posed subdivision of a•portion of Section 20-5-11.
The Secretary informed the Commission
that this agenda item and item #3 pertain to the same parcel
and the public hearing should be opened to both Tentative
Tract No. 5963 and Use Variance No. 831.
The Subdivision Committee Report
and the Staff, Report pertaining to both items were .read
by the Secretary.
The hearing was opened to the
audience on both items.
Martin Fenton, representing
Huntington Harbour Corp., addressed the Commission and
read a letter regarding the proposed development. He stated
that 145 statutory condominium units are planned and 200'
boat slips would be available to the owners of the condominium
units and inland rtesidenced of Huntington Harbour.
GeorV_ Shibata, Assistant City
Attorney, addressed the Commission and suggested that an
additional provision of the CC&Rls be included stating:
Any interest in the common area (including private streets)
held by the individual parcel or condominium unit owners
can not be devised , conveyed or dedicated separate and
apart from the devise conveyance, and or dedication of the
individual parcel or condominium unit for a life in being
plus 21 years, excepting this may be accomplished under the
same conditions or grounds as are available under judicial
partition."
Rodney Hill, Attorney, representing
Huntington Harbour Corp., addressed the Commission and suggested
that the precise wording be included in,the CC&Rls be worked
out with Huntington Harbour and City Attorneys Office.
There being no other comment the

A MOTION WAS MADE BY
LAWSON AND SECONDED BY WORTHY TO APPROVE TENTATIVE TRACT
MAP NO. 5963 UPON THE FOLLOWING CONDITIONS:
1. The Tentative Map revised May 12, 1965, shall be the
approved layout:
2. Approval of this Tentative Map shall be null and void
unless Use Variance No. 831 is approved by the City Council.
3. Drainage, lighting and sewer plans shall be approved
by the Director of Public Works.
4. The water and fire hydrant systems shall be approved
by the Director of Public•Wor_ks and the Fire Chief.
50 All provisions for a community association and for
perpetual maintenance of common areas shall be approved
by the Planning Director and City Attorney.
6. All rights for construction of any structure not shown
on the approved plot plan shall be dedicated to the -City.
7. All private street widths and corner radi shall comply
with adopted Planning Commission Standards for Plan-
ned Residential Developments.

8.' Private street structural sections shall comply
with Public Works requirements.
9. The cul-de-sac on Saybrook Laneshall have a minimum
radius of 50 f t .
10. Lighting systems shall be installed on all private
drives"and common areas with illumination at least
equal to lighting on public streets and said lighting
•shall•be approved by the Director of Public Works.
11. All utilities shall'be installed underground.
12. The business license fee shall be based on the
number of dwelling units.
13. All waterways shall be deeded in fee to the City.
14. All property within Tentative Tract No. 5963 shall
annex to the Harbor Maintenance District now being
formed.
15. All Standard Subdivision requirements that are
applicable shall be complied with.
16. - All streets within the condominium shall be private
streets.
17. Common area (including private streets) can not be
dedicated separate and apart from the individual
parcel or condominium units.

A MOTION WAS MADE BY CRABB AND
SECONDED BY LAWSON TO RECOMMEND APPROVAL OF UV # 831 TO
THE CITY COUNCIL WITH THE FOLLOWING CONDITIONS:
1. Access to the parking garage shall be redesigned to
provide for a passanger unloading zone. Said redesign
shall be submitted to the Planning.Department for
approval.
2. A minimum parking.ratio of .75:1 shall be provided in'
the parking garage for each non -condominium boat slip.
Said parking shall conform to City Standards.
3. All parking areas along Saybrook'Lane, Humbolt Drive,
and between Lots 1 and 4 of Tentative Tract No. 5963
shall be screen& with a combination of fencing and lands-
caping.
4. All private streets shall meet the minimum standards for
planned residential developments as adopted by the
Planning Commission,
5. The amount of designated recreation space ,shall meet
the adopted Planning Commission Standards.
6. The CC&Rls shall be submitted to the Planning Director
and City Attorney for approval and said CC&Rls shall.-,
contain at least the following provisions. -
A. Recreation areas within the development shall be
reserved for the exclusive use of residents within
the project and their non-paying guests.
B. Owners and/or tenants shall be required to abide
by Association rules and there shall be penalties for
violation of said rules.
C. Any interest in the.common area (including private
streets) held by the individual parcel or condominium
unit owners can not be devised, conveyed or dedicated
separate and part from the devise conveyance, and
or dedication of the individual parcel or condominium
unit for a life in being plus 21 years, excepting this
may by accomplished under the same conditions or
grounds as are available under judical partition.'
7. There shall be no fence, structure, or landscaping
constructed or maintained over 32 -feet high within
a 25 ft. X 25 ft. triangular area at the intersection'
of streets.
8. All rights for development and construction of any
structures within the common area not included in the
approved development plan shall be dedicated to the
City.
9. No structures, other than those shown on the approved
plot plan, shall be constructed within the project.
10. Recreation facilities plan shall be submitted to the
Planning Staff for approval.

SECONDED BY CRABB TO ADOPT RESOLUTION NO. 517 RECOMMENDING
DENIAL OF ZONE CASE NO. 517 TO THE CITY COUNCIL FOR THE
FOLLOWING REASONS:
1. `Preliminary "master .plan .studies designate the property
for medium density use.
2. The property is fronting on a secondary Highway which
is not a desirable location for commercial use.
3. Approval of the zone change would, in effect, create
a spot zone.

reasons for the request.
Mr. Williams, addressed
the Commission and, -explained the legal status of property
interest in lots 3 and 10, located west of the subject
property. He -further stated that all of Block D is under
litigation.
Mr. Collins, purchaser
of the property addressed the Commission and suggested that
the City Attorney contact his attorney regarding the
-legal status of-the.lots included in his application.
Roger Watson, 17971
Beach Boulevard, Huntington Beach, addressed the Commission
and stated that improvements on the subject property should
be installed. He also submitted a copy of a letter from
the City Council which denied _his request to waive the off -
site improvements.on his property along Beach Boulevard.
Bill Hartge, Depifty
Director of Public Works, addressed the Commission and
recommended that the applicant be required to pay drainage
fees, and a litigation report be submitted with the deed
for dedication of Talbert Avenue,to the Public Works Department.
He also stated that improvements should be installed on
Talbert Avenue and Beach Boulevard prior to occupancy of the
building.

of the City of Huntington Beach; Beginning at a point 275
feet NW1ly of said R/W and extending 125 feet along said line;
thence SWfly at a 900 angle to said line 50 feet to the Stly
R/W line; thence SE'1y 125 feet, thence NE'ly at a 900 angle
to the original point.

The Planning Director informed the
Commission that property included in this request was just
annexed to the City as part'of the Bolsa'Chica State Park
Annexation. He pointed out that this entire beach area is
a current topic of discussion between the State and City
jurisdiction is unresolved. He further stated that there is
a distinct possibility that private property between the
Bolsa Chica State Beach and Highway 1 will be purchased by
either the State or the City for public use.
It was noted that the applicants
want to construct a commercial use on the Pacific Electric
Right-of-way which will • cater to the beach crowd.
Commissioner Bazil pointed out that
the area is presently zoned R-1 and it has not been master
planned nor studied for future use, For these reasons -

PROPOSED AMENDMENT TO ARTICLE 910 and 970 - Continued
The Secretary
distributed copies'of a proposed amendment to Article 910 and
970 regarding setbacks for front, side and rear yards.
Commission reviewed
the proposed amendment and it--was-their consensus to
continue the matter to the next study session.

a communication submitted by the Orange County Planning Commission
regarding Use Variances No. 5555, 5556, and 5557.
The Commission reviewed
the requests and it was their unanimous recommendation that
each be denied because the density proposed is too high, lot
coverage is excessive, off-street parking is inadequate
and the turning radius to the off-street parking is
inadequate.

Chairman Kaufman suggested that
the Secretary send a reply to the Westminster Planning

them of public hearings and proposed subdivisions near,
our common boundaries.
