BOARD MEMBERS PRESENT: John Mandrell, Herbert Day, Richard Harlow.
BOARD MEMBERS ABSENT: None.
MINUTES: The minutes of June 16, 1965 were
accepted as transcribed.
AREA VARIANCE NO. 65-45
A2plicant: William S. Greer
To allow a 4 ft. side
yard setback in devia Lion to the required 5 ft. Located on the
west side of 14th Street, 50 ft. north of Magnolia Avenue in the
R-2 Two Family Residence District. Legally described as Lots 5
and 7, Block 514, Huntington Beach Tract, Seventeenth -Street
Section.
The hearing was opened to
the audience; there being no comment the hearing was closed•..
Mr. Greer stated that he
did not have knowledge of the change in the side yard setback
when he purchased the building. Mr. Greer further stated that there
would be great expense to alter the building to conform to the
ordinance,
Board discussion followed.
A MOTION WAS MADE BY
DAY AND SECONDED BY MANDRELL TO APPROVE AV NO. 65-45 FOR THE
FOLLOWING REASONS:
1. The house was purchased shortly after the ordinance was
changed to require a 5 ft. side yard setback instead of
4 ft.
2. There are other dwellings in the area with 4 ft. side yardsetbacks.
3. There would be a financial hardship if the dwelling were to
be altered.
ROLL CALL VOTE:
AYES: Mandrell, Day.

THE MOTION CARRIED.
AREA VARIANCE NO. 65-46
ARplicant: Robert J. & Lucille B. Blantz
To allow a fence
12 ft. high to be constructed along the side and rear property
lines in deviation to the maximum 6 ft. height in the R-1
Single Family Residence District. Located on the west side
of GreenView Lane, 30 ft. north of Donlyn Street. Legally
described as Lot 8 of Tract No. 4243.
The hearing was opened
to the audience.

stated that the fence will be on the north property line `.
only and not the west property line as indicated in the
legal'notice.
Richard Harlow explained that this was
an error by the Planning Department and that the Board could -
still consider his request.
Herbert Day brought up the suggestion
that the top 6 ft. of the fence should be left open.
L. E. Swanson, a neighbor of Mr.
Blantz, spoke in behalf of the request.
There being no further comment;
the hearing was closed.'
Board discussion followed.
It was the consensus that the fence was
necessary to protect the property from the hazard of golf' -
balls from a nearby golf course.
A MOTION WAS MADE BY HARLOW AND SECONDED
BY DAY TO APPROVE AV NO. 65-46 AS REVISED WITH THE FOLLOWING
OJ NDITIONS :
1. The fence shall be open above 6 ft.
2. Approval shall be for the fence onl:the north property
line only.

AREA VARIANCE NO. 65-47
Applicant: James W. & Jole G. Jones
To allow a 6 ft. high block wall to be
constructed on the front property line in deviation to the
required 15 ft. front yard setback in the R-1 Single Family
Residence District. Located at 16631 Ross Lane onnthe'
west side of Ross Lane on the south side of Royer Circle.
Legally described as Lot 30, in Tract 3506.
The hearing was opened to the
audience.
Mrs.'Jones, the applicant, explained
the request. It was noted that the house is situated
sideways on the lot.
Herbert Day stated that a condition
should be required that the property could not be'fenced_
along the east property line.'
There being no further comment the
hearing was closed.
Board discussion followed. It was
noted that similar requests of this nature have been approved
in the area and the lots were considered as reverse corner
lots with fence requirements applied accordingly.

BY HARLOW-TO APPROVE AV NO. 65-47 SUBJECT TO THE FOLLOWING

1. There shall be no fence constructed along the exterior
side yard on Ross Lane -higher than 42".
2. The fence shall not exceed 42" within the east 15 ft.
along the south property line.

AREA VARIANCE NO. 65-48
Applicant: William Hill
To permit an enclosed
patio to encroach to within 7 ft. 6 in. of the rear property
line in deviation to the required 20 ft., rear yard setback
in the R-1 Single Family Residence District. Located at
15761 Sherbeck L ane on the SW corner of Shannon Drive and
Sherbeck Lane. Legally described as Lot 1 in Tract 4138.
Mrs. Theofanos, a
neighbor to the rear of Mr. Hill objected to the request
because of the noise and the close proximity of the structure
to their home.
Mrs. Mackey, an abutting
property owner, stated that she also objected to the request
because of the noise and intrusion of privacy.
Mr. Hill, the applicant,
explained his request and stated that the structure was
primariy for wind protection.
Herbert Day, explained
the ordinance pertaining to attached structures in'the rear
yard area.
There being no further
comment, the hearing was closed.
Board discussion
followed. It was noted that similar requests had previously
been approved but in all cases a 10 ft. rear yard setback was
required.
A MOTION WAS MADE BY
HARLOW AND SECONDED BY DAY TO APPROVE AV NO. 65-48 WITH THE
FOLLOWING CONDITION:
1. A minimum rear yard setback of 10 ft. shall be maintained
for the enclosed pyetion of the patio.

AREA VARIANCE NO. 65-49
Applicant: Jack E. Groth
To allow the construction
of a body shop with a 5 ft. rear yard setback in deviation to
the required 10 ft. setback in the C-2 Community Business District.

The hearing -was opened to the
audience.
Tom King, abutting property owner,
objected to the proposal because his residence would be
next to the proposed structure.
Richard Harlow stated that the
applicant indicated that he was going to withdraw the
request.
There being no further comment the
hearing was closed.
It was the consensus to continue the
action to give the applicant time to state his position.

BY HARLOW TO CONTINUE AV NO. 65-48 UNTIL JULY 71 1965.

The hearing was opened to the
audiece.
Graham Wilson, representing Luxury
Homes, Inc. , explained the request to the Board.
Richard Harlow explained that all
fences and entrance facilities•should be on private
property.
There being no further comment,
the hearing was closed.
Board discussion followed:
I't _was- noted' that' although this request
is • not '•within -the • •stric:t interpretation of the ordinance it
will provide for a better appearing entrance to the
subdivision from an arterial highway which has always been
the desire of the City.

USE PERMIT NO. 65-14
Applicant: Masami and Yemiko Hiroshima
To permit the construction
of a planned development containing 180 units and extending more
than 150 ft. from a public street in the R-3 Multiple Family
Residence District. Located on -the southwest corner of
Warner Avenue and Edwards Street. Legally described as the
E2 of the NEk of the NWk of Section 27-5-11 excepting the
south 860 ft.-thereof. -
The hearing was opened to
the audience.
James R. Wilde, architect
for the project, discussed the proposal with the 'Board.
Mr. Wilde found the
suggested conditions of approval acceptable.

A MOTION WAS MADE BY
HARLOW AND SECONDED BY DAY TO APPROVE UP NO. 65-14-SUBJECT
TO THE FOLLOWING CONDITIONS:
1. Warner Avenue and Edwards' -Street shall be fumy 'improved
to City Standards. Improvements shall include °street lights,
street trees, and street signs.
2. Vehicular access rights along all arterial highways, except
at approved driveway -intersections, shall be dedicated to
the City of Huntington Beach.
3. All Streets shall conform to City of Huntington Beach
Standards. Master Plan of Arterial Street and Highways
Standards shall apply where applicable. Street sections
shall be determined by soil 11R1' value and traffic, index.
4. Water supply shall be through the City of Huntington
Beach's water system.
5. Sewage disposal shall be through the City of Huntington
Beach Is system.
6. Drainage of the property shall be approved by the Department
of Public Works.
7. The property shall participate in the local drainage
assessment district.
8. Retaining walls shall be provided where there is a
difference in elevation of one (1) foot between adjoining
lots or lots abutting City right - of - way.

9. Preliminary and final soil reports shall be submitted
by an' approved private soils engineer to the City
prior to issuance of building permits.
10. A six (6) ft. high block wall shall be constructed
alon the west property line. Said wall shall be reduced
to 45" within the northerly 10 ft. The height of said
wall shag comply with the provisions of Section 9732.1
of the Huntington Beach Ordinance Code.
11. All utilities shall.be installed underground.
12. A plan specifying trash pickup areas shall be submitted
to the Department of Public Works for approval.
13. The water, sewer, and fire hydrant system shall be approved
by the Department of Public Works and Fire Department.
14. Off-street parking facilities including landscaping,
number, arrangement, access, paving and striping of
all parking spaces shall meet all adopted ordinances
and the latest adopted Planning Commission Standards.
15. No structures, other than those shown on the approved
plot plan, shall be constructed within the project..
16. All provisions of DV No. 65-2 shall be complied with.
17. The easterly 4 covered parking spaces located along
the south property line shall be relocated behind the
50 ft. setback required for detached accessory buildings.
18. The required on -street guest parking spaces shall be
indicated on the plot plan at the time application-- is
made for a building permit.
