The minutes of March 10, 1965, were accepted as transcribed. AREA VARIANCE NO 65-2 Applicant: Alco-Pacific Constr. Co. To allow a 10 foot front yard set- back in deviation to the required 15 foot front yard setback in the R-1 Single Family Residence District on Lots 14, 16, 18, 203, 41, 47, 502 53, 56, 602 623 65, 672 70, 72, 75, 782 81 and 84, Tract 5638. Also to allow a 5 foot rear yard setback in deviation to the required 10 foot rear yard set- back for one wing of the main building on Lot 41, Tract 5638. Located at the northeast corner of Slater Avenue and Spring- dale Street. The hearing was opened. John Ballew, representing the applicant, addressed the Board and offered to answer questions. There being no other comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY DAY AND SECONDED BY HARLOW TO APPROVE AV 65-2 FOR THE FOLLOWING REASONS: 1. Previous variances of this nature have been granted to other developers for aesthetic reasons which include staggered setbacks. 2. The Planning Commission has instructed the Planning Department to prepare an amendment to the --ordinance to permit this type of request. 3. Lot 41 is an irregular shaped lot and there is sufficient rear yard remaining. Also, the lot line from which the 5 foot setback is measured could be construed as an extended side lot line. ROLL CALL VOTE: AYES: Mandrell, Day, Harlow. NOES: None. THE MOTID N CARRIED. AREA VARIANCE NO 65-3 Applicant: James Strachan To allow a 14 foot rear yard in deviation to the required 15 feet in the R-1-Single Family Residence District. Located at the northeast corner of Springfield Street and Pine Street and legally described as the N2 of Lot 2, Block 1801', Tract 12. The hearing was opened. -1- 3/17/65 Page #2, Minutes, March 17, 1965 James Strachan, applicant, addressed the Board and explained his request. There being no other comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY DAY AND SECONDED BY HARLOW TO APPROVE AV 65-3 FOR THE FOLLOWING REASONS: 1. Similar variances of this nature have been granted in the area. 2. There will be adequate turning radius from the alley. 3. The remaining rear yard is in excess of the minimum yard required by ordinance. ROLL CALL VOTE: AYES: Mandrell, Day, Harlow. NOES: None. THE MOTION CARRIED. AREA VARIANCE NO 65-4 Applicant: Larry F. Klang To allow the use. of an existing block wall in deviation to the 6 foot block wall re- quired for separation between commercial and residential uses. Located at the southwest corner of Edwards Street and McFadden Avenue and legally described as Lot 82, Tract 4275. Six letters -were read; three in favor of the request with modifications and three opposing the request. The hearing was opened. Larry Klang, applicant, addressed.the Board and explained his.plans for landscaping, screening and for providing bumper guards against the existing block wall. He also stated the market would be liable for any. damage to the wall. Mrs.'William Johnstone, 6471 Dunn Drive; Mrs. Howard Bartels, 15532 Toway Lane; Mrs. Weldon Gates, 15522 Toway Lane all addressed the Board and protested using the existing block wall giving as reasons that their privacy would be invaded and it would create a safety problem for their children and pets. Carl Calamia questioned the type of screening and landscaping to be provided by the appli- cant. comments, the hearing was closed. There being no further Board discussion followed. Sam Ferguson, Assistant Building Director, was asked if it would be possible to add one or two courses of block to the existing wall. He stated that the Building Code would not allow this. A MOTION WAS MADE BY HARLOW AND SECONDED BY DAY TO DENY AREA VARIANCE NO 65-4 FOR THE FOLLOWING REASON:' -2- 3/17/65 Page #3, Minutes, March 17, 1965 1. The zoning ordinance,specif ically requires a 6 foot high block wall for separation purposes and the applicant has failed to provide sufficient justification for his request. ROLL CALL VOTE: AYES: Mandrell, Day, Harlow. NOES: None. THE MOTION CARRIED. AREA VARIANCE NO 65-5 Applicant: Lloyd Mannes To allow the use of an existing block wall in deviation to the 6 foot block wall required for separation between commercial and residential uses. Located at the southwest corner of Heil Avenue and Golden - west Street and legally described as Lot 85, Tract 4381; excepting therefrom the Northerly 140 feet of the Easterly 135 feet. The hearing was opened. Lloyd Mannes, applicant, addressed the Board and explained his request. Mrs. Greerly, 16522 Marie Lane; Robert McClellan, 16502 Marie Lane; Kathryn Ashby, 16532 Marie Lane and Helen Schabatka, 16542 Marie Lane, all addressed the Board and opposed the request giving as reasons that their privacy would be invaded and there would be a safety hazard created. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MA DE BY HARLOW AND SECONDED BY DAY TO DENY AV 65-5 FOR THE FOLLOWING REASON: 1. The zoning ordinance specifically requires a 6 foot high block wall for separation purposes and the applicant has failed to provide sufficient justification for his request. ROLL CALL VOTE: AYES: Mandrell, Day, Harlow. NOES: None. THE MOTION CARRIED. DIVISION OF LAND NO 65-1 Applicant: Kaufman & Broad Homes, Inc. To allow the division of nine parcels of land located at the northeast corner of Adams Avenue and Brookhurst Street and legally described as Lots 11, 17, 222 253 302 45, 60, 68 and 83, Tract 5206. Further legal on file. Charles Tenenbaum, representative of the applicant, addressed the Board and explained that this division would involve splitting each of the lots in half and connecting each half to the lot on either side resulting in a larger unit being built -on these lots. hearing was closed.
