BOARD MEMBERS ABSENT: None. MINUTES: The Minutes of April 7, 1965, were accepted as transcribed. AREA VARIANCE NO 65-13 Applicant: Ron Montgomery Assoc. To allow a 12 foot front yard setback in deviation to the required 15 foot and a 15 foot rear yard setback in deviation to the required 20 foot. Located in the R-1 Single Family Residence District at the intersection of Peale Lane and Gilbert Drive and legally described as Lot'77, Tract 4677. The hearing was opened. Delmer E. Potts, owner of said property, addressed the Board and gave his reasons for the request. Ron Montgomery, applicant, addressed the Board and stated that Mr. Potts, the property owner, would like to take full advantage of the view. He also stated that the building would be in line with the setbacks of surrounding building. There being no other comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY DAY AND SECONDED BY HARLOW TO APPROVE AV 65-13 FOR THE FOLLOWING REASONS: 1. The subject lot is irregular shaped. 2. There is sufficient rear yard remaining. 3. The front of the house is set back 20 feet. ROLL CALL VOTE: AYES: Mandrell, Harlow, Day. NOES: None. ABSENT: None. THE MOTION CARRIED, AREA VARIANCE NO 65-14 Applicant: Joe Muniz To allow a 10 foot rear yard setback in deviation to the _required 15 foot and a 4 foot side yard setback in deviation to the required 5 feet. Located in the R-1 Single Family Residence District at the northwest corner of Newland Street and Bridgeport Drive and legally described as Lot 47, Tract 3908. The hearing was opened. The applicant addressed the Board and gave his reasons for the request. He stated that the request for the 4 foot side yard is to keep the proposed addition in line with the existing garage. i Page #2, Minutes: April 14, 1965 There being no other comment, the hearing was closed. It was noted that encroach- ment into the rear yard was in keeping with past Board and Com- mission policy and that there is sufficient remaining rear yard. A MOTION WAS MADE BY HARLOW AND SECONDED BY DAY TO APPROVE AREA VARIANCE NO 65-14 WITH THE CONDITION THAT A 5 FOOT SIDE YARD BE MAINTAINED. ROLL CALL VOTE: AYES: Mandrell, Harlow, Day. NOES: None. ABSENT: None. THE MOTION CARRIED. DIVISION OF LAND NO 65-4 Applicant: Fernhill Homes To allow a division of land of Lots 97, 982 992 100, 1112 112 and 121 of Tract No 5430. Located at the northwest corner of Warner Avenue and Graham Street. The suggested condition of approval was presented. A MOTION WAS MADE BY MANDRELL AND SECONDED BY HARLOW TO APPROVE DIVISION OF LAND NO 65-4 WITH THE FOLLOWING CONDITION: 1. A record of survey shall be recorded. ROLL CALL VOTE: AYES: Mandrell, Harlow, Day. NOES: None. ABSENT: None. THE MOTION CARRIED. DIVISION OF LAND NO 65-5 Applicant: Dorothy Lamb To allow a division of land into three separate parcels. Located at the southeast corner of Garfield Avenue and Cannery Street and legally described as: Parcel 1: The NW'k, NW'k, Section 6-6-10; except therefrom the NIly 819 feet of the Wily 694 feet thereof. Parcel 2: The North 540 feet of the West 694 feet of the W2j NWk, Section 6-6-10. Parcel 3: The North 819 feet of the West 694 feet of the WZ, NWT, Section 6-6-10; except therefrom the North 540 feet thereof. approval were presented. The suggested conditions of Ralph Allen, representing the applicant, addressed the Board and stated that there were no objections to the conditions suggested by the Board. Board discussion was held. It was the consensus to con- tinue the hearing to April 21, 1965, pending the decision of the Planning Commission regarding an adjustment in the zone boundary of the property involved. THE MOTION CARRIED. =2- Page #3, Minutes: April 14, 1965 USE PERMIT NO 65-4 AREA VARIANCE NO 65-10 - Continued Applicant: Paul Calvo To permit the construction and operation of a restaurant in the C-4 Highway Commercial District. Also to allow an 8 foot setback from property line in deviation to the required 50 foot setback on Main Street and a 10 foot setback from property line in deviation to the required 80 foot setback on Ellis Avenue. Located at the northwest corner of Ellis Avenue and Main Street and legally described as that portion of the South 125.00 feet of the East 348.48 feet of the SE4, NE4, Section 35-5-11. Further legal description on file in the Planning Department Office. The Secretary informed the Board that the applicant did not have enough time to submit revised plot plans as requested by the Board. He suggested that the hearing be postponed to April 21, 1965. A MOTION WAS MADE BY HARLOW AND SECONDED BY DAY TO CONTINUE THE HEARING ON UP 65-4 AND AV 65-10 TO APRIL 21, 1965, TO ENABLE THE APPLICANT TO SUBMIT A REVISED PLOT PLAN NO LATER THAN 12:00 A.M., TUESDAY, APRIL 20, 1965.
