr . Jack Hall, 9381 Nantucket cket Drive, City, addressed the Council and -
inquired as to what had been € one in regard to the sell report study
of the Mobil Home Park north of Yorktown and west of Hr ookhur9st Street,
as directed at the Council meeting of January 4, 1965. Mr. Hall re-
quested a reply and report to the Homeowners Association on non-
conforming uses and sail report.
Council directed Acting Planning Director Reynolds to prepare n re-
port and file one with the pity Clerk, forward copies to each, Council-
man and send one to the Glen Mar Homeowners Association.
RECESS
Mayor Shipley called a recess of the Council at 8o 58 P.M.
ICouncil was reconvened at 9:15 Facia by the Mayor.
Mayor Shipley announced that this was the day and hour set for a
public hearing on. Resolution No. 498 of the City Planning Commission,
recommending approval of a portion of Zone Hiss No. 498, on property
located south of Heil Avenue, north of Los Paton, crest of Bolsa Chica
and east of .Al-gonquin Street, and directed the Clerk to read the legal
notice'.
The Clerk read notice of public hearing on Zone Case No. 498 as pub-
lished in the Huntington Beech. News on February 4, 1965, setting; the
hour of 7 a 30 o'clock P.M., or as soon thereafter as possible, on
Monday the 15th day of February, 1965 in the Council Chamber of the
Civic Center!, Huntington. Beach, California, as the time and place for
a public hearing for the purpose of considering a Resolution of Intent
for a change of zone to regulations of the Districting Ordinance', fr°€ w:
RI Single Family Residence District, to: R2 Two Family Residence Dis-
trict and H3 Limited Multiple Family Residence District; and from
County ]. General Agricultural, AR Agricultural Residential and R4
Suburban Residential, to: City R2 Two Family Residence District and
R3 Limited Multiple Family Residence District.
The Clerk informed the Council that they had been provided with copies
of the Planning Director's transmittal and the Resolution of the

read a letter from Howard Hiroshima requesting C2 zoning for his
property. The Clerk stated that he had received no further communica-
tions or written protests to the Zone Case or to the recommendation

There being no one present to speak on the matter, and there being np
further protests filed, either oral tart written, the hearing was �cic ed
by the Mayor.
Kenneth Reynolds, Acting Planning Director, gave a resume l of the ac-
tion of the Planning Commission in approving Zone Case No. 498.
On motion by Lambert, seconded by Gisler, Council. postponed action on
Zane Case No. 498. Motion carried.
PUBLIC HEARING - ZONE CASE NO. 499 - ACTION CONTINUED
Mayor Shipley announced that this was the day and hour set for e
public hearing on Resolution No. 499 of the City Planning Cam€iss.icn,
recommending approval of Zone Case No. 499, on property located south
of Heil Avenue, north of Lays Fates Street, west of llcl a Ch.ica Street
and east of Algonquin Street, and, directed the Clark to need the
legal notice.

PU8L1C HEARING - ZONE CASE -NO. 503 - WITHDRAWN
Councilman Gisler requested and was granted permission to abstain from
action on Zone Case #5 3, due to a conflict of interest, and vacated
his place at the Council table.
Mayor Shipley announced that this was the day and hour set for a public
bearing on Resolution No. 503 of the City Planning Commission, recom-
mending approval of Zone Case No. 503, on property located on the
southeast corner of Hroo hurst Street and Atlanta. Avenue, and directed
the Clerk to read the .legal, notice.
The Clerk read notice of public hearing on Zone Case No. 503 as
published is the Huntington Beach News on February 4, 1965, setting
the hour of 7v o'clock P.M., or as soon thereafter as possible, o
Monday the 15th day of February, 1965, it the Council. Chamber of the

written protests to the Zone Case or to the recommendation of the Plan-
ning Commission.
Mayor Shipley declared the hearing open.
There being no one present to speak on the matter, and there being no
protests filed, either oral or written, the hearing was closed by
the Mayor.
On motion by Stewart, seconded by Lambert., Council granted the request
of Deane Brothers to withdraw Zone Case No. 503,s Motion carried,
Councilman Gisler resumed his place at the Council table.

Mayor Shipley announced that this was the day and hour set for as public
hearing on Resolution No. 504 of the City Planning Commission, recom-
mending approval of Zone Case No. 504, on property located on the south
side of Liberty Street 1621 west of Beach Boulevard, and directed the
Clerk to read the legal notice.
The Clerk read notice of public hearing on Zone Case W 504 as pub-
lished in the Huntington Beach News on February 4, 1965, setting the
hour of 7:30 o'clock P.M., or as soon thereafter as possible, on Mon-
day the 15th day of February, 1965, in the Council Chamber of the
Civic Center, Huntington Beach, California, as the time and place for
as public hearing for the purpose of considering a Resolution of Intent
for a change of zone to regulations of the Districting Ordinance, from:
R4-X Suburban Residential District, toz C1 Neighborhood Commercial
District, with setback provisions.
The Clerk informed the Council that they had been provided with copies
of the Planning Director's transmittal and the Resolution of the Plan-
ning Commission, recommending approval of Zone Case No. 504, and
stated that he had received no communications or written protests to
the Zone Case or to the recommendation of the Planning Commission.
Mayor Shipley declared the hearing open.
There being no one present to speak on the matter, and there being no
protests filed, either oral or written, the hearing was closed by the
Mayor.
On motion by Lambert, seconded by Gisler, Council concurred with the
recommendation of the Planning Commission, and directed the City Attor-
ney to prepare an Ordinance effecting the change of zone in Zone Case
No. 504. Motion carried-

hearing for Monday, March 1, 1965, at 7:30 P.M., or as soon there-
after as possible, on Zone Case No� 505, and directed the Clerk to
publish notice of same. Motion carried.

of a petition signed by eight residents of Doriane Circle, requesting
that the opening in the block wall facing Edwards Street and Dorian
Circle, be closed, with costs to be divided equally between the eight
residents.
On motion by Stewart, seconded by Welch, Council referred the request
to close the block wall openings facing Edwards Street and Dorian
Circle to the Director of Public Works to proceed with the work at
the petitioners expense. Motion carried.

ITRACT 5251 - DEDICATED ... INPROVENMEENTS ACCEPTED
The Clerk presented a recommendation from the Director of Public Works
that dedicated improvements for Tract No. 5251 - Fashion Homes, Inc.
(Johnson)- be accepted, and authorization granted for the release of
the Improvement Bond and Monument Bond and termination of the Sub-
division Agreement.

On motion by Welch, seconded by Gisler, Council accepted the improve-
ments dedicated for public use in Trani No. 5251, and authorized the
release of the Monument Bond and Improvement Bond and termination of
the Subdivision Agreement; and directed that the developer and bond-

of Monument Bond, Improvement Band and Subdivision Agreement for Tract
No. 563 a Alco-P acific.
On motion by Lambert � seconded. by Welch, Council. accepted Monument
Bond No. 934995 - Glen Falls Insurance Company, and directed the Clerk
to file same; accepted the A r eem6nt-in-Lies. of Bond and Subdivision
Agreement, and authorized the Mayor and City Clerk to execute same
on behalf of the City. Motion carried.

The Clerk presented a transmittal from the Director of Public Wanks
of deeds -to the City as follows
(a) Church. of Latter Day Saints of Jesus Christ for street widening
of Newland Street.
(h) The Roman Catholic Archbishop of Lars Angeles for street widening
at the northeast corner of Talbert Avenue and Beech Boulevard.

On motion by Lambert, seconded by Gisler, Council directed the Finance
Director to make final payment to Earn Construction Company the amount
of $2,185.61 for completion of the Overmyer Reservoir Unit 142, inas-
much as bonds had been received to cover unpaid hills Motion carried.
P The Clerk presented a transmittal from the Director of Public Works-,
with recommendation for approval, requesting authorization to proceed
with arrangements for deeds and agreement relating to Standard Oil
Company ° s proposed transfer of a portion of its -- marketing division
operations to its Pipeline Department at Talbert Avenue and Gotha,rd
Street.
On €potion. by Welch, seconded by Stewart, Council. approved the request
outlined by the Public Works Director to bring the Standard Oil Company
Talbert and Gothar°d property up to City standards, and directed him to
proceed with arrangements as presented. Motion carried.

EXCEPTION V'
Under deferred items, the Clerk presented Conditional Exception ---
UV #782 - Huntington Harbour Corporation, with recommendation for
approval of the Planning Commission - to create lots without direct
access to public street and with less than the required 6000 square
feet mi ' nimum, on property located northeast of Broadway Street and
Bay -view Drive. Action had been deferred from the meeting of February 1,
1965 until the Public Works Director could notify property owners to
de -annex from Sanitation District #11.

On motion by Welch, seconded by. Lambert, Council deferred action on
UV e,7-82 - Conditional Exception to Huntington Harbour, until such
time as property owners are notified to de -annex from Sanit&ti6n
District a 14otion carried.
CF - TAX I RTIFICATE OF NEED & NEC - BUSINESS LICENCE - HERMA, N TATE x
The Clerk presented the application for Certificate of Public Need
and Necessity submitted by Herman R. Tate, to operate a fleet of taxi
cabs within the City. The matter was deferred for study by the Ad-
ministrator, Police Chief and Attorney at the meeting of February 1,
The Clerk presented a letter of recommendation from J. P. Devine,
Assistant District Attorney of Orange County.
On motion by Stewart, seconded by Gisler, Council granted a Certificate
of Public Need and Necessity to Herman R. Tate to operate a fleet of
taxi cabs in the City, subject to approval by the City Administrator
and Chief of Police. Motion carried,
,DVCHI'LDRENS ASTHIN1A RESEARCH INSTITUTE & HOSPITAL - SOLICITATIONS
The City Administrator reported his findings concerning the Children's
Asthma Research Institute & Hospital request to solicit funds door-to-
door in the City on March 5, 6 & 7, 1965.
On motion by 1,ambez1t, seconded by. Welch, Council granted permission
-to the Children's Asthma Research Institute & Hospital to solicit
fupds door-to-door on -March 5, 6 &7, 1965, subject to conditions
stipulated by the Police Department. Motion carried.
HUNTINGTON DRIFTWOOD LEASE AGREEMEWr - REPLACEMENT BOND

The Clerk presented Resolution No. 2122 relative -to submission of a
new bond to replace the existing bond on the Huntington Driftwood Lease,
which was referred to the City Administrator and City Attorney at the
meeting of February 1, 1965.
On motion by Stewart, seconded by Lambert, Council deferred action on
Resolution No. 21-22 until the meeting of March 1, 1965. Motion
carried.
4- AWARD OF CONTRACT - WATFR MAINS - SANITARY PIPELINE CO
The Clerk presented a letter of recommendation from the Public Works
Director, concerning the award of contract on water mains and services
In Blocks 107 to 607, 108 to 608, and in the following streets: York-
town, Hunting -ton, Clay and Delaware. !Ir. Wheeler informed the Council
that a review of the bids presented at the meeting of February 1, 1965
had been completed and recommended that the contract be award6d to the
low bidder, Sanitary Pipeline Company, Inc. - $59,767.20.
On motion by Stewart, seconded by Gisler, Council awarded -the contract
for water mains -to Sanitary Pipeline Company, In.c. - Huntington Beach -
for the low bid of $59,767.20; rejected all other bids; and directed the
Clerk to return the bid bonds to the unsuccessful bidders upon execution
of the contract. Motion carried.

The Clerk presented n request from the Fire Chief for authorization

The City Administrator presented n request from the Anthony Swimming
Pool Company for Council consideration of an amendment to the Ordinance
Code regarding the cash bond required with the issuance of swimming
pool. permits. The Administrator recommended that the Ordinance be
Hallowed to stand as It now exists, due to the lack of responsibility € f
several swimming pool builders.

from the Anthony Swimming Pool Company .for an amendment, to the Ordinance

The City Administrator presented a letter from the Orange County
Building Services Department requesting that the City repaint the
Huntington Beach Municipal Court, and that acoustical the be placed
on the ceiling in the Marshal's Office. Mr. Miller recommended that
only the building be repainted at this time.
On motion by Welch, seconded by Gisler, Council authorized the re-
painting of the Municipal Court Building by City forces, upon receipt
of the rental payment on the old fire station building. Motion carried.

vacated by the promotion of Floyd Belsito to Senior Planning Aide.
This proposal would require the creation of a position of fuld-time
and part-time draftsmen.

Treasurer to cover the purchase of the Peck park site, if acceptable

Acting Planning Director Reynolds informed the Council that the City
had received applications to participate in the State Gant Program
for Regional Facilities., as authorized by the 2.8 Million Dollar 1964
State Bond Issue for Parks.
Following discussion by the Council, a motion was made by Stewart,
seconded by Lambert, directing the City Administrator ester° to proceed with
the filing of an applieetlon for participation in the State Grunt
Program for Regional Facilities, at the earliest possible date; and
