addressed the Commission and requested that "E" and "M" Avenues
and PS" and "T" Streets be dedicated to the City and remaining
streets within the project be retained as private,
Bill Hartge, Deputy Director of Public
Works, addressed the Commission and requested that condition #14
be amended to read as followsg "A 15 foot storm drain easement
shall be provided along the east boundary line or other easements
as determined by the Department of Public Works shall be provided."
There being no other comment the hearing
was closed.
Commission held a lengthy discussion*
The Secretary informed the Commission that the project has 76o4
gross acres with a total, of 730 dwelling units or a density of
9.6,dwelling units per acre. He pointed out that the develop-
ment plan is well done and, generally, meets all Planning Commis-
sion Standards,

TO THE CITY COUNCIL WITH THE FOLLOWING CONDITIONS:
1. The site plan received May 25, 1965, shall be the approved
layout.
2. The CC&R's By -Laws, Articles of Incorporation, and' Mana,S'�T
ment Contract shall be submitted to the Planning Director
and City Attorney for approval.
3. The CC&R's shall contain at least the following provisions:
a. Recreation areas within the development shall be reserved
for the exclusive use of residents within the project
and their non-paying guests.
b. Owners and/or tenants shall be required to abide by
association rules and there shall be penalties for
violation of said rules.
c. Any interest in the common area (including private streets)
held by the individual parcel or condominium unit owners
can not be devised, conveyed or dedicated separate and
part from the devise conveyance, and/or dedication of
the individual parcel or condominium unit for a life in
being plus 21 years, excepting this may be accomplished
under the same conditions or grounds as are available
under judicial partition.
d. If the development is constructed in increments or several;
final maps reciprocal CC&Ras and reciprocal management
agreements shall be established that will cause a merging,
of increments as they are completed. The end result shall

addressed the Commission and gave his reasons for the request.
He stated that the Master Plan indicates a certain flexibility
and the applicant is attempting to conform to the overall Master
Plan.
Bob Galloway, engineer for the applicant,
addressed the Commission and spoke in favor of the proposed zone
change.
There being no other comment the hearing
was closed.
Commission discussion was held. It was
the consensus to continue the hearing for two weeks to give the
'�'applicant time to submit a revised request that will, conform to
the zone boundaries reflected by the Master Plan.:

Mrs. Chacon, applicant, addressed the
Commission and gave her reasons for the request.

The Planning Director informed the Com-
mission that a use variance approach to home occupations causes
a conflict in the Building Code. He stated that the City Attorney;
therefore, is drafting an amendment that should come before the
City Council this month and it should become law within three
months.

by the Orange County Planning Department 'regarding UV #5563
to permit construction of a triplex in the Cm2 General Business
]District located on the southeast side of 16th Street, approx-
imately 60 feet southwest of Highway 1, in Sunset Beach.
The Commission reviewed UV #5563 and it was
their unanimous opinion to recommend approval of the request
because the density is reasonable And the number of and access
tooff®street parking is'adequate.

COMMUNICATION: The Secretary read a letter submitted
by the H. B. Union High School District
informing the Commission of the intent to acquire a high school
site on the NW corner of Garfield and Bushard in the City of
Fountain Valley.
Chairman Kaufman instructed the Secretary
to write a letter to the H. B. Union High School District express-
ing appreciation for their consideration in keeping the Commission
informed and, further expressing a desire to cooperate with the
school district in any possible way.
COMMUNICATION: The Secretary read a letter submitted by
George E. Brown requesting that Use
Variance No. 829 be considered on June 15, 1965, instead of July
20th, as previously determined by the Planning Commission.
