BOARD MEMBERS PRESENT: John Mandrell, Herbert Day, Richard
Harlow.
BOARD MEMBERS ABSENT: None.
MINUTES: The minutes of June 16, 1965 were accepted
as transcribed.
AREA VARIANCE NO. 65-43
Applicant: Reginald Belding
To allow the encroachment
of a garage to within 5 ft. of the exterior side property line in
deviation to the required 10 ft. exterior side yard setback in the
R-1 Single Family Residence District. Located at the northeast ccr ner
of Farinella Drive and Trudy Lane. Legally described as Lot 1
of Tract 4832.

Mr. Belding, the applicant,
explained his reasons for the request. He stated that he felt
there was a unique situation due to the school abutting to the
rear of his property.

Board discussion followed.
It was noted that the side yard setback was not designed to provide
privacy to the property owner to the rear but to keep buildings
setback from the public street.
A MOTION WAS MADE BY HARLOW
AND SECONDED BY MANDRELL TO DENY AV NO. 65-43 FOR THE FOLLOWING
REASON:
1. The applicant failed to show sufficient justification for the
request.
ROLL CALL VOTE:
AYES: Mandrell, Harlow, Day.
NOES: None.
ABSENT: None.
THE MOTION CARRIED.
AREA VARIANCE NO. 65-44
Applicant: Edward 0. Evans
To allow a 9 ft. 8 in.
reduction of the 20 ft. setback for a garage entered directly
from the street in the R-1 Single Family Residence District.
Located on the south side of Figaro Circle, 300 ft. west
of Edgewater Lane and legally described as Lot 32 of Tract
5360.
The hearing was
opened to the audience; there being no comment, the hearing
was closed.

A MOTION WAS MADE BY HARLOW AND SECONDED
BY DAY TO DENY AV NO. 65-44 FOR THE FOLLOWING REASONS:
1. This request has been asked before by other property owners
in the area and all were denied because they failed to
provide sufficient justification for the encroachment.
ROLL CALL VOTE:
AYES: Mandrell, Day, Harlow.
NOES: None.
ABSENT: None.
THE MOTION CARRIED.
