Wednesday, April 7, 1965 BOARD MEMBERS PRESENT: John Mandrell; Herbert Day, Richard Harlow. BOARD MEMBERS ABSENT: None. MINUTES: The minutes of March 31, 19653 were accepted as transcribed. USE PERMIT NO 65-4 AREA VARIANCE NO 65-10 Applicant: Paul JCalvo To permit the construction and operation of a restaurant in the C-4 Highway Commercial District. Also to allow an 8 foot -setback from property line in deviation to the required 50 foot setback on Main Street and a 10 foot setback from property line in deviation to the required 80 foot setback on Ellis Avenue. Located at the north- west corner of Ellis Avenue and Main Street and legally des- cribed as that portion of the South 125.00 feet of the East 348.48 feet of the SE'k, NE'k, Section 35-5-11. Further legal description on file.;in- the Planning Department Office. The hearing was opened to the audience. Paul Calvo, applicant, addressed the Board and explained the plans for the property. He stated that if all the setbacks were observed only about 25 feet of usable property would remain. Sydney Sher, developer of the neighboring Five -Points shopping center, stated that he was in opposition to the request as presented because this parti- cular use uDuld generate considerable amounts of traffic which would create a serious traffic hazard especially on Main Street. He also objected on the grounds that the requested use of the property would block the view of the shopping center and the neighboring theater from the southbound traffic on Beach Blvd. At this time the suggested conditions of approval for UP 65-4 were read. Mr. Calvo stated that there were no objections and the developers were willing to comply with them. There being no further comment, the hearing was closed. Board discussion followed. It was noted that the Department of Public Works would require a full 80 foot right-of-way on Ellis Avenue. It was the consensus of the Board that the 50 foot setback on Beach Boulevard should be enforced and consideration should be given to the reduction of the setback on Ellis Avenue. -1- 4/7/65 Page #2, Minutes: April 7, 1965 A MOTION WAS MADE BY DAY AND SECONDED BY MANDRELL TO CONTINUE THE HEARING TO APRIL 14, 1965, WITH THE CONSENT OF THE APPLICANT, IN ORDER FOR REVISED PLOT PLANS TO BE SUBMITTED NO LATER THAN 12:00 A.M., TUESDAY, APRIL 13, 1965. ROLL CALL VOTE: AYES: Mandrell, Day, Harlow. NOES: None. ABSENT: None. THE MOTION CARRIED. AREA VARIANCE NO 6 5 -9 Applicant: Jay E. Collins To allow the construction of a room addition 16 feet wide on a 60 foot lot to encroach to within 6 feet of the rear property line in the R-1 Single Family Residence District. Located on the south side of Molokai Drive approximately 70 feet west of Luau Lane and legally described as Lot 89, Tract 3903, otherwise known as 9372 Molokai Drive. The hearing was opened to the audience. Mr. Hubbard, agent for the owner of the lot in question, explained that the owner was an invalid and confined to a wheel chair. The new addition was requested to enable her to get around and enjoy the patio.. There being no further comment, the hearing was closed. Board discussion followed. A MOTION BY HARLOW WAS SECONDED BY DAY TO APPROVE AV 65-9-WITH•THE CONDITION THAT A 10 FOOT REAR YARD BE MAINTAINED. ROLL CALL VOTE: AYES: Mandrell, Day, Harlow. NOES: None. ABSENT: None. THE MOTION CARRIED. AREA VARIANCE NO 65-11 Applicant: Bruce R. Boomer To allow a 10 foot front yard in deviation to the required 15 foot in an R-1 Single Family Residence District. Located on the south side of Pheasant Circle and on the east side of Bolsa Chica Street and legally described as Lot 26, Tract 3469. The hearing was opened to the audience. Mr. Boomer; applicant, addressed - the Board and stated that this lot was at the end of a cul-de-sac street and one side of the lot was only 80 feet deep:,which would not allow enough room for the pool he desired to build unless he could move the entire building forward on the lot. Mr. Harry Abercrombie, architect, further explained the requested variance. There being no further comment, the hearing was closed. A MOTION BY MANDRELL WAS SECONDED BY DAY TO APPROVE AV 65-11 FOR THE FOLLOWING REASONS: -2- 4/7/65 Page #3, Minutes: April 7, 1965 1. The lot is located at the end of a cul-de-sac and siding on Bolsa Chica Street a major arterial highway. 2. The part of the building which will set back 10 feet from the street is siding on Bolsa Chica Street. 3. There will be sufficient turning radius and two off-street parking spaces will be provided. 4. A 22 foot setback is provided adjacent to the existing house to the east which is in excess of the minimum front yard setback. ROLL CALL VOTE: AYES: Mandrell, Day, Harlow. NOES: None. ABSENT: None. THE MOTION CARRIED. AREA VARIANCE NO 65-12 Applicant: George Armstrong To allow an attached 3 car garage to set back 10 feet from the front property line in deviation to the 22 feet required in the R-1 Single Family Resi- dence District. Located on the west side of Gilbert Drive be- tween Somerset and Peale Lanes in Huntington Harbour and legally described as Lot 81, Tract 4677. The hearing was opened to the audience. Mr. Armstrong, applicant, addressed the Board and explained that the topography of the property was such that an unsightly condition would result:if he were required to maintain a 20 foot setback for the proposed subterranean three car garage. He further stated that he felt that a 15 foot setback for the garages vould greatly improve the architectural appearance of the house and the entire neighborhood. There being no further comment, the hearing was closed. A MOTION WAS MADE BY HARLOW AND SECONDED BY MANDRELL TO APPROVE THE REQUEST FOR THE THREE CAR GARAGE BUT TO DENY THE REQUEST FOR THE 15 FOOT SETBACK FOR GARAGES ENTERED FROM THE STREET FOR THE FOLLOWING REASONS: 1. Similar variances for 3 car garages have been approved and the Planning Commission has recommended to the City Council that the Huntington Beach Ordinance Code be amended to allow them. 2. The ordinance requires a 22 foot setback for garages entered from the street; however, Huntington Harbour has been granted variances to reduce the setback to 20 feet. In view of this, further reduction would not be feasible. ROLL CALL VOTE: AYES:. Mandre ll, Day, Harlow. NOES: None. ABSENT: None. THE MOTION CARRIED.
