BOARD MEMBERS ABSENT: None. AREA VARIANCE NO. 65-31 Applicant: Rick Farber To allow a 6 foot architectural wall in the front setback in deviation to the 42 inch permitted in the R-1 Single Family Residence District. Located on the south side of Courtney Lane and Roundhill Drive'and legally described as Lot 4, Tract 5677. The hearing was opened to the audience. Rick Farber, applicant, explained his reasons for the request. He stated that the request was not a fence, but an architectural feature. John Mandrell, Chairman, stated his concern for the safety -factor involved. Richard Harlow informed the applicant that 4211 was the maximum height for any fence, wall, hedge, or building in the front 15 feet of the property. He further informed the applicant that the Board was required to determine that a hardship exists on the property or that the intent'of the ordinance was being carried out. Mr. Farber_. presented pictures of existing fences in the area he felt were similar to his request. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY HARLOW AND SECONDED BY MANDRELL TO DENY AREA VARIANCE 65-31 THE REASON BEING THAT THE,APPLICANT FAILED TO SHOW SUFFICIENT JUSTIFICATION FOR THE REQUEST. ROLL CALL VOTE: AYES: Mandrell, Day, Harlow. NOES: None. ABSENT: None. THE MOTION CARRIED. DIVISION OF LAND NO. 65-11 Applicant: Rick Farber To allow an adjustment of lot lines between Lots 3 and 4. Tract 5677. The hearing was opened to the audience. Rick Farber, Applicant, explained his request. He stated that due to an error -in construction -1- 5/19/65 Page No. 2 Minutes: H. B. Board of Zoning Adjustments Wednesday, May 19, 1965 the distance between his house and the adjoining house did not meet City Standards, and the division of land was filed to correct the situation. There being no further comment, the hearing was closed. It was noted that the minimum 60 ft. frontage would be maintained at setback line. Board discussion followed. A MOTION WAS MADE BY DAY AND SECONDED BY MANDRELL TO APPROVE DIVISION OF LAND NO. 65=11 WITH THE FOLLOWING CONDITION: 1. A record of survey shall be recorded in the office of the County Recorder. ROLL CALL VOTE: AYES: Mandrell, Day, Harlow. NOES: None. ABSENT: None. THE MOTION CARRIED. USE PERMIT NO. 65-7 Applicant: Betker Construction Corp. To permit the construction of a 22 unit apartment building in the C-3 General Business District. Located on the east side of 2nd Street approximately 100 feet north of Walnut Avenue and legally described as Lots 22, 2451 26, 28, and 30, Block 201, Huntington Beach Tract. The hearing was opened to the audience; there being'no comment, the hearing was closed. The Secretary read a , letter submitted by the applicant requesting withdrawal of the application. HARLOW AND SECONDED BY DAY TO APPROVE APPLICANT TO WITHDRAW HIS APPLICATION. ROLL CALL VOTE: AYES: Mandrell, Day, Harlow. NOES: None. ABSENT: None. THE MOTION CARRIED.
