MINUTES: The minutes of June 30, 1965 and July 77 1965 were accepted as transcribed. AREA VARIANCE NO. 65-53 Applicant: Ramon A. Lopez To allow one wing of the main dwelling to encroach to within 12 ft. of the rear property line in devia- tion to the required 20 ft. rear yard setback in the R-1 Single Family Residence District. Located on the west side of Waikiki Lane, 65 ft..south of Hilo Circle. Legally described as Lot 85 in Tract 3750. The hearing was opened to the audience. Mr. Lopez, the applicant, answered questions asked by the Board. the hearing was closed. There being no further comment, Board discussion followed. A MOTION WAS MADE BY DAY AND SECONDED BY REYNOLDS TO APPROVE AV NO. 65-53 FOR THE FOLLOWING REASONS: 1. There will be adequate rear yard area remaining with a minimum dimension of 20 ft. and no building will be closer to the rear lot line than 10 ft. 2. There have been similar requests of this nature granted by the Board . k 3. The request is in substantial conformance with the Huntington Beach Ordinance Code. ROLL CALL VOTE: AYES: Mandrell, Day, Reynolds. NOES: None. THE MOTION CARRIED. USE PERMIT NO.`65-15 Applicant: Huntington Pacific Corporation To permit the construction of a planned development containing 107 apartment units and extending more than 150 ft. from a public street in the C-1 Neighborhood Commercial District and C-1-0 Neighborhood Commercial District combined with oil production: Located on the south side of Highway #1 between 6th Street and 9th Street. Legally described as beginning at a point of intersection of the center line of 8th Street and the southwesterly edge of Pacific Coast Highway, northwesterly at 900 a distance of 335' - 4 3/4"; thence southwesterly at•900 a distance of 146' _ �0"; thence southeasterly at 90o.a distance of 301' "; thence southwesterly at 900 to the approximate ordinary high water line; thence southeasterly along said ordinary high water line to -a point.1201.southeasterly of the southwesterly prolongation of the centerline of 7th Street.; thence northeasterly to a point 146' - 10" southeasterly from the southwesterly edge of Pacific Coast Highway; thence southeasterly at 900�a distance of 170' - 011; thence northeasterly at 900 a distance of 146' - 10" to the southwesterly edge of pacific Coast -1- 7/14/65 Page No. 2 Minutes: H. He further stated that because of the precident setting nature of the project he was of the opinion that it should be referred to the Planning Commission for their consideration. The hearing was opened to the audience. William N. Cookerley, 1030 Main Street, Huntington Beach, California, said that he had the understanding from the first mayor of Huntington Beach that the beach.front property would have nothing built on it above 4 ft., and that this point' should be investigated. Joe E. Bloodworth, 112 8t'h Street Huntington Beach, California, stated that he had the same understanding as Mr. Cookerley and objected to the proposal because of a lack of beaches along the coast. Mrs. Bloodworth stated an objection to the request due to the fact that the beauty of the ocean would be hidden from many who now enjoy it. Leroy Paxson, 505 12th Street, Huntington Beach, California, said that the beach would be denied to the public and it would eventually degrade the property value. Francis Mc Kelvy-, objected to the proposal because the human value would be lost. Buddie Sexton, 115A 6th Street, Huntington Beach, California, added his objection to the proposal. Mrs. Mosteller, stated that the beach established the true property value of all surrounding property. John B. Omohundro, 1761. Sunningdale Rd. Apt. 50-L, Seal Beach, California, said that a local Huntington Beach paper stated that plans for development by the Huntington Beach Co. would cover all property along the beach front. He asked if this was the beginning. Ken Reynolds answered his question and clarified the point. Mr. Bloodworth further stated his objection to the proposal. Ruby Albright, 116 8th Street, Huntington Beach, California, agreed with Mr. Bloodworth. Mr. James H. Hendicott, 308 7th Street, Huntington*Beach, California, asked about traffic problems that may be created. John Mandrell answered his question and stated that any traffic considerations would be taken care of through requirements of the City and State Division of Highways. -2- 7/14 /65 Page No. 3 . Minutes: H. B. Board of Zoning Adjustments Wednesday, July 14, 1965 Mr. Bloodworth asked about police, fire, and public access to the proposed project. John Mandrell said that there would be private access and that all requirements would be complied with. George Sheridan -,representing Huntington Pacific Corporation, stated that this request should be taken up with the Planning Commission, He further'' explained the reasons for the request and asked that any questions be brought to him at 2110 Main Street, Huntington Beach, California, Mr. Sheridan explained the H. B. Co.'s participation in the prevention of beach errosion. Mr. Cookerley said that Mr. Sheridan was misleading the people in the audience. John Mandrell stated that further in- formation would be required and that this case should be brought to the attention of the Planning Commission. There being no further comment, the hearing was closed. A MOTION WAS MADE BY MANDRELL AND SECONDED BY DAY TO DEFER UP NO. 65-15 TO THE PLANNING COMMISSION FOR THEIR CONSIDERATION. ROLL CALL VOTE: AYES: Mandrell, Day, Reynolds. NOES: None. THE MOTION CARRIED. AREA VARIANCE NO. 65-52 Applicant: John S. Satterthwaite To allow the construction of a wall 6 ft. in height to encroach to within 10 ft. of the front property line in deviation to the required 15 ft. front yard setback in the R-1 Single Family Residence District. Located on the northeast side of Mariana Circle at the end of said street, 250 ft. west of Wellington Drive. Legally described as Lot 96, of Tract 4677. The hearing was opened to the audience. Mr. Satterthwaite, the applicant, explained his request and reasons for the wall. There being no further comment, the hearing was closed. Board discussion followed. It was noted that there was a hardship on the property because of the side and back property was on a slope. A MOTION WAS MADE BY MANDRELL AND SECONDED BY DAY TO APPROVE AV NO. 65-52 FOR THE FOLLOWING REASONS: -3- 7/14/65 Page No. 4 - Minutes: H. B. Board of Zoning Adjustments Wednesday, July 14, 1965 1. The.wall will create considerable aesthetic value to the house, lot, and street. 2. The lot is at the end -of a cul-de-sac street resulting in sufficient sight clearance for the adjoining property owners. 3. There is a hardship on the property because both the side and back of the lot are on a slope. ROLL CALL VOTE: AYES: Mand7rell, :Day, Reynolds'. NOES: None. THE MOTION CARRIED.
