MINUTES: On motion by.Worthy and seconded by Miller, the Minutes of the Huntington Beach Planning Commission of March 16 and 23, 1965, were accepted as transcribed and mailed by the Secretary. - TENTATIVE TRACT MAP NO 5904 - Continued - Revised Number of Lots: 47 Subdivider: Babette, Inc. Total Acrea?e: 9.4 'Engineer: Duncan and Assoc. Located at the southeast corner of Heil Avenue and Algonquin Street and legally described as being a proposed subdivision .of the W2, N2, NW4, SE4, Section 20-5-11. The Secretary informed the Commission that this agenda item and item #3 pertain to the same parcel and the public hearing should be opened to both Tentative Tract Map No 5904 and Use Variance No 822. The Subdivision Committee Report and the Staff Report pertaining to both the items were read by the Secretary. on both items. The hearing was opened to the audience George McCracken, representing Babette, Inc., addressed the Commission and stated that there were no objections to the conditions suggested by the Subdivision Committee Report and Staff Report. There being no other comment, the hearing was closed. Commission discussion followed. A MOTION WAS MADE BY BAZIL AND SECONDED BY WORTHY TO APPROVE TENTATIVE TRACT MAP NO 5904 WITH THE FOLLOWING CONDITIONS: 1. The Tentative Map received March 19, 1965, shall be the approved layout. 2. "Approval of this Tentative Map shall be null and void unless Use Variance No 822 is approved by the City Council. 3. Boundaries of the tract shall extend to center line on Algonquin Street and Heil Avenue. 4. A 6 foot concrete block wall shall be constructed to City Standards along the east line of Lot 47. 5. The hearing was opened to the audience. Martin Fenton, representing,Huntington Harbour Corp., addressed the Commission and offered to answer questions. There being no other comment, the hearing was closed. A MOTION WAS MADE BY CRABB AND SECONDED BY IA RKIN TO APPROVE TENTATIVE TRACT MAP NO 5481 UPON THE FOLLOWING CONDITIONS: 1. The Tentative Map received March 5, 1965, shall be the approved layout. 2. "P" Lane shall be 60 feet wide. 3. Streets within the tract shall be connected to an existing public street. 4. All waterways shall be deeded in fee to the City. 5. The tract shall be annexed to the Harbor Maintenance District now being formed. 6. Located at the southwest corner of Warner Avenue and Graham Street and legally described as being a proposed subdivisi-on of a portion of the NE4, NW4, . Section 28-5-11. The Secretary read the Sub - division Committee Report. The hearing was opened to the audience. Wayne Scott, engineer for the subdivider, addressed the Commission and objected to condition #3 requiring all property that is held under one ownership to be included in the tract. The Planning Director ex- plained that because land to the west is under the same owner- ship as the proposed subdivision approval should includethe entire parcel. Jim Hancock, representing Crane Development Co., addressed the Commission and stated that the problem was topography as well as locttion of existing structures. There being no further comment, the hearing was closed. Commission held a lengthy discussion. Chairman Kaufman suggested that the matter be continued for two weeks in order to conduct a survey of the property and to determine whether or not the structures encroach within the ultimate right-of-way. Knox To allow the construction of a 3 car garage on a lot with less than 70 feet frontage in the R-1 Single Family Residence District. Located at .the end of Easter Circle, easterly of Channel Lane and legally described as Lot 61, Tract 4499. The hearing was opened to the audience. There being no comment, `the hearing was closed. The Secretary informed the Commission that the subject variance is similar to several others. He pointed out that each previous case was approved, not because of a hardship, but because the Commission indicated that a code amendment providing for 3 car garages on a standard lot would be desirable. THE MOTION CARRIED. USE VARIANCE NO 820 A_ plicant : Balboa Shores Corn. To allow lots with less than 60 foot frontage in the R-3 Limited Multiple Family Residence District. Located on the north side of Slater Avenue west of Beach Boule- vard and legally described as the Nzy SE4, NE4, Section 26-5-11; except therefrom the west 447.28 feet; also except therefrom the east 330.00 feet; also except therefrom the north 320.71 feet. Also known as future lots 1, 2, 3 and 4, Tract 5891. The Staff Report was read by the Secretary. The hearing was opened to the -audience. Ed Mozer, Kemmerer Engineering Co., addressed the Commission and explained the reason for the request. He stated that the applicant uuuld have to eliminate one lot in order to comply with provision of the Ordinance Code. There being no other comment, the hearing was closed. Commission discussion was held. The Secretary informed the Commission that a condition of approval on Tentative Tract No 5891 requires all knuckle lots to have a minimum ,width of 60 feet at the front setback line. He pointed out that in this case the front setback is 10 feet and the lot widths at the setback line vary from 48 to 52 feet. -5- 4/6/65 Minutes: April 6, 1965 It was further noted that Lot 2.has an unusual division line within it and apparently the applicant intends to further divide that lot into two lots, each having a frontage of approximately 22 feet. It was the consensus to deny the request because the original condition of approval on Tentative Tract No 5891 should be maintained. Located 300 feet east of the centerline of Beach Boulevard and 468 feet south of the centerline of Adams Avenue and legally described as being a portion of the NW4, NW4, Section 12-6-11. The hearing was opened to the audience. Lois Piper, 20361 Somerville Lane, addressed the Commission and stated that she was concerned with location of the new wells. The Planning Director informed Mrs. Piper that the proposed wells will be among existing wells,, near the properties northwest corner. the hearing was closed. GONE CASE NO 514 Applicant: Standard Oil Company Change of Zone from RA Residential Agricultural District to R-A-O Residential Agricultural District combined with oil prodriction. Located at the southeast corner of Adams Avenue and Beach Boulevard and legally described as a - portion of the NW4, Section 12-6-11; excepting therefrom all of Tracts 3595, 4114, 4649; also excepting therefrom the West 268 feet of the North 225 feet thereof. Further legal description on file in the Planning Department Office. The Staff Report was read by the Secretary. The hearing was opened to the audience. -6- 4/6/65 185 Page #7, Minutes: April 6, 1965 Lois Piper, 20361 Somerville Lane, addressed the Commission and requested that soundproofing be required to eliminate excessive noise and vibration. There being no other comment, the hearing was closed. The Planning Director pointed out that this gem rat area is an established oil field and that some type of 0-Combining Oil District is appropriate. It• was the consensus of the Commission that an 01 Combining District 300 feet wide should be established around the perimeter of the property as a buffer between the 110" District and surrounding property. RESOLUTION NO 514 A Resolution of the City Planning Com- mission Recommending !Approval of Zone Case No 514 is Modified to the City Council. A MOTION WAS MADE BY MILLER AND SECONDED BY WORTHY TO ADOPT RESOLUTION NO 514 RECOMMENDING APPROVAL OF ZONE CASE NO 514 AS MODIFIED TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. Prior to the RA zoning, this property was zoned R-4-Y which permitted oil production. 2. In view of the recent development of subdivisions in the area, a buffer strip of R-A-01 along the entire• perimeter of the property would be desirable. Located on the north side of Hudson Drive approximately 180 feet west of Starfire Lane and legally described as Lot 30 of Tract 4992. The Secretary read a communication submitted by Buchanan -Hudson Development Co., opposing the subject variance. The Staff Report was read by the Secretary. The hearing was opened to the audience. Ronald Muzzy, applicant, addressed the Commission and gave his reasons for the request. There being no other comment, the hearing was closed. The Secretary pointed out to the Commission that the City has maintained a firm position on use variances for home occupations and none have been granted because a commercial use belongs in a commercial zone with buildings constructed to Fire Zone II requirements. The Secretary informed the Commission that the subject zone case is a routine.change of zone which conforms to the Master Plan of Land Use and it was a condition of approval on Tentative Tract No 5908 that the property be zoned R-1. RESOLUTION NO 513 A Resolution of the City Planning Com- mission Recommending Approval of Zone Case No 513 to the City Council. A MOTION WAS MADE BY CRABB AND SECONDED BY LARKIN TO ADOPT RESOLUTION NO 513 RECOMMENDING APPROVAL OF ZONE CASE NO 513 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. This is a routine change of zone to conform .to the Master Plan of Land Use. 2. There is a tentative tract map on this property which was approved with the condition that the property be rezoned to R-1. ROLL CALL VOTE: AYES: Crabb, Lawson, Bazil, Kaufman, Worthy, Miller, Larkin. Commission discussion was held. The Secretary informed the Commission that at their next meeting a tract map pertaining to the subject property will be presented for consideration. Located on the east side of Bolsa Chica Street approximately 300 feet north of Warner .Avenue and legally described as portions of Lots 3 and 4, Block 5, Tract 86. Further legal description on file in the Planning Department Office. The Staff Report was read by the Secretary. The hearing was opened to"the audience; there being no comment, the hearing was closed. The Secretary informed the Commission that the property included in this application is designated for airport use on the Master Plan. He stated that the airport designation was intended to include standard airport activities of a transportation nature, such as helicopter service, auto- mobile rentals and taxi cab centers. It was noted that the subject change of zone to C-2 and its permitted uses are not specifically provided for by the Master Plan; however, the request appears reasonable because it essentially complies with the Master Plan of Land Use. RESOLUTION NO 512 A Resolution of the City Planning Commission Recommending Approval of Zone Case No 512 to the City Council. ABSENT: None. THE RESOLUTION WAS ADOPTED. EXTENSION OF TIME TENTATIVL TRACT MAP NO 5601 The Secretary read a letter submitted by Robert J. Gulino, requesting a one year extension of time on Tentative Tract No 5601. The Staff Report was read by the Secretary. The hearing was opened to the audience; there being no comment, the hearing was closed. A MOTION WAS MADE BY. WORTHY AND SECONDED BY CRABB TO RECOMMEND APPROVAL OF EXTENSION OF TIME FOR TRACT NO 5601 TO THE CITY COUNCIL WITH THE FOLLOWING CONDITIONS: 1. The Revised Tentative Map dated April 28, 1964, shall be the approved layout. 2. Disposal of runoff water shall be approved by the Director of Public Works. 3. ABSENT: None. - THE MOTION CARRIED. RECESS CALLED COMMISSION RECONVENED Chairman Kaufman called a recess of the Commission at 9:00 P.M. Commis s ion was reconvened at 9:15 P.M. by the Chairman. COMMUNICATION: The Secretary read a com- munication submitted by the Fountain Valley Planning Commission regarding UV 43 which, if approved, would permit establishment of a mobile home park on property located at the northeast corner of Newland Street and Garfield Avenue in the RI-1 Single Family Residence District (1 acre minimum). The Commission reviewed UV 43 and it was their unanimous opinion not to oppose'a mobile, home park at this location if a distinct hardship does exist due to soil conditions. Further, the Commission felt that it should be clearly demonstrated that standard single family dwellings cannot be constructed on this property.. COMMUNICATION: The Secretary read a com- munication submitted by Horace E. Reynolds, 474 E._17th Street, Costa Mesa, endorsing the proposed ordinance for underground utilities. Planning Commission, April 65 1965 189 STATEMENT OF POLICY PUBLIC UTILITY FACILITIES The Secretary distributed copies of policy for underground utilities to the Commission. The Commission reviewed the suggested policy. A MOTION WAS MADE BY CRABB AND SECONDED BY LARKIN TO ADOPT THE FOLLOWING STATEMENT OF POLICY FOR UNDERGROUND UTILITIES ON ALL NEW SUBDIVISIONS: Public Utility Facilities. Utility lines, including but not limited to electric, communications, street lighting, and cable television shall be installed underground.. For the purpose of this Policy, appurtenances and associated equipment such as, but not limited to, surface mounted transformers, pedestal mounted terminal boxes and meter cabinets, and con- cealed ducts in an underground system may be placed above ground. STANDARD CONDITION OF APPROVAL FOR TENTATIVE TP.ACES The Secretary presented a standard condition requiring a block wall to be constructed along all lots siding or backing onto property zoned or intended to be zoned for professional, commercial or industrial use. The Commission reviewed said condition and it was their unanimous recommendation to approve the standard condition for tentative tracts. A MOTION WAS MADE BY BAZIL AND SECONDED BY WORTHY TO ADOPT THE STANDARD CONDITION FOR TENTATIVE TRACTS: A block wall shall be constructed to City Specifications along all lots siding or backing onto property zoned or intended to be zoned for professional, commercial or industrial use. Said wall shall be six (6) feet high, constructed of six (6) inch block and said wall shall be located on the property zoned or intended to be zoned for professional, commercial or industrial use. The height of said wall shall be such that the top will be six (6) feet above the highest ground surface within twenty (20) feet of the common property line on the professional, commercial or industrial side of the wall. Measurement shall be taken at any given point along said wall. This requirement shall pertain to all parcels; including numbered .lots, those labeled "Not a Part" and/or those parcels not within the sub- division but held under the same ownership as the property being subdivided. AMENDMENT TO ARTICLE 910 R-1 SINGLE FAMILY RESIDENCE DISTRICT The Secretary distributed copies of a proposed amendment to Article 910 regarding garages facing a street. He informed the Commission that this provision will -11- 4/6/65 rage #12, Minutes: H. B. Planning Commission, April 6, 1965 require any parking space in the front one-half of the lot to be fully enclosed and equipped with a door to provide for its complete enclosure. The Commission reviewed the proposed amendment and it was their unanimous recommendation to approve said amendment. PROPOSED AMENDMENTS TO ARTICLES 941, 943, 945 AND 947 - COMMERCIAL DISTRICTS The Secretary ,distributed copies of proposed amendments regarding maximum sign height and area within the front yard setback for all commercial, zones. He informed the Commission that this provision will provide for a uniform sign height of 50 feet and a maximum size of 200 square feet. The Commission reviewed the proposed amendments and it was their unanimous recom- mendation to approve said amendments. PROPOSED ORDINANCE - PARK AND -RECREATION ATION The Secretary distributed copies of a proposed ordinance providing for payment of taxes in connection with construction of dwelling units, the deposit of such taxes in the park and recreation facilities fund and the use of such fund for public park and recreation purposes. He stated that the proposed ordinance was referred to the Planning Commission, by the City Council at their meeting on April 5, 1965. The Commission reviewed the proposed ordinance and it was their consensus to continue. said matter to the May 4, 1965, meeting. PLANNING DIRECTOR The Planning Director in- formed the Commission that Friday, -April 2, 1965, representatives from the City Council, Planning Commission, Home Council, Board of Realtors, Chamber of Commerce and Huntington Beach Company met and discussed various topics for an Urban Land Institute,panel study.
