None. The minutes of April 21, 1965, were accepted as transcribed. USE PERMIT NO 65-5 Applicant: Peter A. Giovannoni To allow the construction of a restaurant in the C-4 Highway Commercial District. Located 660 feet south of Talbert Avenue on the west side of Beach Boulevard and legally described as a portion of the N2, N 2, SE4, NE4, NE4, Section 35-5-11. Further legal description on file in the Planning Department Office. The hearing was opened to the public. Peter A. Giovannoni, applicant, addressed the Board and explained his plans. There being no other comment, the hearing was closed. Board discussion followed. It was pointed out that the 'approval of the subject use permit would in no way constitute a granting of a division of land. A MOTION WAS MADE BY DAY AND SECONDED BY HARLOW TO APPROVE UP 65-5 SUBJECT TO THE FOLLOWING CONDITIONS: 1. The Fire Department shall approve all fire prevention facilities. 2. All off-street parking facilities shall meet Planning Com- mission Standards. 3. Five percent of the parking lot shall be landscaped. 4. Beach Boulevard shall be im proved*to State Standards. 5. Drainage fees shall be paid. ROLL CALL VOTE: AYES: Mandrell, Day, Harlow. NOES: None. ABSENT: None. THE MOTION CARRIED. AREA VARIANCE NO 65-15 Applicant: Harry S. Okuda, DDS To allow the construction of a medical - dental building to be built to the side and rear property lines in tle R-5 Professional, Motel and Trailer Park District. Located on the north side of Warner Avenue approximately 200 feet east of Goldenwest Street and legally described as Lots 31 and 32, Block C, Tract 392. The hearing was opened to the public; there being no comment, it was closed. Board discussion followed. It was noted that a hardship did exist due to the high percentage of the property being taken for street purposes. -1- 4/28/65 Page #2, Minutes: April 28, 1965 A MOTION WAS MADE BY HARLOW AND SECONDED BY DAY TO APPROVE AV 65-15 SUBJECT TO THE FOLLOWING CONDITIONS: 1. Warner Avenue shall be dedicated and improved to City Standards. Improvements shall include street trees and street lights. 2. There shall be an additional 17.4 feet dedicated on Winters Avenue to provide for ultimate right-of-way. 3. A 6 foot concrete block wall shall be constructed along the rear property line on Winters Avenue. 4. Drainage fees shall be paid. 5. A 5 foot setback shall be provided along Winters Avenue. 6. Parking stall dimensions shall be reduced to 19 feet rather than the 20 feet as shown on the plot plan. 7. A minimum 25 foot turning radius shall be maintained. ROLL CALL VOTE: AYES: Mandre 113 Day, Harlow. NOES: None. ABSENT: None. THE MOTIO N CARRIED. AREA VARIANCE NO 65-16 Applicant: Leo L. Majeski To allow the construction of a room addition 20 feet wide on a 70 foot lot to encroach to within 14 feet of the rear property line in the R-1 Single Family Residence District. Located at the northeast corner of Mill Circle and Ford Drive and legally described as Lot 19, Tract 4329. The hearing was opened to the public; there being no comment, the hearing was closed. A MOTION WAS MADE BY DAY AND SECONDED BY HARLOW TO APPROVE AV 65-16 FOR THE FOLLOWING REASONS: 1. There will be sufficient rear yard remaining. 2. This request is within the intent of the Ordinance. ROLL CALL VOTE: AYES: Mandrell, Day, Harlow. NOES: None. ABSENT: None. THE MOTION CARRIED. AREA VARIANCE NO 65-17 Applicant: Fred Ulrich To allow a substandard turning radius for driveway approach in the R-1 Single Family Residence District. Located on the west side of Bolero Lane approximately 900 feet southwesterly of its intersection with Nalu Circle and Baruna Lane and legally described as Lot 52, Tract 5050. The hearing was opened to the public. Fred Ulrich, applicant-; addressed the Board and stated his reasons for requesting the exception. He further mentioned that he preferred a side opening garage door for appearance reasons. - There being no other comment, the hearing was closed. -2- 4/28/65 Page #3, Minutes: April 28, 1965 Board discussion followed. A MOTION WAS MADE BY HARLOW AND SECONDED BY MANDRELL TO DENY AV 65-17 FOR THE FOLLOWING REASONS: 1. The Huntington Beach Ordinance Code specifically requires a minimum of 25 feet turning radius. 2. Any deviation from this could set a precedent .and -thereby encourage similar requests. ROLL CALL VOTE: AYES: Mandrell, Day, Harlow. NOES: None. ABSENT: None. THE MOTION CARRIED. USE PERMIT NO 65-4 ) Continued AREA VARIANCE NO 65-10) Applicant: Paul Calvo To permit the construction and operation of a restaurant in the C-4 Highway Commercial District. Also to allow an 8 foot setback from property line in deviation to the required 50 foot setback on Main Street and a 10 foot setback from property line in deviation to the required 80 foot setback on Ellis Avenue. Located at the northwest corner of Ellis Avenue and Main Street and legally described as that portion of the South 125.00 feet of the East 348.48 feet of the SE4, NE4, Section 35-5-11. Further legal description on file in the Planning Department Office. The hearing was opened to the public. Paul Ca,lvo, applicant;:•explained the revised plot plans for the subject'parcel.• He stated that the plan was in conformance with the request of the Board and asked favorable consideration on this basis. John McCleskey, agent for Denny's Restaurants, addressed the Board and further explained the plot plan. Blanche Homen, agent for the property owner, stated that the revised plot plans met with their approval,: ; , - Bob Colwell, architect; spoke in favor of the subject request. There being no further comment, the hearing was closed. Board discussion followed. It was noted that if the setback along Ellis -Avenue was complied with, development of the property would be impractical. A MOTION WAS MADE BY MANDRELL AND SECONDED BY DAY TO APPROVE UP 65-4 AND AV 65-10 SUBJECT TO THE FOLLOWING _CONDITIONS : _ 1. Ellis Avenue shall be dedicated to City Standards. 2. Ellis Avenue and Main Street shall be improved to City Standards or an agreement shall be entered into with the City.for the improvement of such streets and it shall be accompanied by a bond to guarantee such improvements. 3. Vehicular access rights,. -along Ellis Avenue and Main Street shall be approved by Department of Public Works. -3- 4/28/65 Page #4, Minutes: April 28, 1965 4. All streets shall conform to City of Huntington Beach Standards. Master Plan of Arterial Street and Highways Standards shall apply where applicable. Street Sections shall be determined by soil 11R1' value and traffic index. 5. Water supply shall be through the City of Huntington Beach's water system. 6. A domestic water system shall be installed or fees paid. 7. Sewage disposal shall be through the City of Huntington Beach's sewage system. 8. A sanitary sewer system shall be installed or fees paid. 9. Easements for utilities or walkways may be required. 10. Drainage of the property shall be approved by the Department of Public Works. 11. The property shall participate in the local drainage assessment district. 12. Retaining walls shall be provided where there is a difference in elevation of one (1) foot between adjoining lots or lots abutting City. •right -of =way. 13. Preliminary and final soil reports shall be submitted -by an approved private soils engineer to the City prior to issuance of building permits. 14. The water, sewer and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 15. Off-street parking facilities including landscaping, number, arrangement, access, paving and striping of all parking spaces shall meet all adopted ordinances. Layout of all.spaces shall be as shown on the plot plan. 16. If a satisfactory agreement is entered into with the City for the use of Ellis Avenue, the area south of parking stall #14 shall be landscaped. 17. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 18. Parking spaces 1 through 9 fronting on Ellis Avenue and 21 and 22 adjoining said spaces shall be deleted when Ellis Avenue is improved to facilitate traffic circulation on the subject parcel. 19. Failure to abide by and faithfully comply with any and all conditions attached to the granting of UP 65-4 shall constitute grounds for the revocation of said use permit by the City Council.
