MINUTES: The minutes of March 17, 1965, were accepted as transcribed. AREA VARIANCE NO 65-6 Applicant: John W. Arnold To allow a 15 foot rear yard setback in deviation to the required 25 foot required in the A-1-X General Agricultural District. Located approximately 240 feet south of Cypress Street on the west side of Ash Street and legally described as the East 140 feet of the S 2 of Lot 3, Block D, Tract 436. The hearing was opened to the audience. John Arnold, applicant, addressed the Board, and explained that as soon as the new building was completed he intended to demolish the existing building on the pipe rty. There being no further comment, the hearing was closed. Board discussion followed. It was noted that similar variances of this nature have been granted in this area which is master planned for medium density development and the requested setback conforms to the R-2 zone. A MOTION WAS MADE BY HARLOW AND SECONDED BY DAY TO APPROVE AV 65-6 UPON THE FOLLOWING CONDITIONS: 1. Drainage fees shall be paid. 2. The existing building shall be removed prior to final inspection of the new building. ROLL CALL VOTE: AYES: Mandrell, Day, Harlow. NOES: None. THE MOTION CARRIED. DIVISION OF LAND NO 65-2 Applicant: Arthur Hiroshima To allow the division of land into two separate parcels. Located at the southwest corner of Edwards Street and Warner Avenue and legally described as: Parcel 1: The North 460 feet of the E2, NE4, NW4, Section 27-5-11. Parcel 2: The EZ, NE4, NW4, Section 27-5-11; excepting there- from the North 460 feet thereof. Richard Harlow, Secretary of the Board, presented the suggested conditions of approval. Robert cant, addressed the Board and requiring dedication of Warner postponed until after sale of as the property is improved. Board discussion followed. It was their contention that deviation from the standard condi- tions could not be granted inasmuch as the policy requiring dedication has been in effect for some time and there were no exceptional circumstances pertaining to this property which would warrant any special privileges. A MOTION WAS MADE BY DAY AND SEOONDED BY HARLOW TO APPROVE DV 65-2 UPON TIE FOLLOWING CONDITIONS: 1. Street right -of -way shall be dedicated to City Standards. 2. Street improvements includ in street trees and street lights shall be provided to gity Standards on Warner Avenue and Edwards Street at the time the property is developed. 3. Drainage fees shall be paid at the time the property is developed. 4. Division of Land No 65-2 shall not be effective until an agreement is signed and recorded agreeing to the conditions listed above. ROLL CALL VOTE: AYES: Mandrell, Day, Harlow. NOES: None.
