Wednesday, May 12, 1965 BOARD MEMBERS PRESENT: John Mandrell, Herbert Day, Richard Harlow. BOARD MEMBERS ABSENT: None. MINUTES: The Minutes of May 5, 1965, were ac- cepted as transcribed. AREA VARIANCE NO. 65-27 Applicant: Community Methodist Church To allow the construction of an 8 foot high block wall in deviation to the 6 foot permitted in the R-1 Single Family Residence District. Located on the west property line of the following described parcel: That`'pottion`of "the-E2-, -NW4, SE4; Sdction 22-5-11-beginning at-a­point'-660 feet- east' of the'lintersection of --Edwards' and Heil; thence south---300'-feet;--thence east--400 feet; thence north 300 feet; thence west to the point of"beginning. The hearing was opened to the audience. Oscar Stricklin, Representative of the applicant, addressed the Board and explained the re- quest. He stated that the purpose of the fence was to provide privacy to the7Church and the abutting property owner. Further, that the fence would act as a screen from the sun during the afternoon hours. Mr. Stricklin also stated that the abutting property owners had been contacted and did not object to the fence. There being no*other comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY DAY AND SECONDED BY MANDRELL TO APPROVE AV 65-27 AS PER PLOT PLAN FOR THE FOLLOWING REASONS: ' 1. The requested fence would provide privacy and protection to the Church and the abutting property owner. 2. The fence will provide a separation between the -Church .and the adjoining residence. 3. A portion -of t'he -f' cd will abutt a dead-end street: ROLL CALL VOTE: AYES: Mandrell, Day, Harlow. NOES: None. ABSENT: None. THE MOTION CARRIED. ' AREA VARIANCE NO. 65-28 Applicant: James 0. Hillman To allow a 6 foot'rear yard in deviation to the required 15 feet in the R-1 Single Family Residence District. 'Located on the north side of Heil Avenue 205 feet east of Clubhouse Lane and legally described as Lot 11, Tract 3647. Board of Zoning Adjustments Wednesday, May 5, 1965 A MOTION WAS MADE BY HARLOW AND SECONDED BY DAY TO APPROVE AV 65-28 FOR THE FOLLOWING REASONS: 1. There will be sufficient rear yard remaining. 2. This is an addition between an -existing main structure and an accessory building. ROLL CALL VOTE: AYES: Mandrell, Day, Harlow NOES: None. ABSENT: None. THE MOTION CARRIED. AREA VARIANCE NO. 65-29 Applicant: Walter L. Winters To allow a main building and an appurtenant structure to encroach 10 feet into the required 20 foot exterior side yard setback. Located at the southwest corner of 14th Street and Palm Avenue and legally described as Lots 25 and 27, Block 614, Huntington Beach Tract, 17th Street Section. to the audience. The hearing was opened Mr. Winters, applicant, addressed the Board and stated that he purchased the lot and had his house plans prepared before learning that he would be required to set back an additional 10 feet for the widening of Palm Avenue. He also stated that he felt a precendent had already been set by the Commission when they approved a similar request on Palm Avenue approximately one year ago. Rev. Russell Shaw, 627 llth Street, addressed the Board and stated that he had personally checked most of the existing structures on Palm Avenue and found them to setback an average of 11 feet, 6 inches from existing property lines. Mr. Woodrow Smith, nearby property owner, stated that he had no objections to the request. He further stated that as a property owner he was interested in the future status of Palm Avenue. Norman Wells, 404 llth Street, asked the Board about the future widening of Palm' Avenue and questioned the need for an arterial highway in this area. He further stated that he was in favor of this request. Mrs. Larue Nitzkowski, 1220 Palm Avenue, Mated that "she _Was attending the meeting in behalf of Mr. Winters, the applicant, and felt that the home would be an asset,to the community. She -also asked. questions pertaining to the widening of.Palm Avenue. Mrs. Winters, addressed the Board and asked that they grant the variance due to the fact that a previous variance of this same nature has already been granted by the Planning Commission. Mr. Mandrell pointed out that the proposed widening pro- bably would not take place for some 10 years. A MOTION WAS MADY BY MANDRELL AND SECONDED BY DAY TO APPROVE AV 65-29 SUBJECT TO THE FOLLOWING•'CONDITION: 1. All'architectural features will set back behind the u'ltilmnate right -of -way line. ROLL CALL VOTE: AYES: Mandrell, Day, .Harlow. NOES: None. ABSENT: None. THE MOTION CARRIED. AREA VARIANCE NO: 65=30 Applicant: Peter D. Ciddio To allow a 6 foot brick wall to encroach to within 11 feet -of the front property line in deviation to the required 15 feet. Located on the north side of Heil Avenue west of'Del Mar Lane and legally described as Lot 7, Tract 3752. The hearing was opened to the audience; there being no comment, the hearing was closed. A MOTION WAS MADE BY MANDRELL AND SECONDED BY HARLOW TO -DENY AV 65-30 FOR THE FOLLOWING REASONS: 1. The applicant failed to provide sufficient justification for this request. ROLL CALL VOTE: AYES: Mandrell,'Day, Harlow. NOES , None".- ABSENT: None. THE'MOTION CARRIED. USE PERMIT NO. 65-7 Applicant: Betker Construction Corp. To permit the construction of a 22-unit•apartment building in the C-3 General Business District. Located on the east side of 2nd Street approximately 100 feet north of Walnut Avenue and legally described as Lots-22, 24,'26,'28 and 30, Block 201, Huntington Beach Tract. Richard Harlow stated that the building height exceeds the maximum residential building height for the C-3 zone, therefore,- the applicant will file a Use Variance with the Planning Commission. A MOTION WAS MADY BY HARLOW AND SECONDED BY DAY TO CONTINUE UP 65-7 TO MAY 19, 1965; IN ORDER FOR THE APPLICANT TO REQUEST WITHDRAWAL OF THIS APPLICATION. ROLL CALL VOTE: AYES: Mandrell, Day, Harlow. To allow the division of land into two separate parcels." Located at the southwest corner of Warner Avenue and Graham Street and legally described as: Parcel 1: The N2, NE-4,, NW4, Section 28-5-11; except therefrom the Westerly 250.00 feet. Parcel-2: The westerly 250.00 feet of the N2, NE4, NW4, Section 28 -5-11; except therefrom the north 210.00 feet of the west 100.00 feet. The Conditions of Approval were read. Mr. Duane Stout, representative of the applicant, addressed the Board and questioned Condition #6, regarding the removal of the greenhouse. Gene Hancock of Crane Development Corp. explained the plans for this property. A MOTION WAS MADE BY HARLOW AND SECONDED BY MANDRELL TO APPROVE DL 65-10 SUBJECT TO THE FOLLOWING CONDITIONS: 1. Warner Avenue and Graham Street shall be dedicated to City Standards. 2. Street improvements'shall be installed on Warner Avenue and Graham Street at -the time of development. Street im- provements shall be constructed to City Standards and shall include street lights and street trees. 3. All streets shall conform to City of Huntington Beach Standards. Master Plan of Arterial Street and Highways Standards shall apply where applicable. Street sections shall be determined by soil "R1' value and traffic index. 4. Drainage of the property shall be approved by the Depart- ment of Public Works. 5. The property shall participate in the local drainage assessment district at time of development. 6. The green house indicated on the plot plan to cross the proposed property'line'shall be removed. 7. The Division of Land shall not be effective until- an agreement is signed and recorded agreeing to the conditions listed above. ROLL CALL VOTE: AYES: Mandrell, Day, Harlow. NOES: None. ABSENT: None.
