BOARD MEMBERS ABSENT: None. AREA VARIANCE NO. 65-34 Applicant: R. G. Crouch, Bldg. Cont. To allow one wing of the main dweilling, 23 ft. in width, to encroach to within 10 ft. of the rear property line in deviation to the required 20 ft. rear yard setback in the R-1 Single Family Residence District. Located at 5942 Franmar Circle on the south side of Franmar Circle approximately 180 ft. east of Greenview Lane and legally described as Lot 93, Tract 4243. F The hearing was opened to the audience; there being no comment, the hearing was closed. Board discussion followed. The hearing was opened to the audience; there being no comment, the hearing was closed. Patton To permit the construction of an 18' X 241 addition to encroach to within 16 ft. of the rear property line in deviation to the required 20 ft. rear yard setback in the R-1 Single Family Residence District. Located on the north side of Reubens Drive, 250 ft. east of Ballantine Avenue. Legally described as Lot 6, Tract 5450. The hearing was opened to the audience; there being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY HARLOW AND SECONDED BY DAY TO APPROVE AV NO. 65-38 WITH THE FOLLOWING CONDITION: 1. A 10 ft. rear yard setback shall be provided. ROLL CALL VOTE: AYES: Mandrell, Day, Harlow. NOES: None. ABSENT: None. THE MOTION CARRIED. USE PERMIT NO. 65-10 Applicant: Foodmaker Co. To allow the construction of a dirve-in restaurant in a C-4 Highway Commercial District, located on the northwest corner of Beach Blvd. and McDonald Avenue. Legally described as Lots 119, 120, and 121 of Tract 417. The hearing was opened to the audience; there being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY DAY AND SECONDED BY HARLOW TO APPROVE USE PERMIT NO. 65-10 SUBJECT TO THE FOLLOWING CONDITIONS: 1. Mc Donald Street shall be dedicated and fully improved to City Standards. Improvements shall include street trees, street signs and street lights. 2. Beach Boulevard shall be improved to State Standards. Improvements shall include street trees and street lights. 3. All streets shall conform to City of Huntington Beach Standards. Master Plan of Arterial Street and Highways _ Standards shall apply where applicable. Street sections shall be determined by soil "R" value and traffic index. 4. Drainage of the property shall be approved by the Department of Public Works. 5. The property shall participate in the local drainage assessment district. 6. Block walls shall be constructed to City Specifications along the rear property line. Said wall shall conform to all provisions of Section 9732.1' of the Huntington Beach Ordinance Code. 7. Off-street parking facilities including landscaping, number, arrangement, access, paving, and striping of all parking spaces shall meet all adopted ordinances and the latest adopted Planning Commission Standards. 8. Horner To permit the construction and operation of an automotive service station in a C-4 Highway Commercial District. Located on the southwest corner of.Warner Avenue and Springdale Street. Legally described as the east 200 ft. of the north 210 ft. of the NE quarter of Section 28-5-11. to the audience. explained his request. The hearing was opened John Horner, applicant, John Mandrell informed the applicant that future street improvements would require a change in the street grade which will necessitate installing temporary drives and posting a bond for.future street improvements. Richard Harlow explained why the application for a Division of Land was necessary. There being no further comment, the he was closed. Board discussion followed. A MOTION WAS MADE BY MANDRELL AND SECONDED BY DAY TO APPROVE UP NO. 65-11 SUBJECT TO THE FOLLOWING CONDITIONS: 1. Warner Avenue and Springdale Street shall be dedicated and fully improved to City Standards. Improvements shall include street trees, street signs and street lights. 2. All streets shall conform to City of Huntington Beach Standards. Master Plan of Arterial Street and Highways Standards shall apply where applicable. Street sections" shall be determined by soil "R" value and traffic index. 3. Drainage of the property shall be approved by the Department of Public Works. 4. The property shall participate in the local drainage as- sessment"district. 5. Preliminary and final soil reports shall be submitted by an approved private soils engineer to the City prior to issuance of building permits. 6. Off-street parking facilities including landscaping, number, arrangement, access, paving and striping of all parking spaces shall meet all adopted ordinances and the latest adopted Planning Commission Standards. 7. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 8. Robertson To allow the construction of a building to be used for retail stores and offices in a C-4 Highway Commercial District. Located on the north side of Yorktown Avenue and 72 ft. east of Beach Blvd., and legally described as the east 211 ft. of the west 371 ft. of the south 230 ft. of the WZ, SWk, NW4 of Section 1-6-11; excepting therefrom the north 50 ft. of the west 40 ft. thereof, and the north 70 ft. of the east 16 ft. thereof. The hearing was opened to the audience. Mr. McDonald found the suggested conditions of approval acceptable. There being no further comment, the hearing was closed. A MOTION WAS MADE BY HARLOW AND SECONDED BY MANDRELL TO APPROVE UP NO. 65-12 SUBJECT TO THE FOLLOWING ®NDITIONS : 1. Yorktown Avenue shall be fully improved to City Standards across both Accessor's Parcels 20 and 21 as shown in Accessor's Book 114, Page 4, March 1963. Improvements shall include street trees and street lights. 2. Yorktown Avenue shall conform to City of Huntingtnn Beach Standards. Master Plan of Arterial Street and Highways Standards shall apply where applicable. Street sections shall be determined by soil "R." value and traffic index. 3. Drainage of the property shall be approved by the Department of Public Works. 4. The property shall participate in the local -drainage - assessment :'district. 5. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. Off-street.parking facilities including number, arrangemennt access, paving, and striping of all parking spaces shall meet all adopted ordinances and the latest adopted Planning Commission Standards. 7. The {parking lot shall be landscaped and the amount of landsaaping shall be substantially the same as that shown of Use Permit No. 261. 8. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 9. A recorded easement over the adjoining property to the west shall be submitted to the Building Department indicatins that parking stalls 1 through 12 are able to conform to City Standards with respect to turning radius and parking stall size. 10. O'Bryan To allow the construction of 60 apartment units in the R-4 Multiple Family Residence District. Located on the south side of Atlanta Avenue approximately 1225 ft. east of Beach Blvd. and legally described as Lot 1, Tract No. 811. Herbert Day asked to be excused from the Board because 'of a conflict of interest. - The hearing was opened to the audience; there being no comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY HARLOW/AND SECONDED BY MANDRELL TO APPROVE UP NO. 65-13 SUBJECT TO THE FOLLOWING CONDITIONS: 1. Atlanta Avenue shall be dedicated and fully improved to City Standards. Improvements shall include street trees and street lights. 2. All streets shall conform to City'of Huntington Beach Standards. Master Plan of Arterial Street and Highways Standards shall apply where applicable. Street sections shall be determined by soil "R" value and traffic index. 3. Drainage of the property shall be approved by the Department of Public Works. 4. The property shall participate in the local drainage assessment district. 5. A plan specifying trash pickup areas shall be submitted to the Department of Public Works for approval. 6. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 7. Off-street parking facilities including landscaping, number, arrangement, access, paving'and striping of all parking spaces, shall meet all adopted ordinances and -the latest adopted Planning Commission Standards. 8.
