COMMISSIONE12.S ABSENT: Lawson, Crabb, Kaufman. MINUSES: On motion by Worthy and seconded by Larkin, the Minutes of the Huntington Beach Planning Commission of April 6, 1965, were accepted as transcribed and mailed by the Secretary. MASTER PLAN STUDY: SPRINGDALE - BOLSA VICINITY The Secretary informed the Commission that the hearingg on this agenda item will come up for public hearing on May 4, 1965. He stated that the Staff has compiled a great deal of data to help the Commission in their decision. Floyd Belsito, Planning Tech- nician, addressed the Commission and explained the- present zoning, land use and master plan of land use for the area. He also presented a breakdown of the zoning acreage, present land use acreage and future'land use for property within the study area. Mr. Belsito pointed out that the total acreage presently zoned for commercial use in the Huntington Beach - Westminster area was 94 acres and that only 27 acres was being used for commercial purposes. Further, the adopted master plan of land use in both cities reflect an ultimate total of 119 acres for commercial use. Calculations in the study area revealed a population in the vicinity of 17,400. Past studies indicate that a minimum of 13 acres and a maximum of 42 acres of commercial acreage could realistically be sup- ported by the people in the area. Mr. Belsito also mentioned what effect additional children would have upon the school system if the property were rezoned back to an "R11 zone. In the event it were rezoned back to R-3, it would necessitate the addition of 3 classrooms in the Clegg School site to accommodate these additional children and 2 classrooms in the Shroeder School site. PARK AND RECREATION FACILITIES VVK DISCUSSION Assistant City .Attorney, George Shibata, addressed the Commission and reported on the proposed ordinance. He stated that Assembly Bill 1150 is now being considered by the State Legislature and suggested postponement of any decision. PRIVATE STREETS - DISCUSSION Assistant•City Attorney, George Shibata, suggested to the Commission that a policy statement should be adopted, whereby the property owner within a con- dominium or planned development could not dedicate private streets to the City,. James Wheeler, Director of Public Works, addressed the Commission and stated that people within condominium developments pay less tax per unit than other property owners. He informed the Commission that condominium or planned developments are provided with all- city services except for street sweeping and street maintenance. George Shibata, Assistant City Attorney, suggested that the Planning Department notify the Real Estate Commission when private streets are part of a development. UNDERGROUND UTILITIES - DISCUSSICN The , Planning ,Director informed the Commission that both the Fire and Building Departments con- ducted a study on safety problems connected with underground utilities and were asked to share this information with the Planning Commission. Sam Ferguson, Assistant Building Director, addressed the•Commission and stated his department was concerned with underground utility easements, fences and setbacks on side property lines. He pointed out that the building department does not control the planting of trees or location of clothes line poles. He stated that the main problem is in locating electrical lines out of the main rear yard area in order to avoid construction hazards for swimming pools. He stated that the other matters can be cont.roled by redesigning fencing requirements. Ralph Kiser, representing the Edison Company, addressed the Commission -and stated that underground utilities, if constructed, would follow the side property line. He informed the Commission that approximately 16 to 25% of the area within Huntington Beach would present difficult construction problems. Mr.' Kiser read the following adopted Newport Beach Ordinance to the Commission: "Underground . telephone and utility,systems may be required by the Planning Commission and the design, layout and location shall be approved by the City Engineer". The Commission concurred and decided that all plans for underground utilities should be approved by the Department of Public Works and, at that time, they would be checked for compliance to location of the service with respect to property lines. The Commission changed their statement of policy to reflect this thinking and also..changed the language from "shall" to "may" which is intended to provide. more flexibility. The new statement of policy reads as follows: -2'-' 4/27/65 �o Pane #3, Minutes: April 27, 1965 Public Utility Facilities: Utility lines, including but not limited to electric, communications, street lighting and cable television may be installed underground. For the purpose of this Policy, appurtenances and associated equipment such as, but not limited to, surface mounted transformers, pedestal mounted terminalc-.boxes and meter cabinets, and concealed ducts in an underground system may be placed above ground. All plans for installation of underground utilities shall be approved by the Department of Public Works'. A" MOTION WAS MADE BY WORTHY AND SECONDED -BY MILLER" TO ADOPT A NEW POLICY STATEMENT FOR; UNDERGROUND UTILITIES AND INSTRUCT THE SECRETARY TO TRANSMIT SAID POLICY TO THE CITY COUNCIL. BOLL CALL VOTE: AYES: Bazi1, Worthy, Miller, Larkin. NOES: None. ABSENT: Lawson, Crabb, Kaufman. THE MOTION CARRIED. HOME OCCUPATIONS - DISCUSSION The Planning Director informed the Commission that this topic was referred to the Commission by the City Council for study and recommendation. Suggestions for Home Occupations were distributed to the Commission. The Vice -Chairman opened the discussion on home occupations to the audience. Wes Warvi, representing the Huntington East Home Owners Association, addressed the Com- mission and suggested that no home occupations be" allowed in the Ye sidential development. Bob Dingwall', representing the Sea -Haven Homeowners:Associatio n, addressed the Commission and objected to any home occupations being permitted in the R-1 zone. He further commented on Condition #2 requiring that no garage shall be used in connection with such business except for parking of business vehicles. Charlotte Prusso, 10042 Constitution: Drive, addressed the Commission and asked if' the Commission.would consider her request for teaching organ and piano again which was denied by the Commission. She stated that private teaching of piano or organ is not a business but a profession. 1. Bill Sheets, 6171 Mar Vista Drive, addressed the Commission and suggested that each re- quest should be ' considered on an individual variance basis'. .Bill Rardin, Assistant Fire Chief, informed the Commission that any home occupation con- ducted within a residential dwelling will require inspection and will have to conform to Fire Zone II requirements. " After considerable discussion the Commission decided that home occupation`s should not be a permitted use in Huntington Beach and each .request should be handled on an individual use variance' basis.
