Bill Rardin, Assistant Fire Chief,
addressed the Commission and stated the results of a study per-
formed by the Fire Department on underground utilities.
Ron Wells, engineer for the
subdivider, addressed the Commission and stated that there were
no objections to the conditions su gested by the Subdivision
Committee Report except Condition 8 which requires all utilities
to be installed underground.
John Mandrell, Division Engineer,
Public Works Department, addressed the Commission and suggested
that the sidewalk be constructed from curb to property line alon
that portion of the street to be located across the Edison Co. R�W.

SECONDED BY rAWSON TO APPROVE TENTATIVE TRACT MAP NO 4805 UPON
THE FOLLOWING CONDITIONS AS AMENDED:
1. The Tentative "Map received April 16, 1965,-shall be the
approved layout.
2. Cannery Street shall be dedicated and improved to City
Standards along the Southern California Edison Company R/W.
3. The "Proposed Roadway" connecting Tentative Tract No 5917
to the subject tract shall be dedicated and improved to
City Standards. Except a sidewalk shall be.constructed
from curb to property line in lieu of standard 4 foot
sidewalk.
4. A 6 ft. chain link fence or equivalent shall be constructed
along the Southern California Edison Company R/W on
Cannery Street and along the "Proposed Roadway".
5. The proposed pedestrian walkways shall be improved to
Department of Public Works Standards.
6. The flood control channel shall be fenced to Flood Control

addressed the Commission and objected to Condition #7 requiring
all utilities to be installed underground. He stated that
there were no objections to the other conditions suggested by

UPON THE FOLLOWING CONDITIONS:

APPROVAL OF ZONE CASE NO 511 TO THE CITY COUNCIL FOR --THE
FOLLOWING REASONS:
1. There is an approved tentative tract map for medium density
,use on the subject property.
2. This is a routine boundary adjustment to conform to the
boundaries of the approved tract map.

The Subdivision Committee Report was
read by the Secretary.
The hearing was opened to the audience.
Glen Busby, representing the developer,
addressed the Commission axed objected to Condition #2 requiring
installation of underground utilities. He stated that the
proposed development is surrounded on three sides by overhead
lines and the proposed subdivision would not benefit by in-
stallation of underground utilities.
There being no other comment, the
hearing was . closed.
Commission held a lengthy discussion.
It was noted that the subject property is surrounded on three
sides by overhead power lines and lots that would benefit would
be in the minority.
A MOTION WAS MADE BY LAWSON'AND
SECONDED BY MILLER TO APPROVE TENTATIVE TRACT MAP NO 5929
WITH THE FOLLOWING CONDITIONS:
1. The Tentative Tract Map received March 17, 1965, shall be
the_approved layout.
2. A petition for rezoning-to'NR.-1 shall be . filed approximately
at the time the final map is recorded. Said,petition.shall
reflect adjustments for the C-4 Zone at the southwest
corner of Edinger Avenue and Edwards Street.
3. All Standard Subdivision requirements that are applicable
shall be complied with.

The Secretary informed the Commission
that Tentative Tract 5523 and Use Variance 82.4 pertain to the
same parcel of land and the public hearing should be opened
on both items.

The Subdivision Committee
Report and the Staff Report were read by the Secretary. .Also
a communication submitted by The Meredith Company opposing
the proposed development was read by the Secretary.
The Planning Director informed
the Commission that an incorrect legal description of ,the
property, as submitted by the applicant, was published in the
newspaper and suggested that the matter be readvertised.
The hearing was opened to the
audience.
John Mandrell, Division
Engineer, addressed the Commission and suggested that further
study be made regarding the driveway approaches.
Richard Meredith, 305 E. Main
Street, Tustin, California, addressed the Commission and
objected to the proposed development.
Ralph Jensen, Vice -President
of Hercules Construction Co., addressed the Commission and
explained the proposed development; He stated that the intent
of the variance was to allow some f lexibility in the design
of the tract and asked that the request be granted.
Willis Warner,'Toups Engineering
Company, addressed the Commission and stated that the only
procedure provided to allow deviation from the subdivision
ordinance is to apply for a conditional exception.
John Goetten, engineer for
the developer, addressed the Commission and explained the
driveway approaches.
There being no further comment,

the Commission and spoke in favor of the request. He stated
that the subject property is surrounded by commercial uses.
Dr. Gruber, 701 Main Street, addressed
the Commission and stated that the request should be considered
by variance and not by zone change.
Frederick Mitschle r,.applicant,
addressed the Commission and requested that the zone change be
granted.

out to the Commission that because of the existing zoning, land
use and the method in which property has been subdivided along
both Main Street and Palm Avenue, the penetration of commercial

1. Property to the east, west and north is presently zoned R-3.
2. The commercial uses in the area were allowed by use variances
approximately 15 years ago.

Conditional'Permit C-78 which, if,approved, would permit retail
and wholesale marketing of wigs as a home occupation on property
at 16441 Laura Way, in the R-1 Single Family Residence District.

and it was their unanimous recommendation that the permit be
denied because commercial uses belong in a commercial building.
